BJECTIVES AND

D

ESCRIPTION

This notice of a call for proposals is based on the Regulation No 1295/2013 of the European Parliament and of the Council of 11/12/2013 concerning the implementation of a programme of support for the European cultural and creative sector (CREATIVE EUROPE)1 and its corrigendum of the 27/06/20142.

Within the field of reinforcing the audiovisual sector's capacity, some of the priorities of the MEDIA Sub-programme are the following:

• increase the capacity of audiovisual operators to develop European audiovisual works with a potential to circulate in the Union and beyond and to facilitate European and international co-production, including with television broadcasters;

• encourage business to business exchanges by facilitating access to markets and

innovative business tools enabling audiovisual operators to increase the visibility of their projects on Union and international markets.

The MEDIA Sub-programme shall provide support for: • facilitating European and international co-productions

• facilitating access to professional audiovisual trade events and markets and the use of online business tools inside and outside the Union;

• facilitating circulation of European films worldwide and of international films in Europe on all platforms,.

PPLICANTS

Applicants must be entities (private companies, non-profit organisations, associations, charities, foundations, municipalities/Town Councils, etc.), established in one of the countries participating to the MEDIA Sub-programme and owned directly or by majority participation, by nationals from such countries.

Applications from legal entities established in one of the following countries are eligible as long as all conditions referred to in Article 8 of the Regulation establishing the Creative Europe Programme are met and the Commission has entered into negotiations with the country:

− EU Member States;

− Acceding countries, candidate countries and potential candidates benefiting from a pre-accession strategy, in accordance with the general principles and general terms and conditions for the participation of those countries in Union programmes established in the respective Framework Agreements, Association Council Decisions or similar agreements;

− EFTA countries which are members of the EEA, in accordance with the provisions of the EEA Agreement;

− The Swiss Confederation, on the basis of a bilateral agreement to be concluded with that country;

− Countries covered by the European Neighbourhood Policy in accordance with the procedures defined with those countries following the framework agreements providing for their participation in Union programmes.

The Programme shall also be open for bilateral or multilateral cooperation actions targeted at selected countries or regions on the basis of additional appropriations paid by, and specific arrangements to be agreed upon with, those countries or regions.

The Programme shall permit cooperation and joint actions with countries not participating in the Programme and with international organisations which are active in the cultural and creative sectors such as UNESCO, the Council of Europe, the Organisation for Economic Cooperation and Development or the World Intellectual Property Organisation on the basis of joint

contributions for the realisation of the Programme's objectives.

The Agency may select proposals from applicants in non EU countries, provided that, on the date of the award decision, agreements have been signed setting out the arrangements for the participation of those countries in the programme established by the Regulation referred to above. (Updated list of countries that fulfil the conditions referred to in Article 8 of the Regulation and that the Commission has started negotiations with can be found on the following link:

The present call for proposals is aimed at supporting actions and activities taking place in and outside countries participating in the MEDIA Sub-programme.

Only those applications corresponding to at least one of the 3 Actions below will be considered as eligible:

• Action 1 - Access to physical markets for European professionals • Action 2 - Online tools intended for the professionals

• Action 3 - Common European promotional activities Activities must start between 01/06/2016 and 31/05/2017.

The maximum duration of the action is 12 months. A maximum extension of 6 additional months will be granted, if requested before the deadline specified in the grant agreement. The maximum duration in any case, will be of 18 months.

Eligible applications will be assessed on the basis of a 100-point score on the basis of the following criteria and weighting:

Relevance and European added value (30 points)

• Relevance of the content of the action including the innovative aspects and the International and European dimension vis-à-vis the objectives of the call for proposals and the needs of the industry.

Quality of the content and activities (30 points)

• Adequacy of the methodology to the objectives including the format, the target group, selection methods, synergy and collaboration with other projects, the tools including the use of digital technologies relevant to new business models, the feasibility and cost efficiency. Dissemination of project results, impact and sustainability (30 points)

• Impact on the financing, the international circulation and global audience of projects and works and/or structuring effects on the European audiovisual industry

Organisation of the project team (10 points).

• Distribution of the roles and responsibilities of the team vis-à-vis the objectives of the action.

UDGET

The total budget available is estimated at 7 M €.

The financial contribution of the Union cannot exceed:

- 60% of the total eligible costs of the action in case of action taking place in countries participating in the MEDIA sub-Programme;

- 80% of the total eligible costs of the action in case of action taking place in countries outside the MEDIA sub-Programme.

The Agency reserves the right not to allocate all the available funds.

Proposals must be submitted not later than 28/01/2016 at 12.00 noon (midday Brussels time) using the online application form (eForm). No other method of submission of an application will be accepted.

• This action is a part of the EU support to harmonized approach to the management of animal by-products across Bosnia and Herzegovina with feasibility study for rendering plant. The purpose of this contract is to provide technical assistance in establishing an animal waste management system for animal by–products as well as preparation for construction of animal waste facilities for all forms of animal by–products including arrangements for their collection and transport, which will have a major impact on the reduction of direct risks to human and animal health and the environment.

Any extension of the contract would be subject to satisfactory performance by the Contractor.

CONDITIONS OF PARTICIPATION

11. Eligibility

Participation is open to all legal persons [participating either individually or in a grouping (consortium) of candidates] which are established in a Member State of the European Union or in a country or territory of the regions covered and/or authorised by the specific instruments applicable to the programme under which the contract is financed (see also item 29 below). Participation is also open to international organisations. The participation of natural persons is governed by the specific instruments applicable to the programme under which the contract is financed.

12. Candidature

All eligible natural and legal persons (as per item 11 above) or groupings of such persons (consortia) may apply.

A consortium may be a permanent, legally-established grouping or a grouping which has been constituted informally for a specific tender procedure. All members of a consortium (ie, the leader and all other members) are jointly and severally liable to the Contracting Authority.

The participation of an ineligible natural or legal person (as per item 11) will result in the automatic exclusion of that person. In particular, if that ineligible person belongs to a consortium, the whole consortium will be excluded.

13. Number of applications

No more than one application can be submitted by a natural or legal person whatever the form of participation (as an individual legal entity or as leader or member of a consortium submitting an application). In the event that a natural or legal person submits more than one application, all applications in which that person has participated will be excluded.

14. Shortlist alliances prohibited

Any tenders received from tenderers comprising firms other than those mentioned in the short-listed application forms will be excluded from this restricted tender procedure unless prior approval from the Contracting Authority has been obtained (see Prag 2.4.3.). Short-listed candidates may not form alliances or subcontract to each other for the contract in question.

15. Grounds for exclusion

As part of the application form, candidates must submit a signed declaration, included in the standard application form, to the effect that they are not in any of the exclusion situations listed in Section 2.3.3 of the Practical Guide to contract procedures for EC external actions

Subcontracting is allowed.

If the number of eligible candidates meeting the selection criteria is less than the minimum of 4, the Contracting Authority may invite the candidates who satisfy the criteria to submit a tender.

SELECTION AND AWARD CRITERIA

21. Selection criteria

Same criteria for legal and natural persons

The following selection criteria will be applied to candidates. In the case of applications submitted by a consortium, these selection criteria will be applied to the consortium as a whole: 1) Economic and financial capacity of candidate (based on item 3 of the application form). In

case of applicant being a public body, equivalent information should be provided.

a) The annual turn over of the candidate(s) for each of the two last years must be at least € 1.5 Million.

2) Professional capacity of candidate (based on items 4 and 5 of the application form)

a) At least five permanent staff employed by the candidate(s) work currently in the fields of the contract (i.e. establishment and/or implementing Animal-by products and/or Animal waste system).

3) Technical capacity of candidate (based on items 5 and 6 of the application form)

(a) Over the last 36 months prior to the submission deadline, candidate(s) have worked successfully on at least one project related to the establishment and/or implementing Animal-by products and/or Animal waste system. Project value of minimum € 1,000,000 and the proportion carried out by the candidate(s) must be at least 70%.

This means that the project the candidate refers to could have been started/implemented/completed at any time during the indicated period but it does not necessarily have to be started and completed during that period, nor implemented during the entire period. The candidate may refer to a part of a project where the contract is not yet completed, but then only the part which is successfully completed may be used as reference. In such cases, the candidate must include in the presentation of the experience reference (section 6 of the tender submission form) a description of services actually completed in the requested period (list of outputs etc.) and its financial value. The candidate needs to be able to submit documentary

2014 Page 4 evidence of this part's successful completion, e.g. a statement from the entity which ordered or purchased the service).

Previous experience which would have lead to breach of contract and termination by a Contracting Authority shall not be used as reference. This is also applicable concerning the previous experience of experts required under a fee-based service contract.

An economic operator may, where appropriate and for a particular contract, rely on the capacities of other entities, regardless of the legal nature of the links which it has with them. It must in that case prove to the Contracting Authority that it will have at its disposal the resources necessary for performance of the contract, for example by producing an undertaking on the part of those entities to place those resources at its disposal. Such entities, for instance the parent company of the economic operator, must respect the same rules of eligibility and notably that of nationality, as the economic operator.

If more than 8 eligible candidates meet the above selection criteria, the relative strengths and weaknesses of the applications of these candidates must be reexamined to identify the eight best candidates. The only factors which will be taken into consideration during this re-examination are:

a) The number of valid references as per criterion 3(a).

b) Total value of the proportion carried out by the candidate in projects eligible as per criterion 3(a).

26. Alteration or withdrawal of applications

Candidates may alter or withdraw their applications by written notification prior to the deadline for submission of applications. No application may be altered after this deadline.

Any such notification of alteration or withdrawal shall be prepared and submitted in accordance with Item 25. The outer envelope (and the relevant inner envelope if used) must be marked 'Alteration' or 'Withdrawal' as appropriate.

a) Over the last 36 months prior to the submission deadline, candidate(s) have worked successfully on at least one project related to the establishment and/or implementing Animal-by products and/or Animal waste system. Project value of minimum € 1,000,000 and the proportion carried out by the candidate(s) must be at least 70%.

This means that the project the candidate refers to could have been started/implemented/completed at any time during the indicated period but it does not necessarily have to be started and completed during that period, nor implemented during the entire period. The candidate may refer to a part of a project where the contract is not yet completed, but then only the part which is successfully completed may be used as reference. In such cases, the

candidate must include in the presentation of the experience reference (section 6 of the tender submission form) a description of services actually completed in the requested period (list of outputs etc.) and its financial value. The candidate needs to be able to submit documentary evidence of this part's successful completion, e.g. a statement from the entity which ordered or purchased the service).

If a candidate/tenderer has implemented the project in a consortium, the percentage that the candidate/tenderer has successfully completed must be clear from the documentary evidence, together with a description of the nature of the services provided if the selection criteria relating to the pertinence of the experience have been used.

Previous experience which caused breach of contract and termination by a Contracting Authority shall not be used as reference. This is also applicable concerning the previous experience of experts required under a fee-based service contract.

An economic operator may, where appropriate and for a particular contract, rely on the capacities of other entities, regardless of the legal nature of the links which it has with them. It must in that case prove to the Contracting Authority that it will have at its disposal the resources necessary for performance of the contract, for example by producing an undertaking on the part of those entities to place those resources at its disposal. Such entities, for instance the parent company of the economic operator, must respect the same rules of eligibility and notably that of nationality, as the economic operator.

If more than 8 eligible candidates meet the above selection criteria, the relative strengths and weaknesses of the applications of these candidates must be reexamined to identify the eight best candidates. The only factors which will be taken into consideration during this re-examination are:

a) The number of valid references as per criterion 3(a).

b) Total value of the proportion carried out by the candidate in projects eligible as per criterion 3(a).

26. Alteration or withdrawal of applications

Candidates may alter or withdraw their applications by written notification prior to the deadline for submission of applications. No application may be altered after this deadline. Any such notification of alteration or withdrawal shall be prepared and submitted in accordance with Item 25. The outer envelope (and the relevant inner envelope if used) must be marked 'Alteration' or 'Withdrawal' as appropriate.
