I. Introduction

The Board of Education of Glenview School District 34 is seeking proposals for construction management services for the upcoming general construction and Life/Safety projects. The Projects include, among other things, upgraded lighting, upgraded emergency generators, replacement of domestic water piping, and removal and installation of HVAC equipment. It is anticipated that all work on-site will be completed during the 2014 summer break.

The School District anticipates that the overall construction budget will be approximately $4,500,000.

Project Schedule: See attachment E.

Proposals are due no later than Thursday, January 2, 2014 at 12:00 p.m., and are to be submitted in both hardcopy and electronic format per the attached specifications:

III. General Instructions

Proposals shall be placed in a sealed envelope bearing the title “Construction Manager Proposal” and the name of the Construction Manager. Proposal shall be addressed and delivered to Glenview School District 34, Attn: Mary Werling, Asst. Supt. for Business Services, 1401 Greenwood Road, Glenview, IL 60026 any time prior to, but no later than 12:00 p.m., local time, Thursday, January 2, 2014.

Proposals received after this deadline will not be considered and will be returned unopened.

1. All proposals shall be submitted with each space properly completed. The special attention of Construction Managers is directed to the policy that no claim for relief because of errors or omissions in the proposals will be considered, and Construction Manager will be held strictly to the proposals as submitted. Should a Construction Manager find any discrepancies in, or omission from any of the documents, or be in doubt as to its meanings, they shall advise the Facilities Manager who will issue the necessary clarifications to all prospective Construction Managers by means of addenda.

2. The method of transmittal of the proposal is at the Construction Manager’s risk of untimely receipt by the School District. The School District will not be responsible for delays in delivery by UPS, FedEx, Airborne or any other carrier the Construction Manager chooses. Faxed or emailed copies are not acceptable.

3. A written request for the withdrawal of a proposal or any part thereof may be granted if the request is received by the District prior to the specified time of opening. Construction Managers will not be allowed to withdraw a proposal after the official opening.

4. Proposals must be signed by an authorized official of the organization and the name of the official and their title typed below the signature. The official signing the proposal must initial all erasures and/or corrections in the proposal.

5. All information required by this RFQ should be supplied to constitute a proper proposal.

6. All proposals will be available for inspection in the Glenview School District 34 Business Office after award of contract.

7. The School District is not subject to Federal Excise Tax or Illinois Retailer’s Occupational Tax.

8. In accordance with the Illinois Human Rights Act, which requires that every party to a public sector shall have adopted written sexual harassment policies, P.A. 87-1257, Construction Manager shall certify compliance and produce all required documents upon request. (Attachment C)

9. In the selection of procurement contractors, the School District will not use criteria that may subject qualified individuals with disabilities to discrimination on the basis of their disability, in conformance with the requirements of the Americans with Disabilities Act.

10. Every party to a public contract and every eligible proposer shall comply with the procedures and requirements of the Department of Human Rights Regulations concerning equal employment opportunities and affirmative action. (Attachment C)

11. By submitting a proposal, the Construction Manager certifies that it is in compliance with all laws, ordinances, regulations and codes of state, federal, county and local government agencies, which may, in any manner, affect the preparation of proposals or the performance of the contract.

12. Construction Manager shall submit with its proposal, the signed Non-Collusion Affidavit, (Attachment B) certifying that the Construction Manager is not barred from bidding as result of a conviction for either bid-rigging or bid rotating under Article 33E of the Criminal Code of 1961.

13. Construction Manager agrees to maintain all records and documents for projects of the School District in compliance with the Freedom of Information Act, 5 ILCS 140/1 et seq. In addition, Construction Manager shall produce, without cost to the School District, records which are responsive to a request received by the School District under the Freedom of Information Act and which are in the custody or control of the Construction Manager, so that the School District may provide records to those requesting them within the time frames required. If additional time is necessary to compile records in response to a request, then Construction Manager shall so notify the School District and if possible, the School District shall request an extension so as to comply with the Act. In the event that the School District is found to have not complied with the Freedom of Information Act based upon Construction Manager’s failure to produce documents or otherwise appropriately respond to a request under the Act, then Construction Manager shall indemnify and hold the School District harmless, and pay all amounts determined to be due including but not limited to fines, costs, attorneys’ fees and penalties.

14. The Contractor shall not pay less than the prevailing rates of wages to all laborers, workmen, and mechanics performing work under this

contract, and shall comply with the requirements of the Illinois Wages of Employees on Public Works Act (820 ILCS 130/1-12). These prevailing wage rates are revised by the DOL and available on its website. Contractors will be required to submit to the District a certified payroll for each month no later than the 15th day of the following

IV. Scope of Services

A. Design Phase Services

Construction Manager shall provide constructability review, overall scheduling and coordination, and pre-construction cost estimating, including the following:

• Review the Owner’s needs, goals and requirements.

• Identify potential construction phasing strategies and schedules based

upon the specific project requirements and/or variables

• Prepare and update the construction schedule as needed based on

the approved phasing strategy

• Assist in defining project costs and major cost variables

• Prepare and maintain a detailed project construction budget during

each of the design phases

• Prepare a trade-by-trade construction cost estimate based upon the

in-progress design documents for incorporation into the master project budget

• Prepare a detailed, measured quantity cost estimate for the

in-progress construction documents (Estimates to include all construction work and interior improvements allowing contingencies for all items not detailed but required in the work.)

• Provide cost comparisons of alternate construction systems and

materials during the design and construction documents phases

• Provide recommendations to the design team for value engineering

options and economies where appropriate

• Analyze proposed materials and building systems with respect to

quality, availability and price

• Identify, recommend and expedite the procurement of materials and/or

equipment that require long lead times to ensure delivery to maintain the construction schedule

• Review the final contract documents during preparation to minimize

ambiguities, conflicts, overlaps, and omissions between the proposed subcontractors and/or trade packages

B. Bidding Phase Services

Construction Manager will assist the Architect and Owner with preparing bid documents and administrating the bid process (Attachment E), including the following:

• Prepare list of trade or bid packages identifying the specific scope of

work for each trade or subcontract

• Assist in the preparation of bid forms and documents for solicitation of

competitive subcontractor bids

• Prepare list of potential subcontractors (minimum of 5) for each trade

category

• Solicit bids for various trades in accordance with the applicable public

bidding legal requirements in effect, including but not limited to:

o Preparing of scope of work and bid packages

o Distributing documents

o Conducting pre-bid conferences

o Assisting the architect in resolving questions or interpretations

• Evaluate and analyze bids as to adequacy and completeness

• Conduct scope reviews with the qualified low bidders and make

recommendations to the project team for contract award

• Assist the Board of Education staff in the preparation and execution of

construction contracts for each trade or category of work

C. Construction Phase Services

The Construction Manager will administrate the trade contracts as construction manager at-risk.

• Provide home office and job-site administration of the project

• Provide full-time, on-site coordination and supervision of all trade

subcontractors and construction activities

• Administrate and manage all trade contracts including schedules,

release of work spaces compliance with Contract Documents

• Manage shop drawing and submittal review process in conjunction

with the architects’ software, and ensure expediting of same

• Review requests for information, requests for changes, claims,

Owner’s requests for proposals, and trade contractor's proposals

• Maintain field logs

Coordinate utility services on and off site

• Coordinate any hazardous material abatement with contractors under

other contracts

• Hold and chair weekly progress meetings with Subcontractors and

District and produce and distribute meeting minutes

• Coordinate installation of district relocated items, signage, phone/data,

and other ancillary items

• Monitor contractor safety, substance abuse programs, and contractor

compliance with the States requirement for a criminal background check

• Monitor access onto construction site

• Maintain an accurate set of as-built documents for the District

incorporating all aspects of construction

• Coordinate construction activities with existing District

operations/facilities

• Attend School Board Meetings and other miscellaneous meetings as

requested

• Review and submit pay requests for payment by district in conjunction

with Architect’s review of same

• Obtain insurance bonds and lien waivers from subcontractors

• Provide monthly progress report addressing any cost or schedule

changes

• Update cash flow requirements

• Expedite substantial completion and occupancy certificates

• Gather and organize closeout documents such as as-builts,

guarantees/warranties, and operation and maintenance manuals

• Assist in obtaining inspections of governing authorities having

jurisdiction and act as the district's representative with local municipalities and the applicable Fire Prevention District, and any other occupancy or testing requirements

• Coordinate keying and other security requirements • Assist Owner with occupancy and start-up

• With Owner and Architect, prepare a punch list and expedite its

completion

The Construction Manager shall not self perform any trade work. Rather, all trade contracts shall be publicly bid, and upon award shall be assigned to the Construction Manager.

D. Post Construction Phase

The Construction Manager will assist the Owner with post-construction resolution of construction issues and warranty issues, including the following:

• Coordinate and expedite the resolution of construction related

problems

• Coordinate and expedite the repair/replacement of items covered

under guarantees/warranties

• Conduct follow-up review of the complete facility to review satisfactory

performance of materials and systems at 11months after substantial completion and prior to the end of the 12-month warranty period

V. Contract Form

The selected construction manager shall be expected to enter into a contract prepared by the School District. The contract form will be AIA Document A132-2009, AIA Document A133-2009, or AIA Document A134-2009. The final contract document will be chosen by the Owner and the selected Construction Manager as appropriate to the project scope.

VI. Submission of Proposal

Submit 3 copies of the proposal. Use only 8 ½ x 11 inch paper. Construction Manager should also include in submission, 1 electronic copy of proposal in .pdf format on removable USB flash drive. Please note that the drive will not be returned to firm.

All proposals should contain the following information:

a) A one-page Letter of Transmittal signed by an owner, officer or authorized agent of the firm or organization, acknowledging and accepting the terms and conditions of this request. The letter must contain a commitment to provide both the services described herein and the personnel proposed for the assignment. The Letter of Transmittal should identify all addenda received by the Respondent. b) Construction Manager’s name and contact information. Include direct and mobile phone numbers, email address and years of service with the firm.

c) A brief description of the Construction Manager’s corporate structure, experience and background. Include an organizational chart. d) Construction Manager’s executive contact person in charge of, and overseeing the Project, along with anticipated key employees for the Project. Include resumes for all listed

persons.

Note that the School District views the qualification of key employees to be of paramount importance to evaluation of the proposals and expeditious completion of the Project. Therefore, failure to assign the listed key employees to the Project or reassigning any of the key employees from the Project prior to Final completion shall be deemed a material breach of the contract sufficient to warrant termination with cause and recovery of damages. Key employees include, at a minimum, the Project Manager and Superintendent(s). Other key employees may include, for example, schedulers, safety supervisors, cost engineers, and the like.

e) A list and brief description (single paragraph each) of at least five, and no more than ten, Projects of similar scope and complexity completed in the last five years in which Construction Manager provided construction management services.

f) Client references: List the names of five (5) Illinois School District clients who have worked with your Construction Management Firm that may be contacted, and include at least three (3) for whom services were rendered within the last two years. Include names and phone numbers where representatives can be contacted.

Include contact information for the owners’ representatives on the listed projects as references.

g) Architect references: List the names of five (5) Architectural firms who have worked with your Construction Management Firm that may be contacted, and include at least three (3) that your firm worked with in the last two years. Include names and phone numbers where representatives can be contacted. g) Provide a breakdown of the time commitment to this project

from each member of your firm’s team and their location during the project (office or field).

h) Additional information

Provide brief information on individual pages regarding the following:

1. What methods or techniques does Construction Manager employ to keep a job running smoothly and efficiently when difficult circumstances arise?

2. How does Construction Manager guard against “schedule slippage”?

3. How will Construction Manager maintain communication with the Architect and the School District?

4. What methods does Construction Manager employ to insure quality control, adherence to the Construction Documents and coordination among the trade contractors?

5. Please provide information regarding your current insurance and safety ratings.

6. Submit a statement describing succinctly why your firm is qualified to act as a construction management firm before construction, during construction, and through final payout phases of all subcontracts.

7. Provide a summary of your firm’s in-house services. i) Construction Manager’s proposed compensation.

The Construction Manager’s compensation shall be comprised of Construction Manager’s fee, reimbursable expenses, and trade contracts. List the fee proposal on the form included as Attachment A.

j) Attach the signed certificates and affidavits included as Attachments B, C, and D.

VII. Evaluation of Proposal, Negotiation, and Award.

The School District will evaluate the proposals based on the substance of the proposals and the information provided by the various references provided. The School District may also inquire from other sources as to the submitters’ respective reputations for quality of service.

The following factors may be used in arriving at the selection of a construction management firm, including but not limited to (listed in no specific order):

• qualifications • general experience

• specific record of accomplishments with similar projects • skills and abilities of personnel

• performance data, including but not limited to cost control, and scheduling

procedures

• workloadand scheduling availability to start work on the project • cost factors

VIII. Reservation of Rights

The School District reserves sole and plenary discretion in the evaluation of all proposals, and in the award of the construction management contract. The School District will not pay any costs incurred by the prospective construction managers for preparing or submitting a proposal. The School District reserves the right to modify or cancel, in part or in its entirety, this RFQ. The School District reserves the right to reject any or all proposals, to waive defects or informalities, and to offer to contract with any firm submitting a response to this or any other RFQ. This RFQ does not commit the School District to enter into a contract. The School District reserves the right to award one, or no contract, in response to this RFQ.

Per The Glenview School District 34 Board of Education, a responsible vendor is defined by meeting the following criteria and is able to submit evidence of such compliance. By signing this required form, the undersigned agrees that said vendor is responsible as defined below.

PREVAILING WAGE

By signing below, Construction Manager shall comply with the present Prevailing Wage Act (820 ILCS 130) which provides that no less than the prevailing rate of wages, as founded by the Department of Labor, shall be paid to all laborers, workmen and mechanics performing work on this contract. The most current list of prevailing wages can be obtained without charge by writing the Conciliation Mediation Service, Illinois Department of Labor, 705 Stratton Office Building, Springfield, Illinois 62706.

SEXUAL HARRASSMENT

By signing below, Construction Manager certifies that it has complied with the requirement of 2-105 of the Illinois Human Rights Act (775ILLs5/2-2-105)-1257) with respect to sexual harassment policies. The terms of that law, as applicable, are hereby incorporated into this contract.

DRUG FREE WORKPLACE

Results of said background check must be made available upon request of the School District.

Construction Manager shall comply with current and future regulations requiring that all employees provide the necessary documentation to affirm that they are eligible for employment (Form I-9, US Dept. of Justice, Immigration and Naturalization Service).

Construction Manager will also be in compliance with current and future local, state and federal laws and regulations.
