Minutes of the Regular Council Meeting

Held April 6, 2021 7:00 PM

The regular meeting of the Riverton City Council was held on the above date and time, duly convened by Mayor Richard P. Gard at 7:02 p.m. City Council Members present were Karla Borders, Lindsey Cox, Mike Bailey, Kyle Larson and Kristy Salisbury. Mayor Gard led the pledge of allegiance; and Council Member Bailey conducted the invocation.

Roll call was conducted. Mayor Gard declared a quorum of the Council.

City Staff present: City Clerk/Human Resource Director Kristin S. Watson, City Administrator Tony Tolstedt, Public Works Director Kyle Butterfield, Chief of Police Eric Murphy, Finance Director Mia Harris, Community Development Director Eric P. Carr, and Administrative Assistant/Deputy City Clerk Megan Sims.

Approval of the Agenda – Council Member Borders moved, seconded by Council Member Bailey to approve the agenda as presented. Motion passed unanimously.

Acceptance of Council Member Rota’s Resignation & Declaration of Vacancy: Ward I – Council Member Bailey moved, seconded by Council Member Cox to accept Council Member Rota’s resignation and declared a vacancy in Ward I. Motion passed unanimously.

Communication from the Floor/Response to Citizen’s Comments – None.

Consent Agenda – City Clerk/Human Resource Director Kristin S. Watson read the consent agenda items by title only: Approval of the Minutes – March 16, 2021 Regular Council Meeting; Approval of the Minutes – March 23, 2021 Special Council Meeting; Approval of the Minutes – April 6, 2021 Finance Committee Meeting; Approval of the Finance Committee Recommendations – April 6, 2021 claims to be paid in the amount of $292,990.82 and payroll &

liabilities for 3/12/2021 & 3/26/2021 in the amount of $678,650.13 for a total of $971,640.95; and Approval of the Municipal Court Report for the month of March 2021. Council Member Salisbury moved, seconded by Council Member Borders to approve the consent agenda as presented. Motion passed unanimously.

Public Hearing & Consideration of Ordinance No. 21-003, 1st Reading: Annexation of Various Parcels to Riverton Corporate Boundary – Community Development Director Eric Carr presented Ordinance No. 21-003 which will annex the following addresses to the corporate limits of the City of Riverton: 700 South 4th West, 1220 North Broadway, 1540 Riverview Rd, 800 East Monroe, and 10627 Hwy 789. City Clerk/Human Resource Director Kristin Watson read Ordinance No. 21-003 by title only. Council Member Borders moved, seconded by Council Member Bailey to open the public hearing. Motion passed unanimously. There being no one to address the Council, Council Member Bailey moved, seconded by Council Member Cox to close the public hearing. Motion passed unanimously. Council Member Borders moved, seconded by Council Member Salisbury to adopt Ordinance No. 21- 003 on first reading. Motion passed unanimously.

Public Hearing & Consideration of Ordinance No. 21-004, 1st Reading: Adoption of 2020 National Electric Code (NEC) – NFPA 70 – Community Development Director Eric Carr presented Ordinance No. 21-004. This ordinance updates Section 15.04.010 of the Riverton Municipal Code which will allow for the adoption of the 2020 edition of the National Electrical Code (NEC) - NFPA 70, by the National Fire Protection Association (NFPA) as adopted by the State of Wyoming. City Clerk/Human Resource Director Kristin Watson read Ordinance No. 21-004 by title only.

Council Member Bailey moved, seconded by Council Member Borders to open the public hearing. Motion passed unanimously. There being no one to address the Council, Council Member Bailey moved, seconded by Council Member Larson to close the public hearing. Motion passed unanimously. Honeycutt Softball Complex Memorandum of Understanding (MOU): Girls Fastpitch & Adult Softball – Public Works Director Kyle Butterfield reported on meeting with representatives from the Riverton Girls Fastpitch Softball.

Mr. Butterfield stated the City currently has a Memorandum of Understanding (MOU) with the Girls Fastpitch, however, the City does not have a MOU with the Adult Softball league. The updated MOU with the Girls Fastpitch was presented as well as the new MOU for the Adult league. The changes and new MOU addresses the operation and maintenance responsibilities of the softball field located at the southeast corner of Park Ave and N Smith Rd. Mayor Gard requested the City also help with some infield maintenance on all of the fields. City staff will examine the processes and will report back to the Council at a later date.

Council Member Bailey moved, seconded by Council Member Cox to approve the Memorandum of Understanding between the City of Riverton and the Riverton Adult Softball League. Motion passed unanimously.

Council Member Bailey moved, seconded by Council Member Larson to approve the amended MOU between the City of Riverton and the Riverton Girls Fastpitch Softball. Motion passed unanimously.

Sunset Baseball Complex Memorandum of Understanding (MOU): Little League Juniors & Youth Travel Baseball – Public Works Director Kyle Butterfield presented a Memorandum of Understanding (MOU) between the City of Riverton, Riverton Little League, and Trash Panda Travel Baseball. Each organization has been drafted to communicate the rights and responsibilities of the city, Riverton Little League, and Trash Panda Travel Baseball regarding the operation and maintenance of the baseball facility at Sunset and Major.

Council Member Bailey moved, seconded by Council Member Borders to approve the Memorandum of Understanding between the city of Riverton and the Trash Panda Travel Baseball Organization. Motion passed unanimously.

Council Member Salisbury moved, seconded by Council Member Borders to approve the amended MOU between the City of Riverton and Riverton Little League. Motion passed unanimously.

Saban Baseball Complex Memorandum of Understanding (MOU): Little LeaguePublic Works Director Kyle Butterfield presented an updated Memorandum of Understanding (MOU) between the city and Riverton Little League.

The update to the current MOU addresses the operation and maintenance of the baseball facility located on N Smith Rd. Council Member Larson moved, seconded by Council Member Bailey to approve the Memorandum of Understanding between the city of Riverton and Riverton Little League. Motion passed unanimously.

Bid Award: Main Street Water Improvements – Public Works Director Kyle Butterfield reported of three (3) bids received for the W. Main St. Waterline Replacement Project. This project includes improvement of 460 feet of 12”

waterline, hydrant improvements, 350 square feet of concrete removal and replacement, and over 1,300 square feet of asphalt removal and replacement. Mr. Butterfield stated the lowest and most responsive bid was received from Jerry Bornhoft Construction, Inc. in the amount of $ $266,694.00. Council Member Borders moved, seconded by Council Member Larson to award the w Main St Waterline Replacement Project to Jerry Bornhoft Construction, Inc. in the amount of $266,694.00. Motion passed unanimously.

Bid Award: Wastewater Plant Aerator Drive Replacement – Public Works Director Kyle Butterfield reported of two (2) bids received for the WWTP Aerator Drive Reducer Project. This project includes a Flender Helical Aerator Gear Unit (or equivalent unit), transition plate, flange, monitoring system, and installation costs. Mr. Butterfield reported of the lowest and most responsive bid was received from Jerry Bornhoft Construction, Inc. in the amount of

$79,823.00. Council Member Bailey moved, seconded by Council Member Cox to award the Wastewater Treatment Plant Aerator Drive Reducer Project to Jerry Bornhoft Construction, Inc. in the amount of $79,823.00. Motion passed unanimously.

Regular Council Meeting Minutes Page 3 of 4 April 6, 2021 Airport Grant Agreement: Coronavirus Response and Relief Supplemental Appropriations ActPublic Works Director Kyle Butterfield reported of the FAA awarding the airport $23,000 in Coronavirus Response and Relief Supplemental Appropriations Act (CRRSAA) grant monies in relation to operations, personnel, cleaning, sanitization, janitorial services, combating the spread of pathogens at the airport, and debt service payments. Council Member Bailey moved, seconded by Council Member Borders to accept the Coronavirus Response and Relief Supplemental Appropriations Act grant in the amount of $23,000. Motion passed unanimously.

Joint Powers Agreement: Wyoming Association of Risk Management (WARM) – City Clerk/Human Resource Director Kristin Watson presented an amendment to the Joint Powers Agreement (JPA) of the Wyoming Risk Management (WARM) Property Insurance Joint Powers Board (PIJPB). These changes simply clarify how the 12- month withdrawal notice works and what the assessment is for lack of compliance. Council Member Bailey moved, seconded by Council Member Cox for the approval of the amended and restated Joint Powers Agreement with the Wyoming Association of Risk Management Property Insurance Joint Powers Board. Motion passed unanimously.

Employee Health Insurance – City Clerk/Human Resource Director Kristin Watson presented proposals for employee medical insurances through IMA, Inc., a commercial insurance and employee benefits broker, as well as the city’s current insurance provider, Wyoming Educators Benefit Trust (WEBT). Council Member Larson moved, seconded by Council Member Borders to approve the continued participation in the WEBT health insurance pool.

Motion passed with Council Member(s) Borders, Cox, Larson, Salisbury and Mayor Gard voting aye; and Council Member Bailey voted nay.

Waiver of Building & Permitting Fees for Riverton Medical District – Mayor Richard P. Gard reported of the Riverton Medical District requesting all building and permitting fees to be waived for the construction of the new Riverton Hospital. Council Member Larson moved, seconded by Council Member Cox for the approval of the fee waiver of any building or permitting fees for the Riverton Medical District. Council Member Bailey moved, seconded by Council Member Borders to table this item until the next regular meeting on April 20, 2021. Motion passed unanimously.

Council Committee Reports & Council Members’ Roundtable – Council Member Salisbury commented on the Riverton Chamber of Commerce meeting; Council Member Larson commented on the upcoming meetings he will attend; Council Member Bailey reported on the Riverton Ambassadors meeting he attended; Council Member Cox commented on the PW tour she participated in; and Council Member Borders reported of upcoming meetings she will be attending.

City Administrator’s Report – City Administrator Tony Tolstedt commented on the EDGE Committee applications that have been received, reminded the Council of upcoming meetings and commented on the declaration of vacancy in Ward I.

Mayor’s Comments – Mayor Richard P. Gard thanked Council Member Rota for his hard work and wished him the best of luck. Mayor Gard commented on meetings he attended: WRVC meeting and FCAG; thanked Chief Murphy and the RPD for always being willing to help other departments; thanked the Utility Billing department on their diligent work serving the community with over 4900 utility accounts; and commented on the open cases and active warrants through the Riverton Municipal Court.

Adjourn – There being no further business to come before the Council, Mayor Gard adjourned the Regular Council meeting at 9:42 p.m. There was no objection from the Council.

Work Session Minutes Page 1 of 1 April 13, 2021 RIVERTON CITY COUNCIL

Minutes of the Work Session Meeting

Held April 13, 2021 7:00 PM

The work session meeting of the Riverton City Council was held on the above date and time, duly convened by Mayor Richard P. Gard at 7:00 p.m. City Council Members present were Lindsey Cox, Mike Bailey, Kyle Larson, and Kristy K. Salisbury. Council Member Larson led the pledge of allegiance and Mayor Gard conducted the invocation.

Roll call was conducted. Mayor Gard declared a quorum of the Council. Council Member Larson moved, seconded by Council Member Salisbury to excuse Council Member Karla Borders from tonight’s meeting. Motion passed unanimously.

City Staff present: City Administrator Tony Tolstedt, City Clerk/Human Resource Director Kristin Watson, Public Works Director Kyle Butterfield, Police Chief Eric Murphy, Finance Director Mia Harris, and Community Development Director Eric P. Carr.

Approval of the Agenda – Council Member Cox moved, seconded by Council Member Bailey for the approval of the agenda as presented. Motion passed unanimously.

Community Services Contracts Presentations – The following community organizations presented contracts for services funding requests to the Governing Body for their consideration during the FY 2022 budget preparations: Big Brothers Big Sisters of Northwestern Wyoming $3,000, Central Wyoming CATS $10,000, Central Wyoming Skate Association $500, Eagles Hope Transitional Housing $47,785, Injury Prevention Resources $5,000, Juvenile Justice Services of Fremont County aka Youth Services $25,000, PAWS Animal Shelter $45,000, R Recreation $125,000, Riverton Ambassadors $7,500, Riverton Little League $2,500, and Riverton Volunteer Fire Department $5,000. The total funding requests for fiscal year 2022 totaled $276,285 for the eleven aforementioned organizations, which is in excess of $39,285 from the current fiscal year budget. The funding request from the Riverton Ambassadors is a first- time requests through the contracts for services process. No action was proposed or taken; however, it was the consensus of the Council to fully fund the proposed funding requests, if the budgeting process allows.

Council Roundtable – Council Member Bailey requested Council’s participation in serving breakfast at the Boy’s &

Girl’s Club Fundraiser Event on April 27, 2021, at 6:30 a.m. Council agreed to participate.

Adjourn – There being no further business to come before the Council, Mayor Gard adjourned the Work Session meeting at 8:47 p.m. There was no objection from the Council.

Discussion: The petitioners are proposing to create a 1-lot subdivision at the end of North 8th West. It resides in the County, however, will be reviewed by the City because it is within 1-mile of the corporate boundary.

The Planning Commission reviewed this county subdivision at the April 8, 2021 regular meeting and recommended approval unanimously.

Alternatives:

 Not approve the plat.

 Approve with amendments or stipulations.

Budget Impact: There is no immediate budget impact resulting from the staff recommendation.

SUBJECT: Ordinance 21-003 – An ordinance annexing various properties contiguous to the city limits of Riverton, Wyoming

Recommendation: The City Council approve on second reading Ordinance 21-003 annexing various properties, Fremont County, Wyoming.

Background:

Resolution 1426 was approved by City Council on February 16, 2021.Utility services for water, sewer, and sanitation have either been connected to, or made available to the properties described in Resolution 1426 for over 10 years. Normally, the Riverton Municipal Code would stipulate annexation prior to allowing either singular, or multiple properties to connect to utility services.

For myriad reasons, the properties described in Resolution 1426 were not required to annex into the city; however, those reasons have now expired.

Discussion:

Annexation of properties by municipalities is regulated by Wyoming Statute, Title 15, Chapter 1, Article 4 – Annexation; Determination of Boundaries; Addition and Exclusion of Land. Several of the properties listed in Resolution 1426 have previously submitted requests for annexation;

however, the requests have long since reached their expiration date, which is why staff is recommending following the procedures in W.S. §15-1-404 Annexing territories; initiation of proceedings; by governing bodies.

In following W.S. § 15-1-404, Resolution 1426 was the first step in the process. It was adopted February 16, 2021, certifying compliance with statute. The required advertisements were published March 2nd and March 16th, 2021. A public hearing and presentation of the proposed annexations to the Riverton Planning Commission was not required by State Statue, but was held to allow the Commissioners access to this information since it involves land. Ordinance 21-003 was recommended for approval by the Riverton Planning Commission at their March 18th, 2021 regular meeting, and was approved by the Riverton City Council on first reading April 6, 2021.

Budget Impact:

Infrastructure required for annexation has been in place to the properties listed in Resolution 1426 for well over a decade. The City of Riverton has been providing services to many of the properties since at least 2007; however, the properties have remained in the Riverton Fire Tax District rather than the City of Riverton. The Riverton Fire Tax District’s current mill levy is 75.414, while the City of Riverton Tax District mill levy is 80.414 (a $5.00 per thousand dollars of valuation difference). This means a property with an assessed valuation of $250,000 would see a yearly property tax increase of $118.75.

WHEREAS, the Mayor and the City Council of the City of Riverton, Fremont County, Wyoming, are following W.S.§15-1-404 for the areas proposed for annexation; and,

WHEREAS, seventy-five percent of the perimeter of the area proposed for annexation is contiguous with the City of Riverton, Wyoming in accordance with W.S. 15-1-406(c); and,

WHEREAS, the governing body of the City of Riverton, Wyoming, pursuant to W.S. 15- 1-402(vi) has notified the owners that:

SUBJECT: Proposed Ordinance 21-004, Title 15 – 2020 National Electric Code

Recommendation: The City Council approve on second reading Ordinance 21-004 amending Section 15.04.010 (A) (10) of Chapter 15.04, Building Construction and Maintenance Codes for the purpose of adopting the 2020 version of NFPA 70: National Electrical Code (NEC).

Background: An ordinance automatically adopting the latest version of the NEC was proposed at the March 16th, 2021 regular council meeting. The ordinance, as presented, failed on first reading. Ordinance 21-004 has been modified upon council’s request to reflect the adoption of the specific 2020 publication of the NEC.

The NFPA 70 – National Electrical Code (NEC) is a triennial publication produced by the National Fire Protection Association. It sets a minimum standard to which electrical work is to be completed and is automatically adopted by the State of Wyoming via reference to the most current edition in state law. The latest version of the NEC (c. 2020) was adopted by the state on July 1, 2020. The City of Riverton currently operates under the 2017 edition of the NEC; the predecessor to the 2020 version now available.

Discussion: The State of Wyoming grants authority over electrical construction to the Department of Fire Prevention and Electrical Safety in Title 35 – Public Health and Safety, Chapter 9 – Fire Protection; and more specifically, through the State Fire Marshal’s Office. Under Wyoming Statute § 35-9-121 (a), the State Fire Marshal can:

“…delegate complete authority to municipalities and counties which apply to enforce and interpret local or state fire, building, existing building standards or electrical safety standards…”

The City of Riverton has maintained local enforcement authority under this provision since it was made available.

As a caveat, Wyoming Statute § 35-9-121 (a) (ii) stipulates municipalities granted local enforcement authority shall adopt the same version of the NEC as the state; or:

“…enforcement authority shall immediately revert to the department.”

In other words, electrical work in the state of Wyoming is subject to compliance with the current edition of the NEC. Those municipalities and counties who possess local enforcement authority may either choose to adopt the same version of the NEC as the state, or relinquish their local enforcement authority. If this option is taken, the state would oversee permitting, plan review, and inspection duties for commercial/public electrical work and permitting and plan review duties for residential electrical work (homeowners may elect to have the work inspected for a fee). According to Mr. Mark Young (Assistant State Fire Marshal), the State Fire Marshal’s Office is not in favor of this outcome. They do not have the work force to accommodate the increased plan review and inspection load, which has the potential to produce significant delays.

Adoption of the 2020 NEC (in the form of Ordinance 21-002) was reviewed by the Construction Board of Appeals on March 11, 2021 and was recommended for approval by the City Council unanimously. Ordinance 21-004 was approved on first reading by the Riverton City Council at the April 6, 2021 regular meeting.

Budget Impact: There is no additional cost associated with the adoption of the 2020 NFPA 70 - National Electrical Code (NEC).

SUBJECT: Fee Waiver for Riverton Medical District

Recommendation: That Council consider the factors denoted in this report as part of their consideration towards waiver of fees/costs for the potential Riverton Medical District facility.

Background: At the most recent regular Council meeting, Council discussed the

possibility of waiving fees for the potential Riverton Medical District project proposed to be located in the Eastern Shoshone Business Park. Council previously received the attached information denoting the estimated development costs through the City of Riverton. Those numbers have been updated and are provided.

Pass through costs: Two of the provided estimates are items that are ultimately pass- through costs for the developer. This includes those costs associated with third party review as well as the cost for the water meter. The third party review is estimated

between $16,300 and $21,000 the meter cost is $2,775. These fees are pass through costs associated with development. As these are not costs within the control of the City of Riverton, payment of these fees is not recommended, as this would not be a waiver of fees but rather the assumption of development costs.

Fee Costs: Fees levied by the City of Riverton and their associated estimates are as follows:

Building Permit Fee: between $26,500 and $31,800 Water Tap fee: $11,966

Sewer Tap Fee: $4,823.

Total: These three items total between $$43,289 and $48,589. Waiver of these fees would affect the separate funds as denoted in the Budget Impact section of this

correspondence. Council may choose to waive the following fees for RMD as they deem appropriate.

Agreement Structure: If Council chooses to waive fees associated with recommended fees, Staff will prepare a funding agreement for Council’s approval, which would formalize the specific waiver of funds.

Future Requests: One of the questions / topics of discussion at the previous meeting was the standards by which future proposals are to be considered for the same consideration and what standards would be applied to those future requests. The most notable potential standard for such consideration might be linked to economic impact each project could potentially produce. Waiver of fees could be tied to particular performance of a development in terms of job creation or a similar metric. Additionally, the City could look to develop a scale by which requests are considered. Each of these options and any other potential methods will require significantly more time to develop prior to

consideration.

Alternatives: Council may direct staff as Council deems appropriate towards the waiver of fees associated with the development of the proposed RMD facility. If Council wishes additional analysis and presentation of standards for future fee waivers, additional discussion guidance is requested before a complete recommendation might be made.

Budget Impact: If City Council were to waive fees, the the denoted funds would forgo the following estimated revenue amounts.

1. General Fund: $26,500 to $31,800 2. Water Fund: $11,966

3. Sewer Fund: $4,823

4. Other: It is not recommended to waive/supplement pass through costs associated with third party review and meter purchase.

SUBJECT: Conceptual Airport Property Division

Recommendation: The City Council provide direction to staff on how it wishes to proceed on a proposed division of property near the Central Wyoming Regional Airport.

Background:

Several lots and tracts of land have been for sale near the airport for well over a decade. Some of the land available is either not platted as individual lots, or the lot(s) available is awkwardly shaped, making them more difficult to attract potential buyers.

Discussion:

At the request of the mayor, a conceptual lot layout has been developed for two large parcels proposed for division into smaller portions (see attachment). At this time, staff is requesting direction on whether to proceed with the division proposal. This would require obtaining a land surveyor, developing plats for the proposed property division, and setting property corners.

Budget Impact:

Land surveyor fees required for the proposed division of land were not accounted for in the 20- 21 fiscal year budget, and are anticipated to be on the order of $15k-$25k; however, given the addition of several lot, land sales would likely offset these costs. It should also be noted, under current subdivision regulations, the city would be acting as a developer and as such would be responsible for road improvements throughout the subdivision (water and sewer infrastructure are already in-place).

Council Goals:

Division of certain parcels of land near the airport coincides with council goals: 3. Enhancing City Image and Beautification, 6. Promotion of Economic Development, and 7. Maintaining Financial Stability.
