Third-Party Defendant/Second Third-Party Defendant, SANDRA

LEILA SCHREIBER by her attorneys, PATTERSON & SCIARRINO,

L.L.P., as and for Third-Party Defendant/Second Third-Party Defendant’s Response to Verified Bill of Particulars and Notice to Produce dated July 19, 2017, in accordance with the demands of DANIEL LAPP, LEANORE LAPP, ETTELE LAPP and WILLIAM LAPP by their attorneys, Wilson, Elser, Moskowitz, Edelman & Dicker, LLP, alleges upon information and belief as follows:

1. PLAINTIFF’S BILL OF PARTICULARS: See NYSCEF under

index number for this matter: 701843/2017.

2-4. Third-Party Defendant/Second Third-Party Defendant

objects to this demand as it is in the form of an

interrogatory, evidentiary in nature and beyond the scope of CPLR § 3043. Notwithstanding and without waiving our objection, DANIEL LAPP, LEANORE LAPP, ETTELE LAPP and WILLIAM LAPP possess an easement over the “common driveway” and/or “shared driveway” which affords them access to their individual properties. As

such DANIEL LAPP, LEANORE LAPP, ETTELE LAPP and WILLIAM LAPP had a duty to maintain the “common driveway” and/or “shared driveway” in a reasonably safe condition. That as a result of DANIEL LAPP, LEANORE LAPP, ETTELE LAPP and WILLIAM LAPP’s

breach of the agreement and/or common law, DANIEL LAPP, LEANORE LAPP, ETTELE LAPP and WILLIAM LAPP are liable for contribution and indemnification.

5-10. Third-Party Defendant/Second Third-Party Defendant objects to this demand as it is in the form of an interrogatory, evidentiary in nature, beyond the scope of CPLR § 3043, and not proper for a Bill of Particulars. Notwithstanding and without waiving our objection, the Third-Party Defendant/Second Third-Party Defendants’ acts or omissions on the date of the alleged accident constituting their contributory negligence, assumption of risk and culpable conduct consisted of the following: in failing to maintain, manage and control the “common driveway” and/or “shared driveway” (hereinafter “driveway”) in a reasonably safe and suitable condition; in negligently creating a dangerous condition in the “common driveway” and/or “shared driveway” for residents, invitees and guests; in allowing and permitting the existence of a buildup of ice/snow in the driveway area causing a hazard and danger to persons traveling thereon; in allowing the driveway area to be in a dangerous condition; in failing to

properly shovel the subject driveway; in failing to remove snow and/or ice from the subject driveway; in failing to spread salt and/or sand on the subject driveway; in affirmatively creating the dangerous condition in negligently removing ice and snow from the subject driveway; in failing to inspect the subject driveway; in causing, permitting and allowing a trap, hazard and nuisance to be and exist for an excessive and unreasonable period of time, despite actual and constructive notice thereof, in failing to take necessary steps to alleviate said condition; in failing to undertake proper and/or adequate safety studies and/or surveys; in failing to properly shovel and/or clear the subject driveway before authorizing its use; in failing to erect barricades, or otherwise restrict use of the subject driveway to prevent a hazard, trap and nuisance from endangering the general public; in failing to warn the general public of the subject hazard, trap and nuisance; in permitting and allowing the aforesaid condition to exist at the subject driveway; in failing to properly maintain the subject driveway; in negligently repairing the subject driveway; in failing to inspect the subject driveway; in affirmatively causing and creating the dangerous condition; in failing to prevent the aforesaid accident, which was foreseeable; in being otherwise negligent, careless, reckless and grossly negligent under the circumstances; in allowing and permitting snow and

ice to accumulate in the subject driveway area causing hazard and danger to the people traveling thereon; in allowing and permitting the premises and driveway to be and remain in an icy and slippery condition; and in failing to properly inspect their property. The Third-Party Plaintiffs will request that the Court take judicial notice of the specific sections violated at the time of trial. SANDRA LEILA SCHREIBER reserves her right to supplement and amend this response prior to and at the time of trial.

NOTICE TO PRODUCE

1. WITNESS(ES): Other than those witness(es) presently

known to the plaintiff, DANIEL LAPP, LEANORE LAPP, ETTELE LAPP and WILLIAM LAPP, SANDRA LEILA SCHREIBER is not presently aware of any witness(es) regarding the alleged accident.

2. PHOTOGRAPHS/SURVEILLANCE VIDEO: Upon information and

belief, SANDRA LEILA SCHREIBER is not in possession of any photographs and/or surveillance video pertaining to the alleged accident.

STATEMENTS: Upon information and belief, SANDRA LEILA

SCHREIBER is not presently in possession of any adverse party statements.
