COMES NOW the Plaintiff, STATE OF WASHINGTON, by and through its attorney, ANNA K. ARUIZA, WSBA NO. 39663, Deputy Prosecuting Attorney, and hereby alleges that contrary to the form, force and effect of the ordinances and/or statutes in such cases made and provided, and against the peace and dignity of the STATE OF WASHINGTON, the above-named Defendant did commit the following offense(s)–

Count I

Assault in the First Degree

On or about February 19, 2020, in the County of Kitsap, State of Washington, the above-named Defendant did, with intent to inflict great bodily harm, assault another, to wit: DUSTIN CARL MILLER, with a firearm or any deadly weapon or by any force or means likely to produce great bodily harm or death; contrary to the Revised Code of Washington 9A.36.011(1)(a).

(MAXIMUM PENALTY–Life imprisonment and/or a $50,000.00 fine pursuant to RCW 9A.36.011(2) and RCW 9A.20.021(1)(a), plus restitution and assessments.)

mandatory penalty for this offense is life imprisonment without the possibility of parole pursuant to RCW 9.94A.030 and 9.94A.570)

Special Allegation—Domestic Violence—Intimate Partner [after 7-28-19 and before 3-18-20] AND FURTHERMORE, the Defendant did commit the above crime as an intimate partner against an intimate partner; contrary to Revised Code of Washington 10.99.020.

“Intimate partner” means: (a) Spouses, or domestic partners; (b) former spouses, or former domestic partners; (c) persons who have a child in common regardless of whether they have been married or have lived together at any time; (d) adult persons presently or previously residing together who have or have had a dating relationship; (e) persons sixteen years of age or older who are presently residing together or who have resided together in the past and who have or have had a dating relationship; and (f) persons sixteen years of age or older with whom a person sixteen years of age or older has or has had a dating relationship.

“Dating relationship” means a social relationship of a romantic nature. Factors that the court may consider in making this determination include: (a) The length of time the relationship has existed; (b) the nature of the relationship; and (c) the frequency of interaction between the parties.

AND FURTHERMORE, the Defendant did commit the above crime against a family or household member; contrary to Revised Code of Washington 10.99.020. “Family or household members” means spouses, domestic partners, former spouses, former domestic partners, persons who have a child in common regardless of whether they have been married or have lived together at any time, persons sixteen years of age or older who are presently residing together or who have resided together in the past and who have or have had a dating relationship, and persons sixteen years of age or older with whom a person sixteen years of age or older has or has had a dating relationship.

[Effect: Assault in the fourth degree, where domestic violence was pleaded and proven on or after July 23, 2017, is a class C felony if the person has two or more prior adult convictions within ten years for any of the following offenses where domestic violence as defined in RCW 9.94A.030 was pleaded and proven on or after July 23, 2017: (a) Repetitive domestic violence offense as defined in RCW 9.94A.030; (b) Crime of harassment as defined by RCW 9A.46.060; (c) Assault in the third degree; (d) Assault in the second degree; (e) Assault in the first degree; or (f) An out-of-state comparable offense. RCW 9A.36.041(3).]
