the subject and approval mentioned above,

it

is to

inform

you

that Bangladesh

Telecommunication Regulatory Commission (BTRC

Commission) has approved

the

service on

International (end-to-end) Multi-Protocol

Level

Switching

(MPLS) Circuit

in

favour

of

the

valid International Intemet Gateway

(IIG)

and Intemet Service Provider (ISP) licensees (only Nationwide, Central Zone and Zonal licensees) of the Commission with the following citation, preamble, business

operation and connectivity, tariff strucfure, terms and conditions.

Preamble

Presently international telecommunication services for point to point connectivity are provided mostly

by IPLC network which

is

costly. The provision of the MPLS network would reduce the cost and

which

is

also ensuring

the

monitoring requirements such as service control, application control,

enhanced

traffic

classification, better troubleshooting, centralized martagement, real-time and long-term reporting, ensured high performance etc. This service-approval

will

facilitate the use of MPLS

Circuit

for

the cost effective altemative solution

of

IPLC

in

data network. The Commission looks

forward to create better professional business environment for BPOs, call centres, software developers,

data centers, content providers, content delivery platforms, online editing and designing services etc.

Business-Operation

&

Connectivitv

1.

The

IIGs

are

only

allowed

to

contract

/

negotiate

with the

intemational-carrier and/or

international-subscriber

to

provide International MPLS Circuit either ways. On the other hand, ISPs are only allowed to contract

/

negotiate with domestic-subscribers to provide MPLS Circuit.

In both the cases, during service provisioning, international-carrier must have MPLS Network to Network Interface OrNI) with the IIG only.

2.

No

international-carrier shall install any node inside Bangladesh,

by

violating abovementioned Clause No: f . in whatsoever circumstances.

3.

The entity

having

the

business-contract

with the

subscriber

/

International MPLS Circuit or, the ISP for Domestic MPLS Circuit) provider regarding this very service.

4.

In

case

of

International

MPLS Circuit, the

Access

Network

Service (last-mile solution) in Bangladesh

will

be provided through the ISP's Domestic-MPLS

/

Ethernet network. Moreover, that ISP

will

be treated as service-partner for the service of International MPLS Circuit.

5.

In case of International MPLS Circuit, the

NNI

must be established between International-Carrier

and

IIG.

On the other hand,

in

case of Domestic MPLS Circuit, the

IIG

shall facilitate

/

provide

the Network to Network Interface G.INI)

to

interconnect

with

the ISP(s). However,

in

both the cases, the

MPLS

Circuit(s) shall be completed (either Originated

or

Terminated) through the

Bangladeshi ISPs only as the Access Network Service (last-mile solution).

6.

In case of either International or Domestic MPLS Circuit, the IIGs shall remain solely responsible

to

ensure

the

Lawful

Interception

(LI)

vis-d-vis

the

Deep Packet Inspection

(DPI)

for

the Commission and the Law Enforcement Agency (LEA).

7.

IIGs

are authortzed

to

split

the bulk-resource(s)

to

ensure

the

optimum utilization

of

MPLS

Circuit.

8.

IIGs

and ISPs

shall

provide

the

IP

addresses

of

local

and remote

end

information

to

the

Commission. Moreover,

IIGs

must maintain necessary monitoring system

to

monitoring the

MPLS Circuit established through its network / systems.

9.

IIGs and ISPs shall have to give proper justification for their pattern

of

data-usage as and when asked

by

the Commission. Moreover, the service and

its

associate network arrangements and connectivity shall abide by the ILDTS Policy, 2010.

10.

MPLS Circuit is intended primarily for data services only. No commercial voice

tariffis

allowed over MPLS network. Thereafter, connectivity-provisioning

with

Public Telephone Network(s),

such as CMPO, PSTN, IPTSP is not allowed under this service.

The very service shall be provided as per the ITU-T Recommendation No: G.81 13. 1 I Y .1372.1

of

November 2012 or any variant standardized later on.

12.

All

the

stakeholders (International-Carrier,

ILDC,

IIG,

ISP,

End-User

on Both

End)

shall endeavour to ensure their connectivity as per the depicted network-topology of MPLS Circuit.

Tariff

Structure

13.

The IIG(s) and ISP(s) may have their internal business model (either Revenue-Share or Rental-Resource), which shall have to work analogously with the service-tariff.

14. The business-contract (service level agreement) between the IIG and ISP (in every applicable case) shall be decided by the bilateral-contract between the applicable

IIG

and ISP. This provision may also apply for the NNI Porting Charge (in case of Domestic MPLS Circuit) in form of MRC.

15.

All

the approved

tarif(s)

are exclusive

of all

sorts of applicable

VAT

and Tax and the

tarif(s)

should be considered as the maximum applicable rate, the operator(s) may offer discounted

tariff

than the approved maximum rate.

No

installation, other (new/hidden) fees/charges, other than

specified in the refened document, shall be there with these service(s).

16.

The following Tariff-Structure

is

only applicable

for

International MPLS Circuit. Whereas, the

18.

International MPLS Service Provider and/or International Carrier(s) are recommended

to

share 50%

of

the revenue

with

IIG

(due

to

half-circuit concept). Moreover,

IIG

shall endeavour to ensnre at least 90% of the total revenue of MPLS Circuit from Intemational MPLS Circuit part.

Operator(s) should not deviate from the approved features, modality and tariff-structure other than

acquiring the modified/revised Service

&

Tariff Approval from the Commission. General Terms

&

Conditions

19.

This very letter shall take effect from the date of issuance of this letter and the approval referred above shall be treated as void from the same date as well.

20.

The certified copy

of

the said bilateral-contract

I

SLA regarding the MPLS Circuit(s) shall be submitted to the Commission for information purpose.

21.

This service-approval shall only be applicable for the valid IIG and ISP licensee(s) of BTRC.

22.

IIGs shall have to share its annual gross revenue (as Revenue Share as per the

IIG

License) with

the Commission maintaining separate account for service(s) based on MPLS Circuit.

23.

Both the IIGs and ISPs shall endevour to ensure the Grade

of

Service (GoS), Quality of Service

(QoS) and Quality of Experience (QoE) according to the National and International Standards (i.e.

ITU, IETF, IEEE, ETSI, ISO, FCC, BTRC EtC.)

24.

The Commission reserves

the

exclusive

right

and authority

to

amend/reconsider the service/

tarifflaforementioned clauses regarding this issue,

if

necessary, without any prior notification.
