8.1 Conditions concerning the GTF, Entry, Storage and Exit Points

Upon delivery or redelivery of Natural Gas to and from the GTF, Entry, Storage and Exit Points, an hourly quantity of Natural Gas corresponding to the Accepted Nomination shall be consid- ered as having been supplied in the same Hour.

8.2 Conditions concerning the BNG Entry Point

8.2.1 Energinet.dk’s obligation to receive at the BNG Entry Point

Each Hour at the BNG Entry Point, Energinet.dk shall receive the Shipper’s quantity of BNG al- located at the BNG Portfolio for the Hour in question.

If, in any Hour, the Shipper delivers quantities of BNG larger than specified for the Hour in question in the Accepted Nomination to the BNG Entry Point, Energinet.dk shall, to the extent possible, seek to receive such additional quantities provided it can be done without causing operational problems in the Danish Gas System. However, the delivery cannot exceed the Maximum Hourly Quantity at the BNG Entry Point, calculated for all of the Shipper’s Capacity Agreements as a whole.

If a Shipper's total hourly delivery at the BNG Entry Point deviates more than permitted ac- cording to clauses 6.4, 6.5 and 8.2.2 for 2 Gas Days or more in the preceding 30 Gas Days, Energinet.dk has the right to order the Shipper to stop or reduce its delivery at the BNG Entry Point.

If, in accordance with the foregoing, Energinet.dk is unable to receive the BNG quantities spec- ified in the Accepted Nomination at the BNG Entry Point, imbalances may occur between the Shipper’s daily deliveries. In such case Energinet.dk shall settle any positive or negative imbal- ances of BNG at the Neutral Gas Price.

8.2.2 Shipper's delivery at the BNG Entry Point

The Shipper shall each Hour at the BNG Entry Point deliver the BNG quantities specified for the Hour concerned in the Accepted Nomination.

The Shipper's total Gas Day delivery to the BNG Entry Point cannot deviate by more than plus/minus 20 per cent from the quantity of BNG stipulated for all Hours of the Gas Day in all of the Shipper's Accepted Nominations at the BNG Entry Point.

The Shipper's total hourly delivery to the BNG Entry Point cannot exceed the Maximum Hourly Quantity at the BNG Entry Point for all of the Shipper's Capacity Agreements collectively.

8.3 Conditions concerning the Exit Zone

8.3.1 Energinet.dk’s redelivery obligation in the Exit Zone

Each Hour in each Allocation Area or at each Direct Site, Energinet.dk shall redeliver to the Shipper the Natural Gas quantity stipulated for the Hour in question in the Accepted Nomina- tion applicable to the Allocation Area or Direct Site in question.

If, in any Hour, the Shipper offtakes Natural Gas quantities larger than the ones specified for the Hour in question in the Accepted Nomination in the Allocation Area or at the Direct Site, Energinet.dk shall, to the extent possible, seek to redeliver such additional quantities provided it can be done without causing operational problems in the Transmission System. However, the redelivery cannot exceed the Maximum Hourly Quantity in the Exit Zone, calculated for all of the Shipper’s Capacity Agreements as a whole.

If a Shipper's total hourly offtake in the Exit Zone deviates more than permitted according to clauses 6.4, 6.5 and 8.3.2 for 2 Gas Days or more during the preceding 30 Gas Days, Ener- ginet.dk is entitled to suspend either in full or in part the redelivery of the Shipper’s Natural Gas quantities or to order the Shipper to stop or reduce its offtake in all or part of the Exit Zone.

Energinet.dk is not obliged to redeliver Natural Gas quantities if such quantities in the Hour ex- ceed the physical Capacity announced by Energinet.dk for the individual Transition Point, see Energinet.dk’s website.

If, in accordance with the foregoing, Energinet.dk is unable to redeliver the Natural Gas quan- tities specified in the Accepted Nomination in the Allocation Area or at the Direct Site, as the case may be, imbalances may occur between the Shipper’s daily deliveries. In such case Ener- ginet.dk shall settle any positive or negative imbalances of Natural Gas at the Neutral Gas Price.

8.3.2 Shipper’s offtake in the Exit Zone

Every Hour in each Allocation Area or at each Direct Site, as the case may be, the Shipper must take the Natural Gas quantities specified for the relevant Hour in the Accepted Nomina- tion in the Allocation Area or at the Direct Site, as the case may be.

The Shipper's total Gas Day offtake in the Exit Zone cannot deviate by more than plus/minus 20 per cent from the Natural Gas quantity stipulated for all Hours of the Gas Day in all of the Shipper's Accepted Nominations in the Exit Zone.

A Shipper's total hourly offtake in an Allocation Area or at a Direct Site cannot exceed the Max- imum Hourly Quantity in the Exit Zone for the Shipper's Capacity Agreements collectively.

Fees related to the Exit Zone follow according to clause 17.2 a) i) and b).

8.4 Liability, risk and right of disposal

At the Entry Points the liability and risk for the Natural Gas and the right of disposal to the Natural Gas shall pass from the Shipper to Energinet.dk. The foregoing shall not affect the Shipper’s liability according to clause 11.3 e).

At the Storage Points the liability and risk for the Natural Gas and the right of disposal to the Natural Gas shall pass from Energinet.dk to DONG Storage or Energinet.dk Gas Storage and vice versa at the individual Storage Points.

In the Allocation Areas, at the Direct Sites or the Exit Point the liability and risk for the Natural Gas and the right of disposal to such Natural Gas shall pass from Energinet.dk to the Shipper. The foregoing shall not affect Energinet.dk’s liability according to clauses 11.4 d) and 11.5 b).
