PURPOSE OF SURVEY:

The purpose of this survey was to retrace the remainder of an existing tract described in Document Number 960065108 in the Office of the Recorder of Allen County, Indiana. Said existing tract being part of Lot 2 in Jacob H. Feichter's Subdivision as shown in Plat Book 14B, Page 76 in the Office of said Recorder. Located at 9727 Coldwater Road, Fort Wayne, Indiana.

In accordance with Title 865, Article 1, Rule 12, Section 1 through 30 of the Indiana Administrative Code, the above theory of location was based up the following opinions and observations a result of uncertainties in lines and corners because of the following:

A) AVAILABILITY AND CONDITION OF REFERENCE MONUMENTS

The monuments found are shown on the survey and listed on the survey under monument legend.

The existing monuments of the Public Land Survey corners were held as controlling corners and were used as the basis for this survey. The corners of the subject tract are marked and labeled as shown on the survey drawing. Uncertainties based on existing monuments are not readily determinable due to the use of said local corners. The following monuments were accepted as the location of the Public Land Survey corners.

· Southwest corner Northwest Quarter: Section 1,T31N,R12E: Survey Marker Nail (-0.0, Per Co. Witness)

This corner is witnessed in the Allen County Surveyor's Office, and this survey maker nail's location checks

with distances from county witness posts.

- The South line of the Northwest Quarter of Section 1,T31N,R12E was established per the above referenced Southwest corner and by a 1” bar in a highway box labeled as monument “V” on the survey drawing.

B) OCCUPATION OR POSSESSION LINES

There were no uncertainties based on visual inspection of occupation or possession lines.

C) CLARITY OR AMBIGUITY OF DESCRIPTIONS

There were ambiguities found within the descriptions used for the survey. Documents used include:

1. Document Number 960065108

- A portion of this legal description appears to be missing from Document Number 960065108. See note under Record Description on the survey drawing.

2. Document Number 2013062692 3. Document Number 2016057812 4. Document Number 200071182 5. Document Number 200066412 6. Document Number 200044607

7. Survey completed by Donovan Engineering dated May 10, 1993 recorded as Document Number 96-033998.

8. Survey completed by The Turnbell Group as Survey Number 89-13 dated September 27, 1989 and recorded as Document Number 89-38984.

9. Plat of Jacob H. Feichter's Subdivision (Plat Book 14B, Page 76) D) THEORETICAL UNCERTAINTY OF THE MEASUREMENTS

Based on the use of the property (commercial property, industrial property, condominiums, townhouses, apartments, multiunit developments-- single family residential subdivision lots--real estate lying in rural areas) the acceptable relative positional accuracy is rural survey 0.26 feet (79 millimeters) plus 200 ppm.

THEORY OF LOCATION:

The West (389.49 feet) line of the subject tract was established per the West line of Lot 2 in Feichter's Subdivision, which was established as being 1311.46 feet East of the Southwest corner of the Northwest Quarter of Section 1 as measured along the South line of said Northwest Quarter (Per Document Number 200066412) at its South end, and by a found 3/8” steel rebar labeled on the survey drawing as monument “B” at its North end. This 3/8” steel rebar was also found to be the deed distance of 15.10 feet (Per Document Number 2016057812) South of the North line of said Lot 2.

The North (561.69 feet) line of the subject tract was established per the previously described 3/8” steel rebar at its West end, a 5/8” steel rebar labeled on the survey drawing as monument “D”, and by deed angles and distances as shown in Document Number 2016057812 at its East end. The location of the East end of this line was also verified by angles and distances as described for the 0.333 acre tract in Document Number 200066412. The Easterly (27.17 feet, 98.43 feet, 36.68 feet, 134.71 feet, and 112.75 feet) lines of the subject tract were established per the Westerly lines of said 0.333 acre tract in Document Number 200066412, which were established per deed angles and distances. The South (91.00 feet) line of the subject tract was established per the South line of said Northwest Quarter, which was established under

“Availability and Condition of Reference Monuments” above. The remaining Southerly (70.69 feet and 170.65 feet) lines of the subject tract were established per the Northerly lines of the 0.142 acre tract in Document Number 200066412, which were established per deed angles and distances.

This survey is valid only with original signature and seal, full payment of invoice, and complete with all pages of survey. The information shown on the survey documents is intended for this transaction only as dated on said survey documents. Any reuse without written verification and adaptation by the land surveyor for the specific purpose intended will be at the users' sole risk and without liability or legal exposure to the land surveyor.

Since the last date of field work of this survey, conditions beyond the knowledge or control of Miller Land Surveying, Inc. may have altered the validity and circumstances shown or noted hereon.

I affirm, under the penalties for perjury, that I have taken reasonable care to redact each Social Security number in this document, unless required by law, Brett R. Miller.

The commitment for title insurance was not provided at the time of this report, nor did the surveyor perform a title search. An abstract or title search may reveal additional information affecting the property.
