5. OPERATOR POINT CALCULATION

Operator Point Calculation uses the driving incident records of operators in the household for inclusion in the calculation of Average Operator Factor.

A. Definitions

1. Experience Period

The experience period shall be the three years prior to the effective date of the policy for both new and renewal policies.

2. Convictions

Points are calculated for convictions occurring during the experience period for motor vehicle violations of the applicant or any other currently resident operator.

Convictions include those categorized in the Operator Point Calculation Table.

a. Over the threshold

Points are accumulated for each accident that occurred during the experience period – for which the company paid a claim - involving the applicant or any current resident operator, while operating an auto.

Accumulate points for each accident that results in:

(1.) Bodily Injury or Death

(2.) Total Damage to any property including his or her own, net payment in excess of $1,000.

4. Not At Fault Accidents

a. Accidents incurred by an operator demonstrated to be a named insured or a principal operator of an auto insured under a separate policy; and

b. No points are assigned for accidents occurring under the following circumstances:

1. Auto lawfully parked (if the parked vehicle rolls from the parked position then any such accident is charged to the person who parked the auto); or

2. The applicant, owner or other resident operator involved in an accident (a) reimbursed for 50% or more of his or her damages by, or on behalf of, the other driver or drivers involved in the accident, or (b) has received a judgement in a court of law against the owner or operator involved in the accident for 50% or more of the loss incurred.

In addition, no Uninsured Motorists coverage claim made against any insurer by any insured covered by the policy shall be considered for the purpose of assigning driving record points.

3. There has been a determination by a law enforcement agency that the damage inflicted on the owned or operated vehicle was done by an individual operating a stolen vehicle whether or not that individual was apprehended.

4. The operator or owner of the other vehicle involved in the automobile accident with the insured vehicle has had his or her license and/or registration suspended by action of the Registry of Motor Vehicles for failing to satisfy financial responsibility requirements.

5. Auto is struck in the rear by another vehicle and the applicant or other resident operator has not been convicted of a moving traffic violation in connection with this accident; or

6. Operator of the other auto involved in the accident was convicted of a moving traffic violation and the applicant or resident operator was not convicted of a moving traffic violation in connection with the accident;

or

7. Auto operated by the applicant or any resident operator is struck by a

“hit-and-run” vehicle, if the accident is reported to the proper authority promptly by the applicant or resident operator; or

8. Accidents occurring when using auto in response to an emergency if the operator of the auto at the time of accident was a paid or volunteer member of any Fire Department, First Aid Squad, or any law enforcement agency. This exception does not include an accident occurring after the auto ceases to be used in response to such emergency;

or

9. For any loss or incident if the applicant or resident operator was a law enforcement officer or a member of a federal law enforcement agency and such loss or incident occurred while in the course of his or her employment for a state, city or town police department.

10. Accidents involving damage by contact with animals or fowl; or 11. Accidents involving Physical Damage, limited to and caused by flying

gravel, missiles, or falling objects.

12. Applicant or other operator residing in the same household, or owner, who receives payment only under Personal Injury Protection.

13. For any loss or incident if the applicant or resident operator was a

commercial vehicle driver and such loss or incident occurred while in the course of his or her employment. For the purpose of this rule, a

commercial vehicle shall be a motor vehicle in excess of ten thousand (10,000) pounds or a motor vehicle used for public livery.

14. For any loss or incident if the applicant or resident operator was a bus driver and such loss or incident occurred while in the course of his or her employment for the Rhode Island public transit authority or a private or municipal school bus company.

5. Months Since Most Recent Incident

a. The number of months prior to the effective date of the new business policy or renewal that the most recent at fault and the most recent conviction occurred.

6. Refund of Surcharged Premium

a. If points have been assigned for an accident and it is later determined that the accident falls under one of the exceptions in this rule, the company shall refund to the insured the increased portion of the premium generated by the accident.

Old Dominion Insurance Company B. Administration of Operator Point Calculation

1. New Business

a. Initial information shall be obtained from an application signed personally by the applicant.

b. The signature of the applicant on all applications received from an agent, broker or solicitor shall be certified by such agent, broker or solicitor.

2. Renewal Business

Information shall be determined from any one or combination of the following:

Company's own records; or Motor Vehicle records; or

An application signed by the applicant and producer.

C. Point Calculation

1. For each Operator, determine:

a. the number of At Fault Accidents over the threshold

b. the number of each type of speeding violation resulting in a conviction c. the number of each type of minor violation resulting in a conviction d. the number of each type of major violation resulting in a conviction

e. the number of months since the most recent accident and most recent violation resulting in a conviction

2. Obtain the applicable points from the tables in the Driver Accident/Violation Points Table.

3. Total the points per Operator.

4. Refer to the Miscellaneous Coverages section of the rate pages for the flat dollar additive amount which applies for a maximum period of 3 years.

D. Driver Achievement Discount

1. The Flat dollar reductive amount applies to the listed coverages if the principal operator assigned to the rated vehicle has been licensed for a t least three years, has not been convicted of a moving traffic violation or been involved in ay accident during the three year period immediately preceding the effective date of the policy. Refer to the Miscellaneous Coverages section of the rate pages for the flat dollar reductive amount.

Type Description

H The insured has a homeowner policy with us (HO 2, 3, 5, 8) C The insured has a Condominium policy with us (HO6) T The insured has a Tenants policy with us (HO4)

E The insured has a homeowner policy (HO 2, 3, 5, 8) policy insured elsewhere.

None None of the above definitions apply.

NOTE: Named Non-owner policies are not eligible for the credit.

2. Vehicles Equipped with Anti-Theft Devices

Discounts on Comprehensive Coverage shall be afforded on vehicles equipped with the anti-theft devices defined in paragraph c. below.

A Supplemental application is required for evidence of installation of anti-theft devices meeting the following criteria prior to granting a discount.

a. The anti-theft device discounts are shown in the Non Driver Factors Section of the Rate Pages.

b. If a vehicle is equipped with more than one anti-theft device, the amount of the discount is shown in the Non Driver Factors Section of the Rate Pages.

c. Definitions of Anti-Theft Devices

(1) "Alarm Only Device" means a device which sounds an audible alarm that can be heard at a distance of at least 300 feet for a minimum of three minutes.

(2) "Active Disabling Device" means a device which disables the vehicle by making the fuel, ignition or starting system

inoperative. A disabling device is categorized as active if a separate manual step IS required to engage the device.

(3) "Passive Disabling Device" means a device which disables the vehicle by making the fuel, ignition or starting system

inoperative. A disabling device is categorized as passive if a separate manual step is NOT required to engage the device.

(4) "Vehicle Recovery System Device" means an electronic unit installed in a vehicle that is activated after the vehicle is stolen.

When activated, the device provides information to law enforcement officials or to another public or private entity regarding the vehicle's location. The vehicle recovery system provides for the routine delivery of the information to the appropriate law enforcement entity to assist in the recovery of the vehicle.

3. Senior Operator Motor Vehicle Accident Prevention Course Discount.

a. A 5% Senior Operator Motor Vehicle Accident Prevention Course Discount shall be applied to the premiums for Single Limit Liability, or Bodily Injury and Property Damage Liability, Medical Payments and Collision coverages applicable to the insured motor vehicle provided the principal operator:

(1) is age 55 or older, and

(2) has a completion certificate dated within the most recent 24 months certifying that he or she has successfully completed a Motor Vehicle Accident Prevention Course approved by the Rhode Island Division of Motor Vehicles, and

(3) during the most recent 3 years has not been:

(a) involved in an at-fault auto accident, or (b) convicted of a moving traffic violation.

b. This Discount shall apply:

(1) to new and renewal policies with inception dates within the 24 month period following the course completion date.

(2) only to the motor vehicle principally operated by the insured with the course completion certificate.

(3) only once to each such motor vehicle regardless of the number of operators with course completion certificates.
