THIS EXCHANGE PRODUCT IS CONFIGURED TO WORK WITH THE CUR-RENT SKYPE COMMUNICATIONS, S.A. (“SKYPE”) SERVICE AT THE DATE OF SHIPMENT. NOTWITHSTANDING ANYTHING TO THE CONTRARY HEREIN, ACTIONTEC WILL HAVE NO LIABILITY IF ANY FEATURE OR UTILITY OF EXCHANGE FAILS TO PERFORM IN SUBSTANTIAL CONFORMANCE TO THE APPLICABLE SPECIFICATIONS BECAUSE OF ANY CHANGES MADE BY SKYPE TO ITS PROGRAM OR SERVICES. IF THIS DISCLAIMER IS NOT ACCEPT-ABLE TO YOU, PLEASE RETURN THE PRODUCT IN ITS ORIGINAL BOX TO YOUR POINT OF PURCHASE WITHIN FIFTEEN (15) DAYS OF PURCHASE TO OBTAIN A REFUND. Hardware: Actiontec Electronics, Inc., warrants to the end user (“Cus-tomer”) that this hardware product will be free from defects in workmanship and materials, under normal use and service, for twelve (12) months from the date of purchase (US) or twenty-four (24) months from the date of pur-chase (Europe) from Actiontec Electronics or its authorized reseller.

Actiontec Electronics’ sole obligation under this express warranty shall be, at Actiontec’s option and expense, to repair the defective product or part, delver to Customer an equvalent product or part to replace the defec-tve tem, or f nether of the two foregong optons s reasonably avalable, Actontec Electroncs may, n ts sole dscreton, refund to Customer the pur-chase prce pad for the defectve product. All products that are replaced wll become the property of Actontec Electroncs, Inc. Replacement products may be new or recondtoned. Actontec Electroncs warrants any replaced or repaired product or part for ninety (90) days from shipment, or the

re-Actontec Electroncs warrants the meda contanng software aganst falure durng the warranty perod. The only updates that wll be provded are at the sole dscreton of Actontec Electroncs and wll only be avalable for download at the Actontec Web ste, www.actontec.com. Actontec Electron-ics’ sole obligation under this express warranty shall be, at Actiontec Elec-tronics’ option and expense, to refund the purchase price paid by Customer for any defectve software product, or to replace any defectve meda wth software whch substantally conforms to applcable Actontec Electroncs published specifications. Customer assumes responsibility for the selection of the approprate applcatons program and assocated reference materals.

Actontec Electroncs makes no warranty or representaton that ts software products wll meet Customer’s requrements or work n combnaton wth any hardware or applcatons software products provded by thrd partes, that the operaton of the software products wll be unnterrupted or er-ror free, or that all defects n the software products wll be corrected. For any thrd-party products lsted n the Actontec Electroncs software product documentation or specifications as being compatible, Actiontec Electronics will make reasonable efforts to provide compatibility, except where the non-compatibility is caused by a “bug” or defect in the third party’s product or from use of the software product not n accordance wth Actontec Electron-ics published specifications or user guide.

THIS ACTIONTEC ELECTRONICS PRODUCT MAY INCLUDE OR BE BUNDLED WITH THIRD-PARTY SOFTWARE, THE USE OF WHICH IS GOVERNED BY A SEPARATE END USER LICENSE AGREEMENT.

THIS ACTIONTEC ELECTRONICS WARRANTY DOES NOT APPLY TO SUCH THIRDPARTY SOFTWARE. FOR THE APPLICABLE WARRANTY, PLEASE REFER TO THE END-USER LICENSE AGREEMENT GOVERNING THE USE OF SUCH SOFTWARE.

Obtaining Warranty Service: Customer may contact Actontec

Electron-cs Techncal Support Center wthn the applcable warranty perod to obtan warranty service authorization. Dated proof of purchase from Actiontec Electronics or its authorized reseller may be required. Products returned to Actiontec Electronics must be pre-authorized by Actiontec Electronics with a Return Merchandise Authorization (RMA) number marked on the outside of the package, and sent prepad and packaged approprately for safe shp-ment, and t s recommended that they be nsured or sent by a method that provdes for trackng of the package. The repared or replaced tem wll be shipped to Customer, at Actiontec Electronics’ expense, not later than thirty (30) days after Actiontec Electronics receives the defective product.

REFUND OF THE PURCHASE PRICE PAID, AT ACTIONTEC ELECTRONICS’

OPTION. TO THE FULL EXTENT ALLOWED BY LAW, THE FOREGOING WAR-RANTIES AND CONDITIONS, EXPRESS OR IMPLIED, EITHER IN FACT OR BY OPERATION OF LAW, STATUTORY OR OTHERWISE, INCLUDING WAR-RANTIES, TERMS. OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SATISFACTORY QUALITY, CORRESPONDENCE WITH DESCRIPTION, AND NON-INFRINGEMENT, ALL OF WHICH ARE EXPRESSLY DISCLAIMED.
