In contrast, procedural laws are the rules of courts and administrative agencies. They tell us how to proceed if there is a substantive-law problem. For example, if you drive fifty-three miles per hour in a forty mile-per-hour zone on Main Street on a Saturday night and get a ticket, you have broken a substantive rule of law (the posted speed limit). Just how and what gets decided in court is a matter of procedural law. Is the police officer’s word final, or do you get your say before a judge? If so, who goes first, you or the officer? Do you have the right to be represented by legal counsel? Does the hearing or trial have to take place within a certain time period? A week? A month? How long can the state take to bring its case? What kinds of evidence will be relevant? Radar? (Does it matter what kind of training the officer has had on the radar device? Whether the radar device had been tested adequately?) The officer’s personal observation? (What kind of training has he had, how is he qualified to judge the speed of a car, and other questions arise.) What if you unwisely bragged to a friend at a party recently that you went a hundred miles an hour on Main Street five years ago at half past three on a Tuesday morning? (If the prosecutor knows of this and the “friend” is willing to testify, is it relevant to the charge of fifty-three in a forty-mile-per-hour zone?)

Sub questions considering content, cues and experience help answer the main research question. Qualitative research was applied and a multi-case content analysis was carried out. Four marketeers were interviewed in the pre-analysis. A semi-structured interview was utilized for the data collection, involving 16 marketing experts working at marketing offices, large organizations and freelance marketing experts. Results were analyzed with the aid of a coding scheme (Burnard, 1991) and a second coder. Based on the data, the kind of content suited for marketing and sales webinars is found to be either rather complex, or simpler content made more substantive by the context. At the same time, it is necessary for controlling to be managed across the company’s departments and that it is not perceived to be only a fi nancial activity. Not achieving marketing and sales goals is an immediate threat to the stability of businesses and is associated with permanent monitoring, evaluation and identifi cation of future solu- tions arising out of marketing and sales plans. A failure of customer relations management is the fi rst step to losing long-term market positions in a hyper-competitive envi- ronment. Therefore, it is necessary to continuously moni- tor marketing goals and to search for alternative solutions in good time. If the sales goals fail, this usually results in an immediate decrease in sales, which has an immedi- ate impact on the economic results and cash fl ow. This is followed by an unhealthy structure of the balance sheet, which is usually a signal for creditors that their receiv- ables are threatened; fi nancing may be reduced or stopped completely. While marketing controlling is mainly based on qualitative ratios, sales controlling is more focused on quantitative indicators. In small- and medium-sized companies, marketing and sales activities are often inte- grated into one department, but it is necessary to evaluate and compare the objectives of both the sales process and tactical marketing. Marketing and sales controlling are among the basic elements of the business management process and are followed by the direct fi nancial, innova- tion or production activities of the company.
