The Statutory Short Form And Other Powers Of Attorney For

Purposes Of Financial And Estate Planning; And To Repeal

Certain Provisions Of Such Law Relating To Statutory Gift

Riders (Aging)

WHEREAS, the Greene County Legislature supports Older Greene County residents, and initiatives predicated on ensuring their protection against elder abuse, including financial exploitation; and

WHEREAS, we are committed to protecting our most vulnerable; and WHEREAS, we need to express concern regarding recent legislation surrounding powers of attorney; and

WHEREAS, the language utilized in NYS A.5630-A & NYS S.3923A erases the need for the current statutory form, and makes older individuals extremely susceptible to fraud and abuse; and

WHEREAS, financial exploitation is a horrific problem in New York State, and most often the perpetrators are family members, or trusted friends. 95% of all cases occur in the community, not in long term care facilities; and

WHEREAS, our concerns regarding NYS A.5630-A & NYS S.3923A are the same concerns that the Association on Aging in New York has and are as follows: 1. Concerns about abandoning the statutory form:

NOW, THEREFORE, BE IT RESOLVED, that on behalf of the Greene County Legislature we implore you to veto this legislation; and

BE IT FURTHER RESOLVED, that the Clerk of the Legislature is hereby directed to forward certified copies of this resolution to Governor Andrew Cuomo, Senator George A. Amedore, Jr., Assemblyman Christopher Tague and the New York State Association of Counties.

Authorizing Agreement - Greene County Department Of

Human Services (Aging) And Hearthstone Care LLC For

Companion Care

BE IT RESOLVED, that the Chairman of the Greene County Legislature be authorized to execute an agreement, subject to approval as to form by the Greene County Attorney, between Greene County Department of Human Services (Aging) and Hearthstone Care LLC, 1187 Route 23A, Catskill, N. Y., for homemaker/companion care for clients of the County, upon request, in accordance with Article 19 of the Executive Law, 9, NYCRR 6654.17, other applicable rules and regulations, including those promulgated by NYS Department of Health; NYS Office for the Aging, and the Greene County Department of Human Services for the period of January 1, 2020 through December 31, 2021.

BE IT FURTHER RESOLVED, that per the above mentioned contract, Greene County will pay compensation for homemaker/companion care to Hearthstone Care LLC at the negotiated rate of $25.00 an hour. Compensation shall be payable upon 60 days e.o.m. (end of month) from date of invoice; and

BE IT FURTHER RESOLVED, that per the above mentioned contract, Greene County will pay an additional $2.00 per hour over the current negotiated rate for Level-I services provided to residents living in the Towns of Ashland, Halcott, Hunter, Jewett, Lexington, Prattsville, and Windham (also known as the Mountain Top area) to Hearthstone Care; and

BE IT FURTHER RESOLVED, that mileage for shopping and essential errands as outlined in the care plan will be reimbursed at the current IRS rate. Mileage reimbursement will be made to the specific aide in the form of non-taxed expense reimbursement upon submission of Greene County Travel & Mileage Reimbursement form.

Authorizing Agreement - Greene County Department Of

Human Services (Aging) And Hearthstone Care, LLC - Social

Adult Day Programs

BE IT RESOLVED, that the Chairman of the Greene County Legislature be authorized to execute an agreement, subject to approval as to form by the Greene County Attorney, between Greene County Department of Human Services (Aging) and Hearthstone Care, LLC 1187 Route 23A, Catskill, N. Y., for Social Adult Day Programs for the period of January 1, 2020 through December 31, 2021; and

BE IT FURTHER RESOLVED, that per the above mentioned contract, Greene County will pay compensation for the Social Adult Care services, including transportation, to Hearthstone Care, LLC in the amount of $70.00 per person per day. Transportation will be paid in the amount of $40 per day. Compensation shall be payable upon 30 e.o.m. (end of month) from date of invoice; and

BE IT FURTHER RESOLVED, that in the event a client is scheduled to attend Hearthstone Social Adult Daycare and notice of cancellation was not given by Greene County to Hearthstone Social Adult Daycare, the County will reimburse Hearthstone Care LLC $55 for the cost associated with the occurrence. Greene County will not be responsible for reimbursement for any costs associated with an occurrence change on the part of Hearthstone Care, LLC without notification to Greene County.

BE IT FURTHER RESOLVED, that meals for participants and staff will be provided on a once per day basis by Greene County Department of Human Services in accordance with County approved menu and regulations, as defined by the NYS Office for the Aging and NYS Department of Health. Meals provided shall be reimbursed by Hearthstone Care, LLC to Greene County at a rate of $5.00 per meal.

Consolidating Civil Service And Human Resources

Departments And Appointing Human Resources Director

WHEREAS, Michele Guerin retired as the Civil Service Administrator, effective September 27th, 2019 and she then returned on a per diem basis from September 30th, 2019 until July

3, 2020; and

WHEREAS, Nicole T. Maggio was appointed on an Interim basis to the position of Civil Service Administrator, effective July 6, 2020; and

WHEREAS, Karen MacIntosh-Frering, Human Resources Director, retired effective September 4th, 2020; and

WHEREAS, Nicole T. Maggio was appointed on an Interim basis to the position of Human Resources Director, effective at the close of business on Friday, September 4th, 2020; and

WHEREAS, with the retirement of these two Department Heads, who have historically worked closely together, the members of the Legislature have examined the functions of the Civil Service Department and the Human Resources Department and have determined that consolidation of both departments would stream-line the operations of both, resulting in a single more efficient and effective Department; and

WHEREAS, as a cost saving measure for the County, the decision has been made to combine the job duties of the Civil Service Administrator with that of the Human Resources Director;

NOW, THEREFORE, BE IT RESOLVED, that the Civil Service Department and the Human Resources Department be combined into one Department known as the Greene County ‘Human Resources Department’; and be it further

RESOLVED, that Nicole T. Maggio of Cairo, New York be and hereby is appointed as the Human Resources Director, effective September 17th, 2020 at an annual salary as set forth

in the 2020 budget, payable bi-weekly by the Greene County Treasurer.
