WHEREAS
Section 50
(5)
of the
Plannina
Act,
R.S.O. 1990, as amended, provides that no owner
may convey a part of any
lot
or block which is within a Registered Plan of Subdivision without the consent
of
the Committee of Adjustment or Land Division Committee, as the case may be, unless the land is being
acquired or disposed of by the Federal or Provincial Government or by any Municipality or that is being
acquired for the construction of a transmission line; and
WHEREAS
Section
50
(7) of the
Plannincl
Act,
R.S.O. 1990, as amended, provides that the Council
of the Municipality may, by By-Law, provide that Section 50
(5)
of the
Plannina
Act
does not apply to the
land that is within a registered plan or plans of Subdivision or parts thereof; and
WHEREAS
the developer is requesting that Part Lot Lift be considered to allow for the reduction
from twenty-five lots to twenty-one lots for the subject lots in Phases 3 &
4
of the Cobblestone Ridge
Subdivision; and
WHEREAS
technical staff have indicated they have no concerns or objections to the proposed Part
Lot Lift application;
NOW THEREFORE BE IT RESOLVED
that the Council of the Corporation of the City of Kingston
hereby
ENACTS
as follows:
1.
That Subsection (5) of Section 50 of the
Plannina Act
R.S.O. 1990 as amended does not apply to
Lots 69-78
and
Lots
101-1 15
inclusive of Registered
Plan 13M-26.
2.
That Schedule "A", showing the
location of the subject
lots
(Lots 69-78 and Lots 101-115 of Plan
13M-26 on the west side of Grandtrunk Avenue and the east side of Weston Crescent), is hereby declared
to form part of this By-Law.
3.
This By-Law shall come into force and take effect on the date of its passing.
