EXPLANATORY MEMORANDUM

1. Following the Council Decision to incr-ease the target price and basic intervention

prices for the 1977/78 marketing year by 3~5% for colza and rape seed and by 7.5 % for sunflower seed, the following must also be established for the same

year :

the main intervention centres and the derived intervention prices applicable

thereof;

-the compensatory amounts applicable to cotza and rape seed harvested in Denmark

and the United Kingdom.

2. The intervention prices have been amended to take into account the necessity to

facilitate the supply to the Italian market of these seeds on the one hand, and

on the other, the changes that have occurred in transport costs. At the request

of the French delegation, the centre at Marseille has been abolished, and a

centre at La Pallice has been added tor both kinds of seed, and a centre at

Strasbourg for sunflower seed.

3. Article 52 of the Act concerning the Conditions of Accession and the Adjustments

to the Treaties provides that the derived intervention prices applicable in

Denmark and the United Kingdom shcul.d be gt'adually aligned with the levels of

the common prices. Therefore, the difference between the common prices and the

prices ruling in the United Kingdom should be reduced by one half,

and accordingly the compensatory amounts applicable thereto reduced, for

the period from 1 July to 31 December 1977. From 1 January 1978 the accessio~

compensatory amounts shalt no Longer be applied.

For colza and rapeseed harvested in Denmark the compensatory amount is minir.~c.;L

and is therefore abolished from 1 July ·1~77,.. in accordance with the provisic,-.3

of Article 55 (4) of the abovementioned Act.

4. Financial implications

ThiS proposal is a normal consequence of the annual price decisions. There art.

no financial implications other than those already taken into account in conne..: ..

Having regard to the proposal from the Commission,

Whereas Regulation (EEC) No 1lf63/76(2) fixed the corrpensatory amounts to

be deducted from the subsidy or the export refund for colza and rape seed

harvP.sted in Denmark and the United K.ingdorn during the 1976/77 crop year

and placed under control at the oil mill or exported during that year;

Whereas,. in accordance with Article 52 of the Act of Accession, for the crop

year 1977/78 the derived intervention prices applicable in Denmark and the

United Kingdom are to nove towards alignment with the common prices; whereas

the compensatory amount applicable in the United Kingdom during the period

1 July to 31 December 1977 should therefore be reduced accordingly; whereas

however, in the case of Denmark the application of the said Article results in

a minimal accession cofll)ensatory amount, and whereas, therefore, in accordance with Article 55(4) of the Act no such amount should be fixed,

HAS ADOPTED THIS REGULATION:

Article 1

1. For colza and rape seed harvested in the United Kingdom and placed under

control at the oil mill pursuant to Article 3 of Regulation CEEC) No 2114/71(3)

or exported during the period 1 July to 31 December 19'77, the cornpensi'ltory

amount to be deducted from the subsidy referred to in Article 27 of F<egul.atio•'

No 136/66/EEC(4) and from the export refund referred to in Article 28 cf that

Regulation shall be 1.37 units of account per 100 kilogrammes.

2. The COI1l'Jensatory amount to be deducted in accordance with paragraph 1 shall

not exceed the amount of the subsidy or export refund applicable.

Article 2

Detailed rules for the application of this Regulation shall be determined in

accordance with the procedure Laid down in Article 38 of Regulation No 136/66/EEC.

Article 3

This Regulation shall enter into force on 1 July 1977.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

THE COUNCIL OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Economic Community,

Having regard to Council Regulation No 136/66/EEC of 22 September 1966 on the

amended by Regulation (EEC) No 1707/73(Z),and in particular the first subparagraph

of Article 22 (2) thereof,

Having regard to the proposal from the Commission,

Whereas, in accordance with Article 22 (2) of Regulation No 136/66/EEC, the main

intervention centres for colza, rape seed and sunflower seed, and the derived

intervention prices applicable thereat must be fixed for the marketing year 1977/78;

Whereas the places with the Largest markets situated in the main production areas

should be taken 'as the main intervention centres; whereas, to ensure an appropriate

price Level for Community seed in deficit areas, the most representative places for

the processing of seeds should also be used, as well as places situated outside

production areas which are representative as regards internal trade and the export

of seed;

Whereas, in accordance with Article 24 of Regulation No 136/66/EEC, derived

inter-vention prices must be fixed at a level permitting seed to move freely withi~ the

Community, under natural conditions of price formation and in accordance with

the needs of the market; whereas, to that end, intervention prices should be fixed

so that the differences between them correspond to the price differences to be

expected in the case of a normal harvest;

Whereas the derived intervention prices for the 1976/77 marketing year were fixed

in Denmark and the United Kingdom at a Level lower than the common Level; whereas

these prices should move towards alingment with the common prices, in accordance

with Article 52 of the Act of Accession;

Whereas the experience gained during the course of the 1976/77 marketing year

has shown that the main intervention centres adopted ~or that marketing year,

with the exception of Marseille should be retained, and that the centre of La

Pallice should be added for both kinds of seed, and the centre of Strasbourg for '

sunflower seed;

HAS ADOPTED THIS REGULATION

Article 1

For the marketing year 1977/78, the main intervention centres for colza, rape and

sunflower seed and the derived intervention prices applicable in these centres shall be as shown in the Annex hereto.

Articl.e 2

This Regulation shall enter into force on 1 July 1977.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
