In 2018, a lawsuit was filed in the United States Court of Appeals for the Ninth
Circuit against the United States Environmental Protection Agency (EPA) as a
result of the re-approval of conditional registration of Dicamba OTT (Over the
Top) of XtendiMax
®
. Tavium® Plus VaporGrip® Technology was not a part
of the lawsuit.
After the court ruled against the EPA and vacated the XtendiMax
®
, Engenia
®
and FeXapan
®
registrations on June 3, 2020, the EPA on June 8, 2020 issued
a cancellation order for XtendiMax
®
, Engenia
®
and FeXapan
®
. The court
ruling did not apply to Tavium which maintained its registration.
On October 27, 2020, the EPA extended and amended the registration of
Tavium through December 20, 2025.
