A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CHINO, CALIFORNIA, RECOMMENDING THE CITY COUNCIL APPROVE A CHANGE TO THE CHINO ZONING MAP FROM M2 (GENERAL INDUSTRIAL) TO P (PUBLIC) FOR A 4.62 ACRE PARCEL OF LAND LOCATED AT 13461 RAMONA AVENUE (APN: 1019-441- 06 & 1019-441-06-W). PL20-0028 (ZONE CHANGE).

WHEREAS, Yorba XC, LLC (the “Applicant”), has filed an application with the City of Chino (the “City”) for approval of Zone Change PL20-0028 (the “Project”) to amend the City’s Zoning Map by changing the zoning district from M2 (General Industrial) to P (Public) for a 4.62 acre parcel of land located at 13461 Ramona Avenue, as described in Exhibit A; and

WHEREAS, the Planning Commission has completed its study of the proposed Project and related materials; and

WHEREAS, the proposed Project has been determined to be consistent with the intent of the General Plan as amended; and

WHEREAS, the proposed Project will not adversely affect the harmonious relationship with the adjacent neighborhoods and land uses; and

WHEREAS, all provisions of the California Government Code and Chino Municipal Code related to the proposed Project have been complied with; and

WHEREAS, on April 19, 2021, the Planning Commission held a duly noticed public hearing for the Project in compliance with law, including compliance with the relevant provisions of the California Government Code and Chino Municipal Code, entertained the written and oral report of staff, and considered public testimony on the Project.

NOW, THEREFORE, the Planning Commission of the City of Chino, California, does hereby FIND, DETERMINE, and RESOLVE as follows:

A. The foregoing recitals are true and correct and incorporated herein.

B. Based on substantial evidence, both written and oral, from the public hearing, the Planning Commission makes the following findings and takes the following actions on PL18-0091 (Zone Change):

1. PL20-0028 (Zone Change)

a. The proposed zone change or Zoning Code Amendment is consistent with the goals and policies of the General Plan, as amended. An amendment to the General Plan is being processed concurrently which would change the existing land use from General Industrial (GI) to Public (P). The related land use change to allow the relocation of the administrative offices is consistent

the City’s General Plan goals that promote keeping employees and business in the City, maintaining the highest level of education, consolidation of development, and creation of public buildings that enhance the community design in City; and

b. The proposed zone change or Zoning Code amendment is reasonable and beneficial, and in the interest of good zoning practice, in that the property has been owned by the Chino Valley Unified School District (CVUSD) since 1990 and utilized for the Student Support Services Department, which is consistent with the Public zoning district; and

c. The proposed zone change or Zoning Code amendment will not have a significant adverse impact on the environment. An Initial Study/Mitigated Negative Declaration (MND) has been prepared that concludes with implementation of the mitigation measures, the proposed Project will not have a significant adverse effect on the environment. Potentially significant effects were identified, and mitigation measures have been incorporated as part of the Mitigation Monitoring and Reporting Plan to ensure the effects remain at less-than-significant levels; and

d. The change will not adversely affect the harmonious relationship with adjacent parcels and land uses, in that the proposed Project will allow for the development of the site with an administrative office building for the CVUSD, which is compatible with the adjacent sensitive land uses, which include, which include residential directly to the west and an existing Buena Vista High School directly to the south; and

e. The subject site is physically suitable, including, but not limited to parcel size, shape, access, availability of utilities and compatibility with adjoining land uses for the requested zoning designation and anticipated development, as the site is currently improved the CVUSD Student Support Services Department and future physical development of the site will meet or exceed all minimum development standards related to setbacks, building height, lot coverage, parking, and landscaping, and all appropriate infrastructure and public improvements will be conditioned to be constructed with the development.

2. CEQA Findings. An Initial Study/MND has been prepared that concludes with implementation of the mitigation measures, the proposed Project will not have a significant adverse effect on the environment. Potentially significant effects were identified, and mitigation measures have been incorporated as part of the Mitigation Monitoring and Reporting Plan to ensure the effects remain at less-than- significant levels. The MND satisfies the requirements of the CEQA and the CEQA Guidelines (California Public Resources Code § 21000 et seq.; 14 CCR 15000 et seq.).

3. Recommendation of Approval of PL20-0028 (Zone Change). The Planning Commission hereby recommends the City Council approve PL20-0028 (Zone Change).

4. Actions by the Planning Commission Secretary. The Planning Commission Secretary is hereby directed to attest as to the adoption of this Resolution as of the date set forth below and forthwith transmit a copy of this Resolution, by regular mail, to the Applicant at the address of record set forth in the Application.

AN EASEMENT FOR PIPE LINE AND APPURTENANCES OVER THE EASTERLY 10 FEET OF PARCELS 1, 2, AND 3 OF PARCEL MAP NO. 3511, IN THE CITY OF CHINO, COUNTY OF SAN BERNARDINO, STATE OF CALIFORNIA, AS PER MAP RECORDED IN BOOK 32, PAGES 12 AND 13 OF PARCEL MAPS, IN THE OFFICE OF THE COUNTY RECORDER OF SAID COUNTY.
