El vendedor y la firma rematadora se eximen de toda responsabi- lidad sobre la autenticidad de las obras, firmas, escuelas, títulos, fechas, etc. aunque fueran establecidas en el catálogo, en las propias obras, sean mencionadas en el momento del remate o en su publicidad previa o en los certificados técnicos que se hayan expedido, no aceptando reclamo alguno una vez bajado el mar- tillo y adjudicado el lote al comprador.
Únicamente en caso de que, en forma expresa, en el momento del remate se advierta que el vendedor garantiza la autentici- dad u otra cualidad específica o la inexistencia de vicios ocultos, responderá el vendedor frente al comprador, de acuerdo con las reglas del derecho común.
No obstante, aunque el vendedor no haya garantizado expresamen- te la autenticidad de la obra o la inexistencia de vicios ocultos, responderá frente al comprador si se comprobare que previa- mente al remate le constaban la falta de autenticidad o los vicios. En ningún caso responderá la firma rematadora quien no deberá pagar indemnización alguna ni devolver la comisión percibido, no siendo parte en el negocio celebrado con su intervención, obligándose exclusivamente a comunicar al comprador el nom- bre del vendedor si aquel lo exigiere judicialmente.
El remate se realiza al contado. Seña 30% en el acto. Comisión e impuestos 16,90%. Deberá pagarse en la moneda que se realizó el remate al contado o por orden bancaria de pago irrevocable a favor de Castells & Castells. Los compradores dispondrán de un plazo de tres días desde la fecha del remate para efectuar el pago, vencido el cual la compra generará un interés cuya taza se fijará el día del remate. Transcurrido ocho días a partir del día del remate, sin que el comprador haya pagado el precio, se conside- rará que desistió de la compra, perdiendo la cantidad depositada en concepto de seña o arras.

All the items to be sold at auction have been displayed and listed in advance, so as to allow prospective buyers and other interested parties to view them, check their condition, study their history and any pertinent documentation, and examine them for damage or other defects.
Neither the seller nor the auctioneers bear any responsibility for the authenticity of specific works, signatures, dates, titles, attribution to schools, etc. mentioned in advertising or during the auction, or appearing in the catalogue, on the works, or on previously issued certificates of authenticity. Once the auc- tioneer’s hammer has descended and a lot is assigned to the buyer, no claims will be possible.
Only if it is explicitly stated at the time of the auction that the seller guarantees the authenticity or some other feature of a given item, or declares it free of hidden defects, will the seller be accountable to the buyer, as provided by law.
However, even if the seller has not explicitly guaranteed the authenticity of a given item or its freedom from hidden defects, s/he will be liable should it be proven that s/he was aware of the lack of authenticity or defects in question prior to the auction. Under no circumstances can the auction house be held liable, or required to pay damages or forego its commissions, since it is not a direct party to the transactions but an intermediary, whose sole obligation will be to inform the buyer of the seller’s identity, should the buyer seek that information through the courts. Payment is due at the time of sale and in the currency in which the sale was made (U.S. dollars or Uruguayan pesos), in the form of cash or a check made payable to Castells & Castells. Commission and taxes: 16.90% (to be added to the purchase price). Deposit: 30%, due immediately after the auction. The buyer will then have three business days to complete payment, after which time interest will accrue at a rate set on the day of the auction. If the buyer has not paid in full by a week after the date of the auction, we will assume that s/he no longer plans to purchase the item in question and s/he will forfeit his/her deposit.
