Covenants, Conditions and Restrictions (CCRs):

Each owner in SouthPointe should have received a copy of the CCRs that pertain to their portion of the community. The CCRs for first 5 phases of SouthPointe, known as SouthPointe use the CCRs with amendments 1-4. The CCRs for next 3 phases of SouthPointe, known as Dry Creek use the CCRs with amendments 5-7. SouthPointe and Dry Creek use the appropriate portions of amendment 8. The CCRs are available digitally on the SPOA website.

Development Guidelines:

While the base parameters of improving a lot in SouthPointe or Dry Creek are in the CCRs of each

neighborhood, the details and specifics are separate documents that are given authority by the CCRs. These documents, commonly referred to as the Guidelines (GL) are maintained and distributed by the Architectural Control Committee of SP (ACC). Each neighborhood (SouthPointe and Dry Creek) have their own

Guidelines. The ACC is permitted by the CCRs to make adjustments as needed. This is a valuable tool in keeping the Guidelines relevant and up to date as time passes. This makes using the current Guidelines and forms imperative. the current documents are available on the SPOA management company's web site

(www.cvpmnc.com/community.php). Always use the latest version of the documents when making an

application to the ACC.

The Guidelines in SouthPointe are titled "Architectural, Landscape and Lake Buffer Guidelines". The Guidelines in Dry Creek are titled "Dry Creek at SouthPointe Development Guidelines".

Your SouthPointe Owners Association is using a new invoicing and lockbox system beginning with the 2014 assessments. The system uses BB&T’s Association Services. Their system has a different mailing address for those that remember the previous lockbox system.

Any general correspondence related to your property or association should be directed to Catawba Valley Property Management as in the past.

Payment Options:

1. By Mail: Mail check with invoice coupon.

2. In Person: Take payment and invoice coupon to any BB&T banking location.

3. Online Bill Pay: Use your standard online bill pay provider. Include the bill pay account # shown on payment coupon.

4. Online: Credit card or e-check payment through BB&T online system. See cards below. By Mail: Making your payment by mail:

 All payment checks must be accompanied by the invoice coupon.

 Make checks payable to the "SouthPointe Owners Association".

 Canadian checks must have U.S. dollars printed or written on the check.

 Mail payments to BB&T, P.O. Box 628207, Orlando, FL 32862-8207 In Person: Payments may be made at BB&T Financial Center

 Invoice coupons and payments are accepted at all BB&T financial centers and will post the next business day. All payment checks must be accompanied by the invoice coupon.

 Make checks payable to the "SouthPointe Owners Association".

 Canadian checks must have U.S. dollars printed or written on the check. Online Bill Pay Providers

If you use an online bill pay provider, use the bill pay account number located on your coupon. The number is listed as: "Bill Pay Account Number". Use the bill pay account number only; do not add any other letters, numbers or identifying words in the account number area. The bill pay account number is unique to each property address and payment obligation. If you own more than one property or if you have more than one payment obligation, you will have different bill pay numbers for each payment.

Online Payment System

BB&T’s Online Payment System provides you the convenience of making your payment online or enrolling in Association Pay online. The following options are available online:

 Pay by Card Payment – A one-time payment using a MasterCard®, MasterCard® Debit Card, Diners Club®, Discover® Network and JCB card. (BB&T is working to add other cards)

 Pay by eCheck – A one-time electronic funds transfer by ACH debit from your checking or savings account at a U.S. financial institution.

 Enroll in Association Pay – Authorize recurring electronic funds transfers by ACH debit from your checking or savings account at a U.S. financial institution.

Fees & Deposits: Fees and escrow amounts are listed here for the ACC services.

Specific circumstances may change the escrow amount; contact the ACC with the specifics of your project to verify with amount.

Primary Project: ACC Review Fee $1250.00 Standard Deposit $5,000.00

Septic System Installation Inspection (Dry Creek only) Gravity (Type IIIg) $562.50, or

Pump (Type IIIb) $600.00, or Low pressure (Type IV) $625.00

Re-Submittal Review Fee $250.00 re-submittal greater than 1 year past first final. Supplemental Review Fee $100.00 each review past third final review.

Primary projects are any project requiring the level of ACC review and construction monitoring that a house requires.

Major Change ACC Review Fee $375.00

A major architectural change after the final design is approved that significantly changes the building shape and size. A major change would also be alterations to an existing structure such as additions and exterior renovations that change some or all of building shape, roof, siding materials, windows, doors, landscaping or other major items.

Dock & Pier: ACC Review Fee $250.00 Standard Deposit $1,000.00 Ancillary Project ACC Review Fee $375.00 Standard Deposit $1,000.00

An ancillary project is a smaller scale building for utility or accessory use, often matching or complimentary to the house and not for residential use. Examples are garages, storage/gardening sheds, decks and house addition/renovation.

Minor Project: ACC Review Fee $0.00 Standard Deposit $0.00

A minor project is a change to a structure such as changing the color (of a completed structure), rebuilding an existing deck with a different railing, rebuilding a walkway or stoop differently than original. These do require ACC approval.

Lake Buffer work ACC Review Fee $0.00 Standard Deposit $0.00

Buffer work may include tree removal, planting and constructed paths. ACC approval is required. An escrow may be required depending on the scope of the project.
