3.EARNEST MONEY DEPOSIT (EMD)
1) Contractor should submit online receipt for cost of downloading of tender form and E.M.D. up to 17.00 pm on 26/01/2021 for the work in online Technical documents.
2) Bid shall be treated as invalid if scanned copies are not submitted online along with the bid and / or original physical Online receipt is not submitted as mentioned above. 3) Tender of those who do not deposit earnest money in the above acceptable form shall be summarily rejected
4) The amount of earnest money will be refunded to the unsuccessful tenderer on

1. MANNER OF SUBMISSION OF ONLINE TENDERFORMS
Tenderers should prepare & submit tenders online on e-Tendering Portal of government of Maharashtra www.mahatenders.gov.in in two bid system. Accordingly the rates for the items in Annexure-A, and submit online in prescribed form-commercial envelope, duly encrypted with tenderer‟s digital signature certificate. The required documents as mentioned below need to be uploaded in technical envelope T given in online e-Tender. It may be noted that while online opening of the e-Tender. Technical Envelope T will be opened in the first stage. Commercial Envelopes of only such tenderers will be opened online, who have fulfilled all requisite terms and conditions approved by the designed authority. The tender not fulfilling any of the requisite terms and conditions, will be rejected and no further claim will be
entertained.

To qualify for award of the contract each tenderer in his name should have in last Five years i. e. 2015-16, 2016-17, 2017-18, 2018-19 & 2019-20
Achieved a maximum annual financial turnover (in all classes of civil engineering construction works only) in last Five year i.e. 2015-16, 2016-17, 2017-18, 2018-19 & 2019-20 at price level 2020-21 not less than 75 % annual cost of the work. (Maximum annual financial turn over should have amount is Rs. 60.00 Lakhs.)
Above Turnover should be certified by the registered Chartered Accountant with Tenderer‟s Total Contract Receipts
In support of this, attested copy of Annual Audit Report certified by the Chartered Accountant in which indicates contract receipts should be submitted and also be submitted the work done certificates issued by competent authority.
Satisfactorily completed as a prime contractor of at least one similar Type of work (Building Work) during last Five years i.e. 2015-16, 2016-17, 2017-18, 2018-19 & 2019- 20 of value not less than Rs. 24.00 Lakhs at price level of 2020-2021. b. Commercial Envelope 2 (Commercial Bid)
The rates should be quoted only in the online price tender. The rates not quoted in prescribed online tender form or quoted on separate paper will not be considered and the tender form will be rejected. The rates should be quoted as described in the tender document. The Principal Arts, Commerce and Science College, Lanja reserves the right to call for breakup of rates quoted, if necessary.
The rates quote in BOQ should be for full tender, quoting for half tender will not be considered valid.
c. Commercial Envelope and Technical Envelope 1 should be submitted online as per the stipulated procedure. No tenders will be accepted after stipulated date & time. Also no request for extension of time will been entertained.
d. Tenders sent by Registered Post or by Speed Post/ Courier will not be accepted. e. The firm making any undue effort to bring pressure from outside/Departmental
authority will be liable for outright rejection. 2. FINANCIAL COVER
The second envelope marked as “financial Bid” shall contain only the Bill of Quantities. (BOQ) The same file downloaded from the website must be duly quoted with complete details filled up. The contractor shall upload the same BOQ only, duly filled and quoted his offer percentage of estimate rates with digital signature. The contractor need not upload the B -1 form i.e. detailed conditions of contract along with BOQ. Contractor should not quote his offer any where directly of indirectly in
technical cover. The contractor shall quote for the work as per detailed given in main tender and also.
3. SUBMISSION OF TENDER
The contractor shall before final submission of bid, confirm all the required files, papers are attached properly in the respective covers i.e. in Technical cover and financial cover. Contractor may attach the documents asked in the bidding document by selecting those from those which are already available in “my documents” section in his login.
4. OPENING OF TENDER
The contractor may remain present in the office of the tender opening Authority at the time of opening tender
5.Technical Cover
First of all, Envelope No.1 of the tender will be opened to verify its contents as per requirements. The documents so attached by the bidder will be verified by the tender evaluation committee of the department. If the various documents contained in this Envelope do not meet the requirement of the Department, a note will be recorded accordingly by the tender opening authority and the said bidder‟s financial Bid will not be considered for further action. The summary of technical bid opening
will be mailed to all concerned contractors automatically by the system. The scheduled date & time of financial bid opening will mailed to contractors whose technical bids are accepted by the tender evaluation committee.
6.Financial Cover
This envelope shall be opened on the date & time specified and communicated to concerned bidder through mail. The tendered rates or percentage above or below the estimated rates shall then be read out.
7. The contractor will have to sign the original copy of the tender papers and the drawings according to which the work is to be carried out, he also have to give a declaration to the effect that he has fully studied the plans, specifications, local conditions and availability of labour and materials and that he has quoted his rates with due consideration to all these factors.
8. The right is reserved to revise or amend the contract documents prior to the date notified for the receipt of tenders or extended date. Such deviations, amendments or extensions, if any, shall be communicated in the form of corrigendum through website www.mahatenders.gov.in
9. The bidders are subject to be disqualification, if they have made misleading or false representations in the forms, statement and attachments submitted in proof of the qualification, requirements; and / or record or poor performance such as a abandoning the words, not properly completing the contract, in coordinate delays in completion, litigation history or financial failures etc.
10. EXAMINATIONS OF DRAWINGS AND SITE CONDITIONS: - The bidder shall carefully examine the drawings, conditions of contract,
specifications etc. He shall also inspect the site and acquaint himself about the climate, physical and all other conditions prevailing at site, the nature, magnitude, special features practicability of the works, all existing and required means of communications and access to site, availability of housing and other facilities, the availability of labour and materials, labour camp site, stores and godown etc. He shall obtain all necessary information as to the risk, contingencies and other circumstances which may affect and influence the tender. No claims on any of the above or any other factors will be entertained by the Government, should there be any discrepancy or doubt or obscurity the contractor shall submit the same to The principal Arts, Commerce and Science College, Lanja as concerned of elucidation as soon as possible.
11. The tender submitted by the contractor shall remain valid for a period of 30 days from the date of opening of financial bid.
12.The contractor(s) whose tender is accepted is required to note that no foreign exchange will be released by the Department.
13. Tenders, which do not fulfill all or any of the conditions or are incomplete in any respect are liable to summary rejection without any further notice.
14. Right to reject any or all tenders without assigning reasons there for is reserved. The acceptance of the tender lies with the The Principal Arts, Commerce and Science College, Lanja as the case may be.
The notice inviting e-tender shall form part of the tender agreement.
The successful tenderer will be required to produce to the satisfaction of the specified concerned authority a valid and concurrent license issued in his favour under the provisions of the contract Labour (Regulation and Abolition) Act 1970, before starting the work, failure to do so will invite acceptance of the tender to be withdrawn and earnest money forfeited.
15.SETTLEMENT OF DISPUTES
a) It will be responsibility of the tenderer to prove beyond doubt his liability for any exemption from paying the earnest money Deposit and/ or Security Deposit wherever applicable, The tenderer should produce relevant document/ certificates from the competent authority in such case.
b) All the disputes between indenting agencies shall be settled by the undersigned. However, the disputes between the contractor and undersigned or the appeal against the decision of undersigned in disputes refer to him, shall lie with The Principal Arts, Commerce and Science College, Lanja proceedings if any will be under the Ratnagiri Court only.
16.REMOVAL OF DIFFICULTY
a) The undersigned shall take such decisions to remove difficulties due to ambiguity of provisions in the tender documents or due to provisions which are inconsistent with the objectives of this tender.
