CHAPTER 2B THE PRE-SCHOOL CLASS

ARTICLE 1

Edu ca tion in the pre-school cla ss sha ll stim u la te ea ch individu a l child’s developm ent a nd lea rning . It sha ll la y the fou nda tions for fu tu re schooling . Specia l su pport sha ll be g iven to children needing it. (SFS 1997:1212).

ARTICLE 2

For children w ho a re resident in Sw eden, the m u nicipa lity w here the child is perm a nently residing sha ll be a lloca ted a pla ce in the pre-school cla ss a s of

the a u tu m n term in w hich the child rea ches the a g e of six a nd u ntil the child beg ins com pu lsory schooling . The pre-school cla ss, sha ll provide a t lea st 525 hou rs of edu ca tion per yea r.

Children m a y be a ccepted into the pre-school cla ss before the a u tu m n term in w hich the child rea ches the a g e of six.

The m u nicipa lity m a y conclu de a g reem ents w ith a nother pa rty to fu lfil the ta sk s concerning the pre-school cla ss. By m ea ns of su ch a g reem ents, a m u nicipa lity m a y su pply services on beha lf of a nother m u nicipa lity. Ta sk s covering the exercise of a u thority m a y not, how ever, be tra nsferred u nder this reg u la tion to a com pa ny, a n a ssocia tion, a society, a fou nda tion or a pa rticu la r individu a l. ARTICLE 3

Pla ces w ithin the pre-school cla ss sha ll be provided a s close to the child’s ow n hom e or school a s is possible w ith du e a ccou nt being ta k en of w ha t is needed to m a k e effective u se of prem ises a nd other resou rces. Rea sona ble a ccou nt sha ll a lso be ta k en of the w ishes of the pa rent or g u a rdia n.

The m u nicipa lity sha ll a ttem pt to ensu re tha t children u se the pla ces a lloca ted a nd inform pa rents a bou t the a ctivities a nd a im s of these. (SFS 1997:1212).

ARTICLE 4

If a child is being ca red for in a h ospita l or a nother institu tion, the org a niser m u st ensu re tha t the child h a s the opportu nity to ta k e pa rt in a ctivities equ iva lent to those provided by the pre-school cla ss. (SFS 1997:1212).

ARTICLE 5

Edu ca tion in the pre-school cla ss sha ll be free of cha rg e. For tha t pa rt of the a ctivity exceeding 15 hou rs per w eek or 525 hou rs per yea r, the m u nicipa l- ity m a y, how ever, cha rg e rea sona ble fees in a ccorda nce w ith the principles determ ined by the m u nicipa lity. Rea sona ble fees m a y be cha rg ed for child- ren a dm itted u nder Article 2, second pa ra g ra ph. Fees , how ever, m a y not exceed the costs incu rred by the m u nicipa lity. (SFS 1997:1212).

ARTICLE 6

A com pa ny, a n a ssocia tion, a society, a fou nda tion or a n individu a l person w ishing to ru n a ctivities corresponding to the pre-school cla ss a re requ ired to ha ve a perm it issu ed by the m u nicipa lity in w hich the a ctivity sha ll be ru n. Su ch a perm it is issu ed u ntil fu rther notice or for a specific period.

A perm it is not needed for su ch a ctivities w hich the m u nicipa lity throu g h a g reem ents u nder Article 2, third pa ra g ra ph ha s ha nded over to a n individu a l to ca rry ou t. (SFS 1997:1212).

ARTICLE 7

A perm it to provide su ch a ctivities referred to in Article 6 m a y only be g ra nted if the a ctivity fu lfils the requ irem ents for g ood qu a lity a nd sa fety. A perm it m a y be issu ed su bject to conditions concerning qu a lity a nd sa fety of the a ctivity.

If the a ctivity either a s a w hole or a su bsta ntia l pa rt thereof is cha ng ed or m oved, a new perm it is requ ired. (SFS 1997:1212).

ARTICLE 8

Activities referred to in Article 6 a re su bject to the inspection of the m u nicipa lity w here the a ctivity is being ru n. The m u nicipa lity is entitled to inspect the a ctivity a nd obta in inform a tion a nd docu m ents needed to ca rry ou t the inspection. (SFS 1997:1212).

ARTICLE 9

If som ething u nsa tisfa ctory occu rs in su ch a ctivities referred to u nder Article 6, the m u nicipa lity sha ll requ ire the pa rty responsible for the a ctivity to rem edy this.

If the u nsa tisfa ctory sta te of a ffa irs is seriou s a nd the instru ctions of the m u nicipa lity a re not follow ed, the m u nicipa lity m a y w ithdra w the perm it. (SFS 1997:1212).

ARTICLE 10

The m u nicipa lity is em pow ered to provide fu nds for a ctivities referred to u nder Article 6, providing the fees a re not u nrea sona bly high. Su ch fu nds shou ld be provided w ith a n a m ou nt per child th a t does not devia te u nrea - sona bly from the cost per child incu rred by the m u nicipa lity in corresponding a ctivities. (SFS 1997:1212).

ARTICLE 11

The pa rty w ho is or ha s been a ctive professiona lly ru nning a ctivities corresponding to the pre-school cla ss, m a y not w ithou t a u thorisa tion revea l a ny inform a tion tha t he or she ha s becom e a w a re of concerning the individu a l’s persona l circu m sta nces. (SFS 1997:1212).

ARTICLE 12

A decision m a de by a m u nicipa lity concerning a perm it u nder Article 6 a nd on a n oblig a tion or the w ithdra w a l of a perm it m a y u nder Article 9 be a ppea led to a g enera l a dm inistra tive cou rt.

The decision of the m u nicipa lity on a n oblig a tion or the w ithdra w a l of a perm it u nder Article 9 a nd the decision ta k en by the cou rt sha ll h a ve im m edia te effect.

Lea ve to a ppea l is requ ired in order to a ppea l to the Adm inistra tive Cou rt of Appea l. (SFS 1997:1212).

ARTICLE 13

A fine m a y be im posed on the pa rty w ho w ithou t a perm it ru ns a ctivities referred to u nder Article 6.

Pu blic prosecu tion proceeding s m a y only be initia ted a fter consent ha s been received from the m u nicipa lity in w hich the a ctivity ha s been opera ted or from The Na tiona l Ag ency for Edu ca tion. (SFS 1997:1212).
