CPS London Rape & Serious Sexual Offences Unit

Metropolitan , City of London and British Transport Polic e

File Submission P rotoco l

The Rape and Serious Sexual Offences (BASSO) unit of the Crown Prosecution Service (CPS) will prosecute offences of rape and other offences alleging penetration (including attempts) . These include where :

• A Full Code Test decision is require d • A Threshold Test decision is required

o Between gam and 5pm Monday to Friday Threshold Test applications will b e

considered by the duty BASSO lawyer . All documents should be received n o later than 4pm .

o Between 5pm and gam and at weekends Threshold Test applications will b e

considered by CPS Direct (CPSD) .

There are two mailboxes that officers must use for communication to the BASSO unit :

• the LRCC mailbox - ' II pre-charge matters

• the BASSO mailbox - for all post charge matter s

The Police

Pre -Charge Referrals for a Full Code Test Decisio n

The DI/SIO must first be satisfied that the investigation is suitable , the full code test is met, and case papers are ready for a referral to the BASSO .

Referrals to the BASSO must be given an 01 MP URN, which is obtained from the SCO casebuilders (Complex Case Unit - CCU )

An initial referral will consist of the following documents : 1 . The BASSO Referral for m

3. A typed ROVI (MG15) with timings, for each Video Recorded Interview (VRI's) in the investigation . This does not need to be a full verbatim account of the interview . A

chronological summary of the interview, with timings at key points, will suffice . This is intended to be used as a guide to assist the BASSO lawyer whilst watching the VRI . Once these documents are completed by the officer in the case , they will be forwarded to a Detective Sergeant (DS/ ERO) who will check the contents and add the endorsement to confirm that:

• Either the Full Code Test is met , or the decision requires the assessment of complex evidence or legal issues in line with paragraph 8 of the Directors

Guidance (In either case reasons for that view must be recorded within the endorsement)

All key evidence has been gathered

All reasonable lines of enquiry have been pursued

These documents only, will then be forwarded to the Detective Inspector (DI/SIO) who will make the referral to the RASSO by e-mail sending the initial forms t o

z

The MPS/CPS RASSO liaison DI will check the e-mailed documents and will send the OIC an e-mail to confirm the case has been accepted . The DS/ERO and DI/SIO will be copied in .

Once the case has been accepted , the OIC will be invited to deliver a copy of the full case papers including a copy of any VRI 's to the RASS0 13

4 This file must contain all relevant papers in line with the RASSO file submission checklist and be supervised and signed by the DI /SIO . The delivered file should contain sufficient evidence and information for the prosecutor to make a charging decision on the full code test . If the supervised RASSO checklist is not present or adequately completed the case will not be accepted by the RASSO admin team and will be returned to the officer

making the delive ry.

On receipt of the case file , the RASSO will allocate the file for review by a lawyer . The allocated lawyer will conduct an initial assessment of the evidence . If they consider the case file is incomplete or has been inappropriately submitted under the full code test it will be rejected by the reviewing lawyer and will be returned to the RASSO DI without providing advice, with a wri tten rationale for rejection . The RASSO DI will then escalate this to the regional DCI .

Face to face meetings between Police and RASSO lawyers for pre charge advice are available in cases for example where a case is pa rticularly complex or sensitive. In these cases the request for a face to face will be agreed in advance between the Police and the RASSO Unit Head . The process for this is for the DI /SIO to request a face to face meeting , providing the rationale for this in the MG3 of the initial submission . The RASSO DI will then discuss this with the Unit head before accepting the case , and the officers concerned will be informed of the outcome once the case is accepted .

Following a review under the full code test , in the cases where fu rther evidence is required by the prosecutor before a charging decision can be made then an Action Plan will be produced and sent to the OIC , copying in the supervising DS and the SIO , the details of which will be obtained from the RASSO referral form . The OIC will :

• Update the CRIS repo rt with the action s

• Complete the work requested in the Action Plan within the set time for a reply . • Deliver the fu rther work required within the set time scales together with a MG3 A

in one communication where possible (not drip fed) , either by e-mail t o

5 r by hand if appropriate , for the attention of th e

reviewing lawyer making clear reference to the suspect name and URN . If, on receipt of any action plan , the officer in the case feels the actions set are not appropriate (for example , they relate to actions in their view could be completed post

charge) they should discuss these with their supervisor who, if they are in agreement, should raise this with the RASSO DI who will cause the matter to be reviewed .

Pre -Charge Referrals for Early Investigative Advic e

There will be cases where the full code test is not met , however Police consider that guidance and advice from a prosecutor would be beneficial . Examples include pa rticularly sensitive or complex cases , or cases which are likely to attract high media interest . If a referral for early advice is required , the DI /SIO must endorse the MG3 to explain why this would be of assistance . The DI/SIO will then make the referral in the normal way . If they

consider the early advice should be face to face , the DI /SIO should also follow the process for this outlined above .

Threshold Test Case Decision s gam to 5p m

The RASSO prosecutors will be responsible for Threshold Test decisions between the hours of gam to 5pm Monday to Fridays and a duty lawyer will be available throughout the

day via6 to make these decisions and give general advice . If general advice

(as opposed to charging advice or early consultation) is required then the officer should in the first instance consult with a supervisor to ensure this is an appropriate request .

Referrals on the Threshold test to RASSO must be given an 01 MP UR N before

submitting the advice , which is obtained from the SCO casebuilders (Complex Case Unit - CCU )

In Threshold Test cases all of the evidence / paperwork to be made available for review should be submitted before 4pm . It is considered good practice to contact the lawyer in advance so that they can anticipate the referral .

The RASSO will be responsible for referring Threshold Test appeals to an appropriate manager between gam and 5p m

5pm to ga m

Threshold Test referrals between 5pm and gam will be through CPS Direct (CPSD) and all appeals between these times will also be through CPSD .

Referrals on the Threshold test to CPSD must be given an 01 MP UR N before submitting the advice . Out of hours this is obtained from the SCO casebuilders (Complex Case Unit

-CCU) shared drive .

It is essential that all appeals against a CPSD decision are made immediately to an

appropriate CPSD manager . RASSO managers will not take responsibility for any appeals against CPSD decisions, that could and should have been made to CPSD at the time the original decision was made .

Appealing of the Prosecutor's Decision - Threshold Test

Appeals by police to a prosecutor 's decision not to charge should be made by a person of at least the rank of Inspector .

The appeal should only be made if in the opinion of the Inspector they believe the prosecutor's rationale for not charging is flawed in relation to their decision that :

a) there is insufficient evidence currently available to apply the evidential stage of the Full Code Test, an d

b) there are reasonable grounds for believing that further evidence will become available within a reasonable period, an d

c) the seriousness or the circumstances of the case justifies the making of an immediate charging decision, an d

d) there are continuing substantial grounds to object to bail in accordance with the Bail Act 1976 and , in all the circumstances of the case , an application to withhold bail may be properly made .

Appealing of the Prosecutor's Decision - Full Code Tes t

Appeals by police to a prosecutor 's decision not to charge should be made by a person of at least the rank of Detective Chief Inspector (DCI) . The notification of the appeal must be received by the RASSO within 14 days of the decision not to charge being received by the OIC . There will then be an agreed timescale between the RASSO unit head and the DCI , for the submission of the appeal , normally involving a face to face meeting between both

pa rties to discuss the appeal .

The appeal should only be made if in the opinion of the DCI the full code test has been misapplied and the decision needs to be reversed .

On charging the suspect - Full Code Test and Threshold Tes t

Whenever a suspect is charged , the OIC must prompt the custody officer to ensure that NSPIS shows the correct 01 MP URN for the case . If the case is inadve rtently charged with the custody number as the URN this will cause problems for post charge casebuilding .

The 10 should then compile the first appearance file in accordance with national file build standards (see Annex C) , and send this to the ERO for review.

• The ERO/DS will then place all documents for the first appearance file into the

appropriate folder kept by SCO case builders , informing them by e-mail or telephone that this has been done and informing them of the relevant cou rt dates. The case

builder will upload the file to the NSPIS case prep and onto CMS at least four clear working days before the first hearing where it is a bail case .

• In the case of threshold , in-custody charges during the day-time , the OIC will contact the SCO case builders to inform them of the charge and they will create a folder for the case . The OIC and DS will then provide the SCO case builders with the relevant

material for the first hearing via the process outlined above .

• In the case of threshold , in custody charges out of hours , the OIC will e-mail the SCO case builders the first appearance file in order for the case builders to upload all of the documentation to CMS in time for the first hearing .

• In all threshold test cases , due to the potentially tight timeframes involved , it is also considered good practice for the OIC to bring a paper file for the first appearance to fully ensure that the CPS have the relevant material available for them at this

hearing .

• After the first hearing and upon receiving the full file request from CPS , the OIC will supply the case builder with the upgraded case file for the prosecution of the

defendant , ensuring that any additional material specified in any action plan is included. The case builder will upload the full file to CMS within 14 days , ensuring all items are properly labelled .

• Post charge , evidence should never be e-mailed direct to CPS . All material MUST be sent to SCO Case builders for uploading . At all stages it remains the

responsibility of Police (via case builders) , and not CPS , to upload any electronic material in a case .

• In some cases where the SCO case builders find the size of the digital material is too big for the capacity of NSPIS , they will liaise with the RASSO DI to arrange for this to be burnt onto disk and served direct on CPS .

• If material cannot be uploaded digitally due to its volume / size then arrangements should be made between the OIC and CPS to hand deliver copies of the material to the RASSO unit.

Other Actions Post Charge Typing of statements

The OIC will make sure that all the statements are type d Copying / serving of VRI 's and Interview tape s

The OIC will make immediate arrangements for the VRI to be copied , enough for one for each defendant.

Subject to any editing being required prior to service , the OIC should serve a copy of the VRI on each defendant 's solicitor in person on behalf of the CPS .

o Preferably this will be on charge , but could be on or before the first hearing of the case in the Magistrates ' Court

o The VRI will not be supplied without the usual unde rtaking being given , a record of which will be kept by the OIC with the case paper s

o The OIC will show the VRI has been served on the form at Annex A

o The CRiS repo rt will also be updated to the effect that the VRI is served on the defence .

If the case was charged on the full code , the RASSO will retain the VRI that was originally submitted for the charging advice . One further copy of the VRI needs to be provided to the RASSO for counsel . If the case was a threshold test charge , two copies of the VRI will need to be provided to the RASSO , one for them and one for counsel . These should be delivered as soon as practicable after charge .

In the event that the copy of the VRI cannot be served on the defence solicitor(s) as indicated above , it will be supplied to the RASSO as soon as practicable after charge but in bail cases at least four clear working days before the first appearance in the Magistrates ' Court. It will save officers a journey to the RASSO unit if the copy for counsel can also be supplied to local CPS at that point . Each copy VRI should be

put in envelopes marked `Defence copy' and ` Prosecution Counsel 's copy' as applicable .

The OIC will also endeavour to serve copies of the suspect taped interview on the defendant or his/her solicitor, and will record this on the CRiS and notify the CPS lawyer using the form at Annex A. If this is not possible , copies will be supplied to local CPS prior to the first hearing in envelopes marked `Defence copy ' and `Prosecution Counsel 's copy ' as applicabl e

If there is any direct communication with the RASSO lawyers by the police it will be will be

through the I$ ailbox marked in the subject title bar with

the defendants name URN number-and the case lawyer's name . However , any fu rther post charge material including MG20 's MUST be uploaded onto the digital file via case builders and not e-mailed direct to the RASSO lawyer or the RASSO mailbox . It may , however , be appropriate to inform the RASSO lawyer by e-mail that additional material has been uploaded , pa rticularly if urgent.

The MG3A authorising the charge(s) may be accompanied with an Action Plan and

subsequently there will be deadlines to meet during the cou rt/trial process . In these cases the OIC will :

Update the CRIS report with any actions se t

Complete the investigation and comply with the deadlines set for the case pape r management for post charge case s

Comply with any Judges Order within the set time for delivery .

The RASSO Prosecutor s

Pre -Charge

For files submitted for a charging decision the RASSO prosecutors will : Issue a receipt that the file (or further material) has been delivere d

Make a charging decision within two weeks of the full file being delivered o r Produce an Action Plan (to develop the evidence so a charging decision can be

made) within two weeks of case file delivery .

Where an Action plan is provided, the lawyer will set a deadline for the

completion of the Action plan . If the OIC can not complete the action plan in line with the timeframes, they will update the lawyer of this .

Once a charging decision has been reached, the OIC, and DS will be emailed the MG3/MG3A advising this, along with the letter to the victim (if appropriate) . If

NFA, the RASSO will ensure that copy documents and VRI's are destroyed at the RASSO .

Post Charg e

As the case progresses the RASSO lawyer or paralegal officer (PO) will email the OIC with requests for fu rther evidence , copying in the officer's supervising DS and the case builder in line with the existing MPS/CPS escalation process (see Annex

B) . Any further documentation will be uploaded into NSPIS by the case builder for input onto the CPS CMS case management system .

For cases investigated by the City of London Police e-mails sent to the OIC should also be sent to the ,9

In the event that RASSO find a case has been `double registered ' i.e . has more than one URN , they must liaise with the SCO case builders BEFORE merging a case , in order to establish which URN is being used to upload .

Escalation Process

In relation to post charge cases the CPS and Police will comply with the CPS / MPS Escalation Policy published in October 2012 , which has been tailored for RASSO

procedures and is attached at Annex B . Key aspects of this policy are highlighted in yellow . For matters falling outside the published CPS/MPS Escalation process both CPS and

Police will refer any unresolved issues to their line manager for resolution in the first

instance . Where necessa ry this will involve the input of the RASSO DI who may liaise wit h the Level D Unit head and DI/SIO to resolve the issue . Examples from Police might include where there are significant delays in advice , where material has been lost , or where an

officer has been unable to contact the lawyer direct with an urgent case progression issue that requires their attention . Examples from CPS might include where there has been no

response to an action plan in the timeframes provided , or the action plan is not adequately completed . Where this escalation fails to resolve the issue the matter will be referred by the RASSO DI to the CPS Level E manager and MPS SMT lead for action .
