On behalf of the Jawaharlal Nehru University (JNU), New Delhi, Communication and Information Services (CIS) invites sealed tender (Technical and Commercial) for Development of JNU official website.
The present website is http://www.jnu.ac.in . JNU wish to replace this site with a content-management system (CMS) containing a modular structure and work-flows and accessible to PWDs and visually impaired. Website would be bi-lingual (English & Hindi version) using Unicode compliant and portal capabilities for its intranet and dynamic WebPages.
Sealed tenders are invited by Jawaharlal Nehru University (JNU) from reputed, well experienced and qualified CMS based website and portal designing reputed capable companies developing such state of the art CMS based website of the Jawaharlal Nehru University.

Introduction
The existing website of Jawaharlal Nehru University (JNU) can be accessed at http://www.jnu.ac.in both for English and Hindi contents. The existing website provides vast amount of information through various sections/ web pages. The site provides information on history and background of the University, and also furnishes up to date account of Academic structure, Programs/ Courses offered, Admission (Prospectus, Forms, Results), Faculty members, Research & Seminar, Management Development Program, Placement, Student, Jobs, Tenders, News & Events and Announcement, Alumni, GIS maps and intranet portal etc. The existing vision of the Web Portal for Jawaharlal Nehru University (JNU) plans to have a dynamic state-of-the-art web portal which would truly reflect and add to the University’s vibrant academic environment and campus life but the difficulty is it has been observed that over the years the traffic on JNU’s website (www.jnu.ac.in) has increased significantly. The existing website is not compatible with new versions of technology, requirement of the JNU and has many interoperability challenges.
Objective
This entails a working blend of creative and latest responsive CMS based web technologies and Eye – Catching presentation of information, accessible to PwDs, alongwith portal capabilities in bilingual i.e. English & Hind. The website should be elegant and uncluttered in look and user friendly in its layout and content, capabilities to allow transaction and integrated with payment gateways, accessible through the smart devices. Hence, require a mobile version of JNU’s website also for a smaller screen and limited speed both for English and Hindi contents:
a) Technical changes required in Jawaharlal Nehru University (JNU) existing website structure and thus to draw up a detailed migration specification for this.
b) To draw up the appropriate specification for the smart phone version of Jawaharlal Nehru University (JNU) website. The website should be adaptive on different devices.
c) To draw up the appropriate specification for JNU’s mobile app for the CMS based website with portal based capabilities.
e) Platform for Website, Mobile Website and Mobile Applications
i. It has been suggested that a single platform (of technology) is required on which the above three services will run. At present the technology of existing website is not compatible with other advanced technologies.
ii. We are looking for a website that Adaptive Design (i.e. adapts to desktop, tablet and Smartphone devices based on screen-size)
Scope of Work
The JNU website should be designed with a view to giving maximum exposure to content and design. The site will display the full range of University activities and functions. Website should be accessible to all users including persons with visual impairment, hearing impairment, physical impairment, learning disabled including the intranet web-portal design and development. The website design, development and testing stages ensure that the website is compliant with International accessibility standards, best practices and security standards. The website contents will be developed and made available both in English and Hindi Languages. The hardware and hosting of the website will be provided by JNU.
Look and feel with aesthetics design, good color combination, background and screens, structure and layout, easy navigation facility to upload documents and other information and allowing users to define the period for which document is available on the site. Facility to add corrigendum / addendum / amendments to main tender document through appropriate links should be provided enabling the visitors to view the main and linked documents in an integrated manner. The Website should be developed using Free and Open Source Software (FOSS) solutions for platform independence using the specific Content Management Software and web analytics on all Operating System, along with following features:
• Alignment with JNU’s current business strategies and business goals, with easy adaptability to effect direction and content changes as and when the current strategic goals change.
• Interactive presentation of content.
• Collecting information from visitors by enticing them to providing feedback or post comments. • User friendly with easy to navigate features and easy to use functions.
• Faster download of pages.
• User should be able to reach the required page within 2 to 3 clicks.
• The Sections like ‘what new’, ‘latest updates’, ‘Tender’, ‘Vacancy’ etc. must be dynamic. • Provide for extensive Website analytics and statistics: covering traffic reports, visitor analysis,
duration analysis, content wise analysis, top landing pages and top exit pages, other statistics and reports as may be required by JNU.
• Support for visually impaired and otherwise disabled or challenged users
• User administration services as part of a comprehensive Content Management System which should be integrated into the Website design
• Support to create microsites / web portals within a main website using a subdomain / virtual directory
• To provide customizable automated templates
• Scalability to incorporate EduERP, File Tracking, Online Recruitment MOODLE, LMS, EGovernace applications etc.
• Latest stable versions of software be used as on date of implementation • Perform periodic updation of all softwares including their dependencies
• To design and develop the website as per GOI guidelines in Hindi and English with CMS , compliant to PwDs Guidelines and ability to add more languages (No Google translation to be used).
• Comprehensive search facility of individual section of the website as well as entire website both in English and Hindi.
• Graphical, Pictorial and audio video interfaces, wherever and whenever needed. • To prepare the administrative interface for content entry by JNU.
• To prepare the administrative section of the website for bilingual content. • Conversion of content as per GOI guidelines in the approved time line by JNU. • Addition of content as per the requirement.
• Extensive training should be provided to users at JNU related to Department / Faculty, etc. Additionally a separate training should be provided to Web Administrator.
• To provide clearance of website from CERT-In empanelled agency or any Government of India Agency for security audit certificate / safe to host certificate
Technical Requirements
The requirement of the website platform mentioned below:
• Operating System (OS), Data Base, Web Service, Web development language, Screen Designing : On Open Source Platform
• The entire website with portal capabilities should be based on Web 2.0 and robust CMS based technologies.
• Disaster Recovery and Business Continuity Plan: A detailed DRP/BCP for the Website services should be submitted as a part of the proposal.
Design
• The desired navigation structure, general functionalities and reference points for the design will be discussed with the successful Bidder prior to start of work. In this context, the University will also be open to design & development suggestions from the successful Bidder.
• The website will be based on a Content Management System (CMS) like Joomla, Drupal etc. • Three theme-based template prototypes will be developed by the Solution Provider for the
chosen CMS having the flexibility to change color / font / menu themes. One of the prototypes will be finalized by the University for Actual Development and deployment.
• The existing content and feature of the JNU website will be migrated to the new redesigned website that will be hosted on a University server on an appropriate Linux platform.
• The site design must be cross-browser and cross-OS compatible up to the most recent browser / OS versions.
• Support for three platforms: Desktop/Tablet or Notebook and Mobile form factors • Multi-site and Micro-site support
• Content of the website should be readable using any Screen Access Reader Software for Visually Challenged
• W3C standard
• Weightage will be given to capabilities in templating, theme-design and security capabilities of the bidder
• Faculty information page, Academic Program, Management Development Program (MDP), Research & Seminar page design etc.
• We want Faculty/ Staff display directory information. Hence, it is enable RSS and XML Feeds on data.
• Feedback form with integration of e-Mail to respective area.
• The portal should support Web 2.0 based tools such as RSS feeds, Blogs, Chats, Podcasts etc. • The website should have a Moodle feature integrated within it for allowing student teacher
interface for individual courses
• Feature of email which is involving sending automated replies, tracking, reporting and download Statistics etc.
• The website should incorporate necessary security features against hacking and defacement. All logins and payments transaction must operate on secure protocols. It should provide support for website security audit.
• The portal should comply fully with the guidelines issued from time to time by the Government of India and the Government of NCT of Delhi for development of websites.
• Multi-lingual content – Ability to create content in multiple languages. It is expected that the basic site will be in English and Hindi (No Google translation to be used). If content is not translated, the link should show English content by default. Ability to add more languages in future.
• The web portal should be integrated with GIS maps of the campus and the schools/department/areas should be plotted on GIS maps using which public can view the campus area with the parameters to be provided by CIS for GIS.
• The application should be responsive and browser compatible • Data must be stored in optimized manner in the scalable database. • Synchronization of web portal data capabilities with database • Web portal should have session management capabilities • Should have role based authentication and functionalities
• Should have user management, roles and rights management module for administrator integrated with LDAP of the university.
• Should have application based backup and restore facility including integration of Third party backup and restore facility
• Repository of the database must be maintained within the database along with the data description
• The application must be platform independent
• Data entry screens must have the provision of saving the draft data
• The portal must be capable of supporting decentralized as well as centralized processing • Utilize modern workflow capabilities in streamlining interactions among functional processes • Provide application development tools to support the continuous development/refinement of
applications.
• Provide interactive validation of data entry by users
• The portal should have a feature to interact by the way of email and SMS.
• Public (parents, researchers, policy makers, officials) should be able to submit feedback through feedback Mechanism. These should be categorized as specified.
• The necessary and already available data should be pre populated into the entry forms to reduce the entry work and this will also increase the consistency of the data.
• A mobile app (Android, windows and iOS) for the web portal with complete functionality should be made available.
• All the suggestions in the due course of time should be incorporated into the CMS based web portal until made Go Live. The changes after Go-Live will come under Change Management process and will be taken care by the onsite resident engineer as per the contract agreement.
• It should have provision of proper logs , audit trails and security signed by the approved agencies of the government.
Content Management System (CMS)
• Enable in-house content creation using a variety of design templates. • Intuitive and easy-to-learn interface for the non-technical user.
• WYSIWYG and Drag-and-Drop interfaces wherever applicable and possible. • Draft and publish functionality.
• Page review by specific users prior to publishing with commenting capabilities.
• Auto-archive pages when they reach a pre-determined age. Configuration of age-out should be controlled via the administration.
• Version control with revision history: time stamp and username captured along with version number.
Search
• It should provide a search module for efficient information retrieval. Search capability that allows users to find content easily, including from uploaded media.
• SEO-friendly development, including at a minimum: appropriate use of alt tags, content-specific URLs (custom override URLs a nice-to-have feature), header tags, clean and hierarchical page architecture, and use of quality metadata. The CMS have must all the above features.
Analytics
• Integrate Google Analytics and best practices development for easy access to analytics • A portal to a Google Analytics dashboard in the admin panel is a nice-to-have feature • Control Panel feature

User-Based Permissions

Data Import
Payment Gateway
• Facilitate online payments (through Direct Debit or Debit and Credit Cards of multiple Banks) through the Portal. Provide interface and access to the external payment gateway for enabling the online payment services. Payment Gateway services should provide complete audit functionality for tracking and monitoring/reconciling the financial transactions taking place through JNU. Is case of unsuccessful transactions the Payment gateway should be able to refund the amount to the calling account.

JNU will host an e-Forms section for use by JNU members in requesting services such as Conference, Workshop, Seminars etc. These services are normally requested via filling an application form. This section of the portal site will allow users to fill in the service form online and submit the form to the concerned department for processing. It should also include:
• back end integration with databases • uploading of photographs
• attachment of supporting documents in PDF format • provision of scanned signatures
• generating receipt by users for future references
Training
Proposals should include comprehensive training to technical staff on configuration, audit reports, and management of the site. The team member responsible for training department managers on using the new site should be included in the proposal. A proper KT shall be conducted by the vendor before sign off the project completion and application goLive.
Support and Maintenance
• Identify the resources needed internally and externally to support the new website after its launch. Include a budget for the external resources and describe the internal resources, i.e., skills, anticipated workload, roles, responsibilities, and workflows. Ongoing support costs should be included in the proposal. and should include, but are not limited to, the following:
• Content management system upgrades, including minor fixes to custom code or design to accommodate deprecated features or CMS changes that negatively affect the page design or function
• Work with IT department to ensure that proper backups are in place for the site • Implement new features
• Maintain compatibility with social media sites as APIs are changed or updated • Improve site performance and compact/repair database as required
• Support for normal maintenance including bug-fixing, required adjustments, modifications, or alterations in the website for a period of one year from the date of commissioning of the site.
Copyrights and Trade Marks
• The source code, text, design, trademarks, photos and graphics in editable mode, or other artwork furnished in designing of the new website shall be owned by JNU upon completion of the successful implementation of website by bidder. Complete documentation, source code of the website has to be provided as it should be copyright to JNU.

Time Schedule
The complete site design, development and migration of content shall be completed within 60 days from the issue of supply order for which an activity wise time chart would be prepared and adhered to.
Within 15 days of the start of work, the template prototypes of the proposed system have to be submitted for approval.
Review
The progress of the work will be reviewed between the JNU and the Solution Provider on a weekly basis upon commencement of the start of work.
On-site development
The bidder will assign their technical staffs to work on this project on-site for better understanding and smooth flow of the work.
The bidder will develop CMS based website using advanced/latest technology.
The bidder will provide the hardware and software and other necessary items to their technical staff on their own cost.
General Terms & Conditions of Bid
1. Bid Submission: Two Bid System (Technical Bid and Financial Bid):
A.) The two bid system will be followed for this tender. Bidder is advised to carefully read this tender document before submitting their bid. In this system bidder must submit his offer in two separate sealed envelopes under Main Envelop as explained below.
I. Envelope No.1 “Technical Bid”
II. Envelope No. 2 “Financial Bid”
Both the envelops should then be sealed in a third envelop marked as “TENDER FOR CMS BASED WEBSITE FOR JAWAHARLAL NEHRU UNIVERSITY” and submitted to The Director, Communication & Information Services, Room No. 218, Administration Building, Jawaharlal Nehru University, New Delhi- 110067 during normal office working hours up to 3:00pm latest by 20.6.2016.
B.) First envelope shall be marked as Technical Bid and should contain: • One Demand Draft for Earnest Money Deposit (EMD).
• Companies Registration Certificate in case of Companies or Partnership Deed in case of firms or Self Proprietary Declaration in case of Proprietary Firm.
• All the documents establishing Bidder’s eligibility and qualification mentioned in the Bid Document.
C.) Second envelope shall be marked as Financial Bid which will contain price schedule in the prescribed Performa in Annexure V with any supporting financial bid documents, if required.
D.) The Bid shall be clearly printed and legibly signed by the Bidder or a person or persons duly authorized to bind the Bidder to the Contract. A Written power-of-attorney accompanying the bid should support the latter authorization.
The person or persons signing the bid shall initial all pages of the bid.
E.) Any inter-lineations, erasures or overwriting shall be valid only if they are signed by the person(s) signing the bid.
F. ) Bidders will be selected by the following steps given as under:
i. Short-listing of eligible vendors satisfying the technical qualification requirements, evaluation criteria laid in this Tender document.
ii. The Financial Bids of only those Bidders will be opened whose Technical Bids would clear the technical evaluation specified in the criteria.
iii. Selection of bidder as the Service Provider based on the lowest price quotes and meets the qualification requirements from the technically qualified short listed vendors.
G.) Eligibility Criteria
Bidder should qualify the following eligibility criteria:
a. The bidder should be a Company registered under the Companies Act, 1956 with their registered offices in India and should be operational for last 5 years.
b. The bidder must be registered with Service Tax, Sales Tax department and should have valid PAN number and Service Tax Number.
c. The bidder should have Service support in Delhi NCR.
d. The bidder should have a minimum of five years of experience in developing & maintenance services of websites/portals/web applications.
e. The bidder should have executed three similar projects.
f. The bidder should have executed at least two projects of the State/Central Government, Universities/Institutes. The Bidder will have to give proof of such clients with their contact numbers (as per Annexure III).
g. The bidder must have service tax registration and should be income tax assesses.
h. Bidders should not be under a declaration of ineligibility for corrupt and fraudulent practices. A self-declaration Certificate should be enclosed (as per Annexure IV).
i. The bidder must have minimum annual turnover of Rs 35 lakhs in each of the last 3 (three) financial years. Copy of the audited balance sheet and Profit & Loss Accounts for last three financial years (2012-13, 2013-14, and 2014-15) should be submitted.
j. Signed copy of tender document and corrigendum (if any) should be submitted along with bid.
k. Consortiums are not allowed.
l. The Bidder should have the capability of handling multi lingual projects and should attach proof / certificate from at least 2 referenceable clients for whom multilingual websites were done.
1.H) Technical Bid and Proof of Concept (POC):
i. The bidders shall be asked to present minimum 3 design templates for the JNU on their understanding of the JNU requirement and the presentation shall be followed by a 15-30 minute discussion.
ii. The proposal should address each work area in sufficient detail to demonstrate a clear understanding of the proposed design, including technology use develop the CMS based website with portal capabilities, framework, operations and maintenance. The bidder should provide evidence of sufficient planning to show that work will be accomplished as required and on schedule, utilizing all available resources.
iii. The design templates presented by the bidder POC should demonstrate compliance with all the mandatory requirements mentioned in the TENDER and also demonstrate extra capabilities. During the POC presentation, one technical person from the vendor organization should be present to answer queries and to demonstrate various capabilities.
iv. The bidder will be expected to provide details their past experience in specific contracts of this type. They will also be asked to provide information on performance in these contracts, and present testimonials from previous or existing clients. They will be asked to furnish details of key personnel, both supervisory and technical. Resumes of personnel must include education, experience, background, accomplishments, and other pertinent information.
vi. It is expected that minimal changes to the CMS be made to allow easy continuity, scalability and extensibility as and when the base CMS is upgraded.
1. I) Technical EVALUATION PROCEDURE
The evaluation of Technical bids will be made on the following parameters. Out of 100 marks, bidders obtaining/scoring minim 70 marks/out of 100 marks will only be eligible for the commercial opening of the bids. The award of contract for technically eligible bidders will be purely on the basis of total lowest price quoted by the bidder.
The Technical bids will be scrutinized on the basis of basic responsiveness, solution proposed. Thereafter, the pre qualification short listed bidders would be required to make presentations before the Technical Evaluation Committee.

1. J) Financial Bid:
i. The bidder who have successful qualified of the Technical Bid will eligible for Financial Bid. Only the technically qualified bidders will be called by the financial opening of the tender
ii. The rate may be quoted for Financial Bid in a separate envelope mentioning “Financial Bid” in a sealed cover with signature of authorized person.
iii. The Financial Bid should contain the rate against each item separately. All admissible taxes and duties, if any must be indicated.
iv. The technically qualified bidder with total lowest financial bid (L1) will be awarded the contract.
2. Deadline for Submission of Bids:
• Bids must be received by the JNU at the specified address, not later than the time and date specified in the Invitation for Bids. In the event of the specified date for the submission of Bids being declared as a holiday for the JNU, the bids will be received up to the appointed time on the next working day.
• The JNU may, at its discretion, extend this deadline for submission of bids by amending the bid documents, in which case all rights and obligations of The JNU and Bidders subject to the deadline will thereafter be subject to the deadline as extended.
• Any bid received by the JNU after the deadline for submission of bids prescribed by the JNU will be rejected and/or returned unopened to the Bidder.

Electronic Submissions: Electronic submissions in response to this Request for Proposal will not be accepted. All submissions must be on paper and all papers should be duly signed.
A Technical Bid meeting scheduled will be informed to vendor.
4. Documents Establishing Bidder’s Eligibility, Qualification and Conformity
a. Balance sheet of last three yearsb. Documents in support of successful execution of projects from the client. c. Certificate of capability (Performa in Annexure II).
d. The Bidder shall furnish, as part of its bid, documents establishing the eligibility and conformity to the bidding documents of the Service / Solution, which the Bidder proposes to provide under the contract (Performa in Annexure III).
5. Check-List for the Documents Submitted with the Bid
a. The Bid Document can be downloaded from the JNU website.b. The Company should be running for the last five years supported by Balance Sheet of Last Three years.
c. Completion of three Projects of similar nature in last 5 years and documents in support thereof from the concerned organizations.
d. Demand Draft of EMD (earnest money deposit) valid for 120 days
6. Earnest Money Deposit
a. The Bidder shall furnish, as part of its bid, an Earnest Money Deposit (EMD) in the form of a DD drawn in favour of Finance Officer, JNU for Rs. 25,000/- (Twenty Five thousand only) and payable at New Delhi.
b. The EMD shall be in Indian Rupees only.
c. Unsuccessful Bidder’s EMD will be discharged / refunded as promptly as possible but not later than 30 working days after the decision on the financial bid is taken.
d. The successful Bidder’s EMD will be kept as performance guarantee and will be discharged on the successful completion of the project.
e. The EMD shall be forfeited:
1. If a Bidder withdraws its bid during the period of Bid validity specified by the Bidder on the Bid Form, or
2. In case of a successful Bidder, if the Bidder denies to accept the work
f. No exemption for submitting the EMD will be given to any agency except NSIC registered bidders.
7. Period of Validity of Bids
a. Bids shall be valid for 90 days from the date of bid opening. A bid valid for a shorter period shall be rejected by the JNU as non -responsive.
b. In exceptional circumstances, the JNU may solicit the Bidders consent to an extension of the period of validity. The request and response thereto shall be made in writing.
c. Bid evaluation will be passed on the bid prices without taking into consideration the above changes.
8. Payment and Other Terms & Conditions
i. Work Order:
a. The JNU will award the work to the Technically Successful bidder, whose bid has been determined as the total lowest price evaluated bid. The Successful Bidder will be notified in writing & The Bidder will confirm the same in writing.
The decision taken by the JNU in the process of Tender evaluation will be full and final and binding on all the bidders.
b. The Work Order has to be accepted by the bidder signing and returning an acknowledgement copy of it within 5 working days. Acceptance of this Work Order shall effect a contract agreement between the Parties under which the rights and obligations of the Parties shall be governed solely by the terms and conditions of this Work Order.
c. The JNU reserves the right to accept the tender either in full or in part. Conditional tenders will be rejected outright.
d. The JNU reserves the right to summarily reject an offer received from any agency on national security considerations, without any intimation to the bidder.
e. The JNU reserves the right to place an order for the full or part quotations under any items of work mentioned in the scope of work.
ii. Payment Term:
100 % payment for first year against successful migration of the web site to the chosen CMS platform deployed with the selected template design, layout and the desired functionality and training as per the SOW and after submission of Bank guarantee of 10% of the total purchase order valid for 14 months. The AMC and onsite Resident engineer’s payment for the 2nd & 3rd year will be done accordingly on quarterly basis at the end of the quarter.
iii. Delay in the Bidder's performance
Any delay of work from the approved schedule would invite a penalty of Rs. 200 per day by the way of deduction from the EMD amount.
Undue delay by the Bidder in the performance of it's contract obligations shall render the Bidder liable to any or all of the following sanctions:
i) Forfeiture of its security deposit.
ii) Termination of the Contract for default.
iv. Penalty Clause
If the Solution Provider is not executing the contract to the satisfaction of the JNU, the JNU may invoke any or all of the following clauses applicable at that stage of the project.
i) Forfeit the Security Deposit AND/OR EMD
ii) Terminate the contract by giving a one month notice.
iii. Delivery Terms (Timeline):
• The Project shall be completed in Three Months from the date of issue of work order and the website must be up and running in productive use.
• The vendor must clearly state his/her development methodology along with a phase wise list of deliverables. Roles and Responsibilities of the vendor and FSM must clearly be stated at a task level. The project milestones and dates must be clearly stated in a tabular form in the proposal. The Detailed Project plan in MS Project however may be submitted within one week from the date of acceptance of work order.
• The successful bidder shall make a Presentation of User Interface and Design Document (for approval) after first two weeks from issue of work order and thereafter a weekly status update of the project progress.
9. Interpretation of the Clauses in the Tender Document
In case of any ambiguity in the interpretation of any of the clauses in Tender Document, the JNU's interpretation of the clauses shall be final and binding on all parties.
10. Corrupt or Fraudulent Practices
The JNU requires that the Bidders under this tender observe the highest standards of ethics during the procurement and execution of such contracts. In pursuance of this policy, the JNU
• Corrupt practice means the offering, giving, receiving or soliciting of any thing of value to influence the action of any JNU official in the procurement process or in contract execution; and
• Fraudulent practice means a misrepresentation of facts in order to influence a procurement process or a execution of a contract to the detriment of the JNU and includes collusive practice among Bidders (prior to or after bid submission) designed to establish bid prices at artificial non-competitive levels and to deprive the JNU of the benefits of the free and open competition.
b. Will reject a proposal for award if it determines that the Bidder recommended for award has engaged in corrupt or fraudulent practices in competing for the contract in question.
c. Will declare a firm ineligible, either indefinitely or for a stated period of time, to be awarded a contract if it at any time determines that the firm has engaged in corrupt and fraudulent practices in competing for, or in executing, a contract.
d. The past performance of the Bidder will be crosschecked if necessary. If the facts prove the same to be dubious, the Bidders tender will be ineligible for further processing.
11. Resolution of Disputes
The bidder shall make every effort to resolve amicably, by direct negotiation, any disagreement or dispute arising between them under or in connection with the any of the or part of the terms and conditions of the contract.
An appeal against the order may be referred to the competent authority of JNU as a sole arbitrator whose decision shall be final and binding on both the parties.
If within thirty days from the commencement of such negotiations, the bidder has been unable to resolve dispute amicably, either party may the matter for resolution to the Vice Chancellor, JNU who will decide it on merit.
The matter regarding any dispute shall be referred for arbitration to any Officer appointed by the Vice-Chancellor JNU, whose decision shall be binding and final.
12. Legal Jurisdiction
All legal disputes are subject to the jurisdiction of Delhi Courts only.
If a firm quotes 'Nil' charges/considerations the bid shall be treated as unresponsive and will not be considered in terms of the O.M No. 29(1)/2014 PPD dated 28.1.2014 of the Ministry of Law/Ministry of Finance.
Any claims, disputes or differences arising out of or in connection with this contract and which cannot be settled by mutual consultation, shall be referred to an arbitrator appointed by the Vice-Chancellor. The award of arbitrator shall be final and binding upon the parties of the contract. The arbitral procedures shall be governed by the Arbitrator and Conciliation Act, 1996 and shall be conducted in JNU.
All or any claim(s), dispute(s) or difference(s) arising out of or in connection with the contract shall be subject to the exclusive jurisdiction of the courts at New Delhi Only.
13. Binding Clause
All decisions taken by the JNU regarding the processing of this tender and award of contract shall be final and binding on all concerned parties.
14. Copyright
The Successful Bidder will hand over all the source code, graphics, templates, documents etc., developed or used in connection with the execution of this work, to the Jawaharlal Nehru University for the purpose of copyright and intellectual ownership. The JNU will have complete rights over the developed website and its associated content, graphics and software infrastructure.
15. The JNU reserves the right:
To verify, modify, revise, amend or change, cancel any of the terms and conditions mentioned above or to reject any or all the tender/s without assigning any reason whatsoever thereof or may terminate the tender process midway without assigning any reason.
