since 1986. As an Omni agent you will have the competitive advantage of being able to offer

your customers affordable rates with low down payments and monthly billing. You have the

option of tailoring your customers’ coverage to their specific needs through varied coverage

levels, different deductibles, variable term policies, and a number of payment plans.

At Omni Insurance Company, ease of doing business is our primary goal. With Omni’s real

time agent website, you will be able to bind coverage, get a policy number, and issue ID cards

in a few short minutes. A simple liability quote only requires an address including zip code,

insured name, date of birth, gender, and vehicle information. Rating occurs in seconds with a

click of a button. Policy status, payment entry, endorsements quotes, and actual

endorsements are simple to do and happen in real time. There is no waiting for confirmation.

You can assure your customer that they have coverage instantly and provide an

up-to-the-moment payment schedule through the end of their policy term. Our website provides you with

over 50 reports to help manage your business including Agent Commission, ACH Bank Sweep,

Cancelled Policies, Reinstatements, and Pending Renewals.

We ask that you utilize this underwriting guide to further familiarize yourself with our

company. We firmly believe that you are our partner and we demonstrate that through our

commitment to the independent agency system. Together we can be successful while

providing your customers with quality insurance protection at affordable rates.

AGENT DUTIES

1. Rate the risk based on the underwriting characteristics of each operator and each vehicle. Our

system will assign operators to vehicles in according to our driver assignment rule.

2. You must list all members of the household over the age of 14 and all other regular operators of

every covered vehicle on the application.

3. The Driver Exclusion Form must be completed and signed by the named insured. Omni will not

afford coverage to excluded operators on the vehicles from which they are excluded.

4. Please explain that it is the insured's responsibility to inform you and Omni if a previously

suspended operator now has a valid driver’s license.

5. Please explain the requirements for obtaining coverage on replacement and additional vehicles to

your customers.

6. Please explain discounts, qualification criteria, and supporting documentation to your customers.

7. Please explain surcharges to your customers.

8.

Please clearly explain to your customers that all claims are to be reported immediately and directly

to Omni.

Our internet site will give you a secure connection to quote polices, write new business, send

endorsements, and view detailed information on all of your insureds’ policies - twenty-four hours a

day, seven days a week. You will be provided with a training manual along with your agency’s unique

username and password. Finding a policy is quick and easy with a variety of search options including:

GENERAL INFORMATION

PROGRAM

 Coverage is offered through Omni Indemnity Company and Florida Independent Management Company.

 Policies may be written on a 6 month basis for New Business only.

 Policies are billed directly with a variety of payment plans available.

 Outside premium financing is not available.

COMMISSION

 Base commission is 12.5% for Tiers A-F for New and Renewal Business.

 Base commission for Non-Owners 18%.

 Commission is paid in advance for the full policy term.

 Net commission is paid at the close of each month.

ACCOUNTING

The following is included in agent monthly statements:

 New business and renewal policies

 Endorsements

 Cancellations and reinstatements

 Commission

APPLICATION

 All new business must be uploaded through our website. Applications and related forms must be signed by the Agent and the applicant.

 If an application is to re-write a previously cancelled policy, and there is earned premium due on the cancelled policy, the amount of earned premium due must be submitted. If the full balance due is not received, the new policy will be cancelled and the outstanding earned premium will be deducted from any refund.

 A down payment is required with each new business submission.

HOW TO BIND COVERAGE

Agents may bind coverage when all of the following are met:

 The risk is acceptable. (Please refer to the Unacceptable Risk section.)

 The producing agent and applicant sign a fully-completed application (including the date and time coverage is bound).

 The required down payment is collected.

 The application and payment are submitted within three calendar days of the effective date.

Binding is NOT allowed for Physical Damage Coverage

during a severe weather alert, hurricane, tropical storm, tornado, or flood watch or warning as issued by the National Weather Service.

 Drivers’ License numbers are on the application for all operators including operators that are excluded from coverage.

POLICY ISSUANCE

 The agent must deliver the policy booklet to insureds at the time the application is completed.

 The company will send the declaration pages directly to the Insured and Lien holder.

UPRATES AND DOWN PAYMENT SHORTAGES

When an uprate or down payment shortage occurs, an additional down payment will be necessary.

 The additional down payment will be billed to the insured with the original declarations page.

ENDORSEMENTS

Endorsement can be uploaded through our website.

 Resulting additional premium charge (AP) or return premium credit (RP) is spread over remaining installments.

 Endorsements requiring a signed form must be signed by the applicant and kept on file.

 Endorsements resulting in a revised premium will be provided real-time.

 All changes requiring premium adjustments shall be computed pro rata.

 Mid-term endorsements will be effective at 12:01 a.m. on the day after the postmark date using the rules and rates in effect at the policy inception or latest renewal date.

 An updated policy declarations page and payment schedule will be mailed the day after the endorsement is processed.

CANCELLATIONS

 A policy is void when down payment funds do not clear the banking institution.

 A policy may not be cancelled flat unless the initial down payment is NSF. Policies flat canceled will be considered void at inception unless check is cured within 15 days following mailed notification by Omni to the insured.

 Company-initiated cancellations for underwriting reasons are pro-rated.

 All other cancellations (including non-payment and insured-requested) are calculated at 90% pro-rata.

 Renewal policies are canceled pro-rata.

REINSTATEMENTS WITH NO LAPSE IN COVERAGE

 A policy that is canceling for non-payment of premium may be reinstated when the past-due amount is either postmarked or received in our office prior to the cancellation date (shown on the cancellation notice). Policies cancelled for any reason other than non-payment will be reinstated ONLY if all requested information is postmarked on or prior to the effective date of cancellation and all payments are current.

 If requesting a reinstatement with no lapse in coverage, a completed No Loss / No Claim Statement must be submitted along with the past due premium amount. The reinstatement request must be made within 4 days of the cancellation effective date.

 A new application must be completed if the required steps for reinstatement are not fulfilled.

REINSTATEMENTS WITH A LAPSE IN COVERAGE

Policies cancelled for non-payment of premium will be reinstated with a lapse in coverage as of 12:01 AM the day following payment or postmark date if:

1. The postmark or payment date is within 29 days of the cancellation date.

2. The insured has paid the entire amount due and this payment is honored by the financial institution.

3. The policy is not in the last 30 days of its term without a renewal offer.

All of the following must be forwarded to Omni:

1. All information that was previously missing.

2. A No Loss / No Claim Statement, if requested.

NOTE: We will honor the date and time of electronic payments

or payments received in your office with proper documentation.

REFUNDS

There are occasions when the company owes unearned premium back to an insured or agent. Refunds are mailed to the insured at the current address on file, unless otherwise requested. If it is necessary to mail the refund to the agent or a different address, please contact Customer Service.

Refunds are computer generated approximately 30 days from the last payment transaction to allow ample time for the payment to clear.

RENEWALS AND NON-RENEWALS

 Thirty days prior to the expiration date, a renewed offer is sent to the insured with a bill for the renewal premium or down payment.

 If the bill is not paid, the renewal offer will expire for non-payment.

 The renewal down payment on 6 and 12 month policies is one month’s premium followed by monthly installments.

 If Omni elects to non-renew your customer, a notice of non-renewal will be sent at least 20 days prior to the anniversary date of the policy.

 Renewal policies are re-scored every 24 months as required by state regulations.

 Polices are re-tiered when re-scored.

RENEWAL REPLACEMENT POLICY

Renewals may be reinstated with a lapse in coverage of up to 30 days from the effective date of the renewal policy.

 If a renewal down payment is paid within 30 days of the renewal effective date, a replacement policy will be issued with a lapse in coverage.

 Attach a completed green Renewal Replacement Form (AC-008) to the payment and send it to Omni.

 The replacement policy will be effective the date and time the insured signs the green slip if payment is made to the agent, or the date Omni receives the renewal down payment if payment is sent directly to Omni by the insured.

 A replacement policy with a lapse is only available when a renewal down payment is late. Late installment payments do not qualify for this program.

CLAIMS

 All losses should be reported to our office by telephone immediately after an accident. New claims may be reported 7 days a week. Voice-mail will be used after normal business hours.

 It is to your customers’ advantage to call as soon as possible.

CONSUMER REPORTS

As a matter of good business practice, Omni requires that the agent provide the consumer with prior notice that credit (for insureds age 19 and older), MVRs and loss reports will be ordered as a routine part of the underwriting process in order to determine eligibility and/or price for insurance products (or, where applicable, to determine eligibility for payment plan options). Most states also require this notice as a matter of law. The notice may be given verbally, initially, but must be followed up in writing when an application is taken.

UNACCEPTABLE RISKS

The Company reserves the right to reject any risk. Unacceptable risks are those involving any item in any of the following categories.

UNACCEPTABLE POLICIES

 Named insureds permanently residing in a state other than the policy state.

 More business or artisan use vehicles than listed drivers.

 More than two business or artisan use vehicles on a policy.

 Information omitted that is essential to rate and issue a policy.

 Applications with a business, partnership, or corporation listed as the named or additional insured.

 If any representation contained in the application or policy change request is false, misleading, or materially affects the acceptance or rating of the risk by either direct misrepresentation, omission, concealment of facts or incorrect statements, the policy will be null and void as of the effective date of the new business application or policy change. Policy recession shall also apply to misstatement of use and omission of fact. Omni will not provide coverage for any insured who has made fraudulent statements or engaged in fraudulent conduct in connection with any accident or loss for which coverage is sought under the policy.

 Physical Damage only (PIP is required in FL)

 Travel Outside of Florida more than 60 days out of the year

 Where resident adult does not have a valid driver’s license, unless disabled.

UNACCEPTABLE INSUREDS/DRIVERS

 In the military and not permanently stationed in a state which the Company is licensed to write business and currently operating

 Operators without a garaging address.

 Operators not possessing a valid driver’s license.

 Operators under the minimum age for state licensing.

 With a suspended or revoked license and not filing an SR-22, unless excluded from coverages.

 Requiring a SR-22 filing in any state other than a state in which the Company is licensed to write business.

 A professional entertainer or person of notoriety must be submitted for approval.

 Persons not physically in Florida at least 10 months of each year (except for acceptable student/military risks and certain out-of country risks; see General Territory Rules)

 Applicants who have been convicted of insurance fraud.

 Any operator not listed on the application who is a resident of the insured’s household is excluded. A specific exclusion must be completed for known (listed) operators not to be rated.

 Any operator with an unverifiable MVR, UNLESS possessing a valid foreign or international drivers license.

 If not a US citizen, must have a valid foreign or international driver’s license. Must not be a transient, seasonal or migratory workers.

 Any operator with three or more at-fault accidents in the 35 months preceding the policy effective date.

 Had a DUI or related offense with a conviction date after 10/1/07, unless filing an FR-44 and liability limits of 100/300/50 or greater.

 Any operator with one or more Personal Injury Protection (PIP) claims in the last 36 months.

 Any combination of one or more operators if they have among them three (3) or more claims of any kind greater than $500 in the prior 36 months, regardless of fault.

UNACCEPTABLE VEHICLES (See Vehicle Definition section)

Ownership/Title

 Not titled or leased to the named insured or a listed driver

 With a salvaged or reconstructed title

 Owned or leased by a partnership, proprietorships, government or corporation

 Without a complete and verifiable garaging address

Use

 Carrying persons or property for compensation or a fee including, but not limited to:

o Used as a motorized home;

o To transport paying passengers or employees

o limousine or taxi services;

o emergency or escort services; or

o Delivery services (food, mail, newspapers, magazines, courier, florist, etc.).

o Used in shows or parades

 Available to multiple drivers for sales, farming, or artisan use

 Vehicles carrying flammable or explosive substances

 Vehicles regularly available to non-listed, non-resident drivers

Types/Equipment

 Large pickup and sport utility vehicles in the 350 and 3500 series (over ¾ ton) are unacceptable. The IZZY system will not allow any of these vehicles to be submitted.

 Flatbed, stake, modified bed or dump truck

 Large vans in the 250/350 and 2500/3500 series (over ½ ton) are unacceptable. The IZZY system will not allow any of these vehicles to be submitted.

 With a gross vehicle weight in excess of 10,000 pounds

 With a cost new value in excess of $60,000

 With less than four wheels

 Not registered for street use

 Gray market vehicles

 Fully electric vehicles

 Kit, classic or antique vehicles

 Any vehicle manufactured in China

 Any vehicle not garaged in Florida at least 10 months each year (except acceptable student/military risks and certain out-of-country risks);

 Altered, modified or customized:

o For reasons including, but not limited to performance, racing, drag contests or stunting, or competition or show.

o With equipment, including, but not limited to cooking, bathroom, or snowplowing.

UNACCEPTABLE FOR PHYSICAL DAMAGE

 With existing damage of $500 or more, unless inspected by the agent and submitted with a complete description of the damage. Photos may be required. Damage cannot affect the safe operation of the vehicle.

 Vehicles over 25 years old

o Age of vehicle (may not exceed 24) = Current calendar year minus (-) vehicle model year

o For example, in 2007:

 a 1983 vehicle would be acceptable for physical damage.

 a 1982 or older vehicle would not be acceptable for physical damage.

 Physical damage added mid-term to a vehicle on an existing policy without also adding a lien-holder requires prior approval and may require an inspection with photos

DRIVER INFORMATION

All members of the household 15 years of age and older must be included in the essential information section of the application with the corresponding reason for not being listed as a driver.

All members of the household who are of driving age must be listed as drivers or excluded. Residents of the household who are not listed on the declarations page may be denied coverage in the event of a claim.

DRIVER EXCLUSIONS

 Driver exclusions are available for any household member and will be honored if the appropriate signatures are provided on the application. Driver exclusions are not available for the named insured, unless disabled.

 Drivers cannot be excluded from a specific vehicle on a policy.

 Drivers requesting an SR-22 or FR-44 may not be excluded.

MARITAL STATUS

 A married person must be living with his or her spouse to be rated as such.

 Drivers who are single, widowed, separated, divorced or co-habitating unmarried couples will be rated as single. Drivers widowed during a policy term will be rated as married for the remainder of the term.

 Co-habitating unmarried adults may obtain insurance jointly. Only one driver may be the named insured and will be required to sign all coverage elections. The other driver may be listed as an additional insured and additional interest on any vehicle he or she owns or co-owns. Please note: Omni’s systems presently issue ID cards to the named insured only. Your agency may be asked by the customer to provide ID cards as needed.

INEXPEREINCED OPERATOR

 Any operator licensed less than 36 months will be surcharged one point.

 If any operator had a previous license from another state and the current license shows less than 36 months from issue date, provide details about the previous license on the application. Otherwise, the operator will be

surcharged one point.

If an operator had a previous license from another country or still holds a license from another country (including Canada and Puerto Rico), please see “Other Point Charges” for details.

NOTE:

The one-point charge for inexperienced operator will be waived if proof of driver training is submitted to the Company. Driver training must include 30 hours of classroom training and six hours of roadwork (State of Florida requirements). Student must receive a letter grade of C or higher to receive waiver of point charge.

OCCASIONAL OPERATOR

 Occasional operator is defined as a youthful driver, age 15-24. Occasional operators should not drive any vehicle in the household more than 40% of the time combined. If the youthful driver drives any vehicle to work or school on a regular basis (more than 2 times per week), the individual should be rated as principal operator. There MUST be more drivers than cars in the household for occasional operator class to apply.

DRIVER’S LICENSE STATUS

 Out-of-state license: Driver agrees to obtain a license in resident (policy) state within the time period required by that state.

 Permit Drivers (see Youthful Drivers section): Drivers age 15 or older with a permit will be added to the policy.

 Newly licensed drivers may be surcharged for up to three years.

 Drivers without a valid U.S. driver’s license may be surcharged for up to three years. Drivers who hold a valid foreign driver’s license should submit a photocopy with their application.

FILING INFORMATION (SR-22, SR-22S, SR-22A, SR-50, FR-44, ETC.)

 Financial Responsibility filings may be requested for any resident operator for Florida.

 The name on the filing must appear exactly as it reads on the driver’s license.

 Out-of-state Financial Responsibility filings are not allowed at this time.

 SR-22S (non-cancelable) filings are available on owners and non-owners policies. If paid-in-full, NO PIF discount applies.

AGE

Drivers who have a birthday within one month of the policy effective date will be rated based on the upcoming age if it yields a lower premium.

YOUTHFUL DRIVERS

 Students away at school:

o within the same state as the policy state will be rated at the school address. Agent must show alternate garaging address with zip code;

o in a state other than the policy state, the vehicle will be rated at the policy address;

o in Alaska, Hawaii, Massachusetts, Michigan, New Jersey and New York are unacceptable risks.

 Drivers under the age of 15 are not rated.

 A driver under age 18 may be listed as a named insured when the application is also signed by a parent or guardian.

MILITARY DRIVERS

 Military Personnel:

a. Must be stationed in Florida – Use territory in which vehicle is principally garaged.

b. Military base, service branch and military address must be listed on application.

VEHICLE INFORMATION

TERRITORY

 Omni’s rating program automatically assigns territory based on the mailing address.

 If the mailing address is listed as a P.O. Box, an alternate street address is required.

 The principal garaging address for each vehicle must be disclosed where different from mailing address.

VEHICLE USAGE DEFINITIONS

Pleasure

 Pleasure use includes those vehicles not driven for business or commercial purposes. Examples include the following:

o To and from work or school

o Farm or ranch usage (except the delivery of farm products)

o Occasional non-required business use, such as infrequent trips to the bank, post office, court, etc.

Business

 Business use includes those vehicles owned or leased by the insured and used in the business or occupation of the insured or driver. Examples include the following:

o Customarily used for work or business other than commuting to or from the principal place of business:

 Services - Cable services, telephone repair, A/C services, etc.

 Sales – Tupperware, Avon, etc.

o Primarily used by professionals visiting multiple locations per day (Examples: real estate agents, insurance agents, doctors, ministers, accountants, etc.).

o Utilized for pulling a trailer, which is used for business purposes, regardless of the number of locations visited per day.

 Business use is acceptable if the listed driver has an occupation similar to the above.

 Business use is not acceptable for vehicles used in delivery, carrying persons, etc. (see Unacceptable Vehicle Use section).

 The number of business use vehicles cannot exceed the number of listed drivers on the policy with a policy maximum of two business vehicles.

 A surcharge applies to business use vehicles.

Artisan

 Artisan use includes those vehicles used to carry tools and supplies between the place of business and job site.

 Artisan designation is acceptable if the listed driver uses the vehicle for the reasons indicated above.

 The number of artisan use vehicles cannot exceed the number of listed drivers on the policy with a policy maximum of two artisan use vehicles.

 A surcharge applies to artisan use vehicles.

 Vehicle must be INDIVIDUALLY OWNED. Corporately owned vehicles are not eligible.

 Vehicle may only be OPERATED BY THE NAMED INSURED or other family members.

 Insured may only have ONE VEHICLE used in this category. Risks with two or more such vehicles are unacceptable.

 Premium is surcharged for business use.

 There may be NO PICKUP OR DELIVERY OF GOODS OR PROPERTY. This includes goods for sale by individuals and groups. The risk is unacceptable if the vehicle issued in this manner.

 Vehicles may not transport explosives or flammable substances. Vehicle may not transport equipment weighing more than 500 lbs.

NEW VEHICLES

Contact our Customer Service Department for any vehicle not listed in the Omni rating program. Vehicle symbols will be assigned based on comparison of such new models to similar existing vehicles.

VEHICLE DEFINITIONS

Conversion Vehicles are incomplete vehicles that have

been completed for acceptable personal or business/ artisan usage.

Customized Vehicles are vehicles with added features,

such as pin striping, wheels, tires, captain’s chairs, tinted windows, etc. These features may be covered under Customizing Parts and Equipment Coverage.

Electric Vehicles are vehicles that run solely on

electricity.

Gray Market Vehicles are vehicles not originally built to

U.S. pollution and safety requirements.

Incomplete Vehicles are vehicles purchased from a

manufacturer that consist of, at a minimum, frame and chassis structure, power train, steering system, suspension system and braking system.

Kit Vehicles are vehicles whose parts may be purchased

in kit form and later assembled. Kit vehicles may also be completely original designs.

Salvage Vehicles are vehicles that have been deemed a

total loss for reasons including, but not limited to damage caused by theft, vandalism, accident or natural disaster.

Vehicles with Existing Damage are vehicles with some

form of unrepaired physical damage at the time coverage is requested.

PRE-INSURANCE INSPECTION GUIDELINES

1. The following vehicles require a pre-insurance inspection form with photographs if covered for Physical Damage (photographs must show all sides of the vehicle):

a. Conversion vehicles – photographs should show interior/exterior of vehicle

b. Vehicles rated as stated amount symbols 93-97 (Symbols 98 and 99 are unacceptable.)

c. Vehicles with Additional Equipment coverage in excess of $2,000

d. Vehicles with existing damage

e. Any vehicle with a current value of $50,000 or more

The above procedure facilitates quick, accurate payment of claims. It is in the insured’s best interest to complete these procedures and properly document special equipment and options on the vehicle.

2. State-Mandated Pre-Insurance Inspections (Inspection Form #507 Only)

In accordance with the Florida Statute 627.744, pre-insurance inspections are REQUIRED on all vehicles with Physical Damage coverage in Broward, Dade, Duval, Hillsborough, Orange, Palm Beach, and Pinellas counties.

3. Omni-Required Inspections (Inspection Form #507 Only)

Omni requires the same pre-insurance inspections in some areas adjacent to mandatory pre-insurance inspection counties. These additional inspections will further reduce claims in those areas. These counties are Collier, Hendry, Le, Martin, Monroe, Pasco, Polk, and St. Johns.

4. Exceptions to #2 and #3 Above

Inspection is not required for vehicles that are:

a. In accordance with Florida Statute 627.744, a policyholder who has been insured for two years or longer, without interruption, under a private passenger motor vehicle policy which provides physical damage coverage if the agent of the insurer verifies the previous coverage. Provide declarations page as verification.

b. On an existing Omni policy that renews with no change in vehicles or coverage.

c. 10 years old or older.

d. A temporary substitute.

e. Leased for less than six months (provide copy of the lease/rental agreement).

f. A new, unused vehicle purchased from a licensed dealer or leasing company. Provide copy of bill of sale and title/registration showing transfer of ownership and copy of window sticker/dealer invoice with all options listed. Lease agreement for over six months will also be accepted.

Basic

(1) This coverage provides 80% medical, 60% wage loss and $5,000 death benefit. It is available with age loss exclusion, deductibles or Military Benefits Coordination. If deductibles are elected, the application must contain information describing the additional insurance available to the insured and relatives.

(2) The elected deductible, wage loss exclusion or Military Benefits Coordination on PIP must be the same on all vehicle of a multi-car risk. Deductibles are not available if the supplemental coverage is through Medicare.

Extended

(1) This coverage provides 100% medical, 80% wage loss and $5,000 death benefit for the named insured and resident relatives living in the household. (Basic PIP is provided to other injured persons. Extended PIP is available with deductible or wage loss exclusion options.)

Florida Hurricane Catastrophe Fund State Assessment (FHCF Assessment) 1% of direct written premium

Effective 1/1/2007, FL mandates an emergency assessment levied

upon the direct written premiums for property and casualty lines of

business. The Florida Hurricane Catastrophe Fund FHCF (State

Assessment) requires an assessment 1% of direct written premium on

each policy. Premium is collected by insurer and remitted quarterly to

the state based on the DWP for that quarter.

All coverages that are described in the Insuring Agreement and/or Endorsements are subject to policy exclusions and conditions.

ACCIDENTS & VIOLATIONS

1. Violations, convictions and/or accidents during the last 35 months are chargeable based upon occurrence date. In the event that an accident and conviction result from the same occurrence, always charge for the accident.

2. MAJORVIOLATIONS

a. Chargeable accidents and major violations are charged for 35 months.

b. When an accident and violation arise out of the same occurrence, charge for the accident or violation with the most points.

3. MINORVIOLATIONS [In accordance with Florida Statute 626.9541(4)(a)]

a. If there have been 3 or more occurrences in the previous 35 months, the third and subsequent minor violations will be charged.

4. If there have been less than 3 occurrences in the previous 35 months, the first minor violation in the most recent 18 months, waive the first occurrence and charge all other minor accidents.
