This program will provide an overview of the current state of HIPAA and HITECH breach analysis and notification
requirements based on the 2013 HIPAA Omnibus final rule. Ms. Watson will discuss the new definition of breach and the
new risk assessment standard and factors, provide examples of breaches and appropriate measures to take in response
to a breach or potential breach, and offer best practices in responding to Office of Civil Rights (OCR) investigations with examples of recent OCR Breach Enforcement Actions.
OBJECTIVES:
At the conclusion of this program, attendees will be able to:
1. Understand the laws and regulations that relate to privacy and security in a health care environment. 2. Determine the benefits of Cyber Liability Insurance in the event of a potential breach.

Understanding the rules of e-discovery is not easy. With increased data stored in electronic medical records, emails and computer databases, it is no wonder organizations have difficulty managing the process during litigation. A request for "any and all health information" pertaining to a patient can be burdensome. This program will educate health care professionals on effective protocols which should be in place to enforce compliance and meet deadlines in a timely fashion.
OBJECTIVES:

1. Understand how the e-discovery rules apply to electronically stored information.
2. Identify certain risk and legal compliance concerns affecting e-discovery including knowing your e-discovery environment, the importance of preservation, and predictive coding.

A variety of factors, including health care reform, are driving a trend toward acquisition of medical practices and physician employment by hospitals — again! During the first cycle of physician employment (circa 1985-1998), hospital executives and physicians made a number of mistakes that resulted in significant financial losses. By the late 1990s, many in the industry viewed physician employment as a failed integration strategy. In reality, the strategy was sound — the failure was in the implementation. Mr. Halley will discuss common missteps made by hospital executives and physicians as well as the critical success factors necessary to ensure physician employment as a viable integration strategy. How does the webinar work?
The audio portion works like any other telephone conference call. The visual materials (slides, charts, graphs, or pictures) are accessible through a web-based virtual meeting. Each attendee will need a telephone for the audio portion as well as a computer with internet access.
How do you connect to the program?
Prior to the webinar, registered attendees will receive an e-mail from KaMMCO with instructions for downloading the course materials. The e-mail will also include a meeting number, a phone number for the audio portion, and a link to the presentation.

Ms. Watson's major areas of law practice include health care law and professional liability defense litigation. She has many years' experience advising health care clients in the areas of regulatory matters, HIPAA/HITECH, medical staff issues, risk management, and compliance issues. She has presented to several organizations on HIPAA, HITECH, data breach, and health care privacy. She also represents hospitals, clinics, and physicians in litigation in state and federal court as well as in front of professional oversight and licensing agencies. She is a member of the Kansas Association of Hospital Attorneys, Kansas Association of Defense Counsel, American Health Lawyers Association, and recently authored the Kansas chapter of the AHLA publication, "Data Breach Notification Laws: A Fifty-State Survey."

Ms. Iyer is a certified legal nurse consultant with extensive experience assisting attorneys with professional liability and personal injury cases. She is president of Med League Support Services, Inc., a 25-year-old independent legal nurse consulting firm. She is past president and current member of the American Association of Legal Nurse Consulting (AALNC). This group consists of self-employed legal nurse consultants, as well as those who work in insurance companies and law firms. She was given AALNC's Lifetime Achievement Award in 2005. She is a current member of the American Nurses Association and a member of the American Association of Healthcare Risk Management. Along with three other editors, she was the chief editor of Nursing Malpractice, 4th edition, published by Lawyers and Judges Publishing Company.
Yolanda Sims, JD, MHA

Ms. Sims provides KaMMCO members with an understanding of loss prevention and risk management issues in the health care field through education and information based on legal research. She interacts daily with a broad array of health care
providers and administrators from hospitals, health systems, and physician practices that seek risk advice on various matters such as health information privacy, federal and state regulatory requirements, and policy development. Ms. Sims holds a joint degree, (JD/MHA) from St. Louis University, School of Law and School of Public Health with a certification in Health Law. She is a member of the Kansas and Missouri Bar Associations, the American Society for Healthcare Risk Management, and the Association of Corporate Counsel.

Daniel O'Connell, PhD

Over the last 35 years, Dr. O'Connell has worked as an educator, consultant, clinician, department chair, and executive director in medical, behavioral health, and educational settings. He is a consultant to The Institute for Healthcare Communication and serves on the faculty of the Foundation for Medical Excellence. He teaches in the Residency Programs at the University of Washington School of Medicine, and for residents and attending physicians at the University of California, Los Angeles. He maintains a coaching and consulting practice working primarily with health care organizations and individual providers on all aspects of the psychology of medicine, leadership in health care settings, and professional interactions. Dr. O’Connell develops educational programs for health care providers, groups, and institutions and has led more than 500 workshops on various topics in the psychology of relationships and
communication in health care. He created a program for the disclosure and resolution of adverse medical outcomes that is widely taught in the United States and Canada.
