Open Public Meeting Statement

In compliance with Chapter 231 of Public Laws of 1975, notice of this meeting was given by way of Annual notice filed with the Township Clerk, the South Brunswick Post, the Home News Tribune and the Trenton Times, and posted on the bulletin board in the South Brunswick Township Municipal Complex, January 2, 2007.

Executive Session Resolution

Resolution 2007-330: Authorizing a Closed session At the July 24, 2007 Meeting of the South Brunswick Township council for the Purpose of Discussing personnel Matters, Contract Negotiations, Pending/Potential Litigation, Safety of Public Property And/Or Real Estate

WHEREAS, there exists a need to hold a closed session for the purpose of discussing matters which fall within the exception of the Open Public Meeting Law, N.J.S.A. 10:4-6, et seq., to wit:

a. Personnel Matters: b. Contractual Negotiations: c. Pending/Potential Litigation: d. Public Safety e. Real Estate and;

WHEREAS, it is unknown at this time when such discussions which take place at said closed session may be disclosed to the public;

NOW THEREFOREBE IT RESOLVED on the 24th, day of July , 2007 by the Township Council of

the Township of South Brunswick, County of Middlesex, State of New Jersey, that:

1. The July 24th, 2007 meeting of the Township Council of the Township of South Brunswick be closed

to the public for discussion of the matters aforesaid.

2. The matters discussed at said closed session be disclosed to the public when the reasons for discussing and acting on same in closed session no longer exist.

Resolution 2007-331: Commending James Allen Kaminski for Achieving the Rank of Eagle Scout WHEREAS, Boy Scout Troop 10 of Monmouth Junction, New Jersey is proud to announce with great pleasure the attainment of the rank of Eagle Scout by James Allen Kaminski ; and

WHEREAS, Eagle Scout is the highest rank that a young man can achieve in Scouting and fewer than two out of 100 Scouts achieve this rank; and

WHEREAS, James began his Scouting activities as a Cub Scout in Pack 107, beginning in 1999. He received his Arrow of Light in March 2000; and

WHEREAS, He joined Troop 10 in the spring of 2000. He has held leadership positions such as Historian, Patrol Leader and Assistant Senior Patrol Leader. He is a member of the Order of the Arrow and has 32 merit badges. Highlights of his community service include joining the troop in both their trips to rebuild homes destroyed by Hurricane Katrina in Mississippi, in 2006 and 2007. He also has volunteered for three years as a Cub Scout Day Camp leader; and

WHEREAS, For his Eagle Scout Project, James chose to lead his troop in building a trail connecting the South Brunswick Senior Center to Reichler Park. This trail gives seniors easy, safe access to the park from their recreation area. A dedication of the trail was held on June 7, 2007; and

WHEREAS, James is a lifelong resident of South Brunswick. He attended Monmouth Junction Elementary School, South Brunswick Upper Elementary School, Crossroads South Middle School and South Brunswick High School. He is a 2007 SBHS graduate and will begin attending the University of the Arts in Philadelphia in the fall; and

NOW, THEREFORE, BE IT RESOLVED on this 24th day of July 2007 by the Mayor and

Township Council of the Township of South Brunswick, County of Middlesex, State of New Jersey, that:

1. The Mayor and Township Council recognize that attainment of the rank of Eagle Scout

requires significant effort and achievement on the part of the recipient and hereby commends James Allen Kaminski for his efforts and dedication to the Scouting Program in the attainment of Eagle Scout.

2. A copy of this Resolution be spread upon the official minutes of the Township of South

Brunswick in recognition of James Allen Kaminski and copies be forwarded to him. Mayor Gambatese read the resolution aloud.

Resolution 2007-332: Commending Eric David Rittenhouse for Achieving the Rank of Eagle Scout WHEREAS, Boy Scout Troop 10 of Monmouth Junction, New Jersey is proud to announce with great pleasure the attainment of the rank of Eagle Scout by Eric David Rittenhouse; and

WHEREAS, Eagle Scout is the highest rank that a young man can achieve in Scouting and fewer than two out of 100 Scouts achieve this rank; and

WHEREAS, Eric started his scouting career as a Tiger Cub continuing through the ranks of Cub Scouts in Pack 107 earning his Arrow of Light. From there he joined Boy Scout Troop 10 advancing through the ranks of Boy Scouts until he achieved the rank of Eagle Scout on March 2, 2007. On the road to Eagle he became a member of The Order of the Arrow and achieved 26 merit badges. Eric has held the leadership positions of Den Chief for younger scouts and Patrol Leader for the troop; and

WHEREAS, The Planning and construction of the 3,000 paver Labyrinth (Prayer Path) was done foe Eric’s Eagle rank service project at The First Presbyterian Church at Dayton. It required over 400 work hours and many hours of planning and preparation. Eric’s leadership in this project resulted in a structure that will be utilized by the church family and the community for prayer, relaxation, and meditation; and

WHEREAS, Eric attended Monmouth Junction School, South Brunswick Upper Elementary School, Crossroads School, and South Brunswick High School graduating in June 2007 with high honors. He will attend Ramapo College in Mahwah, N.J. in the fall where he plans to major in business; and

WHEREAS, in addition to scouting, Eric enjoyed volunteering in the community through Habitat for Humanity and the High School’s Key Club. He is also a member of the National Honor Society and volunteered at the school;

NOW, THEREFORE, BE IT RESOLVED on this 24th day of July 2007 by the Mayor and

Township Council of the Township of South Brunswick, County of Middlesex, State of New Jersey, that:

Resolution 2007-333: Commending Nickolas Low-Beer for Attaining the Rank of Eagle Scout WHEREAS, Boy Scout Troop 90, of Kendall Park, New Jersey is proud to announce with great pleasure the attainment of the rank of Eagle Scout by Nickolas Low-Beer; and

WHEREAS, Eagle Scout is the highest rank that a young man can achieve in Scouting and fewer than two out of 100 Scouts achieve this rank; and

WHEREAS, Nickolas became a Scout in May of 1999, and has earned the rank of Tenderfoot in July of 1999, 2nd Class in May, 2000, 1st Class in November 2000, Star in September, 2001, Life in

October, 2002 and Eagle Scout in February 2007, Nickolas is Troop 90’s 57th Eagle Scout. In order to

reach the rank of Eagle Scout, a Scout must progress through the ranks, demonstrating an increasing knowledge of outdoor skills, citizenship tasks, and leadership with each step. Nickolas did all this and has held the following positions in his career as a Boy Scout such as Patrol Quartermaster, Assistant Patrol Leader, Den Chief, Troop Librarian, Patrol Leader, Troop Scribe, and Troop Assistant Senior Patrol Leader. Nickolas has earned 22 merit badges during his scouting career; and

WHEREAS, Nickolas has shown remarkable leadership both within and outside the troop and he as earned the respect of both adults and scouts alike; and

WHEREAS, the most difficult requirement for an Scout is the completion of a Leadership Service Project. Nickolas Eagle Scout Leadership Service project involved creating a driving directory for all the streets serviced by the Kingston First Aid & Rescue Squad.

WHEREAS, Nickolas recently graduated from South Brunswick High School and was a member of both the National Honor Society & National Latin Honor Society, was a church altar server, he is a

member of the Kendall Park Fist Aid Squad, Captain of Explorer Post,. he is one of fourteen Scouts who gave up his spring break to travel to Mississippi to help victims following Hurricane Katrina. Nickolas plans to attend Rutgers University this fall and major in biology or biochemistry. Medical school is in his future plans; and

NOW, THEREFORE, BE IT RESOLVED on this 24th day of July 2007, by the Mayor and

Township Council of the Township of South Brunswick, County of Middlesex, State of New Jersey, that:

1. The Mayor and Township Council recognize that attainment of the rank of Eagle Scout

Resolution 2007-334: Commending Steven Josephson for Attaining the Rank of Eagle Scout

WHEREAS, Boy Scout Troop 90 of Kendall Park, New Jersey is proud to announce with great pleasure the attainment of the rank of Eagle Scout by Steven Josephson; and

WHEREAS, Eagle Scout is the highest rank that a young man can achieve in Scouting and fewer than two out of 100 Scouts achieve this rank; and

WHEREAS, Steven held the following ranks, becoming a scout in May of 2000,Tenderfoot in October 2000, 2nd Class Scout in March 2001, First Class Scout in April 2001, Star Scout in January

2002, Life Scout in October 2002, Eagle Scout in May 2007, he was Troop 90’s 58th Eagle Scout. During

Steven’s scouting career he has earned 45 merit badges and attended both Philmont and Floodwood High Adventure Scout Camps. In order to reach the rank of Eagle Scout, Boy Scouts must progress through the ranks, demonstrating an increasing knowledge of outdoor skills, citizenship tasks, and leadership with each step. Steven did all this and has held the positions in his career as Patrol Leader, Troop Quartermaster, Troop Guide, Troop Instructor, and Troop Assistant Senior Patrol Leader. Steven has shown remarkable leadership both within and outside the troop and he has earned the respect of both adults and scouts alike; and

WHEREAS, the most difficult requirement for a Scout is the completion of a Leadership Service Project. Steven’s Eagle Scout Leadership Service Project involved collecting over 1600 pounds of personal supplies for our Military Troops in Iraq; and

WHEREAS, Steven recently graduated from South Brunswick High School and was a member of the National Honor Society and President of the South Brunswick High School Military Club. Steven embodies the principals of scouting, and looks forward to leveraging his scout skills when he reports to the United State Marine Corp Boot Camp in August, 2007. As a Marine, Steven plans to specialize in Aircraft Rescue and Fire Fighting. Steven’s future plans include being a paid City Firefighter;

NOW, THEREFORE, BE IT RESOLVED on this 24th day of July 2007, by the Mayor and

Township Council of the Township of South Brunswick, County of Middlesex, State of New Jersey, that:

Public Portion

Mr. Lee Becker Sorelli, Vineyard Lane, urged Council to move forward with the Deans Pond Lane West water and sanitary sewer.

Mr. Monzo reported that there are some recent updates to the possibilities with gravity fed systems and tying in to the Baker project.

Mr. Schmalz gave an overview on the information received from Alaimo Engineers. He stated that Alaimo will be providing costs estimates.

Mr. Howard Bellizio, Homestead Lane, is in favor of moving this water and sewer bond ordinance.

Mr. Robert Weilly, Homestead Lane, expressed concern with the contamination of the well at this property on Homestead Lane.

Todd Bellizio, Homestead Lane, was in favor of this water and sewer bond ordinance. He reported that his water has been tested and has radium in it.

Kevin Bellizio, Homestead Lane, expressed concern with the condition of wells in the Homestead Lane John Kainer, asked Council for support on a subdivision in this area and also would like to endorse this project and hope the township will consider it.

Jane Snyder, Kendall Park, Chair of Open Space Advisory Committee, expressed mourning on the passing of Ruth Spataro. She also expressed concern with the consideration of purchasing two lots that the Open Space Advisory Board has recommended against.

Howard Bellizio reported that the wooden cross in St. Barnabas Cemetary is gone. He also asked if this water and sewer ordinance is postponed, to let him know when it will be rescheduled. Staff will get back to him.

Reports

Mr. Monzo reported on the following:

 The bids for the Community Center Improvements will be going out tomorrow. They are to be

returned on August 16, 2007 and will be awarded on August 28, 2007. Mr. Sears reported on the following:

 The water and sewer department began working on the Friendship Road water line.

 The discovery for the South Brunswick Center vs. South Brunswick has been completed, briefs

have been filed and a trial is scheduled for August 10, 2007.

 The Department of Environmental Protection meeting regarding Route 522 1A and the light at

to August 2, 2007.

 The Appellate Division ruled in favor of South Brunswick regarding the Riya Finnegan litigation

but Riya is trying to appeal the decision to the NJ Supreme Court. Mr. Carley reported on the following:

 National Night Out will be held on August 2, 2007 at 5:00 p.m. at Woodlot Park.

 The South Brunswick High School Music Department will be sponsoring the South Brunswick

Open Golf Tournament on August 17, 2007 at Bunker Hill Golf Course.

 Since the adoption of the Rental Inspection Ordinance, approximately 250 apartments were

inspected for code violations. This insures the safety and quality of life for residents. Mr. Camarota reported on the following:

 He thanked the South Brunswick Police Department and Public Works Department and everyone

who helped make the Fourth of July Fireworks and concert a great success.

 He attended the Beechwoods Park Concert and it was very enjoyable.

 He attended the “Movie in the Park” at Woodlot Park and had a great night out.

 He thanked Joe Monzo for all his efforts regarding the bids for the Improvements to the

Community Center.

 The construction for the turf field will begin next week.

Mr. Killmurray reported on the following:

 He sent his condolences to Ruth Spataro’s family and stated she will be greatly missed.

 He attended the Annual Family Fun Day at Woodlot Park, which was sponsored by the South

Brunswick Library.

 He congratulated Troop 10 and Troop 90 Eagle Scouts and their families for their great

achievements.

 He congratulated the owners of Pleasant Hill Farm on Ridge Road for receiving the “Farm of the

Year” award and Robert Von Thun Junior for “Farmer of the Year” award.

 He reminded staff of the August 17th deadline (to return the form) for Gypsy Moth Spraying.

Ms. Barrett reported on the following:

 She commended the Recreation Department for their Summer Camp Program.

 She and the senior citizens send their thanks to Eagle Scout James Kominski for the trail he

constructed from the Senior Center to Reichler Park.

 She thanked Susan Trilli, Supervisor of the Senior Breakfast, for all her efforts in making the

breakfast such a big success.

Mr. Gambatese reported on the following:

 We received a grant in the amount of $75,000.00 from the State of New Jersey, Department of

Transportation, for the Freedom Trail Bikeway.

 He received a letter from the Office of the Governor, inviting all NJ Mayor’s to participate in a

meeting regarding “NJ Future”.

 On August 7, 2007 he will be meeting with the Department of Transportation regarding the

widening and road improvements of Route 1 in South Brunswick.

 He commended the police department for their Youth Academy.

 He congratulated the South Brunswick Viking Gold Team as champions in the East Brunswick

Tournament and the Montgomery Tournament.

WHEREAS, there exists a need to hold a closed session for the purpose of discussing matters which fall within the exceptions of the Open Public Meeting Law, N.J.S.A. 10:4-6, et. seq., such as contract negotiations, personnel matters, safety of public property, real estate and/or pending/potential litigation; and

WHEREAS, the specific matters to be discussed in closed session at the Work Session of August 14th, 2007 have not yet been determined but will be publicly announced at the commencement of the Work Session; and

WHEREAS, it is unknown at this time when such discussions which take place at said closed session may be disclosed to the public;

Resolution 2007-336: In Support of Ordinance 2007-51, Rezoning Property Located Along

Beekman Road Owned by Brunswick Square At South Brunswick (Block 94.02, Lot 38) From R-2.1 to ARRC Inconsistent with the Master Plan

WHEREAS, the Planning Board has recommended to the Township Council a change in the zoning of the property located along Beekman Road owned by Brunswick Square at South Brunswick (Block 94.02, Lot 38) from R-2.1 to ARRC even though this change would be inconsistent with the Master Plan; and

WHEREAS, while the proposed zoning contemplated in Ordinance 2007-51 is inconsistent with the Master Plan, the Council believes that it is in the best interest of the Township to do so for the reasons set forth below; and

WHEREAS, any rezoning of property inconsistent with the Master Plan requires a resolution in support thereof pursuant to N.J.S.A. 40:55D-62 (a);

NOW THEREFORE BE IT RESOLVED on this 28th day of August, 2007, by the Township Council of the Township of South Brunswick, County of Middlesex, State of New Jersey, that:

1. The Township Council hereby supports Ordinance No. 2007-51, and supports the rezoning of

property located along Beekman Road owned by Brunswick Square at South Brunswick (Block 94.02, Lot 38) from R-2.1 to ARRC.

2. The Master Plan Subcommittee and the Planning Board have recommended that this property be

rezoned from R-2.1 to ARRC.

3. The Subcommittee utilized three criteria in evaluating this property for appropriateness, which the

Township Council finds persuasive as reasons to rezone it:

a) The first is the ability of a senior to walk from the future development of the site to a bus stop.

b) The second is the availability of shopping within walking distance from the site. c) The third is that development of this property as ARRC provides a buffer to arterials for aesthetic and safety needs.

1. The Township Council finds that this property meets all three criteria, and is therefore suitable for the

proposed Land Use Plan designation and AARC zoning.

2. The Planning Director has reported that the Master Plan Reexamination Committee plans to consider

modification of the Township Master Plan in order to change this property to the ARRC designation later this year.

3. A rezoning of this property to ARRC will provide an opportunity for seniors currently living in South

Brunswick to remain in town, in a location that is convenient to shopping and major mass transportation routes, at an affordable price.

Resolution 2007-337: Authorizing the Person-To-Person Transfer of Plenary Retail Consumption License 1221-33-011-004 From Ground Round, Inc. to South Brunswick Investment Group, LLC

WHEREAS, South Brunswick Investment Group, LLC has applied for a person-to-person transfer of plenary retail consumption license #1221-33-011-004 from Ground Round, Inc.;

WHEREAS, the submitted application is complete in all respects; and

WHEREAS, the Township Clerk of the Township of South Brunswick has reviewed the

application of South Brunswick Investment Group, LLC and all the relevant documents and finds them to be in substantial compliance with all relevant statutes of the State of New Jersey and ordinances of the Township of South Brunswick; and

WHEREAS, the Township Council is satisfied that South Brunswick Investment Group, LLC has substantially complied with the notice requirements of the statutes and Township ordinances; and

WHEREAS, the South Brunswick Police Department conducted an investigation in connection with this application; and

WHEREAS, pursuant to N.J.A.C. 13:2-7.10(b), as amended, a statement as to the source of funds used in the purchase of the license and all additional financing obtained in connection with the license has been submitted and reviewed; and

WHEREAS, there were no objections to said transfer from person-to-person.

NOW, THEREFORE, BE IT RESOLVED on this 26th day of June, 2007 by the Township Council of the Township of South Brunswick, County of Middlesex, State of New Jersey, that:

1. The Township Council is satisfied that South Brunswick Investment Group, LLC has complied with the requirements of N.J.S.A. 33:1-26

WHEREAS, the County of Middlesex currently utilizes space at the Senior Center for the purpose of providing daily hot meals and nutrition support services to enrolled participants in the Senior Meal Program (i.e., Meals-on-Wheels) for a fee of $250.00 per month; and

WHEREAS, the monthly lease rate of $250 per month shall be amended retroactive to July 1, 2007 to a monthly rental amount of $500.00, which will be funded with Older Americans Act (OAA) federal grant funds; and

WHEREAS, the Department of Law has reviewed the form of agreement and has found same to be acceptable as to form;

NOW THEREFORE BE IT RESOLVED on this 24th day of July, 2007, by the Township Council of the Township of South Brunswick, County of Middlesex, State of New Jersey, that:

Resolution 2007-342: NJDOT Transportation Trust Fund

WHEREAS, the State of New Jersey Department of Transportation has announced that the Fiscal Year 2008 Municipal Aid Program is underway, and has encouraged municipalities to submit applications for pedestrian and bicycle projects as well as their normal roadway projects at this time; and

WHEREAS, the Township Engineer has recommended the submission of applications for grants related to a number of projects within South Brunswick which would fall into the 2008 category of projects covered by the Fiscal Year 2008 Municipal Aid Program promulgated by the NJDOT Transportation Trust Fund; and

WHEREAS, the Township Council believes that it is in the best interests of its residents to submit applications for possible grant funds from the Transportation Trust Fund for the projects recommended by the Township Engineer;

NOW THEREFORE BE IT RESOLVED on this 24th day of July, 2007, by the Township Council of the Township of South Brunswick, County of Middlesex, State of New Jersey, that:

1. It hereby authorizes and approves the submission of applications for grant funds from the New Jersey

Department of Transportation Trust Fund Fiscal Year 2008 Municipal Aid Program for the following projects listed below in priority order:

A. Roadway Improvements

Ridge Road (between Route 522 and Georges Road) - This project will provide for curbing and drainage improvements in order to address existing problems in this area.

Raymond Road (in the vicinity of Douglass Drive) - This project will provide for curbing, sidewalk and drainage improvements in order to address existing problems in this area.

B. Pedestrian Improvements

Ridge Road (between Route 522 and Georges Road) - This project will provide for the construction of a sidewalk extending from the Georges Road/Culver Road intersection toward Route 522.

Freedom Trail (Stouts Lane area) - This project will provide for the continued construction of a bikeway within the right-of-way of the former railroad in the vicinity of Stouts Lane.

2. The Mayor, Township Engineer and Township Clerk shall be and are hereby authorized

to execute any and all documents necessary to submit the appropriate grant applications for these projects.

Resolution 2007-343: Authorizing Release of Bonds for Crossings At South Brunswick (Girsh) Major Subdivision

WHEREAS, Girsh Development Inc. requested a release of the bonds posted for its development; and

WHEREAS, the Township has the following incomplete site work bonds on file in order to guarantee the completion of the site landscaping and the driveway paving work on the following lots:

WHEREAS, CME Associates indicated in a letter dated June 29, 2007 that based upon satisfactory completion of the previously incomplete site work, it does not object to the release of the incomplete site work bonds at this time;

NOW THEREFORE BE IT RESOLVED on this 24th day of July, 2007, by the Township Council of the Township of South Brunswick, County of Middlesex, State of New Jersey, that:

1. The Township Council hereby authorizes the release of the above mentioned bonds for Crossings at

South Brunswick (Girsh) major subdivision at this time.

Resolution 2007-344: Authorizing a Contract with Griffin Pipe Products Co. for Cement Lined Ductile Iron Pipe

WHEREAS, the Township of South Brunswick has advertised for bids for Cement Lined Ductile Iron Pipe and bids were received on June 28, 2007; and

WHEREAS, the lowest responsible bidder for Cement Lined Ductile Iron Pipe was Griffin Pipe Products, Co., 1100 West Front Street, Florence, NJ 08519-1099; and

WHEREAS, the bids were reviewed by the Utilities Department Director and the Purchasing Agent and same were found to be in order; and

WHEREAS, the Utilities Department Director has recommended that contracts be awarded to the above vendor on a unit price, open end contract basis as shown in Schedule A with a certification of the availability of funds being provided on each purchase order as supplies are required and prior to liability being incurred and the Township Manager has approved said recommendation; and

WHEREAS, a certification of availability of funds will be provided by the Township Treasurer on each purchase order as supplies are required and prior to liability being incurred; and

WHEREAS, the Department of Law has approved of said certification as to form;

NOW, THEREFORE, BE IT RESOLVED on this 24th day of July, 2007, by the Township Council, that:

1. A contract be and is hereby authorized with Griffin Pipe Products, Co. for Cement Lined Ductile Iron Pipe on a unit price, open end contract basis at unit prices as set forth in the annexed Schedule A. 2. These expenditures shall be charged to the appropriate accounts at the time of certification of availability of funds on each purchase order as supplies are required and prior to liability being incurred. 3. The Purchasing Officer is authorized to return the contract document fee and bid bonds to those qualified bidders who are entitled to a refund in accordance with the bid specifications.

4. The Township Manager or his designee and Township Clerk be and are hereby authorized to execute the contract.

Resolution 2007-345: Amending the Contract with Environmental Resolutions, Inc. for Engineering Services for Design of the Kingston Sidewalks

WHEREAS, the Township awarded a contract for engineering services to Environmental Resolutions Inc. for the design of the Kingston sidewalk project by way of a resolution dated June 27, 2006 following a “fair and open process”, as defined by N.J.S.A. 19:44A-20.4 et seq.; and

WHEREAS, Environmental Resolutions, Inc. has submitted a proposal dated June 26, 2007 to provide the necessary engineering services for construction observation and contract management services for an amount not to exceed $5,500.00; and

WHEREAS, funds are available for this purpose and a certification of availability of funds shall be provided by the Township Treasurer in Account No. 04-2003-0900-4403-4-00810 by Joseph P. Monzo/jmb________________________________________

WHEREAS, the Department of Law is satisfied that said certification is in proper form;

WHEREAS, Sockler Realty Group was appointed as the Township Appraiser by resolution dated January 1, 2007, following a “fair and open process,” as defined by N.J.S.A. 19:44A-20.4, et seq.; and

WHEREAS, the contract calls for Sockler Realty Group to perform appraisal services as may be directed: and

WHEREAS, Sockler Realty Group has indicated that it could provide appraisal services for property located at 3841 U.S. Route 1 (Block 93, Lots 11.03, 11.04 and 11.05) in an amount not to exceed $3,000.00; and

WHEREAS, funds are available for this purpose and a certification of availability of funds shall be provided by the Township Treasurer from Account No.20-9999-0000-0000-2-235381 by Joseph P. Monzo/jmb; and

WHEREAS, the Department of Law is satisfied that said certification is in proper form;

WHEREAS, the Code of the Township of South Brunswick, specifically, Section 62-76 et. seq. mandates that the Planning Board members shall be appointed by the Mayor with the advice of the Township Council; and

WHEREAS, presently a vacancy exists on the Planning Board;

NOW, THEREFORE BE IT RESOLVED on this 24th day of July, 2007 by the Township Council of

the Township of South Brunswick, County of Middlesex, State of New Jersey that:

1. Barry Nathanson be and is hereby appointed to fill an unexpired term as a Class IV Member of the Planning Board, said term to expire December 31, 2009.

Resolution 2007-350: Authorizing Execution of an Agreement With Sharp Shooters Basketball Inc. To Provide a Summer Basketball Camp Program

WHEREAS, the Township of South Brunswick (“Township”) and Sharp Shooters Basketball, Inc. desire to provide a one week basketball camp for the South Brunswick Community; and

WHEREAS, the Township of South Brunswick and Sharp Shooters Basketball, Inc. have mutually agreed as to the services to be provided, as set forth in the annexed agreement; and

WHEREAS, it is in the interest of the community to provide this worth while program; and

WHEREAS, the specific details of the agreement are on file in the Township Clerk's office;

WHEREAS, the Township of Plainsboro as lead agency for the Cooperative Pricing System of Mercer/Middlesex County has advertised for bids for Gasoline and Diesel Fuel and bids were received on May 22, 2007; and

WHEREAS, the lowest responsible bidder for Gasoline and Diesel Fuel was, Riggins, Inc., 3938 South Main Street, Vineland, New Jersey 08360-7743 ; and

WHEREAS, Riggins, Inc. agreed to extend its prices to the other members of the Cooperative Pricing System of Mercer/Middlesex County; and

WHEREAS, the Purchasing Agent has recommended that a contract be awarded on an open end contract basis with a certification of availability of funds to be provided on each purchase order as

supplies are required and prior to liability being incurred to Riggins, Inc. based on the Newark, New Jersey low reseller Tank Car Price as published in the Journal of Commerce on the day of delivery plus a delivery charge as follows:

Diesel Fuel -$.094 per gallon Gasoline -$.064 per gallon and the Township Manager has approved said recommendation; and

WHEREAS, a certification of availability of funds shall be provided by the Township Treasurer on each purchase order as services are required and prior to liability being incurred; and

WHEREAS, the Department of Law is satisfied that said certification is in proper form;

NOW, THEREFORE, BE IT RESOLVED, on the 24th day of July, 2007 by the Township Council of the Township of South Brunswick, County of Middlesex, State of New Jersey, that:

1. A Contract be authorized with Riggins, Inc. for Gasoline and Diesel Fuel on a unit price basis, as set forth in the above schedule.

2. These expenditures for South Brunswick Township's portion, shall be charged to the

appropriate account at the time of certification of availability of funds on each purchase order as Gasoline and Diesel Fuels are required and prior to liability being incurred.
