TheTexasStateBoardofExaminersofPsychologistsproposes amendmentsto§465.1,Definitions.Theproposedamendments willdefine"supervision"asthattermisusedinBoardrules,and providegreaterclarityandguidancetolicensees.Theproposed amendmentalsoincludesthedefinitionof"childcustodyevalu- ation"and"adoptionevaluation"asthosetermsaredefinedby Tex. H.B.1449,84thLeg.,R.S.(2015).

DarrelD.Spinks,ExecutiveDirector,hasdeterminedthatforthe firstfive-yearperiodtheproposedamendmentwillbeineffect, therewillbenofiscalimplicationsforstateorlocalgovernments asaresultofenforcingoradministeringtherule.

Mr. Spinks hasalsodeterminedthat foreachyearofthefirst fiveyearstheruleisineffect,thepublicbenefitanticipatedasa resultofenforcingtherulewillbetohelptheBoardprotectthe public. Therewillbenoeconomiccoststopersonsrequiredto complywiththisrule. Therewillbenoadverseeffectonsmall businessesorlocaleconomies.

Theamendment isproposed underTexas OccupationsCode, Title3,SubtitleI,Chapter501,whichprovidestheTexasState BoardofExaminersofPsychologistswiththeauthoritytomake allrules,notinconsistentwiththeConstitutionandLawsofthis State, which are reasonably necessary for theproper perfor- manceofitsdutiesandregulationsofproceedingsbeforeit. Noothercode,articlesorstatutesareaffectedbythissection.

§465.1. Definitions.

Thefollowingtermshavethefollowingmeanings: (1) "Client"hasthesamemeaningas"patient."

(2) "DualRelationship"meansasituationwherealicensee andanotherindividualhavebothaprofessionalrelationshipandanon- professionalrelationship. Dualrelationshipsinclude,butarenotlim- itedto,personalfriendships,businessorfinancialinteractions,mutual cluborsocialgroupactivities,familyormaritalties,orsexualrelation- ships.

(3) "Forensicpsychology"istheprovisionofpsycholog- icalservicesinvolvingcourts,legalclaims,orthelegalsystem. The provisionofforensicpsychologicalservicesincludesanyandallpre- liminaryand exploratoryservices,testing,assessments, evaluations, interviews, examinations, depositions, oral or written reports, live or recorded testimony,or any psychologicalservice provided by a licenseeconcerningacurrentorpotentiallegalcaseattherequestof apartyorpotentialparty,anattorneyforaparty, oracourt,orany otherindividualorentity,regardlessofwhetherthelicenseeultimately providesareportortestimonythatisutilizedinalegalproceeding.A

personwhoisthesubjectofforensicevaluationisnotconsideredto

beapatientundertheserules. "Forensicevaluation"isanevaluation conducted,notforthepurposeofprovidingmentalhealthtreatment, butratherattherequestofacourt,anattorney,oranadministrative body including federal and private disability benefits providers to assistinaddressingaforensicreferralquestion.Additionally,forensic services would include fitness for duty evaluations, psychological evaluations conductedafteranemploymentofferhas beenmade in highriskprofessions,andriskassessmentevaluationsofemployees asaresultoftheiraggressiveorthreateningbehavior.

(4) "Informed Consent" means the written documented consent of the patient, clientand otherrecipients of psychological services only after the patient, client or other recipient has been madeawareofthepurposeandnatureoftheservicestobeprovided, includingbut notlimited to: the specificgoals ofthe services; the procedurestobeutilizedtodelivertheservices;possiblesideeffects of the services, if applicable; alternate choices to the services, if applicable; the possibledurationof theservices; theconfidentiality ofandrelevantlimitsthereto;allfinancialpolicies,includingthecost andmethodsofpayment;andanyprovisionsforcancellationofand paymentsformissedappointments;andrightofaccessofthepatient, clientorotherrecipienttotherecordsoftheservices.

(5) "Licensee"means alicensedpsychologist, provision- allylicensedpsychologist,licensedpsychologicalassociate,licensed specialistinschoolpsychology,applicantstotheBoard,andanyother individualwhomtheBoardhastheauthoritytodisciplineunderthese Rules.

(6) "Multiple Relationship" means any relationship be- tween a licensee and another individual involving a professional relationshipanda[morethanone]non-professionalrelationship.

(7) "Patient"meansapersonwhoconsultsorisinterviewed byalicenseeforadiagnosis,evaluation,ortreatmentofanymentalor emotionalconditionordisorderofthatpersonregardlessofwhether thepatientorsomeotherindividualorentitypaidfortheconsultation orinterviewexceptasidentifiedinparagraph(3)ofthissection,where thesubjectofforensicevaluationisnotconsideredtobeapatient.

(8) "Professionalrelationship"isanyrelationshipbetween alicenseeandanotherindividual,groupororganizationinwhichthe licenseedeliverspsychologicalservicestotheindividual,group,oror- ganization.

(9) "Professionalstandards"aredeterminedbytheBoard throughitsrules,regulations,policiesandanyothersourcesadopted bytheBoard.

(10) "Provisionofpsychologicalservices"meansanyuse byalicenseeofhisorhereducationortraininginpsychologyinthe contextofaprofessionalrelationship.Psychologicalservicesinclude, butarenotlimitedto,therapy,diagnosis,testing,assessments,evalua- tion,treatment,counseling,supervision,consultation,providingforen- sicopinions,renderingaprofessionalopinion,performingresearch,or teachingtoanindividual,group,ororganization.

(11) "Recognized member of the clergy," as used in §501.004(a)(4)[Section501.004(a)(4)]oftheAct,meansamember ingoodstandingofandaccountabletoadenomination,church,sector religiousorganizationlegallyrecognizedundertheInternalRevenue Code,§501(c)(3)[Section501(c)(3)].

(12) "Records"areanyinformation,regardlessofthefor- matinwhichitismaintained,thatcanbeusedtodocumentthedelivery, progressorresultsofanypsychologicalservicesincluding,butnotlim- itedto,dataidentifyingarecipientofservices,datesofservices,types ofservices,informedconsents,feesandfeeschedules,assessments,

treatmentplans,consultations,sessionnotes,testresults, reports,re- leaseformsobtainedfromaclientorpatientoranyotherindividual orentity,andrecordsconcerningapatientorclientobtainedbytheli- censeefromothersources.

(13) "Report"includesanywrittenororalassessment,rec- ommendation,psychologicaldiagnosticorevaluativestatementcon- tainingtheprofessionaljudgmentoropinionofalicensee.

(14) "Testdata"refersto testingmaterials,testbooklets, testforms,testprotocolsandanswersheetsusedinpsychologicaltest- ingtogeneratetestresultsandtestreports.

(15) "Supervision"referstodirect,systematicprofessional oversightofindividualswhoprovidepsychologicalservicesunderthe authorityofasupervisinglicensee,wherebythesupervisorhasthere- sponsibilityandabilitytomonitorandcontrolthepsychologicalser- vicesprovidedtoensurethepatient'sorclient'sbestinterestsaremet andthatthepublicisprotected.Inthecontextofpsychologicaltraining andeducation,"supervision"alsoreferstotheformalprovisionofsys- tematiceducationandtrainingforpurposesoflicensureorcompetency thatservestoassistindividualswithgainingexperienceanddeveloping theskillsnecessaryforlicensureorcompetentpracticeinaparticular practicearea. However,theterm"supervision"doesnotapplytothe supervisionofpurelyadministrativeoremploymentmatters.

(16) "Childcustodyevaluation"hasthesamemeaningas assignedbyTex. Fam.CodeAnn.§107.101.

(17) "Adoptionevaluation"hasthesamemeaningasas- signedbyTex. Fam.CodeAnn.§107.151.

Theproposednewrulealsoservestoprovidegreaterprotection tothepublicbyestablishingclarityandguidanceinareassuch asdocumentationofsupervision,amountsofdirectsupervision, andthepermissiblenumberofsupervisees.

§465.2. Supervision.

(a) SupervisioninGeneral. Thefollowingrulesapplytoall supervisoryrelationships.

(1) Alicenseeisresponsibleforthesupervisionofallindi- vidualsthatthelicenseeemploysorutilizestoprovidepsychological servicesofanykind.

(2) Licenseesensurethattheirsuperviseeshavelegalau- thoritytoprovidepsychologicalservices.

(3) Licenseesdelegateonlythoseresponsibilitiesthatsu- perviseesmaylegallyandcompetentlyperform.

(4) Allindividualswhoreceivepsychologicalservicesre- quiringinformedconsentfromanindividualundersupervisionmust beinformedinwritingofthesupervisorystatusoftheindividualand howthepatientorclientmaycontactthesupervisinglicenseedirectly. (5) All materials relating to the practiceof psychology, uponwhichthesupervisee'snameorsignatureappears,mustindicate thesupervisorystatusofthesupervisee. Supervisorystatusmustbe indicatedbyoneofthefollowing:

(A) Supervisedby(nameofsupervisinglicensee); (B) Underthesupervisionof(nameofsupervisingli- censee);

(C) Thefollowingpersonsareunderthesupervisionof (nameofsupervisinglicensee);or

(D) Superviseeof(nameofsupervisinglicensee). (6) Licenseesprovideanadequatelevelofsupervisionto allindividualsundertheirsupervisionaccordingtoacceptedprofes- sionalstandardsgiventheexperience,skillandtrainingofthesuper- visee,theavailabilityofotherqualifiedlicenseesforconsultation,and thetypeofpsychologicalservicesbeingprovided.

(7) Licenseesutilizemethodsofsupervisionthatenablethe licenseetomonitoralldelegatedservicesforlegal,competent,andeth- icalperformance.Methodsofsupervisionmayincluderemoteorelec- tronicmeansif:

(A) adequatesupervisioncanbeprovidedthroughre- moteorelectronicmeans;

(B) thedifficultiesinprovidingfull-timein-personsu- pervisionplaceanunreasonableburdenonthedeliveryofpsychologi- calservices;and

(C) nomorethanfiftypercentofthesupervisiontakes placethroughremoteorelectronicmeans.

(8) Licenseesmustbecompetenttoperformanypsycho- logicalservicesbeingprovidedundertheirsupervision.

(9) Licenseesshalldocumenttheirsupervisionactivitiesin writing,includinganyremoteorelectronicsupervisionprovided.Doc- umentationshallincludethedates,times,andlengthofsupervision.

(10) Licenseesmayonlysupervisethenumberofsuper- viseesforwhichtheycanprovideadequatesupervision.

(b) SupervisionofStudents,Interns,Residents,Fellows,and Trainees. Thefollowingrulesapplytoall supervisoryrelationships involvingstudents,interns,residents,fellows,andtrainees.

(1) Unlicensed individuals providing psychological ser- vices pursuant to §§501.004(a)(2), 501.252(b)(2), or 501.260(b)(3) ofthe Actmust beunderthesupervision ofaqualifiedsupervising licenseeatalltimes.

(2) Supervisionmustbeprovidedbyaqualifiedsupervis- inglicenseebeforeitwillbeacceptedforlicensurepurposes.

(3) Alicenseepracticingunderarestrictedstatuslicenseis notqualifiedto,andshallnotprovidesupervisionforapersonseek- ingtofulfillinternshiporpracticumrequirements,orapersonseeking licensureunderthePsychologists'LicensingAct,regardlessoftheset- tinginwhichthesupervisiontakesplace,unlessauthorizedtodosoby theBoard. AlicenseeshallinformallsuperviseesofanyBoardorder restrictingtheirlicenseandassistthesuperviseeswithfindingappro- priatealternatesupervision.

(4) A supervisor must document in writing their super- visee's performance during a practicum, internship, or period of supervisedexperience required forlicensure. The supervisor must providethisdocumentationtothesupervisee.

(5) Anindividualsubjecttothissubsectionmay,aspartof arequiredpracticum,internship,orperiodofsupervisedexperience requiredforlicensurewiththisBoard,superviseothersinthedelivery ofpsychologicalservices.

(6) Forprovisionaltrainees,asupervisormustprovideat leastonehourofindividualsupervisionperweekandmayreducethe amountofweeklysupervisiononaproportionalbasisforprovisional traineesworkinglessthanfull-time.

(7) Licenseesmay not superviseanindividualto whom theyarerelatedwithintheseconddegreeofaffinityorconsanguinity.

(c) SupervisionofProvisionallyLicensedPsychologistsand LicensedPsychologicalAssociates. Thefollowingrulesapplytoall supervisoryrelationshipsinvolvingProvisionallyLicensedPsycholo- gistsandLicensedPsychologicalAssociates.

(1) Provisionally Licensed Psychologists and Licensed PsychologicalAssociatesmustbeunderthesupervisionofaLicensed Psychologistandmaynotengageinindependentpractice.

(2) AProvisionallyLicensedPsychologistwhoislicensed inanotherstatetoindependentlypracticepsychologyandisingood standinginthatstate,andwhohasappliedforlicensureasapsychol- ogistmayduringthetimethattheBoardisprocessingtheapplicant's applicationforlicensureasapsychologist,practicepsychologywithout supervision.However,uponnotificationfromtheBoardthatanappli- canthasnotmetthequalificationsforlicensureasapsychologist,the provisionallylicensedpsychologistsmustobtainsupervisionwithin30 daysinordertocontinuetopractice.

(3) Aprovisionallylicensedpsychologistmay,aspartof aperiodofsupervisedexperiencerequiredforfulllicensurewiththis Board,superviseothersinthedeliveryofpsychologicalservices.

(4) Asupervisormustprovideatleastonehourof indi- vidualsupervisionperweek. Asupervisormayreducetheamountof weeklysupervisiononaproportionalbasisforsuperviseesworkingless thanfull-time.

(d) SupervisionofLicensedSpecialistsinSchoolPsychology internsandtrainees.Thefollowingrulesapplytoallsupervisoryrela- tionshipsinvolvingLicensedSpecialistsinSchoolPsychology,aswell

asallinternsandtraineesworkingtowardlicensureasaspecialistin schoolpsychology.

(1) AsupervisormustprovideanLSSPtraineewithatleast onehourofsupervisionperweek,withnomorethanhalfbeinggroup supervision. Asupervisormayreducetheamountofweeklysupervi- siononaproportionalbasisfortraineesworkinglessthanfull-time.

(2) Supervisionwithinthepublicschoolsmayonlybepro- videdbyaLicensedSpecialistinSchoolPsychology,whohasamin- imumofthreeyears ofexperienceprovidingpsychologicalservices withinthepublicschoolsystemwithoutsupervision. Toqualify,ali- censeemustbeabletoshowproofoftheirlicense,credential,orau- thoritytoprovideunsupervisedschoolpsychologicalservicesin the jurisdictionwherethoseserviceswereprovided,alongwithdocumen- tationfromthepublicschool(s)evidencingdeliveryofthoseservices. (3) Supervisorsmustsignalleducationaldocumentscom- pletedforstudentsby thesupervisee,includingstudentprogressre- ports,studentevaluationreports,orsimilarprofessionalreportstocon- sumers,otherprofessionals,orotheraudiences.Itisnotaviolationof thisruleifsupervisorsdonotsigndocumentscompletedbyacommit-
