This StatementofLimited WarrantyincludesPart1 -GeneralTerms,Part2 -Country-unique Terms,andPart3 -WarrantyInformation.Thetermsof Part2 replaceor modifythoseof Part1. ThewarrantiesprovidedbyIBMinthisStatement of LimitedWarranty applyonly toMachinesyoupurchaseforyouruse, andnotfor resale.Theterm“Machine”meansanIBMmachine,itsfeatures, conversions, upgrades,elements,oraccessories,or anycombinationof them.Theterm
“Machine”doesnotinclude anysoftwareprograms, whetherpre-loadedwiththe Machine,installedsubsequentlyorotherwise. NothinginthisStatementof Limited Warrantyaffectsanystatutoryrightsofconsumersthat cannotbe waivedorlimitedby contract.
WhatthisWarrantyCovers
IBMwarrantsthateach Machine1) isfreefromdefectsinmaterialsand workmanship and2)conformsto IBM’sOfficial PublishedSpecifications (“Specifications”) whichareavailableonrequest.Thewarrantyperiodforthe MachinestartsontheoriginalDateofInstallationandisspecifiedinPart 3 -Warranty Information.Thedateonyourinvoiceor salesreceiptistheDateof InstallationunlessIBMoryourresellerinformsyouotherwise. Manyfeatures, conversions,or upgradesinvolvetheremoval ofpartsandtheirreturnto IBM.A partthatreplacesaremovedpartwillassumethewarrantyservice statusofthe removed part.UnlessIBMspecifiesotherwise,thesewarrantiesapplyonlyinthe countryor regioninwhichyoupurchasedtheMachine.
THESEWARRANTIESAREYOUREXCLUSIVEWARRANTIESANDREPLACE ALLOTHER WARRANTIESOR CONDITIONS,EXPRESSOR IMPLIED,
INCLUDING, BUTNOTLIMITEDTO,THEIMPLIEDWARRANTIESOR CONDITIONSOFMERCHANTABILITYANDFITNESS FORAPARTICULAR PURPOSE. WhatthisWarrantyDoesnot Cover This warrantydoesnotcoverthefollowing:
v anysoftwareprograms,whetherpre-loadedorshippedwiththeMachine,or installedsubsequently;
v failureresultingfrommisuse(includingbutnotlimitedto useofanyMachine capacityorcapability,other thanthatauthorizedbyIBMinwriting), accident, modification,unsuitablephysicaloroperating environment,or improper maintenancebyyou;
v failurecausedbyaproductforwhich IBMisnotresponsible;and
v anynon-IBMproducts,includingthosethatIBMmayprocureandprovidewithor integrateintoanIBMMachineatyour request.

Thewarranty isvoidedbyremovalor alterationof identificationlabelsonthe Machineoritsparts.
IBMdoesnotwarrantuninterruptedor error-freeoperationof aMachine.
Anytechnicalor othersupportprovidedfora Machineunder warranty,suchas assistanceviatelephonewith“how-to”questionsandthoseregardingMachine set-upandinstallation,isprovidedWITHOUTWARRANTIESOFANYKIND.

If theMachinedoes notfunction aswarrantedduringthewarranty period,contact IBMoryourresellerto obtainwarrantyservice.IfyoudonotregistertheMachine withIBM,youmayberequiredtopresentproofof purchaseasevidenceofyour entitlement towarrantyservice.
WhatIBMWill DotoCorrectProblems
When youcallfor service,youmust followtheproblemdeterminationandresolution proceduresthatIBMspecifies.Atechnicianwillattempttomakeaninitialdiagnosis of yourproblemandhelpyouresolve itoverthetelephone.
Thetype ofwarrantyservice applicableto yourMachineisspecifiedinPart3 -Warranty Information.
You areresponsiblefordownloadingandinstallingdesignated MachineCode (microcode, basicinput/outputsystemcode (called“BIOS”),utility programs,device drivers, anddiagnosticsdeliveredwithanIBMMachine)andothersoftwareupdates fromanIBMInternetWebsiteorfromotherelectronicmedia,andfollowingthe instructionsthatIBMprovides.
If yourproblemcanberesolvedwithaCustomerReplaceableUnit(“CRU”)(e.g., keyboard,mouse,speaker,memory,harddiskdrive andothereasilyreplaceable parts), IBMwillship theseparts toyoufor replacementbyyou.
If theMachinedoes notfunction aswarrantedduringthewarranty periodandyour problem cannotberesolvedoverthetelephone,throughyourapplicationof
MachineCodeorsoftwareupdates,orwithaCRU,IBMor yourreseller,if approved byIBMtoprovidewarranty service,willeither,atitsdiscretion,1) repairitto makeit function aswarranted,or 2)replaceitwithonethatisatleastfunctionally
equivalent. IfIBMisunableto doeither,youmay returntheMachineto yourplace of purchaseandyour moneywillberefunded.
IBMoryourresellerwillalso manageandinstallselectedengineeringchangesthat applyto theMachine.
Exchangeofa MachineorPart
Before IBMoryourreseller exchangesaMachineorpart,youagreeto removeall features, parts,options,alterations, andattachmentsnotunderwarranty service.
You alsoagreeto:
1. ensurethattheMachineisfreeofany legalobligationsorrestrictionsthat preventitsexchange;
2. obtainauthorizationfromtheownerto haveIBMoryourresellerservice a Machinethatyoudonotown;and
3. whereapplicable,beforeserviceisprovided:
a. follow theservice requestproceduresthatIBMoryourresellerprovides;
b. backup orsecureallprograms,data,andfundscontainedintheMachine;
c. provide IBMoryour resellerwithsufficient,free,andsafeaccesstoyour facilities topermitIBMto fulfillitsobligations;and
d. informIBMor yourresellerofchangesintheMachine’s location.
4. (a) ensureallinformationabout identifiedoridentifiableindividuals(Personal Data)isdeletedfromtheMachine(to theextenttechnicallypossible),(b)allow IBM,yourreselleror anIBMsupplierto processonyourbehalfany remaining PersonalDataasIBMor yourresellerconsidersnecessaryto fulfillits
obligationsunderthisStatement ofLimitedWarranty(which mayinclude shippingtheMachinefor suchprocessing tootherIBMservicelocationsaround theworld),and(c)ensurethatsuchprocessingcomplieswithanylaws
applicable tosuchPersonalData.
LimitationofLiability
IBMisresponsiblefor lossof,ordamageto,yourMachineonlywhileit is1) in IBM’s possessionor2)intransitinthosecaseswhereIBMisresponsibleforthe transportationcharges.
Neither IBMnoryourresellerareresponsiblefor anyofyourconfidential,
proprietaryorpersonal informationcontainedinaMachinewhichyoureturnto IBM for anyreason.YoushouldremoveallsuchinformationfromtheMachinepriortoits return.
Circumstancesmay arisewhere,becauseofadefaultonIBM’spartorother liability,youareentitledto recoverdamagesfromIBM.Ineach suchinstance, regardlessof thebasisonwhichyouareentitledto claimdamagesfromIBM (includingfundamental breach,negligence,misrepresentation,or othercontractor tortclaim),exceptfor anyliabilitythatcannotbewaivedorlimitedbyapplicable laws, IBMisliablefornomorethan
1. damagesforbodilyinjury(includingdeath) anddamagetorealpropertyand tangible personalproperty;and
2. theamountof anyotheractualdirectdamages,uptothecharges(ifrecurring, 12months’charges apply)for theMachinethatissubjectof theclaim.For purposesofthis item,theterm“Machine”includesMachineCodeandLicensed InternalCode(“LIC”).
This limitalso appliesto IBM’ssuppliersandyourreseller.It isthemaximumfor which IBM,itssuppliers,andyourresellerarecollectivelyresponsible.
UNDER NOCIRCUMSTANCESISIBM,ITSSUPPLIERSOR RESELLERS LIABLEFORANYOFTHEFOLLOWING EVENIFINFORMEDOFTHEIR POSSIBILITY:1) THIRDPARTYCLAIMSAGAINSTYOUFORDAMAGES
(OTHER THANTHOSEUNDERTHEFIRSTITEMLISTEDABOVE);2)LOSSOF, OR DAMAGETO,DATA;3) SPECIAL,INCIDENTAL,OR INDIRECTDAMAGES OR FORANYECONOMIC CONSEQUENTIALDAMAGES;OR 4)LOST

BothyouandIBMconsentto theapplicationof thelawsof thecountryinwhichyou acquired theMachineto govern,interpret,andenforceallof yourandIBM’srights, duties, andobligationsarisingfrom,orrelating inanymannerto,thesubject matter of thisStatementof LimitedWarranty,without regardtoconflictoflaw principles.
THESEWARRANTIESGIVEYOU SPECIFICLEGALRIGHTSANDYOU MAY ALSOHAVEOTHER RIGHTSWHICHVARYFROMSTATETOSTATEOR JURISDICTIONTOJURISDICTION.
Jurisdiction
Allof ourrights,duties,andobligationsaresubjectto thecourtsof thecountryin which youacquiredtheMachine.
