Thank you for choosing us for your insurance. This document sets out what is and what is not covered. The schedule shows the cover you have chosen and any special terms that apply. Certain words shown in bold in this insurance have specific meanings and we explain these under
definitions.
Please check that the cover in this document and the schedule meets your needs and that you understand it. If you have any questions about your insurance, please contact your insurance adviser who arranged this insurance for you.
Contract details
This policy is a contract between the insured (named in the schedule) and Canopius
Underwriting Limited on behalf of Canopius Managing Agents Limited
Provided that the premium specified has been paid in the required manner, we will provide the insurance specified in this policy and schedule and any attached endorsements during the period
of insurance.
All information supplied to us by or on behalf of the insured is deemed to be incorporated the policy.

Insured Person may be eligible to compensation from the scheme should any participating Underwriter be unable to meet its obligations under this contract.
If the Insured or Insured Person were entitled to compensation under the scheme, the level and extent of the compensation will be dependent upon the nature of this contract.

This insurance is written in English and all communications about it will be in English.

CurrencyWhere this document, the schedule and any endorsement shows a currency in sterling (£) this currency will apply to insurance arranged only in the United Kingdom. If the currency is shown in euros (€) this currency will only apply to insurance arranged in Ireland.

Irish law
The insurance cover that this document relates to was granted by the holder of a ‘binding authority’ in Ireland from Lloyd’s Underwriters. It has been issued in Ireland in line with section 94 of the Insurance Act 1936.
The holder of this binding authority, whose name and address are shown on the
schedule, along with Lloyd’s Underwriters’ Representative in Ireland, has all the power
set out in the Insurance Acts and Regulations 1909 to 2000.
Without affecting what we have already mentioned in this document, the underwriters agree that Irish law applies to this contract. If there is a disagreement under the policy, any suitable court in Ireland can deal with the case. Any disagreement will be settled in line with the law and practice that applies in the court.
Any summons, notice or process will be served on Lloyd’s Underwriters’ Representative at the address shown above.

General definitions – The meaning of words
The words and phrases below have the meanings shown whenever they appear in this document, schedule and endorsements.
Accident
A sudden, unexpected, violent and external specific event which happens during the time of cover, at an identifiable time and place and which causes bodily injury. It also includes death or disability solely as a result of unavoidable exposure to severe or exceptional weather conditions.
Bodily injury
Identifiable physical injury to an insured person’s body, caused directly and solely by an
accident and independently of illness, or disease or any other cause (except illness directly
resulting from that physical injury) which results in an insured person’s death or disability within 12 months of the date of the accident.
Canopius Underwriting Limited
Sompo Canopius is a brand name for Canopius Managing Agents Limited. Canopius Underwriting Limited is an Appointed Representative of Canopius Managing Agents Limited which is authorised by the Prudential Regulation Authority and regulated by the Financial Conduct Authority and the Prudential Regulation Authority (Financial Services Register number: 204847).
This insurance is underwritten by Lloyd’s Syndicate 4444 which is managed by Canopius Managing Agents Limited registered in England & Wales, no. 01514453. Registered office: Gallery 9, One Lime Street, London EC3M 7HA.
Hospital
An institution which:
1. has permanent full-time facilities caring for patients overnight; and
2. has facilities for the diagnosis and medical and surgical treatment of ill people by medical
practitioners; and
3. provides twenty four (24) hour nursing services supervised by Registered General Nurses or nurses with similar recognised qualifications; and
4. is not intended to be a mental institution, nursing home, hospice, convalescent home or residential care home as defined under the Registered Care Homes Act 1984.
Hospitalisation
An overnight stay in a hospital as an in-patient, such stay being certified as necessary by a
medical practitioner. Included activities
Aerobics, Archery, Athletics training (not competing), Badminton, Bowls, Cricket, Cycling (excluding competitions or mountain biking), Fell Walking or Running, Fencing, Fishing, Golf, Hiking or Trekking (under 1500m with no ropes or guides), Horse Riding - Hacking only wearing a helmet, Netball, Sailing, Yachting or Motor Boating (inland and coastal waters within 3 miles of shore), Scuba Diving* to maximum 10 metres *(PADI/BSAC qualified or under supervision), Shooting with licenced guns, Snorkelling, Squash, Swimming and Tennis.
Where an activity is followed by an *, there are additional terms and conditions as shown under Endorsements applying to the policy.
Insured person
Any insured person named on the schedule.
Internal injuries
Loss of fingers or toes
The permanent physical loss of a finger or toe or the permanent and total loss of use of a finger or toe.
Loss of limb
The permanent physical loss of a hand at or above the wrist, or of a foot at or above the ankle, or the permanent and total loss of use of a hand, arm, foot or leg.
Loss of sight
The permanent and total loss of sight which we will consider as having happened:
in both eyes, if your name is added to the Register of Blind Persons on the authority of a fully qualified ophthalmic specialist; or
in one eye if, after correction, the degree of sight you have left is 3/60 or less on the Snellen scale (meaning that you can see at 3 feet what you should be able to see at 60 feet).
Medical Practitioner
Any suitably qualified medical practitioner registered by the General Medical Council in the United
Kingdom (or foreign equivalent); or in respect of dental treatment only, a dental practitioner who is
registered with the British Dental Association (or foreign equivalent); other than: 1. an insured person.
2. a member of the immediate family of the insured person. 3. a director or employee of the insured.
Partner
Your husband, wife, civil partner or any other person you are living with as if you were
married or were civil partners. (A civil partnership is a formal arrangement giving same-sex partners the same legal status as a married couple).
Permanent Total Disability – if in regular gainful employment
Disability which entirely prevents you from working in any business or occupation of any and every kind and which, after a period of 52 weeks from the date of disability, shows no signs of ever improving.
Permanent Total Disability – if not in regular gainful employment and under 65
Disability which entirely prevents you from working in any business or occupation which you are reasonably suited to by training, education or experience and which, after a period of 52 weeks from the date of disability, shows no signs of ever improving.
Permanent Total Disability – if not in regular gainful employment and over 65
Disability which entirely prevents you from performing at least four of the following activities of daily living without the assistance of another person or the use of special equipment and which, after a period of 52 weeks from the date of disability, shows no sign of ever improving.
Feeding and eating
Cutting meat, buttering bread, getting food and drink to the mouth using fingers or utensils.
Dressing
Dressing including fastening zips and buttons, getting clothes from wardrobes and drawers.
Bathing and grooming
Turning on taps, getting in and out of a bath or shower, washing face, hands and so on, drying, combing hair.
Toileting
recognising the need to go to the toilet in time to get there. Mobility and transfer
Getting into and out of bed, transferring from one place to another, for example, a chair to bed, chair to standing, chair to chair.
Walking
Moving from one place to another including when using a wheelchair or walking frame.
Period of insurance
This is the length of time covered by this insurance (as shown in the schedule) and any extra period for which we accept your premium.
Personal effects
Articles worn, used or carried by you, but excluding motor vehicles and their accessories.
Pre-existing condition
A physical or mental disability, or ongoing or recurring medical condition (one that keeps coming back), you had, knew you were likely to have or had symptoms of before the period
of insurance. Schedule
The document attached to and forming part of the policy showing details of the cover the
insured has purchased which are specific to them and to any insured person(s). Terrorism
Any act, or acts, of any person, or group(s) of persons, committed for political, religious, ideological or similar purposes with the intention to influence any government and/or to put the public, or any section of the public, in fear. Terrorism may include, but not be limited to, the actual use of force or violence and/or the threat of such use. Furthermore, the perpetrators of terrorism may either be acting alone, or on behalf of, or in connection with any organisation(s) or government(s).
Thoracic surgery
An operation on organs in the chest cavity.
Utilisation of Biological weapons of mass destruction
The emission, discharge, dispersal, release or escape of any pathogenic (disease producing) micro- organism(s) and/or biologically produced toxin(s) (including genetically modified organisms and chemically synthesised toxins) which are capable of causing incapacitating disablement or death of people or animals.
Utilisation of Chemical weapons of mass destruction
The emission, discharge, dispersal, release or escape of any solid, liquid or gaseous chemical compound which, when suitably distributed, is capable of causing incapacitating disablement or death of people or animals.
Utilisation of Nuclear weapons of mass destruction
The use of any explosive nuclear weapon or device or the emission, discharge, dispersal, release or escape of fissile material emitting a level of radioactivity capable of causing incapacitating disablement or death of people or animals.
War
Any activity arising out of, or any attempt to participate in, the use of military force between nations including:
1. hostilities or warlike operations (whether war be declared or not). 2. invasion, civil war, rebellion, insurrection, revolution.
3. act(s) of an enemy foreign to the nationality of the insured person or the country in, or over which the act occurs.
5. overthrow of the legally constituted government. 6. military or usurped power.
7. explosions of war weapons 8. Terrorism.
9. murder or assault subsequently proved beyond reasonable doubt to have been the act of agents of a state foreign to the nationality of the Insured person whether war be declared with that state or not.

What is not covered
Under Sections 1 - Permanent Disabilities and Section 3- Accidental Death We will not pay the following:
If Super cover applies, the sum insured for Accidental Death if the bodily injury does not lead to death within 52 weeks of an accident.
The sum insured for Permanent Disabilities if the bodily injury results in death within 3 months of an
accident.
Under Section 4 - Personal Effects We will not pay for:
1. the first £25 each and every claim 2. motor vehicles and their accessories
3. damage caused by wear, tear or any gradually operating cause
4. loss of money, stamps, tickets, documents or securities, good or samples 5. property insured under any other insurance
Special condition applying to clothing & personal effects
1 Where an article is under 2 years old and proof of purchase can be provided, we will pay the full replacement value, subject to the policy conditions. For items over 2 years old, we will pay the value of the article as at the date of loss or damage after allowing for wear and tear.
Special conditions
The following special conditions also apply to this insurance.
1 Following your 85th birthday, we will not pay any benefit to you after the end of the period of
insurance.
2 If the effects of an accident on you are made worse because of a pre-existing condition, we will ask a Medical Practitioner to assess the effects that this pre-existing condition has on
your bodily injury. We will reduce the benefit by an amount the Medical Practitioner says
that we should take into account.
3 If loss or disability, covered by this insurance, causes death (within 3 months of an accident) before we have paid any claim for loss or disability, we will only pay the amount shown in the
schedule for insured event Accidental Death.
General exclusions
This insurance does not cover death, loss, disability or expense directly or indirectly caused or contributed to by, resulting from or in connection with the following:
1 War or Terrorism committed in any of the specified countries shown in the schedule or
endorsements accompanying this policy; 2 Radioactive contamination from:
- ionising radiation or contamination from any nuclear fuel, or from any nuclear waste arising from burning nuclear fuel; or
- the radioactive, toxic, explosive or other dangerous effect of any explosive nuclear equipment or part of that equipment;
3 Utilisation of Nuclear, Chemical or Biological weapons of mass destruction
however these may be distributed or combined;
4 Suicide, attempted suicide, intentional self-injury or an insured person having any psychiatric, mental or nervous disorder including stress or depression, post-traumatic stress disorder or form of dementia;
5 An insured person being under the influence of alcohol or non-prescribed drugs, or abusing prescribed drugs where there is sufficient evidence to conclude that the use of alcohol or drugs contributed to an accident, bodily injury, or criminal act;
6 You or an insured person taking part in any criminal act;
7 Sexually-transmitted diseases, HIV, acquired immune deficiency syndrome (AIDS) or any AIDS-related condition or diagnosis or counselling for either AIDS or AIDS-related complex (ARC);
8 an Insured person participating in professional sports;
9 an Insured person undertaking operational duties as a member of the Armed Forces; 10 an Insured person flying other than as a passenger in an aircraft licensed to carry
passengers;
11 Taking part in any activity, unless agreed by us, other than those shown as an included activity
12 Any surgery or treatment that is not medically necessary, cosmetic surgery, reversing cosmetic surgery, or any corrective treatment needed as a result of previous cosmetic surgery.
General conditions
The following general conditions apply to this insurance. 1. Arbitration
If we accept your claim, but disagree over the amount due to you, the matter will be passed to an arbitrator who both you and we agree to. When this happens, the arbitrator must make a decision before you can start proceedings against us.
2. Claims Under Two Sections
We will only pay for a claim resulting from a single event under either section 1 or 2, but not both.
3. Cancelling cover
Your right to change your mind if you are a private policyholder
If this cover does not meet your needs, you may cancel the insurance, without giving reason, by sending us written notice via post or email within fourteen (14) days of the policy starting or within fourteen (14) days of you receiving the insurance documents, whichever is later. We will make a charge equal to the period of cover you have had, as long as we have not paid a claim or are not due to pay one. This charge will be at least £25 plus insurance premium tax (IPT) in the United Kingdom, or €25 plus insurance levy in Ireland or other European countries.
You can cancel this insurance by giving us fourteen (14) days’ notice in writing. If this happens,
as long as we have not paid a claim or are not due to pay one, we will work out the premium for the period up to the end of the thirty (30) days’ notice period and we will return the balance of the premium you do not use, after taking a minimum charge of £50 plus insurance premium tax (IPT) in the United Kingdom, or €50 plus insurance levy in Ireland or other European countries.
We may cancel this insurance by sending you 28 days’ notice, by recorded delivery, to your
insurance adviser as shown in the schedule. We will refund the part of your premium which applies to the remaining period of insurance. Some examples of us cancelling cover are, where
you have deliberately or recklessly misrepresented any information you have supplied, or
withheld any information which we or your Broker have asked for; Where we reasonably suspect or have evidence of criminal or fraudulent activity or where you have failed to pay the premium to
your advisor.
4. Telling us about claims
You must tell us about any possible claim as soon as possible. See page 5 for details of making
claims.
5. Fraudulent claims
If a claim is made which you, an insured person, or anyone acting on your or their behalf, knows is false, fraudulent or exaggerated, we will not pay the claim and we may cancel the cover under this insurance. If a paid claim is subsequently found to be false or fraudulent, you or the
insured person must pay back any benefit that we have already paid. Additionally, we will not
refund any paid premiums.
6. If you do not keep to the policy conditions
We will not pay a claim if you or an insured person have not kept to all the conditions of this
policy.
7. Interest on claim payments
We will not pay interest on any claim payment.
8. Not giving us all relevant information
This contract of insurance will no longer apply if you or an insured person give us incorrect or misleading information, or fail to give us any relevant information.
9. Reasonable care
You and each insured person must take all reasonable steps to avoid or reduce any loss,
10. Transferring this policy
You cannot transfer the benefit of this policy to anyone else or use this contract of insurance as
security or guarantee for a mortgage or commitment of any kind. 11. Contribution
Where a claim is made against us and there is more than one contract of insurance in force covering the same interest, against the same loss and against the same subject matter, we are entitled to call upon any other insurers liable for the same to make a ratable contribution towards the loss.
12. Data protection notice
Please read this notice carefully as it contains important information about the details you will give or have given us.
It is a condition of this insurance that you read and accept the terms of this data protection notice.
You should show this notice to anyone covered by this insurance.
We will process the details you have provided in line with the Data Protection Act 1998 and other
laws which may apply. Your information may also be processed outside of the European area. In all instances we make sure that your information has enough protection.
So that we can assess the terms of an insurance contract, or deal with any claims that may arise,
we may need to share information such as your name, address, date of birth, or other information
which is classed as ‘sensitive’ under the Data Protection Act 1998. For example, this could include details of your medical conditions or criminal convictions. We may pass this information to other organisations that we have carefully chosen as well as other companies within our group. If we provide a credit facility for you to pay your premiums, we may share your information with credit-reference agencies and other companies for use in credit decisions, to prevent fraud and to find people who owe money.
We share information with other insurers, certain government organisations and other authorised
organisations for the following purposes.
Insurance underwriting
We examine the possible risk in relation to your prospective policy (or anyone else involved in the
policy) so that we can:
consider whether to accept a risk;
make decisions about providing and dealing with insurance and other related services for you and members of your household;
set price levels for your policy;
confirm your identity to prevent money laundering; and
check the claims history for you or any person or property likely to be involved in the policy or a claim at any time. We may do this:
when you apply for insurance; if there is an accident or a claim; or at the time you renew the policy. 13. Preventing or detecting fraud
We will share information about you with other organisations and public organisations including
the police for the purpose of: tracing debtors or beneficiaries; recovering debt;
managing your accounts and insurance policies; carrying out fraud searches; and
Insurers pass information to the Claims Underwriting and Exchange Register and the Motor Insurance Anti-Fraud and Theft Register run by Insurance Database Services Limited (IDSL). This helps insurers check information and prevent fraudulent claims. When we deal with your request for insurance we may search these registers.
If you give us false or inaccurate information:
it may mean your insurance policy or prospective insurance policy is not valid; we will pass details to fraud-prevention agencies;
law-enforcement agencies may access and use this information; and
we and other organisations may access and use this information to prevent fraud and money laundering.
14. Cheat line
To protect our policyholders, we are members of the Insurance Fraud Bureau (IFB). If you suspect insurance fraud is being committed, you can call them on their confidential cheat line on 0800 422 0421.
15. Keeping to legal responsibilities
Managing claims
If you make a claim, we may need to release information to another person or organisation involved in that claim. This includes, but is not restricted to, others involved in the incident, their insurer, their solicitor or representative and medical teams, the police or other investigators. We also may have to investigate your claim and conviction history.
Under the conditions of your policy, you must tell us about any incident (such as an accident or theft) which may or may not result in a claim. When you tell us about an incident, we will pass information relating to it to IDSL.
Managing complaints
If you make a complaint about the service we have provided, we may have to pass on details about your complaint, including your personal information, to other people or organisations such as Lloyd’s or the relevant ombudsman.

16. Sanction Limitation and Exclusion Clause
We will not provide cover or be liable to pay any claim or provide any benefit, if to do so would
expose us to any sanction, prohibition or restriction under United Nations resolutions or the trade or economic sanctions, laws or regulations of the European Union, United Kingdom or United Sates of America.
17. Several Liability Notice/Clause
Endorsements
Important – this appendix forms part of the insurance.
An endorsement only applies if the endorsement’s number is shown in the relevant place in the schedule. Details of all endorsements are shown either in this appendix or on a separate sheet supplied with the schedule.
Endorsement – Scuba-diving
This insurance is extended to include scuba-diving.
The insured person must hold a recognised dive qualification by PADI or BSAC or CMAS and the dive must be within the recommended dive club guidelines, keeping at all times to their safety rules and regulations and remaining at all times within the limits of the insured person’s own qualification.
If the insured person does not hold a recognised dive qualification, a person who is qualified must accompany them.
Unless we have agreed otherwise, this insurance does not cover cave diving, wreck diving, diving at depths greater than 30 metres, decompression dives, solo diving or diving for gain or reward.
The insured person should not engage in any form of flying within 24-hours of diving.
