ITB Clause

1.1 The Procuring Entity is OVERSEAS WORKERS WELFARE ADMINISTRATION (OWWA).

1.2 The lot(s) and reference is/are: PB-16-01

Bidding for One (1) Lot - Subscription of Internet Leased Line 50 Mbps Dedicated Internet Connection Services Installation.

2 The Funding Source is:

The Government of the Philippines (GOP) through the 2016 Corporate Budget for the contract approved by the Board of Trustees in the amount of One Million Four Hundred Forty Thousand Pesos (Php1,440,000.00).

The name of the Project is: Bidding for One (1) Lot - Subscription of Internet Leased Line 50 Mbps Dedicated Internet Connection Services Installation.

3.1 No further instructions.

5.1 No further instructions.

5.2 None of the circumstances mentioned in the ITB Clause exists in this Project.

Foreign bidders, except those falling under ITB Clause 5.2(b), may not participate in this Project.

5.4 The Bidder must have completed, within the period specified in the Invitation to Bid and ITB Clause 12.1(a)(iii), a single contract that is similar to this Project, equivalent to at least fifty percent (50%) of the ABC.

9.1 The Procuring Entity will hold a Pre-Bid Conference for this Project on 12 February 2016, 10:00 a.m. (PST) at the Conference Room, 10th Floor, OWWA Center, 7th Street cor. F.B. Harrison Street, Pasay City which shall be opened to all interested parties who purchased the Bidding Documents.

12.1(a)(iii) The statement of all ongoing and completed government and private contracts shall include all such contracts within the last five (5) years prior to the deadline for the submission and receipt of bids.

13.2 The ABC is One Million Four Hundred Forty Thousand Pesos (Php1,440,000.00). Any bid with a financial component exceeding this amount shall not be accepted.

15.4(a)(iii) The Bidder shall complete the appropriate Price Schedules included herein, stating the unit prices, total price per item, and the total amount. All amounts shall be rounded off to the nearest two decimal places.

16.1(b) The Bid prices for Goods supplied from outside of the Philippines shall be quoted in Philippine Pesos.

17.1 Bids will be valid until 120 calendar days from the date of bid opening.

18.1 The bid security shall be in the following amount:

1. The amount of Twenty Eight Thousand Eight Hundred Pesos (Php28,800.00), if bid security is in cash, cashier’s/manager’s check, bank draft/guarantee or irrevocable letter of credit;

2. The amount of Seventy Two Thousand Pesos (Php 72,000.00) if bid security is in Surety Bond;

3. Any combination of the foregoing proportionate to the share of form with respect to total amount of security; or

4. Bid-Securing Declaration – GPPB Circular No. 01-2014 dated 23 May 2014.

18.2 The bid security shall be valid until 120 calendar days from the date of bid opening.

20.1 Bidders shall enclose their original eligibility and technical documents in one sealed envelope marked “ORIGINAL – TECHNICAL COMPONENT”, and the original of their financial component in another sealed envelope marked

“ORIGINAL – FINANCIAL COMPONENT” sealing them all in an outer envelope marked “ORIGINAL BID”.

20.2 Each copy of the first and second envelopes shall be similarly sealed duly marking the inner envelope as “COPY NO. 1 – TECHNICAL COMPONENT” and “COPY NO. 1 FINANCIAL COMPONENT” and the outer envelope as “COPY NO. 1”, respectively. These envelopes containing the original and the copies shall then be enclosed in one single envelope.

20.3 Each Bidder shall submit one (1) original and one (1) copy of the first and second components of its bid, shall be typed or written in indelible ink and shall be signed by the bidder or its duly authorized representative/s. See Instructions to Bidder – Sealing and Marking of Bids Item C.20.

The date and time of bid opening is on 23 February 2016, 10:00 a.m. (PST) shall be done at the bid opening venue mentioned above.

The official time shall be the time indicated in the official timepiece located inside the bid opening venue.

26 To assist in the evaluation, comparison, and post-qualification of the bids, the Procuring Entity may ask in writing any Bidder for a clarification of its bid. All responses to request for clarification shall be in writing. Any clarification submitted by a Bidder in respect to its bid and that is not in response to a request by the Procuring Entity shall not be considered.

27.1 No further instructions.

28.3 The goods are grouped in a single lot and the lot shall not be divided into sub-lots for the purpose of bidding, evaluation, and contract award.

28.3(b) Bid modification must be allowed only in cases of computational errors or omissions. Arithmetical corrections shall be allowed up to two (2) decimal places to the nearest hundredths in all items including sub-total and grand total to enable proper comparison of all eligible bids.

28.6 In case of a tie, GPPB Circular No. 06-2005 shall be adopted using the Dicing

Method with the mechanics of which consists of the following:

1. Toss coin to determine the color assignment of the dice.

2. Both participants shall be given a die each depending on the result of number 1.

3. Participants will simultaneously throw the dice on the box.

4. The higher spots on the face of the dice shall decide the winner for that round.

The winner will be given one (1) point. In case of the draw, no point will be given for both participants.

5. The determination of the winner shall be based on a race to three point system.

29.2(a) Tax clearance per Executive Order 398, Series of 2005, as finally reviewed and approved by the BIR as per GPPB Resolution No. 11-2012 dated April 26, 2013.

29.2(b) Only tax returns filed and taxes paid through the BIR Electronic Filing and Payments System (EFPS) shall be accepted.

NOTE: The latest income and business tax returns are those within the last six months preceding the date of bid submission.

29.2(d) List licenses and permits relevant to the Project and the corresponding law requiring it.

32.4(g) List additional contract documents relevant to the Project that may be required by existing laws and/or the Procuring Entity.
