Central City Mixed use in the notified proposal forming part of Stage 3. However, the height limits of the Cultural 1 zone have not been reflected in the notified proposal. Amendments are therefore sought to address this issue as currently there is no height limit specified for the two sites.
The height limits proposed for the'Arts centre' site and 'Roman Catholic Cathedral' siteare proposed to ensure existing
building scale is not exceeded, to reflect the amenity of the environment and to achieve a compatible building scale with the context of those sites.
Add the following text (in italics with underlining) to rule 13.3.2.3.2. Maximum Building Height for the Central City Mixed use zone a. The maximum height of all buildings shall be in accordance with the Central City Maximum Building Height Planning map.
b. The maximum height of all buildings on the site of the Roman Catholic Cathedral and Cathedral House, being land at 122 - 140 Barbadoes Street shall be 14 metres.
Any application arising from non-compliance with this rule will not require written approvals and shall not be limited or publicly notified.
Rule 13.3.2.3.2 102. 13.16 - Central City Hazardous Substances and Contaminated Land
Policy 13.16.1.1.1.3 √ The phrase "in relation to their location" should be deleted as it is inconsistent with Stage 2 Proposal 12 Hazardous Substances and Contaminated Land. The Crown's submission to Stage 2 Proposal 12 Hazardous Substances and Contaminated Land seeking to amend hazardous
substances provisions to manage only the location of hazardous facilities is being rejected. The Council can show evidence that there is a clear RMA reason for every standard in its amended package to be forwarded with the Stage 2 evidence.
Amend Policy 13.16.1.1.1.3 Identification and assessment of individual and cumulative effects of hazardous facilities, as follows:
a. The identification and assessment of the individual and cumulative effects of hazardous substances in relation to their location shall ensure that residual risks to people, property and the natural environment are minimised.
103. 13.16 - Central City Hazardous Substances and Contaminated Land
Policy 13.16.2.1.1.1 √ The phrase "best practicable option" should be deleted and replaced with "best practice approach" to be consistent with Stage 2 Proposal 12 Hazardous Substances and Contaminated Land. The submission of Gelita NZ to Stage 1 Proposal 12 Hazardous Substances and Contaminated Land seeking to amend the contaminated land provision by replacing "best practice approach" with "best practicable option" is being rejected. Stages 1 and 2 evidence will provide clarification that "best practice approach" is generally understood to mean compliance with a particular guideline or document that is generally understood to be "best
practice". In relation to the purpose of the policy and method of regulating
contaminated land under the NES, "best practice" is more appropriate.
Amend 13.16.2.1.1.1 Policy - Best Practicable Option, as follows: 13.16.2.1.1.1 Policy - Best Practicable Option Practice Approach a. Require any proposal to subdivide, use or develop contaminated or potentially contaminated land to apply a best practice approach to investigate the risks, and either remediate the contamination or manage activities on contaminated land to protect people and the environment.
Note:
The status of some activities will be determined by the requirements of the Resource Management (National Environmental Standards for Assessing and Managing Contaminants in Soil to Protect Human Health) Regulations 2011. Reference should be made to the Ministry for the Environment website for a copy of these regulations, a user's guide, and documents incorporated by reference in these regulations.

The Ministry for the Environment's Hazardous Activities and Industries List (HAIL), the list of properties on Canterbury Regional Council's Listed Land Use Register (LLUR), Council records, and site investigations shall provide the basis for identifying contaminated land or whether it is potentially contaminated. It is the duty of the person undertaking any activity to ascertain whether the land is contaminated, irrespective of whether the land is identified as having a current or past use that is identified in the HAIL. Use of the Ministry for the Environment's Contaminated Land Management Guidelines will form part of the approach to achieving best practicable option practice.
106. 17 - Rural Planning Map 25 The proposed planning map 25 relating to
Cranford Basin incorrectly shows the extent of the area which should be Residential Suburban zoning on Philpotts Road. Under the Operative City Plan a much wider area is shown as Living 1 Deferred. The intention is for the existing Living zoning to be carried through as Residential Suburban. However, a much smaller area is shown, with the remainder Rural Urban Fringe.
Amend Planning Map 25 so that the extent of the proposed Residential Suburban zoning is shown as the same area as that of the existing Living 1 Deferred zoning.
