What is FSMA?
• Food Safety Modernization Act of 2011
– With the enactment of the FSMA in 2011, the FDA was granted broad and sweeping authority to “ensure the safety and security of the food supply”.
– The repeated objective of the FSMA is to shift the focus of food safety in the United States from one of response to that of prevention.

– Both prescribed guidelines and established plans for handling food safety initiatives and occurrences.

– Directs the Food and Drug
Administration (FDA), as the food regulatory agency of the Department of Health and Human Services, to take steps to protect the public from a threatened or actual terrorist attack on the U.S. food supply and other food-related emergencies.

Monitoring Requirement
FSMA
• Proposed sec 1.908(d) (2) (i) “would require the carrier, once the
transportation operation is complete, to demonstrate to the shipper, and if requested, to the receiver, that the carrier maintained conditions during transportation operation consistent with those specified by the shipper
– The FSMA Proposes in the affirmative that “the lack of appropriate
temperature control is a potential
problem in food transportation…so that we propose to include a mechanism by which the carrier must demonstrate to the shipper that food which may
become adulterated if its temperature is not properly controlled during
transportation was transported under proper temperature conditions.”

Temperature Requirement
FSMA
• Proposed sec1.908 (d)(6)(ii) would require that written procedures between the carrier and shipper must specify how the carrier will comply with this requirement. While that procedure would include the proper cleaning, sanitizing and inspection of the vehicle including verification of the vehicle pre-
cooling, it would also specify the data that would be demonstrated to
support the temperature control during the transportation operation.

Training Requirement
FSMA
Proposed sec1.910 would establish training requirements for carriers which require carrier provide training to personnel engaged in the transportation operation that provides an awareness of the Food Safety problems that may occur during the transportation operation and the responsibilities of the carrier under the rule. The training would be provided upon hiring and thereafter as needed. The rule
would also require that records be maintained documenting such training to include the date, name of person trained and the person who administered the training as well as the type of training accomplished.

Retention Requirement
FSMA
• Rule sec 1.912 establishes
requirements for retention of all records applicable to shipper and carriers transportation operations.
The final rule section (published 04042014) affirms the FSMA
amendment to expand FDA’s former records access authority beyond records relating to specific suspect article of food to include records relating to any other article of food that the FDA reasonably believes is likely to be affected in a similar manner.
