The Work Session of the Board of Trustees of the Incorporated Village of Farmingdale was held at 7:00 p.m. on Monday, November 15, 2021.

Superintendent of Buildings Steve Fellman Absent: Deputy Mayor William Barrett

Grant Havasy of Blue and Gold Construction presented his proposal for 1 Conklin Street, for 14 apartments with a new entrance and exit. Representatives from H2M were also there as specialists regarding the traffic access and egress and safety barriers. The proposal will require a change of zone to BB.

GRIEVANCE HEARING DATE REVISION – Upon a motion made by Trustee Parisi and seconded by Trustee Priestley, it was unanimously,

RESOLVED (#2022-11-25), to revise the Grievance Board & Work Session meeting date from the previously approved date of Tuesday, February 22, 2022 to Tuesday, February 15, 2022, as the Grievance Board must meet on the third Tuesday of the month.

The following topics were discussed:

 Political signs

 Fire Department

 Building Department:

o 20 Merritts Road report received from Savik and Murray regarding the Toretta Road dedication:

 4 issues need to be remedied before acceptance

 Mr. Vilardi has been notified

 Road acceptance should be delayed until all homes are built out

 Site cleaned up and port-o-sans removed

 Need estate fencing

o 60 SE Maple St. – illegal second kitchen was removed and the shed needs to be moved to three feet from the property line.

o Kick’N Chicken work continues – there was a question about the proposed buildout, not using the entire former Ubaldo’s space.

o 356 Fulton Street/Heisser Lane has submitted building permit – a denial letter was issued, enabling application for a Special Use Permit to be filed to operate a repair shop and provide adequate parking.

o Robbie Lee is contacting the new owner regarding the site, which has been cleaned up and in the process of finalizing financing – no updates.

o Assisted living on Route 109 is negotiating for final tenant o 7-11 and Sunoco are waiting for Southland approval

o Burgerology has filed seating for 80 people which will require 3 parking spots if the Board waives 90%.

o Route 109 towing has responded with an application – received denial letter and will submit Board of Trustees application for special use permit for wall exceeding 6 feet.

o Peter Florey is waiting for a decision from New York State

o New DPW garage – expect some pricing information by December 1.

o Install storage pad at Ridge Road.

 Highway Department:

o Paving completed including small location on Linwood Ave.

o Leaf program is in progress.

o Highway Dept. crew is back at full strength.

o Lot maintenance and routine maintenance of Main St.

o Testing of new Magniflood interior lighting in DPW garage is continuing.

o Routine garbage pickup in parks and dog stations o Stencils for “Arrows” are completed.

o Ongoing storm planning and debris removal o Removed flags on Main St.

o Town of Oyster Bay – Tree removal, trimming and stump grinding underway and nearing completion.

o Wreaths installed on Village Green, Main St., Conklin St. and Pocket Park.

o 4 trees that have been wrapped are not lighting, need an electrician. One additional tree is to be wrapped.

o Check Cherry St. light repaired by Town of Oyster Bay lighting.

o Savik & Murray is working on 5 Corners Park contract signing.

o Removed branch on Waverly Place and Conklin St. after storm on Saturday.

o Town of Oyster Bay lighting repaired 6 lights in various locations.

o Village Hall sprayed with disinfectant on November 18 & 19.

o Christmas trees are in the Gazebo.

o 285 Secatogue Ave. is being secured.

o Roadwork Ahead is doing the STEP program and installing cement pad at DPW.

o Street light needs to be replaced in front of Whiskey Down Diner. Village Green lights also need repair.

 Water Department

o Water tower construction continues

o Had visit from SCWA and Jericho Water District

o Discussion about wireless services move from existing tank to temporary pole and then onto new tank including NCPD microwave.

 Code Department:

o Friday & Saturday APB security addition is working well in Parking Lot 3.

Need to add on Thanksgiving Eve 2022.

o New marijuana law will require new signage in the Village. Check to see if the marijuana local law has been returned to the Village from New York State.

§ 259-8 (B)4 shall be repealed and § 259-8 (B) shall be amended and read as follows:

B. Exemptions. No building permit shall be required for work in any of the following categories:

(1) Construction or installation of one-story detached structures associated with one- or two-family dwellings or multiple one-family dwellings (townhouses) which are used for tool and storage sheds, playhouses or similar uses, provided the gross floor area is less than 144 square feet (13.38 square meters);

(2) Installation of swings and other playground equipment associated with a one- or two-family dwelling or multiple one-family dwellings (townhouses);

(3) Installation of swimming pools associated with a one- or two-family dwelling or multiple one-family dwellings (townhouses) where such pools are designed for a water depth of less than 24 inches and are installed entirely above ground;

(4) Installation of fences which are not part of an enclosure surrounding a swimming pool;

(5) (4) Construction of retaining walls, unless such walls support a surcharge or impound Class I, II or IIIA liquids;

(6) (5) Construction of temporary motion-picture, television and theater stage sets and scenery;

(7) (6) Installation of window awnings supported by an exterior wall of a one- or two-family dwelling or multiple one-two-family dwellings (townhouses);

(8) (7) Installation of partitions or movable cases less than five feet nine inches in height;

(9) (8) Painting, wallpapering, tiling, carpeting, or other similar finish work;

(10) (9) Installation of listed portable electrical, plumbing, heating, ventilation or cooling equipment or appliances;

(11) (10) Replacement of any equipment, provided the replacement does not alter the equipment's listing or render it inconsistent with the equipment's original specifications; or (12) (11) Repairs, provided that such repairs do not involve:

(a) The removal or cutting away of a load-bearing wall, partition, or portion thereof, or of any structural beam or load-bearing component;

(b) The removal or change of any required means of egress; or the rearrangement of parts of a structure in a manner which affects egress;

(c) The enlargement, alteration, replacement or relocation of any building system; or (d) The removal from service of all or part of a fire protection system for any period of time.
