Snow arrived earlier than normal this year, forcing us to start changing gears for the snow removal season. We put plows on the trucks and then the finicky Iowa weather decided to warm up again and bring on the mud. I officially want to refer to 2019 as “The Year of Mud.” We haven’t been able to catch a break from it since the snow finally melted in the spring and the April showers lasted well into the prime time for ground work. The saturated soil created conditions in which we had to modify many installations from conventional to alternative systems. The soil structure and moisture content created unsuitable environments for previously agreed upon systems, plans and prices. This can be frustrating for both contractors and homeowners. It is a struggle when the costs increase and the best choice is an alternative system that requires a maintenance agreement. We all know how important these agreements are despite the recent events unfolding around Senate File 511.

About a month ago, the Iowa Department of Natural Resources held a meeting for installation contractors, maintenance contractors, sanitarians, and the

industry as a whole (see pages 16 & 17) regarding Senate File 511.

The meeting was to discuss possible changes to Chapter 69 of the Iowa Code and to address alternative system maintenance. There was an excellent turnout and everyone attending was opposed to any changes to the Iowa Code that would set the industry back or be detrimental to water quality. In the next two to five years, the DNR is looking into updating the Code in ways that will improve water quality. This includes changes to what defines trained maintenance providers. In order to bring about positive changes to the future drafts of the Iowa Code, we need to be aware of upcoming changes and give our input as an association.

REPORT

On October 15 and 16, IOWWA vice president and board member Jeff Sherman, Floyd County Board of Health, attended part of the Mega-Conference in Loveland, CO. That conference was put on by the National Onsite Wastewater Recycling Association (NOWRA), the Colorado Professionals in Onsite Wastewater (CPOW), the State Onsite Regulators Alliance (SORA) and the National Association of Wastewater Technicians (NAWT).

Jeff reports there were many very good speakers addressing everything from a NOWRA update to the USDA and troubleshooting septic tanks. His favorite presenter was Mark Elliott, an associate professor in the civil, construction and environmental engineering department at the University of Alabama. His topic was understanding the challenges and opportunities for rural wastewater in resource-poor areas, including the Alabama Black Belt. This is a primary focus of Dr. Elliott’s research.

This session offers an overview of the legal

require-ments mandated under Iowa Code chapter 480. It will include how to maximize efficiency and minimize construction delays by understanding and utilizing the electronic online ticketing system (ITIC) and how to properly utilize the ITIC mapping tools in order to provide a clear, precise and accurate description of the proposed excavation area.

Effluent Sampling – Becoming a DNR-Qualified NPDES Sampler

This session will train contractors or homeowners on the proper technique on how to collect effluent samples for the DNR’s National Pollutant Discharge Elimination System (NPDES) General Permit #4 sam-pling requirements. Attendees will also learn how to properly ship samples so they are not rejected when re-ceived at the lab. Upon completion of this training, the attendee will receive certification to conduct General Permit #4 sampling.

Special Instructions for this session: To receive the Qualified Sampler Certification, you will be required to attend the entire session. There will be a sign-in/sign-out sheet to monitor room activity. After the start of the session (5-8 min.) a sign-in sheet will be distributed so it is important to arrive on time. Contact information will be required including name, company (if applicable), email and complete mailing address. Information will be provided at the session on how you will receive the Qualified Sampler Certificate, preferably via email.

IDNR Updates

TOT inspection-related information will be featured in this session. Emphasis will be on proper inspection techniques and reporting. Reminders of what is in-cluded in the administrative code related to “required” vs “other allowable processes” will be discussed. Other updates will include the creation of a new IDNR TOT database, updates for the septic pumper licensing and NPDES GP4.

The wastewater tank is a key component to the system. Among other things, it must be durable and watertight. This session examines the process of precast concrete tank manufacturing. We will also discuss key best practices during manufacturing and installation that will enhance durability and maintain watertightness of these structures to help extend the service life of the system.

Proper Installation and Inspection of Precast Concrete Tanks

A precast concrete tank made of the best materials and with the finest craftsmanship can still be compromised with poor installation. Learn the most common mistakes committed during poor tank installations. Shortcuts taken during installation can result in significant issues. Learn tips for ensuring the tank is installed correctly as well as proper inspection and testing of the tank.

This discussion will connect the proper care and ser-vice of onsite treatment systems to the protection of groundwater. The session will identify the importance of the steps to be sure that our groundwater resources are available into the future.

A teacher, coach, middle school principal and powerful speaker, Kent Stock is also the man who coached the Norway, Iowa, baseball team during their now-famous last season of play in their hometown. As depicted in the 2007 film, The Final Season, the nationally recog-nized baseball team came together under Stock, then a first-year head baseball coach, to defy the odds. They won Norway’s 20th state title in what would become

the team’s last season before merging with a bigger, neighboring school district. Kent authored a book “Heading for Home: My Journey from Little League to Hollywood.” It outlined his life’s journey, where he’s been thrown a few curve balls, and the behind-the-scenes stories of filming a movie.

Kent was born and raised in Ankeny, Iowa, where he excelled at baseball. He continued his baseball career at Waldorf College and Luther College. In 1985 he began a teaching and coaching career that spanned 23 years. Today, Kent is a vice-president at Community Savings Bank in Robins. He lives in Marion with his wife

Laurie and two teenage daughters.

DNR’S DISCUSSION OF CHAPTER 69

On November 1, 2019, the DNR held a stakeholder meet-ing at the Iowa League of Cities to address proposed changes to Chapter 69 of the Iowa Administrative Code in Senate File 511. These include maintenance requirements and designation of who is allowed to perform maintenance on peat moss bio filter systems, recirculating textile filter sys-tems and anaerobic treatment units. The proposed changes to Chapter 69 are presented on page 17 or go to https:// www.iowadnr.gov/environmental-protection/water-quality/ private-septic-systems and click on the link to Summary of the proposed changes to Chapter 69.

The main purpose for the meeting, which was attended by about 50 people from all sectors of Iowa’s onside wastewater industry, was to discuss proposed changes with industry pro-fessionals. Regulators, contractors, designers, maintenance providers and manufacturers shared thoughts on what a “trained individual” means, frequency of maintenance, eco-nomic impacts, water quality concerns, warranty concerns and more.

The DNR staff explained the rulemaking process. It could take up to two years and is as follows: + Stakeholder meeting to discuss proposed changes.

Amend rule 567—69.1 (455B) definition of “Packed bed media filter” removes the word “normally.”

“Packed bed media filter” means a watertight structure filled with uniformly sized media that is normally placed over an underdrain system. The wastewater is dosed onto the surface of the media through a distribution network and is allowed to percolate through the media to the underdrain system. The underdrain collects the filtrate and discharges the final effluent.

Reason for Change: We are proposing to remove the word “nor-mally” to add specificity to the rule. “Nor“nor-mally” implies that there are situations where watertight structures with media are not placed over an underdrain system, and this is not true.

Amend subrules 567—69.5(2) only change is in 60.5(2).

69.5(1) All private sewage disposal systems that discharge

above the ground surface shall be annually inspected to ensure proper operation.

69.5(2) Private sewage disposal systems that require a

maintenance contract shall be inspected by a manufactur-er’s certified technician trained individual familiar with the operation and maintenance of the system.

69.5(3) Private sewage disposal systems that do not require

a maintenance contract shall be visually inspected by a person with knowledge of the system for any malfunc-tion and shall have the septic tank opened, inspected, and pumped if needed. A record of the inspection and any tank pumping shall be maintained and be made available to the administrative authority upon request.

69.5(4) No private sewage disposal system shall discharge

to a state-owned natural or artificial lake, an outstanding Iowa water or an outstanding national water as defined in 567—subrule 61.2(2) unless authorized by an individual

NPDES permit.

Reasons for changes: 69.5(1), (3) and (4) do not need to be changed. The changes to 69.5(2) implement Senate File 511 (SF511), which was never signed into law. SF511 states in the bill explanation that: The bill prohibits the commis-sion from adopting rules that require an owner of a peat moss biofilter system, a recirculating textile filter system, or an aerobic treatment unit to enter into a maintenance contract. However, the bill requires an owner of a peat moss biofilter system, a recirculating textile filter system, or an aerobic treatment unit to have the system inspected and, if necessary, have maintenance performed by a techni-cian at least once every three years. In addition, a variance has been granted to allow trained individuals to perform maintenance. When the rule was originally written, these technologies were new, and only certified technicians had any knowledge of the systems. Now, the technologies are no longer new, and more people have knowledge of the systems, thus trained individuals are able to inspect and maintain systems.

Amend paragraph 69.13(6)“d” as follows:

d. Maintenance contract. Prior to installation the use of a

peat moss biofilter system, a maintenance contract for the proper monitoring and servicing of the entire treat-ment system shall be established between the owner of the system and a certified technician trained individual familiar with the operation and maintenance of the sys-tem. A maintenance contract is required for the life of the system. All monitoring and servicing of the system shall be performed by a manufacturer’s certified technician the trained individual. Manufacturers are responsible for ensur-ing that an adequate number of certified technicians are available to service all peat moss biofilters at the specified intervals. The certified technician trained individual shall perform the required maintenance and reporting to the owner of the system and to the administrative authority.

Jeff Sherman is currently vice president of the IOWWA Board of Directors and a January conference session presenter. He also is an environmental

health specialist for the Floyd County Board of Health, located in Charles City. Jeff serves Floyd County and deals with a variety of regulations relating not just to septic and well inspections, but to tattoo operations, tanning and pool inspections, nuisance complaints and installing 911 signs.

After working as a machinist, Jeff became a Floyd County employee 13 years ago and began his first interactions with the septic industry. Jeff has been a member of IOWWA since starting his employment and joined the board in 2016 to fill an unexpired board member term. He then was voted into his first three year term in 2017. He values the training that IOWWA provides and the opportunity to interact with the members. Jeff is on the board ballot for 2020 and slated to be the 2020 IOWWA Board President.

Jeff and his wife Dana have been married for 37 years. They have three children — Heather, Brian and Bailey — and five grandchildren. Jeff enjoys woodworking, camping and boating, and when his kids were younger, he took Tae Kwon Do. But he’s never had put his martial arts skills to work in his Floyd County job, though he’s jokingly thought about it!

The certified technician trained individual shall also report any discontinuance of maintenance of the peat moss biofilter system to the administrative authority. Unless otherwise required by this chapter, peat Peat moss biofilter systems shall be inspected at least once annu-ally every two years by the certified technician trained individual. A copy of the maintenance contract shall be on file in the office of the administrative authority.

Reasons for changes: This implements SF511 for peat moss biofilters (see above). The change from “to installation” to “the use of” and “annually” to “every two years” is based on recommendations made during the 2019 legislative session. The new language “Unless otherwise required by this chapter” allows for compliance with 69.5(1).

Amend paragraph 69.13(7)“e” as follows:

e. Maintenance contract. Prior to installation of a

recir-culating textile filter system, a maintenance contract for the proper monitoring and servicing of the entire treatment system shall be established between the owner of the system and a certified technician trained indi-vidual familiar with the operation and maintenance of the system. A maintenance contract is required for the life of the system. All monitoring and servicing of the system shall be performed by a manufacturer’s certified technician the trained individual. Manufacturers are responsible for ensuring that an adequate number of certified technicians are available to service all recirculat-ing textile filters at the specified intervals. The certified technician trained individual shall perform the required maintenance and reporting to the owner of the system and to the administrative authority. The certified techni-cian shall also report any discontinuance of mainte-nance of the system to the administrative authority. Recirculating textile filter systems shall be inspected at least once annually by the certified technician trained individual. A copy of the maintenance contract shall be on file in the office of the administrative authority.

Reasons for changes: This implements SF511 for recirculating textile filters (see above). Inspection frequency not changed.
