Attendees: Board of Selectmen: Paul McCormick, Heidi Schadt, Sheryl McMahon, Wayne Bergeron and Alan Tuttle. Town Administrator Rick White, Assistant Town Administrator Sandra Fife and Wendy Pells Secretary.

The Pledge of Allegiance was recited.

HEARINGS 6:30 PM

A public hearing will be held on April 2, 2013 at 6:30 PM at the Dennis Town Office, 485 Main Street, South Dennis, Massachusetts relative to an application hearing for a Privately Licensed Shellfish Area by: Joan Thomas under Massachusetts General Laws, Chapter 130, Section 57 for the purpose of cultivation of shellfish on the tidal flats of Crowes Pasture, Lot CCB23-3Y, in the Town of Dennis. Sheryl McMahon read the hearing notice into the record. There were no comments from the public. Motion:

Wayne Bergeron moved to approve the application. Alan Tuttle seconded. The Board of Selectmen voted 4-0-1 (PM).

Sheryl McMahon read the hearing notice into the record. There were no comments from the public. Motion:

under Massachusetts General Laws, Chapter 130, Section 52 for the purpose of cultivation of shellfish on the tidal flats of Crowes Pasture in the Town of Dennis. Plans are filed and may be seen during business hours at the Town Office Building.

ADMINISTRATIVE MATTERS Paul McCormick returned to the panel of Selectmen.

Change of manager, Dennis Yacht Club

John Webster introduced himself to the Licensing Board. Motion:

Heidi Schadt moved to approve John Webster as the new manager for the Dennis Yacht Club. Wayne Bergeron seconded. The Licensing Board voted 4-0-1 (PM).

Consider Approving Lease for Melpet Stable

Ro Nelson and Jenny Margeson introduced themselves. Heidi Schadt explained that this is a three year lease. The first year would be rent free in lieu of improvements to the barn and fencing. The second and third year would be $500.00 per month.

Motion:

Wayne Bergeron moved to sign the lease. Heidi Schadt seconded. The Board of Selectmen voted 5-0-0.

Rick White requested that the Selectmen contact Town Counsel to proceed with land court action in order to subdivide the land.

Motion:

Wayne Bergeron moved to proceed with subdividing the property. Heidi Schadt seconded. The Board of Selectmen voted 5-0-0.

REVIEW WARRANT ARTICLES DY School Budget

Jim Plath stated that there will be a $600,000.00 shift in the budget. He requested the Selectmen to hold off on placing this article at this time.

Sheryl McMahon stated that the shift over the previous years has been millions of dollars. The Town of Dennis will never recover that funding. She stated that we need to support the schools by placing the article.

Motion:

Sheryl McMahon moved to place the article. Heidi Schadt seconded. The Board of Selectmen voted 5-0-0.

Consider Selectmen’s Policy to hire veterans Motion:

Alan Tuttle moved to place and support the article. Heidi Schadt seconded. The Board of Selectmen voted 5-0-0.

Veteran’s Policy Motion:

Heidi Schadt moved to adopt the following Veteran’s Policy. Wayne Bergeron seconded. The Board of Selectmen voted 5-0-0.

(GL Chapter 59 §5N)

This program offers Dennis Veterans the opportunity to participate in a property tax relief program to a maximum of $500 per year in return for volunteer service to the town. The program begins with Fiscal Year 2014, and for each year will run from January 1, 2014 to December 31, 2014.

Participants in this program may earn abatements in addition to any property tax exemptions they may be eligible for under other statutes, such as personal property exemptions under G.L. 59 §5 or residential exemptions under G.L. Ch. 59 §5C. They may also defer the balance of their taxes under G.L. Ch. 59 §5(41A) if they are eligible to do so. Duties may include answering phone, taking messages, typing, data entry, mailing, filing, meals on wheels delivery, indoor and outdoor maintenance, driving, or other roles where veteran’s may be of assistance.

Eligibility:

Domiciled in Dennis.

Homeowner of property for which tax relief is sought.. Residing at property for which tax relief sought. Only one tax credit per household may be given.

Must have skills appropriate for the position or have the Veteran’s Agent certification that one is unable to work in any of the available positions and are thereby eligible to have a proxy perform the work for you.

Must be a Veteran as defined in M.G.L. clause forty-third of section 7 of chapter 4. Terms:

Credit for work will be given at the rate then current minimum wage of the Commonwealth and will be applied to the participants Dennis tax bill.

The maximum tax credit given will be $500 per year, which would be 62.5 hours of work, performed. Number of volunteers is limited to 10 or $5,000.00 per fiscal year.

To be credited in a given fiscal year, work must be completed by the preceding December 31st. The abatement amount earned is not considered income or wages for purposes of state income tax withholding, or workman’s compensation.

Under current federal law the abatement amount is included in the taxpayer gross income for both federal and FICA tax purposes.

The Gross amount earned will be applied to the overlay account and the taxpayer’s actual tax bill will show a credit for the amount earned net federal withholdings.

It is the responsibility of the participants to report any credit to the IRS as an earning in the tax year in which it is received.

An approved representative for persons physically unable to provide such services is allowed. Procedure:

Application is to be made on the Veteran’s Tax Work-Off Application (www.town.dennis.ma.us) and returned to the program coordinator, who will interview the applicant and refer/ her/him to a Department Head who has requested volunteer assistance. An effort will be made to accommodate capacities and interests. Applications for positions will be filled on a first come, first served, space available basis.
