Note: The Resolution became ineffective (except for Art. 9 Section 2) on January 1, 2002 as a result of the enactment of Resolution No. 5/2001 of the Commission for Banking Supervision of December 12, 2001 concerning the scope and detailed procedures for determining capital requirements related to particular types of risk, including exceeded limits of large exposures, the procedure and detailed principles for calculating the bank’s risk-based capital ratio taking into account banks’ affiliations with other subsidiaries or entities within the same group, and concerning the specification of additional balance sheet items of the bank considered together with equity in the capital adequacy calculation and concerning the scope and procedures for their establishment (Official Gazette of NBP No. 22, Item 43). 6. Note: On January 1, 2004, Resolution No. 1/2003 of the Commission for Banking Supervision of June 4, 2003 became effective (Official Gazette of NBP No. 11 Item 16),amending Resolution No. 5/2001 concerning the scope and detailed procedures for determining capital requirements related to particular types of risk ,including exceeded limits of large exposures, the scope and detailed principles for calculating the bank’s risk-based capital ratio taking into account the banks’ affiliations with other subsidiaries or entities within the same group, and concerning the specification of additional balance sheet items of the

bank considered together with equity in the capital adequacy calculation and concerning the scope and procedures for their establishment.

Resolution No. 6/2001 of the Commission for Banking Supervision of December 12, 2001 on detailed procedures for determining the capital base of banks belonging to banking groups for the purpose of applying the standards and limits stipulated in the Banking Law, on the level and detailed scope of deductions from a bank‘s core capital and the conditions for such deduction, on other items of bank balance sheets to be included in supplementary capital, the level thereof and the conditions for such inclusion, on other deductions from a bank‘s capital base, the level thereof and the conditions for such deduction, and on the consideration to be given to a bank‘s links with subsidiary undertakings or other undertakings belonging to the same group of companies in determining the method used to calculate the capital base (Official Gazette of NBP No. 22, Item 44).

Resolution No. 7/2001 of the Commission for Banking Supervision of December 12, 2001 concerning the detailed procedures and conditions for including receivables and extended off balance sheet commitments in determining compliance with large exposure limits, on the specification of other receivables and extended off balance sheet commitments exempt from the provisions concerning large exposure limits, and on the consideration to be given to a bank‘s links with subsidiary undertakings or other undertakings belonging to the same group of companies in calculating large exposures (Official Gazette of NBP No. 22, Item 45).

Note: On January 1, 2004, Resolution No. 2/2003 of the Commission for Banking Supervision of July 2, 2003 became effective (Official Gazette of NBP No. 13 Item 19), amending Resolution No. 7/2001 concerning the detailed procedures and conditions for including receivables and extended off balance sheet commitments in determining compliance with large exposure limits, on the specification of other receivables and extended off balance sheet commitments exempt from the provisions concerning large exposure limits, and on the consideration to be given to a bank‘s links with subsidiary undertakings or other undertakings belonging to the same group of companies in calculating large exposures.

Note: On January 1, 2004 Resolution No. 48/2003 of the Management Board of the National Bank of Poland of November 14, 2003 concerning the mode and detailed rules regarding the banks’ submission of data to the National Bank of Poland, necessary to prepare the balance of payments and the balance of the state’s foreign claims and liabilities became effective (Official Gazette of NBP No. 21 Item 36) and repealed the above mentioned Resolution.

24. Resolution No. 29/2003 of the Management Board of the National Bank of Poland of September 12, 2003 concerning the introduction of the “Regulations for the NBP’s accounts and deposit accounts for securities and for operations involving securities and their registration on accounts and deposit accounts of these securities” (Official Gazette of NBP No. 15 Item 23, adj. No. 20, Item 35).

25. Resolution No. 29/1999 of the Management Board of the National Bank of Poland of August 27, 1999 concerning the Central Register of Treasury Bills (Official Gazette of NBP No. 18, Item 29, of 2002, No. 8, Item 19).

26. Resolution No. 3/2002 of the Management Board of the National Bank of Poland of February 15, 2002 concerning the mode and detailed principles to be followed by the banks when submitting to the National Bank of Poland data necessary to set the monetary policy and to carry out periodical evaluations of the state’s monetary situation, the banks’ financial situation and the risk of the banking sector (Official Gazette of NBP No. 5, Item 9, adj. Note: On January 1, 2004, Resolution No. 23/2003 of the Management Board of the National Bank of Poland concerning the mode and detailed principles to be followed by the banks when submitting to the National Bank of Poland data necessary to set the monetary policy and to carry out periodical evaluations

of the state’s monetary situation, the banks’ financial situation and the risk of the banking sector became effective (Official Gazette of NBP No. 16 Item 26) and repealed the above mentioned Resolution.

27. Resolution No. 36/28/PPK/1999 of the Management Board of the National Bank of Poland of June 25, 1999 concerning the issue of bonds by the NBP which are designed for banks in relation to the lowered rate of mandatory reserve (Official Gazette of NBP No. 15, Item 23, adj. No. 18, Item 30, of 2002, No. 7, Item 14).

Resolution No. 5/6/PPK/2002 of the Management Board of the National Bank of Poland of February 8, 2002 concerning the issue of bonds by the NBP which are designed for an exchange of part of the bonds purchased by banks in connection with reduced mandatory reserve rate (Official Gazette of NBP No. 3, Item 5).
