CROP-HAIL FORMS FOR 2014 CROP YEAR

WISCONSIN

NCIS crop-hail form revisions for Wisconsin have been filed and approved for use beginning

with the 2014 crop year. The following forms remain in effect until further revised or

withdrawn:

reverse side of this bulletin. A copy of the revised form and the listing (300 page) indicating all

forms for use in Wisconsin for the 2014 crop year are included with this bulletin. For reference,

the NCIS form filing number for Wisconsin is 2014NCISCH-WI2.

Summary of NCIS Crop-Hail Policy Form Changes for 2014 Crop Year

2014-NCIS 3WI Wisconsin Amendatory Endorsement replaces

: 2010-NCIS 3WI

The exception to the “Cancellation” provision in the NCIS 3 General Provisions was revised by

adding language that states no premium will be refunded if the insured cancels after coverage has

expired. This language was added as protection for an insurer who provides coverage

throughout the insurance period while the crop is growing and harvested, but then receives a

request from an insured to cancel coverage at such time that the schedule provided in the special

provisions would provide a percentage of the premium be returned.

WISCONSIN AMENDATORY ENDORSEMENT

In compliance with the insurance laws of the State of Wisconsin, the following provisions are added to the policy forms listed below. If a similar provision is already contained in the policy, this endorsement will take precedence over such similar provision.

GENERAL PROVISIONS NCIS 3 are amended as follows:

CHANGES - Section 631.09 (1)

Knowledge by an agent of the Company of any fact which breaches a condition of the policy shall be knowledge of the Company if such fact is known to the agent at the time the policy is issued or an application made or thereafter becomes known to the agent in the course of his dealings as an agent with the named insured. Any fact which breaches a condition of the policy and is known to the agent shall not void the policy or defeat a recovery thereon in the event of loss.

REPRESENTATIONS, WARRANTIES AND CONDITIONS – Section 631.11

Provision No. 12 “Concealment or Fraud” of General Provisions NCIS 3 is amended to read as follows:

We do not provide coverage if you, or any party acting on your behalf, intentionally concealed or misrepresented any material fact or circumstance relating to this insurance, either before or after a loss, if the misrepresentation or concealment:

a. was material;

b. was made knowingly or with the intent to deceive; c. was relied and acted upon by the company; or d. contributed to the loss.

CANCELLATION - Section 631.36 (2)

Provision No. 13a of General Provisions NCIS 3 is amended to read as follows:

You may cancel this policy at any time by giving us written notice and returning the policy to us. If you cancel, we will refund premium you have paid for the current season, if any, according to the following table, except that no premium will be refunded if coverage has expired:

Provision No. 13b of General Provisions NCIS 3 is amended to read as follows:

We may cancel all or any part of the insurance provided by us at any time during the first 60 days during which the insurance is in force by notifying you in writing at least 10 days before the date and hour cancellation takes effect.

We may cancel all or any part of the insurance on any policy which has been in effect for more than 60 days, by notifying you in writing at least 10 days before the date and hour cancellation takes effect, for any of the following reasons:

1. nonpayment of premium; 2. material misrepresentation;

3. substantial change in the risk assumed, except to the extent that the insurer should reasonably have foreseen the change or contemplated the risk in writing the contract; or

4. substantial breaches of contractual duties, conditions or warranties.

Notices of cancellation may be delivered or mailed by first class mail to you at your mailing address shown in the declarations. Proof of mailing will be sufficient proof of notice. If we cancel all or any part of this policy, we will return the premium paid for the amount of insurance per acre on the portion canceled.

NOTICE OF LOSS - Section 631.81

The named insured shall furnish notice or proof of loss as soon as reasonably possible and within one year after the time required by the policy but failure to furnish such notice or proof within the time required by the policy shall not invalidate or reduce a claim unless the Company is prejudiced thereby and it was reasonably possible to meet the time limit. Notice or proof of loss may be furnished by personal delivery or by mailing in a pre-paid first class envelope addressed to the Company at its Home Office or to any branch office of the Company or to an agent of the Company.

SUBROGATION. (Recovery of a loss from a third party)

Provision No. 18 of General Provisions NCIS 3 is amended to read as follows:

Because you may be able to recover all or a part of your loss from someone other than us, you must do all you can to preserve any such rights. If we pay you for your loss then your right to recovery will belong to us. We will not require any subrogation proceeds until you have recovered all of your loss. If we recover more than we paid you plus our expenses, the excess will be paid to you.
