Guidance and

Application

for trading at the Manchester Street

Markets

The Manchester Street Markets are monthly markets at various locations across the city, including: Northenden (Northenden Village, Palatine Road) – first Saturday of each month, Withington (Withington Village, Copson Street) – second Saturday of each month, and Chorlton (Manchester Road, in front of the library) – third Saturday of each month. If you wish to trade on any of the Manchester Street Markets, you must be registered on our Street Markets trader database. Only traders registered on this database will be able to apply to trade on the individual Street Markets.

To apply to register on the Street Markets trader database you will need to: • Read the following application guidance notes

• Fill in the attached application form

• Submit the completed form along with all the relevant supporting documents.

For the application to be valid, you will need to: • Fill in all mandatory sections

• Provide proof of your legal right to work in the UK • Provide two proofs of your home address

• Provide proof of your public liability insurance

• Provide a recent personal passport sized colour photo

• Where applicable, provide proof of your registration as a dealer in second-hand goods or as a food business establishment

• Submit the form and documents.

Guidance Notes

Trading at the Street Markets

The Manchester Street Markets operate monthly in various locations around Manchester. If you want to trade on these markets you need to register on the Street Markets trader database. When planning events, Manchester Markets will contact traders registered on the database to invite them to trade at the markets.

You can cancel your registration at any time by providing written notice to Manchester Markets.

Who can apply?

Any individual or business legally eligible to work in the UK and wanting to trade at the Manchester Street Markets to sell their goods and services may apply to register on the trader database, unless they have any outstanding charges with or are currently excluded from trading at Manchester Markets.

The application process

To apply to register on the Street Markets trader database you need to complete and submit the attached application form. Guidance and application forms are available on-line, or from the Manchester Markets head office and the Street Markets office. Applications can be submitted on-line, by hand or by post to the market office.

You must also submit the following supporting documents with your application: • Proof of your legal right to work in the UK

• Two proofs of your home address • Proof of your public liability insurance

• A personal colour passport-sized photograph

• Proof of registration for a food business establishment (where applicable) • Proof of registration as a dealer in second-hand goods (where applicable).

All supporting documents must be originals, i.e. photocopies are not accepted. If you are

sending documents by post we recommend that you use a high-value postal service, e.g. Recorded Signed For or Special Delivery. You can also show these documents in person, at the Manchester Markets Head Office or at any of the market offices. If you choose to apply online you will be required to provide a scanned copy of your documents; however, the original must be shown before the completion of your agreement.

What is the Manchester Markets Service Standards?

The Manchester Markets Service Standards, previously known as the Regulations and Disciplinary Procedure, contain the terms, conditions and standards of trading. Copies are available online, at the market office or at the Manchester Markets head office.

Proof of legal right to work in the UK

It is a criminal offence under section 21 of the Immigration, Asylum and Nationality Act 2006 to knowingly employ a person aged 16 or over who is subject to immigration control, for work the person is not permitted to undertake. All applicants must provide the appropriate information as

listed below to demonstrate they have the legal right to work in the UK as a trader. Personal information maintained by Manchester Markets is subject to cross-system and cross-authority comparison to prevent illegal working in the UK.

Provision of documents

Subject to further UK Border Agency guidance and unless otherwise stated, any one document from List A or List B below will be considered as acceptable proof of a legal right to work in the UK. The documents from List B have time restrictions, so if you provide one of these we will carry out a follow-up check every 12 months, unless you can later produce a document from List A.

There are some documents which also require you to provide proof of your National Insurance. These are marked with an asterix (*) and further details are provided. All documentation must be original, current and valid, copies are not acceptable.

* Documents marked with an asterisk - If you are providing any of the documents from A6 to A12, B7 or B8 you must also provide a document issued by a previous employer or

Government agency, e.g. Inland Revenue (now HM Revenue and Customs), the Department for Work and Pensions, Jobcentre Plus, the Training and Employment Agency (Northern Ireland) or the Northern Ireland Social Security Agency, which contains the National Insurance number and name of the holder.

List A

A1 A passport showing that the holder is a British citizen or a citizen of the United Kingdom and Colonies having the right of abode in the United Kingdom.

A2 A passport or national identify card showing that the holder is a national of a European Economic Area country or Switzerland.

A3 A residence permit, registration certificate or document certifying or indicating permanent residence issued by the Home Office, the Border and Immigration Agency, or the UK Border Agency to a national of a European Economic Area country or Switzerland.

A4 A permanent residence card or document issued by the home Office, the Border and Immigration Agency, or the UK Border Agency to the family member of a national of a European Economic Area country or Switzerland.

A5 A passport or other travel document endorsed to show that the holder is exempt from immigration control, is allowed to stay indefinitely in the United Kingdom, has the right of abode in the United Kingdom, or has no time limit on their stay in the United Kingdom. A6* An Immigration Status Document issued by the Home Office, the Border and Immigration

Agency, or the UK Border Agency to the holder with an endorsement indicating that the person named in it is allowed to stay indefinitely in the United Kingdom or has no time limit on their stay in the United Kingdom.

A7* A full birth certificate issued in the United Kingdom which includes the name(s) of at least one of the holder’s parents.

A8* A full adoption certificate issued in the United Kingdom which includes the name(s) of at least one of the holder’s adoptive parents.

A9 * A birth certificate issued in the Channel Islands, the Isle of Man or Ireland. A10* An adoption certificate issued in the Channel Islands, the Isle of Man or Ireland.

A11* A certificate of registration or naturalisation as a British citizen.

A12* A letter issued by the Home Office, the Border and Immigration Agency, or the UK Border Agency to the holder which indicates that the person named in it is allowed to stay indefinitely in the United Kingdom.

List B

B1 A passport or travel document endorsed to show that the holder is allowed to stay in the United Kingdom and is allowed to stay in the United Kingdom and is allowed to do the type of work in question.

B2 A Biometric Residence Permit issued by the UK Border Agency to the holder which indicates that the person named in it can stay in the United kingdom and is allowed to do the work in question.

B3 A residence card or document issued by the Home Office, the Border and Immigration Agency, or the UK Border Agency to a family member of a national of a European Economic Area country or Switzerland.

B4 A work permit or other approval to take employment issued by the Home Office, the Border and Immigration Agency, or the UK Border Agency, in combination with:

• A passport or another travel document endorsed to show the holder is allowed to stay in the United Kingdom and is allowed to do the work in question.

• A letter issued by the Home Office, the Border and Immigration Agency, or the UK Border Agency to the holder or the employer or prospective employer confirming the same.

B5 Certificate of Application issued by the home Office, the Border and Immigration Agency, or the UK Border Agency to or for a family member of a national of a European Economic Area country or Switzerland stating that the holder is permitted to take employment which is less than 6 months old, in combination with evidence of verification by the UK Border

Agency Employer Checking Service.

B6 An Application Registration Card (ARC) issued by the Home Office, the Border and Immigration Agency or the UK Border Agency stating that the holder is “ALLOWED TO WORK” or “EMPLOYMENT PERMITTED”, in combination with evidence of verification

by the UK Border Agency Employer Checking Service.

B7* An Immigration Status Document issued by the Home Office, the Border and Immigration Agency or the UK Border Agency to the holder with an endorsement indicating that the person named in it can stay in the United Kingdom, and is allowed to do the type of work in question.

B8* A letter issued by the Home Office, the Border and Immigration Agency, or the UK Border Agency to the holder or the employer or prospective employer, which indicates that the person named in it can stay in the United Kingdom and is allowed to do the work in question.

Proof of home address

To verify your current address applicants must provide two proofs of home address. All documents must be recent and show your full name and address. These can be any of the

following documents:

• A statement of account from your bank or building society, less than three months old • A financial statement from your bank, building society or other financial organisation (e.g. a

• A bill from your utility provider (e.g. provider of gas, electricity, water, telephone), less than three months old

• A valid TV licence, less than 12 months old

• A valid insurance policy certificate, less than 12 months old

• A government agency document (e.g. Benefits Agency, Employment Service, Inland Revenue), less than 12 months old

• An addressed payslip, P45 or P60 document, less than three months old.

Proof of public liability insurance

Public liability insurance provides you with protection from loss or damage resulting from a claim for damages by a member of the public or other third party arising from any accident or injuries sustained whilst you are trading at the market.

Manchester Markets require all traders to have, and maintain throughout their agreement, public liability insurance providing cover for a minimum £5 million for trading on British markets. You must provide a current insurance policy certificate or National Market Traders Federation membership card in your name.

You should be able to obtain cover from any reputable public liability insurance provider, but we have provided details of two companies specialising in market trader public liability insurance. • National Market Traders Federation (NMTF): when you register with the NMTF you will be

offered a free market trader insurance package consisting of public liability up to £5 million (including product liability, food poisoning and ear piercing) and employers liability up to £10 million. Proof of registration for a food business establishment

Under UK law, if you are operating or intending to operate a food business, you need to register this (including market stalls, delivery vehicles and other movable structures). Registration allows local authorities to keep an up-to-date list of all premises in their area so they can visit them when they need to.

If you are regularly trading as a food business in Manchester, you must provide evidence that you have registered with Manchester City Council’s Regulatory and Enforcement Services. For further information and to register contact the Manchester Regulatory and Enforcement Services at:

Proof of registration as a dealer in second-hand goods

If you are trading in second-hand goods, you must register with the local authority. Therefore, where you are selling second-hand goods in Manchester you must provide evidence that you have registered with Manchester City Council’s Regulatory and Enforcement Services.

National Insurance

Most people who work in the UK have to pay National Insurance contributions (NICs), which are collected by HM revenue & Customs (HMRC). There are different types of National Insurance contributions, depending upon whether you are employed or self-employed.

There are special National Insurance rules for people who travel outside the UK and for people who come to the UK from abroad. When you come to work in the UK you have to register for a National Insurance number and immediately start paying National Insurance contributions in the UK on the same basis as other people who normally live and work here.

Assessment of applications

Valid applications will be assessed and we will generally notify you of the outcome within 14 days of receipt. Applications are not valid if they have not been completed correctly and where all the appropriate supporting information has not been provided. Applications will not be assessed where the applicant or business has outstanding arrears with or is currently excluded from trading at Manchester Markets.

The details of successful applicants will be added to the trader database, which we will use to invite bookings for occupancy at the markets.

The booking process

Manchester Markets will invite traders registered on the database to trade at the markets. To book a trading place you will need to complete a separate form to book stalls on individual markets, which we will send to you.

The criteria used to assess bookings and allocate trading spaces at the market are: • the type of goods and services the applicant wants to sell

• the space requirements

• the balance of trades at the market (so as maintain a balance of supply and demand).
