we are concerned with your privacy and its protection. Therefore, we want you to know about our procedures for protecting your policy, and your right and responsibilities regarding recorded information about you. As our customer, we want you to understand how we gather information, how we protect it and how you can help insure its accuracy.
This information is provided to you in accordance with the Federal Fair Credit Reporting Act, Public Law 91-508, and the Privacy Laws of your state.
WHAT KIND OF INFORMATION IS COLLECTED ABOUT YOU
We get most of our information directly from you. In most cases, the application you complete gives us all the informa-tion we need to evaluate you or your property for insurance. Should we need additional information or want to verify infor-mation you have given us, we will contact you, either by phone or mailed questionnaire. Once you have been insured with us for a period of time, your record may contain informa-tion related to any claims you made under your policy.
In some insurance transactions, we may not be able to get all the information we need directly from you. In that case, we may obtain information from outside sources at our own expense. For example, with auto insurance, we routinely obtain a record of accidents, violations and convictions from your State Motor Vehicle Department and/or C.L.U.E. Similarly, we may ask a doctor who has treated you to con-firm or give us more details about medical information you have given us.
We may get information by personal or telephone inter-views or by writing members of your family, friends, neigh-bors, employers, insurance agents or other insurance companies with whom you have applied for a policy, and oth-ers who you know. Sometimes, before we ask for information from one of these sources, we may ask you to sign an AUTHORIZATION, which gives us the right to proceed.
In some instances, we will have your insurance agent contact the sources described above to get the additional information we need. However, it is common for an insurance company to ask an independent source to help it verify infor-mation and add to inforinfor-mation given on an application. There are many such companies, which are commonly called “con-sumer reporting agencies,” which are in the business of being an outside, independent source of information to insurance companies. If we retain an agency to gather information for us, we will choose one that is discreet and impartial. We may only ask such an agency to verify the address, marital status or other information you have given us in your application. If
Such reports are used to help us decide if you qualify for the insurance for which you have applied. The consumer reporting agency would obtain information about you in the same way that we would. That is, they will contact persons you know. If the agency prepares a report on you, it may deal with your mode of living, character, general reputation and personal characteristics, such as your health, job and finances. When it is applicable, such a report could also have information on your marital status, driving record, job duties, drug or alcohol use, dangerous sport activities or any official record or criminal activity.
On insurance for homes, buildings or boats, for example, if we asked an independent agency to prepare a report, the agency would send out an investigator to view your property and verify information on your application. The report would contain information on the value and condition of your prop-erty, and would frequently contain a photograph of it. Similarly, on insurance for personal property, such as jewelry, antiques or art, you may be required to obtain a report pre-pared by an appraiser. Only in a rare case would we ask for an investigator or consumer report in connection with an auto policy. If we did, information in that report would relate to your driving record, use of the automobile, drug or alcohol use and similar details.
The information we receive about you from an independ-ent reporting agency will be treated in the same confidindepend-ential way in which we treat the information you gave us on your application. However, the information collected by the agency may be retained by them and later shared with others who use these reports. It will be given to others only to the extent permitted by the Federal Fair Credit Reporting Act and your state’s Fair Credit Reporting Act, if it has one.
If we use an independent reporting agency to prepare a report on you, you have the right to be personally interviewed by them. Information you give the agency during an interview will be included in the report sent to us. If you wish to be inter-viewed, please tell us how the agency can contact you, and every effort will be made to interview you.
Even if you are not interviewed, you have the further right to request that the reporting agency provide you with a copy of the report it makes. To do so, contact your agent. We, in turn, will provide you with the name and address of any agency we have used to prepare a report on you so that you can contact them directly to find out more about the report. WHAT WE DO WITH INFORMATION ABOUT YOU Information about you will be kept in our policy records. We will refer to and use that information for purposes related to issuing and servicing insurance policies and settling claims.
Without your prior authorization, we may, as permitted by law, share information about you contained in our files with certain persons or organizations. The types of persons or organizations with which we may share information include: 1. your agent, broker or sales representative,
agencies as it is needed in connection with any applica-tion, policy or claim involving you,
5. an insurance-support organization which is established to collect information for the purpose of detecting and pre-venting insurance crimes or fraudulent claims,
6. a medical professional to inform you of a medical condi-tion of which you may not be aware,
7. persons or organizations that conduct scientific research, including actuarial studies, management audits, financial audits or program evaluations,
8. our affiliated companies or

ENDORSEMENT
THIS ENDORSEMENT CHANGES THE POLICY. PLEASE READ IT CAREFULLY.
This Endorsement is a part of your policy. Except for the change it makes, all other terms of the policy remain the same and apply to this Endorsement. It is effective at the same time as your policy is issued with it. If issued at a later date, the name, policy number and effective date must be shown.

This policy does not insure against loss, damage, costs (including defense) or expenses in connection with any kind of description of seepage, pollution, contamination including mold, debris removal or cost of clean up, direct or indirect, arising from any cause whatsoever.
Nevertheless, if a fire policy is attached to this Endorsement and a fire arises directly or indirectly from seepage, pollution, contamination, debris removal and/or clean up, any loss or damage insured under this Policy arising directly from that fire

This policy does not insure against loss, damage, costs, expenses, fines or penalties incurred or sustained by or imposed on the Insured at the order of any governmental authority, court or other authority arising from any cause whatsoever.
This policy does not apply to any:
A. Liability, including defense, arising out of the actual, alleged or threatened discharge, dispersal, spill, release or escape of pollutants, contamination, debris removal or clean up:
(1) At or from premises owned, rented or occupied by the named insured;
(2) At or from any site or location used by or for the named insured or others for the handling, storage, disposal, processing or treatment of waste; (3) Which are at any time loaded or unloaded from a
covered auto or transported, towed, handled, stored, treated, disposed of or processed as waste by or for the named insured or any person or organization for whom the named insured may be legally responsible; or
(4) At or from any site or location on which the named insured, employee or any contractor or subcon-tractor working directly or indirectly on behalf of the named insured, is performing operations: (a) If the pollutants are brought on or to the site
or location in connection with such opera-tions; or
(b) If the operations are to test for, monitor, clean up, remove, contain, heat, detoxify or neutral-ize pollutants;
(5) Bodily Injury or Property damage except when caused by heat, smoke, or fumes from a hostile fire; B. Loss, cost or expense arising out of any governmental direction or request that the named insured test for, monitor, clean up, remove, contain, treat, detoxify or neutralize pollutants.
The words “hostile fire” are used herein to mean a fire which becomes uncontrollable or breaks out from where it was intended to be.
The word “pollutants” as used herein shall mean any solid, liquid, gaseous, or thermal irritant or contaminant, including, but not limited to, smoke, vapor, soot, fumes, acids, alkalis, chemicals and waste. Waste includes materials to be recycled, reconditioned or reclaimed.
It is the intent and effect of this provision to exclude any or all coverages afforded by this policy for any claim, action, judgement, liability, settlement, defense or expenses in any way arising out of a discharge, dispersal, release or escape of pollutants whether such results from the Insured’s activities or the activities of others and whether or not such is sudden, gradual, accidental, intended, foreseeable, expected, fortu-itous, inevitable and wherever or however such occurs. *Entries may be left blank if shown elsewhere in this policy for this coverage.
THIS ENDORSEMENT CHANGES THE HOMEOWNERS COVERAGE FORM. PLEASE READ IT CAREFULLY.
SCHEDULE
The limits of liability shown on the Declarations for this Endorsement (CC-26) apply to the total of all loss or costs payable under this endorsement, regardless of the number of “occurrences”, the number of claims-made, or the number of locations insured under this endorsement and listed in this Schedule.
1. Section I — Property Coverage Limit of Liability for the Additional Coverage “Fungi”,
Wet or Dry Rot, or Bacteria. Total Limit of Liability $5,000

The following definition is added: “Fungi”
a. “Fungi” means any type of form of fungus, including mold or mildew, and any mycotoxins, spores, scents or by-products produced or released by fungi. b. Under Section II, this does not include any fungi that
are, are on, or are contained in, a good or product intended for consumption.
SECTION I — PROPERTY COVERAGES E. Additional Coverages
The following Additional Coverage is added: 13. “Fungi”, Wet or Dry Rot, or Bacteria
a. The amount shown in the Schedule above is the most we will pay for:
(1) The total of all loss payable under Section I — Property Coverages caused by “fungi”, wet or dry rot or bacteria;
(2) The cost to remove “fungi”, wet or dry rot, or bacteria from property covered under Section I — Property Coverages;
(3) The cost to tear out and replace any part of the building or other covered property as needed to gain access to the “fungi”, wet or dry rot, or bacteria; and
to, during or after removal, repair, restoration or replacement. The cost of such testing will be provided only to the extent that there is a reason to believe that there is the presence of “fungi”, wet or dry rot, or bacteria.
b. The coverage described in 13.a. only applies when such loss or costs are a result of a Peril Insured Against that occurs during the coverage period and only if all reasonable means were used to save and preserve the property from further damage at and after the time the Peril Insured Against occurred.
c. The amount shown in the Schedule for this cover-age is the most we will pay for the total of all loss or costs payable under this Additional Coverage regardless of the:
(1) Number of locations insured under this endorsement; or
(2) Number of claims-made. SECTION II — CONDITIONS
Condition 1. Limit of Liability is elected and replaced by the following:
A. Limit of Liability
Our total liability under Coverage E for all damages result-ing from any one “occurrence” will not be more than the Coverage E limit of liability shown in the Declarations. This limit is the same regardless of the number of “insureds”, claims-made or persons injured. All “bodily injury” and “property damage” resulting from any one accident or from continuous or repeated exposure to sub-stantially the same general harmful conditions will be con-sidered to be the result of one “occurrence”.
Our total liability under Coverage F for all medical expense payable for “bodily injury” to one person as a result of one accident will not be more than the Coverage F limit of liability shown in the Declarations.
However, our total liability under Coverage E for the total of all damages arising directly or indirectly, in whole or in part, out of the actual, alleged or threatened inhala-tion or ingesinhala-tion of, contact with, exposure to, existence of, or presence of any “fungi”, wet or dry rot, or bacteria will not be more than the Section II — Coverage E — Aggregate Sublimit of Liability for “Fungi”, Wet or Dry Rot, or Bacteria. That sublimit is the amount shown in the Schedule. This is the most we will pay regardless of the: 1. Number of locations insured under the coverage forms
to which the endorsement is attached; 2. Number of persons injured;
3. Number of persons whose property is damaged; 4. Number of “insureds”; or
5. Number of “occurrences” or claims-made.
This sublimit is within, but does not increase, the Coverage E limit of liability. It applies separately to each consecutive annual period and to any remaining period of less than 12 months, starting with the beginning of the coverage periods shown in the Declarations.
With respect to damages arising out of “fungi”, wet or dry rot, or bacteria described in 1. Limit of Liability of this endorse-ment, Condition 2. Severability of Insurance is deleted and replaced by the following:
B. Severability of Insurance
This insurance applies separately to each “insured” except with respect to the Aggregate Sublimit of Liability described in this endorsement under Section II — Conditions, A. Limit of Liability. This condition will not increase the limit of liability for this coverage.

All other provisions of the homeowner coverage form apply. PERSONAL PROPERTY COST
BROADENED COVERAGE (HO 00 02 AND HO 00 03 EXCEPT
3 AND 4 FAMILY) SECTION I
For an additional premium, covered losses to the following property are settled at replacement cost at the time of loss: a. Coverage C — Personal Property;
b. If covered in this policy, awnings, carpeting, household appliances outdoor antennas and outdoor equipment, whether or not attached to buildings.
(Condition 3. Loss Settlement does not apply to property described in paragraphs a. and b. above.)
Personal Property Replacement Cost coverage also applies to articles or classes of property separately described and specifically insured in this policy.
1. PROPERTY NOT ELIGIBLE
Property listed below is not eligible for replacement cost settlement. Any loss will be settled at actual cash value at the time of loss but not more than the amount required to repair or replace.
a. antiques, fine arts, paintings and similar articles of rar-ity or antiqurar-ity which cannot be replaced.
b. memorabilia, souvenirs, collectors items and similar articles whose age or history contribute to their value. c. articles not maintained in good or workable condition. d. articles that are outdated or obsolete and are stored or
not being used. 2. REPLACEMENT COST
a. We will pay no more than the least of the following amounts:
(1) replacement cost at the time of loss without deduction for depreciation;
(2) the full cost of repair at the time of loss; (3) the limit of liability that applies to Coverage C; or (4) any special limits of liability stated in this policy.

more than the actual cash value for the loss or dam-age until the actual repair or replacement is complete. c. You may make a claim for loss on an actual cash value basis and then make a claim within 180 days after the loss for any additional liability in accordance with this endorsement.
3. LIMIT OF LIABILITY
The limit of liability for Coverage C has been automatical-ly increased to 70% of the Coverage A limit of liability at no additional premium.
All other provisions of this policy apply.

For an additional charge, we will cover the items described in this endorsement which are scheduled on your Declarations Page. Each item is insured for a specific amount of insurance which replaced any other coverage that might be provided by the policy for the described items. This coverage is subject to the DEFINITIONS, SECTION I — CONDITIONS, SECTION I AND SECTION II — CONDITIONS of the policy and all provi-sions of this endorsement. The Section I deductible as shown on the Declarations Pages DOES NOT APPLY to this coverage. DEFINITIONS
1. “COMPUTER PROGRAM” means DATA in the form of instruction used to direct data processing equipment to perform a task.
2. “DATA” means facts, concepts or instructions that are recorded on MEDIA.
3. “MEDIA” means the material on which DATA is entered, such as magnetic tapes, disk packs or floppy disks. PROPERTY INSURED
We cover each of the below numbered types of property for which a limit of liability is shown in the Declarations. 1. Electronic home information and entertainment systems
including peripheral electronic and electro-mechanical processing equipment is scheduled. This class of proper-ty includes (a) video or sound systems; (b) data process-ing equipment; and (c) COMPUTER PROGRAMS and MEDIA purchased from a commercial source.
2. DATA recreation meaning the reasonable costs incurred to recreate DATA from source documents. We will not pay any costs related to obtaining or creating source documents. NEWLY ACQUIRED PROPERTY
We cover newly acquired property of a type already insured under this endorsement up to a limit of 25% of the amount of

property to us within 30 days of acquisition and pays the addi-tional charge from the data acquired.
PERILS INSURED AGAINST
We insure for risk of direct damage to the items scheduled except:
1. Wear and tear, gradual deterioration, insects, vermin, inherent vice.
2. War, including undeclared war, civil war, insurrection, rebellion, revolution, warlike act by a military purpose, and including any consequence of any of these. Discharge of a nuclear weapon shall be deemed a war-like act even if accidental;
3. Nuclear Hazard, to the extent set forth in the Nuclear Hazard Clause of Section I — Conditions.
4. Delay, loss of market, loss of income or interruption of BUSINESS.
5. Mechanical breakdown, faulty construction, error or omission in design. We will pay for direct loss caused by resulting fire or explosion.
6. Dishonest acts by an INSURED. Nor do we insure against dishonest acts by any persons entrusted with the property, except a carrier for hire;
7. Short circuit or other electrical disturbance within the property covered unless caused by power failure, origi-nating on or within 100 feet of the RESIDENCE PREMISES or lightning;
8. Dampness of atmosphere or extremes of temperature unless the direct cause of loss is rain, snow, sleet or hail; 9. Programming errors or incorrect instructions to the
machine;
10. When the described property is away from the RESI-DENCE PREMISES for BUSINESS use.
TERRITORIAL LIMITS
We cover the items scheduled while they are anywhere in the world, except as shown in exclusion 10 above.
CONDITIONS
1. Loss Clause: The amount of insurance under this endorsement shall not be reduced except for a total loss of scheduled item. We will refund the unearned premium applicable to such item after the loss or you may apply it to the premium due for the replacement item.
2. Loss Settlement: Covered property losses are settled as follows:
WE WILL NOT PAY MORE THAN THE LEAST OF THE FOLLOWING AMOUNTS:
a. Replacement Cost at time of loss without deduction for depreciation;
b. The full cost of repair at time of loss;
c. The amount of insurance applying to the lost or dam-aged items as shown on the declaration.
We will pay no more than the actual cash value of the loss or damage until repair or replacement is completed. You may then make claim for any additional liability on a replacement cost basis within 180 days after the loss.
SPECIAL PACKAGE ENDORSEMENT
For an additional premium, we cover the following: SECTION I — PROPERTY COVERAGES COVERAGE C — PERSONAL PROPERTY Special Limits of Liability, Item 5, is replaced by: 6. $2,000 for loss by theft of jewelry, watches, furs, precious
and semi-precious stones. We will not pay more than $1,000 for any one article.
Special Limits of Liability, Item 9 is replaced by:
10. $500 on property away from the residence premises used at any time or in any manner or any business purpose. COVERAGE D — LOSS OF USE
Section 3 is deleted and replaced by:

The amount we will pay is increased from $500 to $2,500.
9. Lock Replacement
We will pay up to $100 for locks and cylinders which are replaced as a direct result of stolen keys. We and the police must be promptly notified of the theft. The locks must be replaced within 72 hours after the keys are stolen. Keys are those to buildings and structures at the residence premises. We do not cover locks used with any vehicle, watercraft or aircraft. Keys given to a cus-todian are not considered stolen. We will pay the amount spent to repair or replace the locks or cylinder with ones of like kind and quality.
This coverage is extra insurance. No deductible applies.
10. Loss of food in a refrigerator or freezer.
We will pay up to $500 for damage to food stored in a freezer or refrigerator on the residence premises, when the loss is caused by a power interruption or breakdown. If you know of a loss, you must use all reasonable means to avoid further loss or this additional coverage is void. SECTION II — LIABILITY COVERAGES
PERSONAL INJURY COVERAGE
Under Coverage E — Personal Liability, definition bodily injuryis amended to include personal injury.
“Personal Injury” means injury arising out of one or more of the following offenses:

b. injury caused by a violation of a penal law or ordinance committed by or with the knowledge or consent of an insured;
c. injury sustained by any person as a result of an offense directly related to the employment of this person by the insured;
d. injury arising out of the business pursuits of an insured; or e. civil or public activities performed for pay by an insured. SECTION II — EXCLUSIONS
Exclusion 1f. under “This exclusion does not apply to”, item 3 is replaced by:
3. a motorized golf cart:
a. While used for golfing purposes on a golf course. b. While being driven to or from a golf course by an
insured off public roads.
Exclusion 2c. is deleted and replaced by:
c. Property Damage to property occupied or used by or in the care of the insured. This exclusion does not apply to property damage caused by fire, smoke, explosion or accidental discharge or overflow of water or steam from within a plumbing, heating or air condi-tioning system, or from within a household appliance or from rain or snow. If the property is in the residence premises and such damage is a result of the direct force of wind or hail to the building which causes an opening in a roof or wall and the rain or snow enters through this opening, then coverage does apply. Claim Expenses
Under c, the amount of expenses we will pay is increased from $50 to $75 per day.
Amended Personal Liability Coverage
a. The limit shown on the Declarations Page under Coverage E is raised by $100,000 for each occur-rence.
This insurance does not apply in three instances.
a. It does not apply to liability as a result of a business owned by or controlled by an insured or by a partner-ship or joint venture of which an insured is a partner or member.
b. It does not apply to liability as a result of rendering or failure to render professional services of any nature (other than teaching).
c. It does not apply to bodily injury to a fellow employee of the insured injured in the course of work.
All other provisions of this policy apply. GUARANTEED REPLACEMENT
COST ENDORSEMENT
(Applies only when loss to dwelling building exceeds the Coverage A — Limit of Liability shown in the Declarations) To the extent that coverage is provided, we agree to provide an additional amount of insurance in accordance with the fol-lowing provisions:
CH06-0289 (Ed. 4-04)
A. If you have:
1. Allowed us to adjust the Coverage A limit of liability and the premium in accordance with:
a. the property evaluation we make; and b. any increases in inflation; and
2. Notified us, within 30 days of completion, of any improvements, alterations or additions to the dwelling building which increase the replacement cost of the dwelling by 5% or more;
the provisions of this endorsement will apply after a loss, pro-vided you elect to repair or replace the damaged or destroyed dwelling building.
B. If there is a loss to the dwelling building that exceeds the Coverage A limit of liability shown in the Declarations, for the purpose of settling that loss only:
1. We will provide an additional amount of insurance, but in no case greater than 125%* of the Coverage A limit of liability; and
2. The Section I Condition 3. Loss Settlement paragraph b. is deleted and replaced by paragraph b., c., and d. as follows:
b. The dwelling building under Coverage A at replacement cost without deduction for deprecia-tion. We will pay no more than the smallest of the following amounts for like construction and use of the same premises:
(1) The replacement cost of that part of the dwelling building damaged or destroyed; (2) The necessary amount actually spent to
repair or replace the damaged or destroyed dwelling building; or
(3) The limit of liability under this policy that applies to the dwelling building, plus any addi-tional amount provided by this endorsement. c. We will pay no more than the actual cash value of
the damage until actual repair or replacement is complete.
d. You may disregard the replacement cost less set-tlement provisions and make claim under this pol-icy for loss or damage to the dwelling building on an actual cash value basis. You may then make claim within 180 days after loss for any additional liability on a replacement cost basis.
3. You agree to:
a. Report to us, within 60 days, any improvements to the dwelling. If you do not and the cost of these improvements exceeds $5,000 then the limit shown on your Declarations Page will again become the maximum limit.
b. Pay premiums recomputed, at renewal, to reflect the then current replacement cost of the dwelling and amount of increase shall be determined by reports of a recognized appraisal agency,
reflect-of the renewal premium will constitute acceptance of the revised limit.
*Entries may be left blank if shown elsewhere in this policy for coverage.
All other provisions of this policy apply. INFLATION GUARD ENDORSEMENT
At each renewal date, or at any other time during the policy term, the limits shown on the Declarations Page for Coverage A, B, C, and D, if applicable, may be changed. The new lim-its will reflect current costs in the area where the residence premise is located. These costs will be determined by an appraisal firm.
Your limit will never be lowered without your permission. This endorsement does not change the requirements of the Coinsurance Clause if it applies.
SUMP PUMP/BACK UP SEWERS AND DRAINS (HO 00 02, HO 00 03, HO 00 06 ONLY)
For an additional premium, we cover direct and accidental loss caused by water which backs up through sewers or drains or water which overflows from a sump pump system that is designed to remove subsurface water which is drained from the foundation area. This coverage applies to the described dwelling only and not other structures on the premises.
This coverage does not apply:
a. If the loss is caused by your negligence.
b. If the loss occurs by seepage or leakage over an extend-ed period of time.
c. If the loss occurs or is in progress:
(1) 5 days after the effective date of this coverage if added at the inception date or renewal date of this policy; or
(2) 30 days after the effective date of this coverage if added at any time other than the inception date or renewal date.
Under SECTION I — PERILS INSURED AGAINST, the fol-lowing paragraph of the Accidental discharge or overflow of water or steam peril is deleted:
“caused by or resulting from water which backs up through sewers or drains or water which enters into and overflows from within a sump pump, sump pump well or other type system designed to remove subsurface water which is drained from the foundation area,”
Under SECTION I — EXCLUSIONS, the following paragraph of the Water Damage exclusion is deleted:

LIMIT
The maximum limit of liability for damage caused by an occur-rence is the amount shown on the declarations page under this endorsement.

(4) loss that occurs by a seepage or leakage over an extended period of time and which is not caused by the failure of a sump pump itself.
2. Freezing of a plumping, heating, air conditioning or auto-matic fire protective sprinkler system or of a household appliance, or by discharge, leakage or overflow from with-in the system or appliance caused by freezwith-ing. This exclu-sion applies only while the dwelling is vacant, unoccupied or being constructed, unless you have used reasonable care to:
a. maintain heat in the building; or
b. shut off the water supply and drain the system and appliances of water.
3. Freezing, thawing, pressure or weight of water or ice, whether driven by wind or not, to a:
a. fence, pavement, patio, or swimming pool; b. foundation, retaining wall, or bulkhead; c. pier, wharf or dock.
4. Theft in or to a dwelling under construction, or of materi-als and supplies for use in the construction until the dwelling is finished and occupied.
5. a. wear and tear, marring and deterioration;
b. inherent vice, latent defect, mechanical breakdown; c. smog, rust, mold, wet or dry rot;
d. smoke from agricultural smudging or industrial opera-tions;
e. release, discharge or dispersal of contaminants or pol-lutants;
f. settling, cracking, shrinking, bulging or expansion of pavements, patios, foundations, walls, floors, roofs, or ceilings;
g. birds, vermin, rodents, insects or domestic animals. 6. a. Vandalism and malicious mischief or breakage of
glass and safety glazing materials if the dwelling has been vacant for more than 30 consecutive days imme-diately before the loss. A dwelling being constructed is not considered vacant.
b. Constant or repeated seepage or leakage of water or steam over a period of weeks, months or years from within a plumbing, heating, air conditioning, or auto-matic fire protective sprinkler system or from within a household appliance.
c. Involving collapse, other than as provided in Additional Coverages — 8. Collapse. However, any ensuing loss to property described in Coverage A not excluded or excepted in this policy is covered.
If any of these cause water damage not otherwise excluded, from a plumbing, heating, air conditioning or automatic fire protective sprinkler system or household appliance, we cover loss caused by the water including the cost of tearing out and replacing any part of a building necessary to repair the sys-tem or appliance.
We do not cover loss to the system or appliance from which this water escaped.
Under items (1) through (4), any ensuing loss to property described in Coverage A and C not excluded or excepted in this policy is covered.
7. a. breakage of:
(1) Eyeglasses, glassware, statuary, marble; (2) Bric-a-brac, porcelains, and similar fragile articles
other than jewelry, watches, bronzes, cameras and photograph lenses. There is coverage for breakage of the property by or resulting from: (a) fire, lightning, windstorm, hail;
(b) smoke, other than smoke from agricultural smudging or industrial operations;
(c) explosion, riot, civil commotion;
(f) water not otherwise excluded; (g) theft or attempted theft; or
(h) sudden and accidental tearing apart, crack-ing, bumping or bulging of:
(a) a steam or hot water heating system; (b) an air conditioning or automatic fire
pro-tective sprinkler system; or (c) an appliance for heating water.
b. dampness of atmosphere or extremes of temperature unless the direct cause of loss is due to rain, snow, sleet or hail;
c. refinishing, renovating, or repairing property other than watches, jewelry and furs;
d. collision, other than collision with a land vehicle, sink-ing, swamping or standing of watercraft, including their trailers, furnishings, equipment and outboard motors; e. destruction, confiscation or seizure by order of any
government or public authority;
f. acts of decisions, including failure to act or decide, of any person, group, organization or governmental body. However, any ensuing loss to property described in Coverage C not excluded or excepted in this policy is covered.
SECTION I — EXCLUSIONS
Under 1b. Earth Movement. The following paragraph is added:
This exclusion applies only to property described in Coverages A and B.
Under 1c. Water Damage. The following paragraph is added: Water damage to property described in Coverage C away from premises or location owned, rented, occupied or controlled by an insured is covered.
Water damage to property described in Coverage C on a premises or location owned, rented, occupied or con-trolled by an insured is excluded even if weather condi-tions contribute in any way to produce the loss.

Covered losses to the following property are settled at replacement cost at the time of loss:
a. Coverage C — Personal Property;
b. If covered in this policy, awnings, carpeting, household appliances, outdoor antennas and outdoor equipment, whether or not attached to buildings.
Condition 3 Loss Settlement, does not apply to property described in paragraphs a. and b. above.
Personal Property Replacement Cost coverage also applies to articles or classes of property separately described and specifically insured in this policy.
1. PROPERTY NOT ELIGIBLE
Property listed below is not eligible for replacement cost settlement. Any loss will be settled at actual cash value at the time of loss, but not more than the amount required to repair or replace:
a. antiques, fine arts, paintings and similar articles whose age or history contribute to their value; b. memorabilia, souvenirs, collectors items and similar
articles whose age or history contribute to their value; c. articles not maintained in good or workable condition; d. articles that are outdated or obsolete and are stored or
not being used.
2. REPLACEMENT COST CONDITIONS — COVERAGE C a. We will pay no more than the least of the following amounts and only when items are replaced, otherwise replacement is actual cash value with deduction for depreciation:
(1) replacement cost at the time of loss without deduction for depreciation;
(2) the full cost of repair at the time of loss; (3) the limit of liability that applies to Coverage A and
C; or
(4) any special limits of liability stated in this policy. b. When the replacement cost for the entire loss under
this endorsement is more than $500, we will pay no more than the actual cash value for the loss or dam-age until the actual repair or replacement is complete. c. You may make a claim for loss on an actual cash value basis and then make a claim within 180 days after the loss for any additional liability in accordance with this endorsement.

b. Constant or repeated seepage or leakage of water or steam over a period of weeks, months or years from within a plumbing, heating, air conditioning, or auto-matic fire protective sprinkler system or from within a household appliance.
c. Involving collapse, other than as provided in Additional Coverages — 8. Collapse. However, any ensuing loss to property described in Coverage C not excluded or excepted in this policy is covered.
If any of these cause water damage not otherwise excluded from a plumbing, heating, air conditioning or automatic fire protective sprinkler system or household appliance, we cover loss caused by the water including the cost of tearing out and replacing any part of a building necessary to repair the sys-tem or appliance.
We do not cover loss to the system or appliance from which this water escaped.
Under items (1) through (4), any ensuing loss to property described in Coverage A and C not excluded or excepted in this policy is covered.
7. a. breakage of:
(1) eyeglasses, glassware, statuary, marble; (2) bric-a-brac, porcelains, and similar fragile articles
other than jewelry, watches, bronzes, cameras and photograph lenses. There is coverage for breakage of the property by or resulting from: (a) fire, lightning, windstorm, hail;
(b) smoke, other than smoke from agricultural smudging or industrial operations;
(d) aircraft, vehicles and malicious mischief, earthquake or volcanic eruption;
(e) collapse of a building or any part of a building; (f) water not otherwise excluded;
(g) theft or attempted theft; or
(h) sudden and accidental tearing apart, crack-ing, bumping or bulging of:
(1) a steam or hot watter heating system; (2) an air conditioning or automatic fire
pro-tective sprinkler system; or (3) an appliance for heating water.
1) dampness of atmosphere or extremes of temperature unless the direct cause of loss is due to rain, snow, sleet or hail;
2) refinishing, renovating, or repairing property other than watches, jewelry and furs;
3) collision, other than collision with a land vehicle, sink-ing, swamping or standing of watercraft, including their trailers, furnishings, equipment and outboard motors;
4) destruction, confiscation or seizure by order of any government or public authority;
5) acts of decisions, including failure to act or decide, of any person, group, organization or governmental body. However, any ensuing loss to property described in Coverage C not excluded or excepted in this policy is covered.
SECTION I — EXCLUSIONS
Earth movement (Item 2), the following paragraph is added: This exclusion applies only to property described in Coverage C.
Water Damage (Item 3); the following paragraph is added: Water damage to property described in Coverage C away from premises or location owned, rented, occupied or controlled by an insured is excluded even if weather con-ditions contribute in any way to produce the loss. SECTION I — CONDITIONS
PERSONAL PROPERTY REPLACEMENT COST — COVERAGE C
Covered losses to the following property are settled at replacement cost at the time of loss:
a. Coverage C — Personal Property;
b. If covered in this policy, awnings, carpeting, household appliances, outdoor antennas and outdoor equipment, whether or not attached to buildings.
Condition 3 Loss Settlement, does not apply to property described in paragraphs a. and b. above.
Personal Property Replacement Cost coverage also applies to articles or classes of property separately described and specifically insured in this policy.
1. PROPERTY NOT ELIGIBLE
Property listed below is not eligible for replacement cost settlement. Any loss will be settled at actual cash value at the time of loss, but not more than the amount required to repair or replace:
a. antiques, fine arts, paintings and similar articles whose age or history contribute to their value; b. memorabilia, souvenirs, collector items and similar
articles whose age or history contribute to their value; c. articles not maintained in good or workable condition; d. articles that are outdated or obsolete and are stored or
not being used.
2. REPLACEMENT COST CONDITIONS — PERSONAL PROPERTY COVERAGE C
a. We will pay no more than the least of the following amounts and only when items are replaced, otherwise replacement is actual cash value with deduction for depreciation:
(1) replacement cost at the time of loss without depreciation;
(2) the full cost of repair at the time of loss; (3) the limit of liability that applies to Coverage C; or (4) any special limits of liability stated in this policy. b. When the replacement cost for the entire loss under
this endorsement is more than $500, we will pay no more than the actual cash value for the loss or dam-age until the actual repair or replacement is complete. c. You may make a claim for loss on an actual cash value basis and then make a claim within 180 days after the loss for any additional liability in accordance with this endorsement.
SECTION II — LIABILITY COVERAGE PERSONAL INJURY COVERAGE
Under Coverage E — Personal Liability definition bodily injury is amended to include personal injury.
“Personal injury” means injury arising out of one or more of the following offenses:
a. false arrest, detention or imprisonment or malicious prosecution;
b. libel, slander or defamation of character; or
c. invasion of privacy, wrongful eviction or wrongful entry. SECTION II — Exclusions do not apply to personal injury. Personal injury insurance does not apply to:
a. liability assumed by the insured under any contract or agreement except any indemnity obligation assumed by the insured under a written contract directly relating to the ownership, maintenance or use of the premises; b. injury caused by a violation of a penal law or ordi-nance committed by or with the knowledge or consent of an insured;
c. injury sustained by any person as a result of an offense directly or indirectly related to the employment of this person by the insured;
d. injury arising out of the business pursuits of an insured;
e. civil or public activities performed for pay by an insured.
3. A motorized golf cart:
accidental discharge or overflow of water or steam from within a plumbing, heating or air conditioning system, or from within a household appliance or from rain or snow. If the property is in the residence premises and such dam-age is a result of the direct force of wind or hail to the building which causes an opening in a roof or wall and the rain or snow enters through this opening, then coverage does apply.
SECTION II — ADDITIONAL COVERAGES CLAIMS EXPENSES
Under 1c., the amount of expenses we will pay is increased from $50 to $75 per day.
Amended Personal Liability Coverage
a. The limit shown on the Declarations Page under cov-erage E is raised by $100,000 for each occurrence. Part Time Business Pursuits of an Insured Under 18 Years of Age:
Section II also applies to part-time business pursuits of an insured who is under the age of 18.
This insurance does not apply in three instances: a. It does not apply to liability as a result of a business
owned by or controlled by an insured or by a partner-ship or joint venture of which an insured is a partner or member;
b. It does not apply to liability as a result of rendering or failure to render professional services of any nature (other than teaching);
c. It does not apply to bodily injury to a fellow employee of the insured in the course of work.
All other provisions of this policy apply. ANIMAL EXCLUSION
Coverage for bodily injury, medical payments or property damage sustained by any party caused by any domestic or non-domestic animal/pet that is kept, owned, or maintained, by any named insured of this policy, is excluded.

HOME ENTERTAINMENT CENTER COVERAGE
For an additional charge, we will cover the items described in this endorsement which are scheduled on your Declarations Page. Each item is insured for a specific amount of insurance which replaced any other coverage that might be provided by the policy for the described items. This coverage is subject to the DEFINITIONS, SECTION I — CONDITIONS, SECTION I AND SECTION II — CONDITIONS of the policy and all provi-sions of this endorsement. The Section I deductible as shown on the Declarations Pages DOES NOT APPLY to this coverage. DEFINITIONS
1. “COMPUTER PROGRAM” means DATA in the form of instructions used to direct data processing equipment to perform a task.
2. “DATA” means fact, concepts or instructions that are recorded on MEDIA.
