Education service Contract for non-national students and persons admitted to Warsaw School of Arts (Wyższa Szkoła Artstyczna w Warszawie) acadmic courses run in cooperation with Warszawska Szkoła Fotografii on rules non pursuant to Polish nationals

The subject of this Contract is specifying terms of payment for non-nationals admitted to academic courses run by the Warsaw School of Arts (WSA) in cooperation with the Warszawska Szkoła Fotografii, who study on rules non pursuant to Polish nationals. This Contract is drawn up on the basis of Art. 4 of resolution No 06/06/2015 of the Warsaw School of Arts Senate dated 30 June 2015 on specifying, under art. 160a para. 5 of the Act of 27 July 2005 – Law on Higher Education, model contracts on terms of payment for education services concluded with students and WSA study center students in force since the beginning of 2015/2016 academic year, as well as in relation to terms of Contract concluded between the School and Warszawska Szkoła Fotografii

This Contract covers provisions on payment for education services for first-cycle full- and part-time1 studies in the field: Painting, according to art. 160a of the Act of 27 July 2005 – Law on Higher Education (Unifrom text: Official Journal of Laws of 2012 item 572 as ammended).

The School confirms, that it is a non-public vocational university established on the basis of permission granted by minister responsible for higher education and acting compliant with the Act of 27 July 2005 – Law on Higher Education (Unifrom text: Official Journal of Laws of 2012 item 572 as ammended), hereinafter referred to as „the Act”, as well as its implementing provisions.

The School declares, that it fulfills statutory demand to facilitate the widest possible access to education and research opportunities as well as putting into effect the principle of equal treatment.

COMMITMENTS § 1

1. The school commits to provide education services in return of payment in favour of the Student according to curriculum and study plan in force at the School provided for non-nationals in cooperation with Warszawska Szkoła Fotografii.

2.

The School declares that it fulfills requirements to run courses in the field of study subject of this Contract, covering staffing and other necessary conditions, including facilities, related to essential equipment, conducting courses and undertakes to ensure these conditions are met untill the end of the planned education period.

3. The school commits to provide:

1) staffing with qualifications suitable for the courses offered,

2) facilities necessary for the proper implementation of the curriculum, 3) administrative and technical service of the courses,

4) possibility of using its library,

5) other services as specified in the Contract concluded between the School and the Warszawska Szkoła Fotografii.

4. The School declares that in the event of opening of its liquidation proceedings the Schools authorities shall actively pursue possibilities to enable the students graduation on conditions equal to those declared in this Contract. 5. The School declares that studies being the subject of this Contract last, according to the study plan, for 7 semesters

and enable the Student to be granted at least 180 ECTS points (first-cycle studies). § 2

1. The Student declares to take part and pass courses as specified in the study plan and curriculum.

2. The Student declares to make suitable fee payments and other payments mandatory at the School on the basis of relevant Polish laws as well as internal regulations of the School with the reservation of Art. 3.6 of this Contract. 3. The Student declares to honour the WSA Statute, Regulations of Studies, Rector’s Ordinances, including ordinances

on tuition fees at the Warsaw School of Arts as well as Rector’s Ordinances on other fees resulting from the course of studies at the Warsaw School of Arts for students of a given cycle of full- and part-time studies.

4. The Student declares to provide the School with a medical certificate proving lack of contraindications to commence studying in the field of Painting, according to Art. 1.2.2 of the Ordinance of the Minister of Science and Higer Education of 12 October 2006 on taking up and continuation of studies by foreign nationals as well as their participation in their scientific research and experimental development (OJoL. No 190 item. 1406 as amm.). 5. The Student states, he/ she has a valid accident and health insurance for the period of studies in Poland or has a

valid European Health Insurance Card (EHIC), and in the case of lack thereof he/ she declares to insure him/ herself in the Narodowy Fundusz Zdrowia (National Health Fund or NFZ) immediately after the studies commence, according to art. 1.2.3 of the Ordinance of the Minister of Science and Higer Education of 12 October 2006 on taking up and continuation of studies by foreign nationals as well as their participation in scientific research and experimental development (OJoL. No 190 item. 1406 as amm.).

6. The Student shall equip him-/ herself in materials and painting, drawing, photo, sketching, graphic, and other tools and equipment needed to design, carry out projects and works, fabric, sewing accessories and protective wear. The Student cover costs of sculpture casts and others, hiring models for semester and diploma shows, painting workshhops, accident insurance and medical certificates, if needed by the School or employer organizing students’ internships. The Students cover also costs of participating in culture and sport activities as well as taking part in domestic and foreign conferences and fees resulting from the procedure of confirming effects of learning if it has been used as specified in art. 99.1.6 of the Act.

7. Remaining rights and obligations of the Student are defined in particular by the Regulation of Studies, Internship Regulations, Regulation of Diploma Granting Process and other acts of internal law of the School.

8. The School may hand over for the Students’ use all kinds of scientific materials including press and objects and materials connected with the Schools’ identification.

TUITION FEE § 3

1. The Student declares to cover cost of tuition fees according to ammount and provisions specified by the Contract of cooperation commenced between the School and the Warszawska Szkoła Fotografii, as specified in para. 6. The Student signing the hereby Contract agrees to cover tuition fees in amount specified below:

a) For full-time studies:

1st academic year: annual tuition fee 9,040 PLN + 750 PLN of registration and enrollment fee 2nd academic year: annual tuition fee 9,040 PLN

3rd academic year: annual tuition fee 9,040 PLN 4th academic year: annual tuition fee 4,520 PLN b) For part-time studies:

1st academic year: annual tuition fee 8,705 PLN + 750 PLN opłata of registration and enrollment fee 2nd academic year: annual tuition fee 8,705 PLN

3rd academic year: annual tuition fee 8,705 PLN 4th academic year: annual tuition fee 4,352 PLN

2. The Student declares also to make other payments according to Rector’s Ordinance on additional payments resulting from the course of study for students of a given cycle for full- and part-time studies in force for a given academic year and complying with Regulations of fees resulting from the course of studies at the Warsaw School of Arts, based on an appropriate Rectors’ Ordinance.

3. The amount of fees, mentioned in para. 1, is subject to change as a result of mutually accepted amendments between the School and the Warszawska Szkoła Fotografii. The changed amount of tuition fee in such case is to be transferred to the School by the Warszawska Szkoła Fotografii from assets previously transferred by the Student (candidate). The amount of fees, mentioned in para. 1, is subject to change also in case of termination of the Contract between the School and the Warszawska Szkoła Fotografii – in which case the Student may be obliged by the School to pay the tuition fees directly to the Schools’ bank account, as specified in para. 9 under pain specified in para. 7.

4. The amount of fees, mentioned in para. 2, is subject to change as a consequence to changes of the Polish law defining their amount or possibility to collect them.

5. The Student does not have the authority to negotiate the amount of tuition fees.

6. Payments mentioned in para. 1, shall be paid to the School on behalf of the Student by the Warszawska Szkoła Fotografii from assets previously transferred by the Student (candidate), amounting to a value set separately between the Student and the Warszawska Szkoła Fotografii. The Warszawska Szkoła Fotografii is bound to respect conditions, manner and deadlines to pay tuition fees to the School as specified in Contract concluded between the School and the Warszawska Szkoła Fotografii.

7. Termination of Contract concluded between the School and the Warszawska Szkoła Fotografii or failure to comply to its provisions by the Warszawska Szkoła Fotografii may give rise to deleting the Student from the School’s list of students and termination of the hereby Contract between the Student and the School if the Student, upon request and within the deadline specified by the School, shall not pay the amount of tuition fee directly to the School’s bank account, in the manner specified in para. 9. The Student hereby declares that he acknowledges provisions of the Warsaw School of Arts Regulations which state, that lack of payment of fees, including tuition fees, may give rise to delete the Student from the list of students of the School. The School is authorised to delete the Student from the list of students also in the case of lack of payment for courses repeated as a result of unsatisfactory results or failure to sign this Contract by the Student, as specified in art. 190.2.4 of the Act.

8. Persons overcompensating for curriculum differences and repeating a course as a consequence of unsatisfactory results are bound to cover the costs of overcompensated or repeated courses specified in an appropriate Rector’s Ordinance on additional payments resulting from the course of study for students of a given cycle for full- and part-time studies in force for a given accademic year.

9. Payments other than tuition fees, specified in para. 1, and subject to para. 3 and 7, which the Student is bound to make as defined in this Contract, shall be paid by him/ her directly to the Warsaw School of Arts bank account no: 64 1020 1127 0000 1902 0200 1170 (Bank PKO BP S.A) ul. Siennicka 6a 04-005 Warszawa.

10. Date of payment made by the Student or the Warszawska Szkoła Fotografii is deemed to be the day of crediting the School’s bank account.

11. In the case of failure to meet the deadline, the School has the right to charge statutory interests for late payments on the amount unpaid.

12. The amount of fees for issuing documents are specified on the date of signatur of this Contract by provisions of the Ordinance of the Minister of Science and Higer Education of 14 Spetember 2011 on documentation of the course of studies (OJoL. No 201 item 1188). The School reserves the right to change the amount of these fees in case of amendments to provisions of the Ordinance of the Minister of Science and Higer Education. Fees for issuing documents related to the course of studies are paid before preparing and issuing the document.

13. The tuition fee does not exceed costs of studies incurred by the School to the extent necessary to carry out and conduct courses, including costs of preparation and implementation of the School’s development strategies, in particular in w development of scientific competence of the personell, didactic and scientific infrastructure, including depreciation and repairs.

§ 4 The Student grants the School his/ her permission to:

1) Announce results, credits (signatures) and other forms of assessing the Student’s work and activity by displaying index numbers in places designated by the Rector or Vice-Rector as well as in the Internet and other similar forms.

2) Disseminate his/ her image and name as well as paintings and diploma works made during the course of education process in information and promotion materials.

3) Make the diploma work available to third parties and reprinting in the School’s scientific journals. 4) Process his/ her personal details.

TERMINATION OF CONTRACT § 5

1. Should the Student resign from studying, he/ she is bound to submit written notice of resignation to the School, return his/ her Student ID and submit clearance slip (exit checklist). Failure to fulfill this obligation results in further recognition of the Student as fully fledged and acting according to provisions of this Contract.i p

2. Fees resulting from the course of studies, including tuition fee, are not subject to refund subject to para. 3

3. Tuition fees are subject to refund for a period during which the Student did not study, if the Non-National was granted a leave of absence gave up studing on health grounds confirmed by medical certificate or on other, documented serious fortuitous events. In such case (weather the School was paid by the Warszawska Szkoła Fotografii or directly by the Student) the School refunds the tuition fee paid directly to the Student after making the following deductions:

a) Payment term since the beginning of the semester (academic year) counted in settlement periods, specified in para. 5, until the beginning of the leave of absence or submitting a medical certificate or other documents confirming serious fortuitous events that justify resignation from further studying, and

b) One additional installment as forseen at the School for 12 installments payment plan (I-VI semester) or accordingly 5 installments payment plan (VII semeste) in the Rector’s Ordinance on

the amount of tuition

fees for the first year students enrolling in

a given academic year and the

payment plans schedule

. 4. From the amount refunded, specified in para. 2, the School has the right to deduct outstanding financial obligations

of the Student towards the School. The payment is refunded within 14 days from issuing the Rector’s decision in this matter to a bank account designated by the Student submitting a written disposition and archived by the School in the Student’s files.

5. Payment term covers the period from the 10th day of one month to the 9th day of the next month.

6. Deleting from the list of students or resignation from further studying do not result in outstanding financial obligations write-off and exemption from making current payments to the School.

7. The Parties agree, that failure to make all due payments to the Warsaw School of Arts may result in refusal to issue periodic assesment card, index book or graduation diploma.

8. In case of Contract termination caused by the Student resignation from further studying, the Student is deleted from the list of students on the date of submitting his letter of resignation from further studying at the School.

9. In case of Contract termination caused by the Student resignation from further studying and deleting from the list of students, the Warsaw School of Arts does not refund enrollment and recruitment fees paid, nor does it refund reactivation fee, in case the student has covered it during the course of studies, as well as any other payment specified in the chart attached to Rector’s Ordinance on additional fees resulting from the course of studies at the Warsaw School of Artsa for a given cycle of full- and part-time studies.

10. The School does not charge for services specified in art. 99a of the Act. ADDITIONAL PROVISIONS

§ 6

1. The Student declares to a written and immediate information on changes to his personal and contact details to the School and other data necessary to fulfill provisions of this Contract. The Student shall bear any responsibilities resulting from failure to fulfill this provision. Correspondence sent by the School to an address designed by the Student shall be considered as delivered following the legal effects.

2. The Student gives his consent to process his personal data in the scope necessary to fulfill provisions of this Contract. The School declares to process personal data according to the law on personal data protection.

3. The Student does not have the right to apply for student financial support benefits (Rector’s scholarship for the best students, the minister’s grant for outstanding achievements, maintenance grant, special grant for the disabled and aid payments) from material aid fund financed from targeted subsidies, as specified in art. 94.1.7 of the Act. 4. A student with outstanding scientific achievements may apply for grants, awards and distinctions payable from

sources other than specified in art. 94.1.6 of the Act, on rules and conditions specified by the School. § 7

1. This Contract has been concluded for the period of studies, subject to § 5.6 of this Contract.

2. This Contract, subject to art. 1, shall expire with the date of the Student’s graduation or date of enforceabled deleting from the list of students, on the condition that the Student has fulfilled all his obligations resulting from this Contract, in particular fulfilling all outstanding and current financial obligaions to the School as specified in the

provisions of this Contract.

3. The Student’s resignation from further studies is considered as termination of this Contract. The Student’s termination of this Contract by written notice of resignation does not relieve him/ her from fulfilling all outstanding or current financial obligations to the School as defined by provisions and implementing provisions of this Contract related to resignation from further studying.

4. All amendments and supplements to this Contract must be made in writing or else shall be null and void.

5. Provisions of the Act of 23 April 1964 – Civil Code (JoL. No 16, art. 93 as amm.) and other acts of law in force, in particular the provisions of the Act of 27 July 2005 r. – Law on Higher Education and ordinances issued under its provisions as well as the School’s internal regulations shall be applicable.

6. Any disputes arising out of this Contract or related to it’s performance shall be settled by the court competent for the place of the School’s registered office. The Parties shall seek to amicably resolve any disputes.

7. The claims resulting from this Contract shall become time-barred after 3 years. § 8

1. This Contract has been drawn up in two counterparts, one for each party.

2. Costs of translating this Contract into a foreign language is covered by the student or person admitted to the School, unless the Rector decides otherwise acting in consultation with the Warszawska Szkoła Fotografii.

3. Changing the principles of training for the Non-National during the course of studies at the Warsaw School of Arts to principles of training for the Polish nationals (eg. As a result of obtaining the Card of Pole or decision of the Non-Native himself, if he has the right to do so) shall result in expiration of this Contract at the end of semester, in which the Non-National has become elligible to change the principles of training or has taken a decision to change the principles of training. Changing the principles of training, specified in the first sentence, requires signing a new Contract according to model contract for Polish nationals.
