2. Project Overview

a. The Project includes the renovation of approximately 1,700 SF within TJ Majors Building. The existing office spaces (316 and 317), will be renovated into 4 new offices, and training areas including model apartment, jail cell and simulator room.

b. The Criminal Justice program is new to Peru State College and the simulator is unique to the region. In addition to students enrolled in the program, the simulator will be used by community partners for training. The state Legislature approved the appropriation funding. The announcement of the project received national media coverage and may see additional press as the project moves into construction. Schedule and quality of work will be important to maintain.

c. The TJ Majors building was originally built in 1917, but building systems were updated in 2014.

Can you please share the contact information for Darrin Reeves? I would like to ask him a few questions

about the building construction.

RESPONSE: Darrin is listed as the Owner’s Representative in Specification Section 011000 – Summary.

Any questions regarding the building should be submitted by RFI to Architect for interpretation to be

issued by Addendum.

2.

Will the water closet in the prison cell be by owner? If by contractor, will you want faucet’s in it? The current

model called out would only have the holes for the faucets and drain.

RESPONSE: Yes, refer to revised specifications and drawings issued with this Addendum.

3.

Are there any owner supplied items besides painting and the existing carpet?

RESPONSE: Yes, refer to revised specifications and drawings issued with this Addendum.

4.

Will the painting scope of work include staining the doors?

RESPONSE: Yes, Contractor scope of work to include staining wood doors.

5.

Will the pollution liability insurance (section A.3.2.9) be required on this project? Our policy limit is

$500,000 which should be sufficient for this project and we hate to add costs to the project that do not benefit

the owner.

RESPONSE: No, refer to revised specifications issued with this Addendum.

6.

Will an area be available for the general contractor to have a desk in a room near the work space?

RESPONSE: Yes, location to be determined prior to start of construction.

7.

Will restrooms in the facility be available for contractor use?

RESPONSE: Yes, as indicated in the General and Supplementary Conditions.

8.

Can we assume that the deck above the existing acoustical ceiling is fully rocked?

RESPONSE: Yes.

9.

Painting walls and ceiling by owner. Will they also paint the hollow metal frames and detention frame and

door?

RESPONSE: Refer to revised specifications and drawings issued with this Addendum.

10.

Is the sink black or white it is noted both ways on the schedule? Is it ok if the vanity is open in the front at the

toe kick? Can you offer a number on the vanity you want or maybe a picture?

1.4 WORK COVERED BY CONTRACT DOCUMENTS

A. The Work of Project is defined by the Contract Documents and consists of the following:

1. Existing office spaces (316 and 317) on Level 3 of T J Majors Hall will be renovated into 4 new offices, and training areas including model apartment, jail cell and simulator, totaling about 1,700 SF. Renovation work includes interior finishing and related construction including interior partitions and doors, in addition to minor mechanical, lighting and power updates, fire sprinkler heads are to be relocated for the new layout.

2. Work is divided into Alternates ad indicated in Section 012300. B. Type of Contract:

1.5 WORK BY OWNER

1.6 General: Cooperate fully with Owner so work may be carried out smoothly, without interfering with or delaying work under this Contract or work by Owner. Coordinate the Work of this Contract with work performed by Owner.

1.7 Concurrent Work: Owner will perform the following construction operations at Project site. Those operations will be conducted simultaneously with work under this Contract.

1.8 Owner will provide materials and labor for carpet installation and paint for wall, ceiling, hollow metal doors and hollow metal door frames.

1.9 OWNER-FURNISHED PRODUCTS

A.

This article defines responsibilities of Owner and Contractor for Owner-furnished products.

B. Owner will furnish products indicated. The Work includes receiving, unloading, handling, storing, protecting, and installing Owner-furnished products.

1. Owner-Furnished Products: a. As indicated on Drawings.

1.10 COORDINATION WITH OCCUPANTS

1.11 Partial Owner Occupancy: Owner will occupy the premises during entire construction period, with the exception of areas under construction. Cooperate with Owner during construction operations to minimize conflicts and facilitate Owner usage. Perform the Work so as not to interfere with Owner's operations. Maintain existing exits unless otherwise indicated.

1.12 Maintain access to existing walkways, corridors, and other adjacent occupied or used facilities. Do not close or obstruct walkways, corridors, or other occupied or used facilities without written permission from Owner and authorities having jurisdiction.

1.13 Provide not less than 72 hours' notice to Owner of activities that will affect Owner's operations.

1.14 WORK RESTRICTIONS

A. Work Restrictions, General: Comply with restrictions on construction operations.

1. Comply with limitations on use of public streets and with other requirements of authorities having jurisdiction.

B. On-Site Work Hours: Limit work in the existing building to normal business working hours of 7:00 a.m. to 6:00 p.m., Monday through Friday, unless otherwise indicated.

1. Weekend Hours: Coordinate with Owner. 2. Early Morning Hours: Coordinate with Owner. 3. Hours for Utility Shutdowns: Coordinate with Owner.

C. Existing Utility Interruptions: Do not interrupt utilities serving facilities occupied by Owner or others unless permitted under the following conditions and then only after providing temporary utility services according to requirements indicated:

1. Notify Owner not less than seven days in advance of proposed utility interruptions. 2. Obtain Owner's written permission before proceeding with utility interruptions.

D. Noise, Vibration, and Odors: Coordinate operations that may result in high levels of noise and vibration, odors, or other disruption to Owner occupancy with Owner.

E. Nonsmoking Building: Smoking is not permitted within the building or within 25 feet (8 m) of entrances, operable windows, or outdoor-air intakes.

F. Controlled Substances: Use of tobacco products and other controlled substances on Project site is not permitted.

G. Employee Identification: Contractor personnel working on Project site shall abide by Campus Services requirements for access to the campus.

H. Contractor shall certify they operate a drug-free workplace and for the duration of the term of the contract will be incompliance with the provisions of the Drug-Free Workplace Act of 1988.

1.15 SPECIFICATION AND DRAWING CONVENTIONS

A. Specification Content: The Specifications use certain conventions for the style of language and the intended meaning of certain terms, words, and phrases when used in particular situations. These conventions are as follows:

1. Imperative mood and streamlined language are generally used in the Specifications. The words "shall," "shall be," or "shall comply with," depending on the context, are implied where a colon (:) is used within a sentence or phrase.

2. Specification requirements are to be performed by Contractor unless specifically stated otherwise. B. Division 01 General Requirements: Requirements of Sections in Division 01 apply to the Work of all

Sections in the Specifications.

C. Drawing Coordination: Requirements for materials and products identified on Drawings are described in detail in the Specifications. One or more of the following are used on Drawings to identify materials and products:

1. Terminology: Materials and products are identified by the typical generic terms used in the individual Specifications Sections.

2. Abbreviations: Materials and products are identified by abbreviations published as part of the U.S. National CAD Standard and scheduled on Drawings.

ADDENDUM NO. 1 SECTION 002113 - INSTRUCTIONS TO BIDDERS

PART 1 - GENERAL

1.1 PROJECT DESCRIPTION

A. The Board of Trustees of the Nebraska State Colleges dba Peru State College, herein called “Owner”, will receive bids for the construction of the Peru State College Criminal Justice Department Renovation located in Peru, NE.

1.2 PROPOSALS

A. Proposals will be received until 2:00 pm, local time, January 19,2021at the Administration Building, Room 311, Peru State College, Peru, NE 68421.

1. Bids will be publicly opened and read aloud. B. Bids received after closing time will not be considered.

C. Means of submittal delivery including all attachments thereto may be via courier, or mail at the option of the bidder. Receipt of the bid at the designated location prior to closing time remains the sole

responsibility of the bidder regardless of the delivery method.

Please be advised that no mail or package carrier guarantees overnight delivery to Peru,

Nebraska. Package must be sealed and designated prominently, CRIMINAL JUSTICE

DEPARTMENT RENOVATION.

D. Bids submitted by electronic facsimile will not be accepted. 1.3 METHOD OF BIDDING

A. One combined proposal shall be submitted for all Work, including General Construction Work, Mechanical Work, and Electrical Work.

1.4 EXAMINATION OF PREMISES AND CONTRACT DOCUMENTS A. Before submitting a bid, each bidder must:

1. Examine the Contract Documents thoroughly,

2. Visit the premises to become familiar with local conditions that may in any manner affect performance of the Work,

3. Become familiar with Federal, State and Local laws, ordinances, rules and regulations affecting performance of the Work, and

4. Carefully correlate those observations with the requirements of the Contract Documents. B. The submission of a bid will serve as a representation by the bidder that they have complied with the

requirements of the above paragraph. 1.5 PREPARATION OF PROPOSAL

ADDENDUM NO. 1 A. Each bidder must obtain a blank form of proposal from the office of the Architect or as attached herewith and prepare and submit a proposal thereon. Proposals from parties who are not known to be regularly and practically engaged in the class of Work called for by the Bidding Documents will not be considered. B. Each proposal (and the attached Bid Bond documents when required) must bear an original blue ink

signature of the bidder and/or the agent of the bidder.

C. Each proposal must be submitted in a sealed envelope bearing on the outside the name of the bidder, bidder’s address, and the name of the Project for which the bid is submitted.

1.6 BOND

A. The successful bidder awarded the Contract will be required to furnish performance and payment bonds in the full amount of the Contract.

1.7 BIDDING DOCUMENTS

A. The bidding documents may be examined at the following:

A. The Owner reserves the right to reject any or all bids or to waive any informalities in the bidding. B. No bidder may withdraw a bid for a period of thirty (30) days subsequent to the receipt of bids without

the consent of the Owner.

1.9 TOUR OF EXISTING BUILDING

A. A tour of the existing building will be conducted at 10:30 a.m., CST, on January 6, 2021 by

representatives of the Owner and the Architect. The purpose of this tour is to familiarize the bidders with the existing conditions. No minutes or memoranda will be published as a result of this tour and it will be the responsibility of each bidder to be represented.

B. If unable to attend scheduled tour of existing building, bidder shall schedule visit to the site with the Owner. Bidders shall contact Darrin Reeves at 402.872.2309 to schedule a site visit.

1.10 BID SECURITY

A. A certified check, cashier’s check or an acceptable bidder’s bond (AIA A310) payable to the Owner in an amount not less than 5 percent of the largest possible total amount for the bid submitted, including the consideration of additive alternates, if any, must accompany each proposal. Such checks or bid bond will be returned to all except the three lowest bidders within 5 days after the receipt of bids, and the remaining checks or bid bonds will be returned promptly after the Owner and the accepted Bidder have executed the

ADDENDUM NO. 1 Contract, or if no award has been made within 30 days after the bid receipt date, upon demand of the bidder. The successful bidder, upon failure or refusal to execute and deliver the Contract and bonds required within 10 calendar days after receipt of notice of the acceptance of a bid, shall forfeit to the Owner, as liquidated damages for such failure or refusal, the security deposited with this bid. 1.11 NEBRASKA SALES AND USE TAX

A. The Bidder is not required to include local option sales and use taxes in the proposal. 1.12 BUILDING PERMIT FEE

A. The Contractor shall pay the building permit fee for this Project. Bidders shall be responsible for all other required permits, including mechanical, electrical, and plumbing permits.

B. The Owner has paid to the State Fire Marshal’s office, an amount of $75.00 for the fire code (and the handicap accessibility) plan review fee. Bidders shall credit this amount against any building permit required for the Project and the credit shall be reflected in their bid.

1.13 DEFINED TERMS

A. Terms used in these Instructions to Bidders which are defined in the General Conditions of the Contract for Construction, Document A201 – 2017 Edition, shall have the meanings assigned to them in the General Conditions.

1.14 QUALIFICATIONS OF BIDDERS

A. To demonstrate qualifications for the Project, each bidder must be prepared to submit within five calendar days of the Owner’s request, written evidence such as financial data, previous experience, and evidence of authority to conduct business in the jurisdiction where the Project is located.

1.15 INTERPRETATIONS

A. All questions about the meaning or intent of the Contract Documents shall be submitted to the Architect in writing no later than January 12, 2021. Replies will be issued by Addenda no later than January 15, 2021 mailed or delivered to all parties recorded by the Architect as having received the Bidding

Documents. Questions received less than seven calendar days prior to the date for receipt of bids will not be answered. Only questions answered by formal written Addenda will be binding. Oral and other interpretations or clarifications will be without legal effect.

1.16 POST BID INFORMATION

A. After January 19, 2021, 2:00 P.M. receipt of bids, provide an electronic pdf attachment of the proposal, in addition to the physical hard copy for distribution and evaluation purposes only. Electronic copy of proposal to be provided on a flash drive, OR emailed to [email protected],

B. Unless waived by the Architect, the Bidder shall, within seven days of notification of selection for the award of a Contract for the Work, submit the following information to the Architect:

ADDENDUM NO. 1 2. The proprietary names and the suppliers of principal items or systems of material and equipment

proposed for the Work.

3. A list of names of the subcontractors or other persons or organizations (including those who are to furnish materials or equipment fabricated to a special design) proposed for the principal portions of the Work.

C. The Bidder will be required to establish to the satisfaction of the Architect and the Owner the reliability and responsibility of the proposed subcontractors to furnish and perform the Work described in the sections of the Specifications pertaining to such proposed subcontractors respective trades.

D. Prior to the award of the Contract, the Architect will notify the Bidder in writing if either the Owner or the Architect, after due investigation, has reasonable and substantial objection to any person or organization on such list. If the Owner or Architect has a reasonable and substantial objection to any person or organization on such list, and refuses in writing to accept such person or organization, the Bidder may, at Bidder’s option, (1) withdraw the bid, or (2) submit an acceptable substitute subcontractor with an increase in the bid price to cover the difference in cost occasioned by such substitution. The Owner may, at Owner’s discretion, accept the increased bid price or disqualify the Bidder. In the event of either withdrawal or disqualification under this subparagraph, bid security will not be forfeited, not withstanding anything to the contrary in Paragraph "Bid Security" of this Section.

E. Subcontractors and other persons and organizations proposed by the Bidder and accepted by the Owner and the Architect must be used on the Work for which they were proposed and accepted and shall not be changed except with the written approval of the Owner and the Architect.

F. Before a Contract is executed, the successful Bidder shall supply to the Architect the following: 1. A schedule of wage rates in effect at the time the Contract is to be dated.

2. Amounts of overhead and profit which are proposed to be added to Change Orders involving additional Work.
