REQUEST:

The City Council adopt Resolution No. 40-18 approving a towing rate fee increase and addition of services.

BACKGROUND:

On December 18, 2017, the City Council approved Resolution No. 36-17 regarding Towing Service Regulations. The fee rates were commiserate with surrounding counties.

DISCUSSION:

The fee rate for tow truck wrecker services has not been updated since April 2006. Since the Santa Rosa County Commission does not set the rates, it is incumbent on the Florida Highway Patrol (FHP) Troop Commander responsible for the affected county to set the rates for the wreckers. FHP met with Santa Rosa County tow truck wrecker service companies who provided a proposal for an increase due to the amount of time since the last increase. The increased fees and addition of services will be will be applied by tow truck wrecker services when contacted by FHP and the Santa Rosa Sheriff's Office.

I. Towing Fees

The following amounts will be the maximum that Tow Truck Wrecker services may charge when requested to respond by the Department. These towing fees may be changed at the discretion of the City Council and shall apply to a Tow Truck Wrecker Service upon written notice from the Department to the Tow Truck Wrecker Service, A Tow Truck Wrecker Service may not begin providing service to the Department until the Tow Truck Wrecker Service has acknowledged and agreed to all the terms and conditions of these Towing Services Regulations for City of Gulf Breeze, including but not limited to the towing fees on the form attached hereto as the Gulf Breeze Police Department Application and Agreement for Inclusion on Tow Truck Wrecker Service Rotation List.

This paragraph does not apply to any action initiated by a wrecker operator to foreclose a lien recognized by Florida law.

RESOLUTION NO. 40-18

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GULF BREEZE, FLORIDA, INCREASING THE RATE FOR REGULAR TOWING SERVICE IN THE CITY OF GULF BREEZE, AND ESTABLISHING AN EFFECTIVE DATE.

WHEREAS, on December 18, 2017, the City Council adopted Resolution No 36-17 approving Towing Services Regulations; and

WHEREAS, the Towing Services Regulations includes a fee schedule setting the schedule of charges for towing and wrecker services; and

WHEREAS, City of Gulf Breeze finds that it is in the public’s best interest to modify the fee schedule from time to time for consistency with the fees set by Florida Highway Patrol; and

WHEREAS, the City’s fee rate has not been adjusted since April 2006; and

WHEREAS, in November 2018, the Florida Highway Patrol adopted new fees which the City now desires to incorporate into its Towing Services Regulations. The new fee rate schedule is attached hereto.

NOW,

THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF

THE CITY OF GULF BREEZE, FLORIDA AS FOLLOWS:

1. That the City Council adopted the attached fee rate schedule for Towing Services Regulation.

This Resolution shall become effective upon adoption by the City Council.
