Interview questions

I would like to talk with you about the amendment on the Law on Intelligence and Security Services and about the intelligence services in the Netherlands. First, I would like to ask you if you believe that the services, the AIVD and MIVD, need more competences?

By giving the intelligence services more powers, it looks like security has become more important than privacy. Do you share this perspective?

The minister and an authorized person, which can be the director of the AIVD, are the supervisors. Do you believe that these officials are the right persons to fulfil this position?

Do you think that supervision should be organized externally?

In the literature is spoken about separating identity and behaviour. So, only identity or behaviour are examined, but to respect privacy not both. Would something like this work within the AIVD and MIVD? Is tapping of phones and Internet a power which is often used by the services?

Do you believe that the services want more powers in the future, in order to get access to every information they would like to have?

So, we do not have to be afraid that in the future security will be the most important and privacy will be forgotten?

A clear definition on privacy is missing in the literature, what is privacy for you? Is security more important than privacy nowadays?

The Internet is growing, do you think that the government should gather information in another way? For example, giving the civilians notice about what is going on?

What is your opinion about the ‘nothing to hide’ argument ?

The literature gives an example for gathering information without harming privacy too much. The idea is that identity and behaviour should be separated. What is identity? And is this idea workable? How do you see the future of the balance?

1.3. Amnesty International

A clear definition on privacy is missing in the literature, what is privacy for you?

Will security become more important than privacy if the new Wiv will be implemented?

We expect from the government that they will protect us from terrorist attacks. So shouldn’t we just accept that we have less privacy because we live in this time period?

So, Amnesty does not agree with the fact that if the services can gather all data they would be able to prevent attacks?

The literature gives an example for gathering information without harming privacy too much. The idea is that identity and behaviour should be separated, is this idea acceptable?

The minister should approve the requests for special powers, is the minister the right person to do this?

Would an independent ex ante supervisor not slow down the information process?

What is your idea on how the balance between privacy and security will develop in the future? 1.4. Privacy First

What is the main goal of the Wiv for the MIVD?

To what extend was it necessary that the services received more powers?

What is your opinion about the criticism on the Wiv that it would violate the right of privacy?

A lot of data can be gathered, how will relevant information be separated from irrelevant information? There is also critique on the fact that the minister is the one who approves the requests for special powers, what is your opinion about this?

Do you see a shift towards security?

Do you know/think that adjustments will be made on the Wiv?

Do you think that after an evaluation in a couple of years, changes are again necessary? 1.6. AIVD

What is the main purpose of the Wiv?

To what extend was it necessary to receive more powers?

There is a lot of criticism on the amendment, especially on the privacy aspect, what is your opinion about this criticism?

Someone I interviewed questioned whether the collected data will be deleted after a while and if the data will not be used for other purposes. Can you comment on this?

Why is interception of civilians necessary?
