Capacity and Competence

Often capacity and competence are

used interchangeably, but they have

different meanings

Capacity: a medical determination that an

individual is not currently capable of making an

informed decision.

Competence: a determination by a legal body,

usually a probate court judge; may result in an

individual’s loss of autonomous decision-making

power.

Respect  for  the  patient’s  dignity,  rights  and  values  

should  guide  all  patient-­‐physician-­‐caregiver  

interactions.

Physician  accessibility  and  excellent  communication  

are  fundamental  to  supporting  the  patient  and

The  physician  should  recognize  the  value  of  family  

caregivers  as  a  source  of  continuity  regarding  the  

patient’s  medical  and  psychosocial  history  and  

facilitate  the  intellectual  and  emotional  transition
