Subject: State of New Jersey v. Thomas Caggiano, Docket No. A-001721-10 Team 01 Delay in submitting data and pending motions to obtain court records illegally denied by various courts to prepare a brief for dismissal with prejudice and payment of attorney fee for Robert Mattia, filing fees, transcript fees and copying costs 1. This is a request for delay in fully responding to your request for documents concerning my filing noted in your letter of Dec 14,2010
2. This is a VERIFIED CERTIFIED AFFIDAVIT based upon my personal knowledge therefore can be used as evi-dence in New Jersey Courts.
3. My wife had a significant fall on Long Island and broke her wrist and suffered other bodily damage requiring emergency room visits for trauma in New York and seeing several doctors for a new cast. These actions have continued as she previously also had dizzy spells as she landed on her face.
4. Futhermore, I visited the Federal Department of the Treasury Special Agents in Las Vegas, noted on my pub-lished web site http://freedomnewsdigest.com and http://thomascaggiano.com as over two hundred pages of evidence was filed against dozens of Borough of Stanhope officials and employees and bribed apparent con-tractor professional engineers and professional planners with the Department of Community Affairs’ Local Fi-nance Board. I met Special Agent Brian Peng, Criminal Investigations, Internal Reveue Service, 110 City Park-way, Suite 200, Las Vegas, Nv 89106, 702-868-5113 and provided him and another Special Agent a CD of evi-dence proving tax fraud among dozens of persons in a vast criminal conspiracy as I at the direction of the Washington D.C. Office of Inspector General Special Agent in Charge am now a witness to the FBI in Washing-ton D.C., Newark, N.J. and Las Vegas, and the United States Postal Inspection Service in Chicago, IL for crimi-nal investigation of dozens of State, County and municipal officials for mail fraud and harrassment and have been with my wife a witness to the State Police of Official Corruption Bureau for years as my POC is Sgt Lit-tles-Floyd who works directly for the State Police and the Official Corruption Bureau as her telephone number is 609-882-2000 ext 6506.
5. To prepare a brief one needs access to court records and to provide your Division records per the Court rules such as a copy of the Transcript records on CD ROM and I needed to examine court records in the Bor-ough of Stanhope municipal court and the Township of Green wherein the municipal court kangaroo court hearings were held with the corrupt municipal prosecutor William Hinkes, Esq. the former law partner of the corrupt Sussex County Prosecutor David Weaver, Esq. who I filed Affidavits of Probable Cause for criminal con-duct by him and other Assistant Prosecutors and my wife Kathryn Caggiano also filed Affidavits of Probable Cause of crimina conduct against Judge Craig U. Dana, JMC as he theatened her with charges, banned her and my standby attorney Robert Mattia, Esq. who also filed motions of his unconstitutional trial and unconstiution-al sentencing. My filing with the Supreme Court’s Advisory Committee on Judicunconstiution-al Conduct against Judge Con-forti, JSC, Judge Craig U. Dana, JMC and Newton, Stanhope, Stillwater municipal Judge Mulhern, JMC are pub-lished on the web site http://thomascaggiano.com and included in the attached CD as adopted referenced ex-hibits to this VERIFIED CERTIFIED AFFIDAVIT as well as other reports to the Office of Attorney General’s De-partment of Law and Public Safety which were distributed by email, fax and letter to various offices in the U.S. Attorney Paul Fishman, Newark, NJ, the FBI in the locations noted above, the Office of Governor, District 24 representatives, the newspapers, Board of Chosen Freeholders, State Police Official Corruption Bureau, ACJC, OAC and the Office of Attorney Ethics which has taken over the investigation from the District XA Ethics Committee of Richard Stein, Esq. the Borough Attorney of Stanhope that committed perjury in Judge Dana’s court, committed perjury in over a dozen Statement of Information Requests responses to the corrupt Depart-ment of Community Affair’s GovernDepart-ment Record Council with its corrupt Office of Attorney General’s Division of Law’s GRC Deputy Attorney General Debra Allen, Esq. as proven in emails provided me in response to my
Open Public Record Act OPRA requests to the excellent GRC Sr. Case manager Frank Caruso. The 36 page re-port and motion to the corrupt Judge Conforti, JSC are also included on the CD.
6. In addition to my being a witness to the FBI and State Police Official Corruption Bureau others have re-ported the corruption of Judges and other corrupt Goverment Officials which included the former municipal clerk of the Borough of Stanhope Ms. Robin Kline, RMC, MAS and more recently the new Town Administrator Ri-chard Stewart who after attempting to get me access to my municipal court records in the Borough of Stan-hope as he reported to me and the Chief of Police of the Borough of StanStan-hope the Borough Attorney Richard Stein told the town administrator that the Oct 18, 2010 hearing with Judge Conforti, J.S.C. was adjourned to late Dec 2010 and I should leave New Jersey. I informed Richard Stewart and the
Chief of Police that Richard Stein’s statements as he was also the municipal prosecutor of the corrupt Borough of Stanhope enterprise that his statement was false as I was contacted by the Superior Court’s clerk for munic-ipal appeals Allyson Kuddar to appear even earlier at 9 a.m. on Oct 19, 2010 and I objected to having such a hearing on Oct 5, 2010 when a court order was issued by Judge Conforti, JSC signed by Ms. Kuddar that stated a brief was NOT scheduled for 21 days and per the Sep 30, 2010, there was no court order I could even hire my own attorneys to represent me in violation of court rules and the Constitutions of the United States and New Jersey.
7. The following Judges have prevented me from examining Borough of Stanhope records, of examing the court records in the Township of Green, or obtaining the transccript records on a CD ROM or obtaining an audio recording of sentencing on a CD ROM even though I completed the Court Documents Records form as Judge Dana wrote on the form the Assignment Judge denied all defendants the ability to get these records so that I could make corrections in the transcript records.
8. The Vicinage Trial Court Administrator Mr. Arnold has refused to return my many telephone calls, letters re-questing per N.J. court rules that he obtain copies of the court records denied by examination or obtaining copies as these records would prove perjury of Richard Stein who falsely told the court all my Open Public Re-cord Act requests for copies of documents were answered as he also falsely told Judge Bozonelis, AJSC under Docket SSX-L-847-07 filed on Dec 18, 2007 in Borough of Stanhope v. Thomas Caggiano and the Government Record Council for a stay of the GRC sending the denial of access complaints under GRC 2006-02 which took the GRC 8 months under its interim order to Stanhope and 3 years to foward the denial of access to the Office of Administrative Law. The case filed in 2007 with Judge Bozonelis has NOT even had a hearing where con-frontation of any plantiff or affiant has been held in over 3 years. The municipal appeal before the Mercer County Superior Court Judge Ostrer, JSC on another petty order conviction is still ripe but I have filed a mo-tion for dismissal with prejudice with the Mercer County Superior Court and the Mercer County Prosecutor’s Office as I met their staff three times providing evidence of criminal conduct by dozens of State officials in Trenton, NJ. My POC in the Mercer County Prosecutor’s Office is Mr. Jingoli, Jr. and in the Morris County Pros-ecutor’s Office Assistant Prosecutor Bob Webber. The U.S.P.S. Inspector in Charge Peter Zegarac at 111 W. Moore St, Suite 900, Phoenix, Ax 85033 has taken over the investigation previously assigned to the Las Vegas, Nv Inspection Division under Complaint 16210546 and the
State of New Jersey’s Office of Attorney Ethics has taken over the investigation against William Hinkes, Esq the Township of Green’s Municipal Prosecutor without any valid contract per the Local Public Contracts Law and the Borough Attorney Richard A. Stein, Esq. that was previously initiated by the District XA Ethics Commit-tee under Docket XA-1--018E.
9. Whereas the Trenton municipal court even refused to provide me copies of transcripts by Judge Sancinito, JMC upon my providing proof to Hon Mitchell E. Ostrer, J.S.C. under Docket 18723 Case #24-2009 which is still ripe, he had to have his staff obtain court records however the transcriber J & J Transcripts has NOT provided me the court records on a CD ROM without page breaks and states which I believe are being misinterpreted by Mr. Newsome that a copy of a CD ROM can cost in fact thousands of dollars whereas under OPRA the same CD would cost $10 or less. I have been unable to get court recordings and court records on a CD ROM from Judge Dana as he stated in his court that a secret court order was issued by Judge Bozonelis, A.J.S.C. that no de-fendant can obtain these records as he threatened me and illegally imprisoned me for 85 days as an inmate. Over 1 year ago Judge Conforti, JSC with the Assistant Prosecutor agreed on Sep 10, 2009 that Judge Dana re-peatedly and in violation of court rules illegally sentenced me. On Sep 10, 2009 ALL fines on the cases under municipal appeals 13-4-08 and 19-09 were ALL vacated as well as all probation and the criminal charges filed against me by Borough of Stanhope were all dismissed without prejudice and then dismissed with prejudice against the State of New Jersy under the malicious indictment IND 08-09-316-I State v. Thomas Caggiano.
10. The court orders themselves violate the Constitutions of the United States of America and the State of New Jersey preventing me from obtaining access to court records as I was threatened with arrest and bail in the street in front of the municipal court when I telephone Richard Stewart to seek access. He was illegally fired by the Borough of Stanhope on Dec 2, 2010
11. I was told by the undersheriff of the corrupt Sussex County Jail that they refuse to respond to my OPRA quests based upon guidance from the Sussex County Counsel as the Sussex County Administrator himself re-quested a criminal investigation by the Sussex County Prosecutor’s office of my false imprisonment and also by the Sheriff Untig as I have met the
IAD staff many times to complain of the corruption, lack of medical care that required my immediate hospital-ization in Newto Memorial Hospital in handcuffs and shakles to the emergency room bed and in court many times in violation of court rules to criminal coercion and witness intimidation as other witnesses appeared in Judge Dana court and were NOT allowed to testify in my defense even though they were eye witness to the as-sualt upon me while standing at the defense table and in handcuffs.
12. As we agreed I will be sending you a more detailed letter for the Appellate Divison to obtain court records illegally in violation of due process and court rules and the Constitutions preventing my providing the required and mandatory records.
13. I expect to provide that request in late Jan 2011 as the excellent Kay Mack, the court clerk in the Superior Court is reviewing the custody of available records from Stanhope, Green Township and Newton courts so that in my future request I can in my letter direct the location where the various records and evidence are located. It is also noted the Borough of Stanhope has illegally kidnapped me from attending Open Public Meetings of its Town Council at its designated location, refused to provide me copies of any government record or even allow my wife to attempt to obtain records as we were both threatening in letters sent to us in Nv with criminal charges by Ellen Horak the corrupt municipal clerk and Richard Stein the corrupt Borough Attorney and munici-pal prosecutor of Stanhope.
14. The Deputy court clerk in Newton Municipal court Tania El is excellent and has been reporting the criminal conduct of Judges to the FBI and State Police Official Corruption Bureau as are now others.
15. Today I recieved over 5 inches of evidence from the excellent Deputy Board of Chosen Freeholders, a cor-rupt organization, that has protected the Judges, Municipalities and Sussex County Prosector and Major Law firms serving many corrupt municipal governments in the criminally infested Sussex County.
16. Therefore, please accept this request for a delay as the holidays are upon us, persons I must contract are not available in their offices to provide the records and despite my efforts and my own attorney’s efforts we were unsuccessful in having courts and prosecutors’ comply with the Rules of Ethics, the rules of the courts, due process and issue unconstitutional court orders which result in letters such as below which by itself proves violation of due process and adequate display of manifest injustice to dismiss the non-criminal charges as all fines were already repaid, all probation was already vacated and findings were made over 1 year ago that Judge Dana repeatedly violated court rules in sentencing imprisoning me for 85 days of his 39 to changed sen-tence of 95 days. Whereas the Dismissal with Prejudice against the prosecutor’s Office occurred and the same prosecutor had an obvious conflict of interest not divulged that he was William Hinkes law partner and William Hinkes did NOT even have a valid contract during the so called trail and witnesses in the court were not al-lowed to testify in my defense one asks what laws and court rules does one follow?
18. I certify the foregoing statements made by me are true. I am aware that if any of the foregoing state-ments made by me are willfully false that I am subject to punishment.
