Auction Types
1. We have two types of auction and it is the Buyer’s responsibility to check which one applies (the terms and conditions of sale applicable to each auction type is different).
1.1 Option One
On the fall of the gavel the Buyer is required to pay a deposit to us equal to 10% of the successful bid price. Exchange of contracts (between the Seller and the Buyer) occurs immediately and the Buyer will sign the contract in respect of the property which is available for inspection by him immediately prior to the auction. Completion of the sale and purchase of the lot will take place 28 days following (or if it is not a Business Day on the next Business Day) the date of exchange of contracts.
1.2 Option Two
If the lot is in an Option Two type auction, the lot will be subject to the Option Two Conditions as follows:-On the fall of the gavel or acceptance of an offer by the Seller, the Buyer shall pay a £3,000 non-refundable reservation fee to us and sign the applicable Sale
Memorandum requiring exchange of contracts to take place within 28 days (or if that day is not a Business Day on the next Business Day) of the date of the Sale Memorandum.
Completion of the sale and purchase of the lot must take place within 14 days (or if that day is not a Business Day on the next Business Day) of the date of exchange of contracts. The Sale Memorandum is not a legally binding contract for the Seller to sell and the Buyer to buy the particular lot but represents the intention to do so. However, the Seller will have the security of the non-refundable reservation fee provided that this fee shall be returned to the Buyer if prior to exchange of contracts the Seller withdraws the property for sale.
All reservation fees will be held in the Client Account of Cumbrian Properties ELA Ltd until exchange of contracts. 2. Payment of Deposit/Reservation Fees
Deposits/reservation fees may be paid by cheque, debit card or by prior arrangement into the Client Account of Cumbrian Properties. Unfortunately cash cannot be accepted.
3. Variation to this Catalogue
An addendum may be displayed at the auction showing any alterations to the information contained in the catalogue. It is the Buyer’s responsibility to check this prior to bidding and we accept no liability for the Buyer (or the Buyers representative) not doing so.
4. Charges
4.1 In all cases (whether a property is sold under Option One or Option Two) the Buyer must pay us a buyers administration fee of £500 plus VAT (£600).
4.2 All fees and charges payable to us shall be paid without deduction counterclaim or set-off.

Bidding
All bids are to be made clearly. The Auctioneer reserves the right to regulate bidding and to refuse undesirable bids. The Vendor reserves the right to bid up to the reserve price or to authorise the Auctioneer to do so.
In the event of any dispute in respect of the Auction, the Auctioneer’s decision is final. Each lot is offered subject to the reserve price unless otherwise stated.
Sealed bids and proxy bids are acceptable. See forms later in this catalogue.
Reserves
All properties unless otherwise stated are sold subject to a reserve price.
NOTE Each auction property is offered at a guide price and is also subject to a reserve price. The guide price is the level where the bidding will commence. The reserve price is the sellers minimum acceptable price at auction and the figure below which the auctioneer cannot sell. The reserve price, which may be up to 10% higher than the guide price, is not disclosed and remains confidential between the seller and the auctioneer. Both the guide price and the reserve price can be subject to change up to and including the day of the auction.
Viewing
All persons wishing to view any property should call the office listed with each lot, to make further arrangements.
Notes
In all cases, whether the property is sold prior, on the night or post auction the successful buyer will be required to pay a buyers registration fee of £500 plus VAT (£600).

4 If you are considering selling your property by auction we will meet you and visit your property with the object of agreeing a realistic reserve price. Firstly, normal bidding. This is quite simple. When you arrive at the auction go to the buyers registration where a Buyer’s Registration Form will be filled in and the staff will issue a bidding number and the Bidding Paddle. When you wish to bid, hold up the number so the auctioneer can see it and register your bids. When you are successful, return to the desk in the foyer where your details and reservation fee will be taken.
Secondly, if you wish, a member of staff can bid on your behalf with you at the auction, simply tell us your limit and we will bid for you. Thirdly, proxy bids. You may authorise bidding up to a limit by the auctioneer in your absence.
Fourthly, if you cannot attend the auction or do not wish to bid in the normal manner we will accept sealed bids for the property, these will be opened at the auction when the lot comes up for sale. When making a sealed offer bear in mind that each property has a reserve price. If your sealed bid is for this amount or more and no-one bids a higher price then the property will be sold to you.
Telephone bid – You may authorise Cumbrian Properties Auctions to conduct a telephone bid on your behalf.
