An Act

toregulate

the Granting of Degrees

AssentedtoJune9th,1983

HER MAJESTY,

by and with the advice and consent of the Legislative

Assembly

of the Province of Ontario, enacts as follows:

1. InthisAct, interpre-

tation

(a) "Minister"

means

the Minister ofColleges and Uni-

versities;

(b) "person" includesa sole proprietorship, partnership, unincorporated association, unincorporated syndi- cate,unincorporated organization ortrust;

(c) "regulations"

means

the regulations

made

underthis Act.

2.

No

person^ shall directlyy orindirectly.y Authority (Qgrant a degree,etc.

(a) grant adegree

(b) provide a

program

ofpost-secondary study leadingto a degree to be conferred by a person in or outside Ontario;

(c) advertise a

program

ofpost-secondary study offered in Ontario leading to a degree to be conferred by a personinor outside Ontario; or

(d) sell,offer forsale,orprovide by agreementfor afee,

reward or other remuneration, a diploma, certifi- cate,

document

or other materialthat is, orindicates orimplies thegrantingor conferringof,a degree,

unlesstheperson,

(e) isby anActof the

authorized to grant the degree; or

Authority to establish a university, etc.

(f) is a degree granting institution established outside Ontarioandhasthe writtenconsent ofthe Minister.

3.

No

person shalldirectly orindirectly, (a) operate or maintaina university;

(b) use or be

known

by a

name

of a university or any derivationor abbreviationthereof;

(c) hold himself outtobea university;

(d)

make

use of, inany advertising relating to aneduca- tional institution in Ontario, the

word

university or any derivationor abbreviationthereof,

unless theperson,

(e) is by an Act ofthe

Assembly

authorized to operate or maintainthe university;or

(f) is a university established outside Ontario and has thewrittenconsent ofthe Minister,

4.

(1)

The

Minister

may

give awritten consentto,

(a) a degree-granting institution established outside Ontario to enable it to

do

any one or

more

of the thingsmentionedinclauses 2 (a)to (d);or

(b) a university established outside Ontario to enable it

to

do

any one or

more

of the things mentioned in clauses 3 (a)to (d).

The

Minister

may

attach such terms and conditions to a consent given under subsection (1) as the Minister considers properto giveeffectto the intentofthisAct.

5.

(1)

Where

the Minister has reasonable and probable grounds to believe that a person has contravened any of the provisions of this Act or the regulations, an inspector desig- nated by the Minister in writing

may

at any reasonable time enter

upon

the business premises of such person, to

make

an inspection for the purpose of determining whether or not the person isincontravention ofthisActorthe regulations.

(2)

Upon

aninspectionundersubsection(1),the inspector, (a) isentitled to free access toallbooksofaccount,cash,

documents,

bank

accounts, vouchers, correspond-

ence and recordsof the person being inspected that are relevant for thepurposes ofthe inspection;and

(b) may.

upon

giving a receipt therefor,

remove

any material referred to in clause (a) that relates to the purposeof the inspection for the purposeof

making

acopythereofinwhichcasethe inspectorshall

make

a copy with dispatch and return the material promptlythereafter totheperson beinginspected.

and no person shall obstruct the inspector in his inspection, withhold or destroy, conceal or refuse to furnish any information orthingrequired bythe inspector for thepurposes ofthe inspection.

as provided in subsection (2)and purport- ^jl^'^J' ing to be certified by an inspector is admissible in evidence in copies

any action, proceeding or prosecution as primafacie proof of theoriginal.

6.

(1) Every person

who.

Offence

(a) knowingly furnishes false information in any appli- cation under this Act or the regulations or in any statement or return required to be furnished under

thisActorthe regulations;or

(b) contravenes any provision of this Act or the regu- lations.

and every director or officer of a corporation

who

knowingly concursinsuchfurnishingoffalseinformation or contravention by the corporation is guiltyof an offence and

on

conviction is liable to afineof not

more

than $2,000 ortoimprisonmentfor a termof not

more

thanoneyear,orto both.

Where

theperson convicted ofanoffence undersubsec- '"^^"^

tion (1) is a corporation, the

maximum

penalty that rnay be imposed

upon

the corporation is $25,000 and not as provided therein.

7.

A

writtenstatement as to, ^551*^"^^'^

ofMinister asevidence

(a) the consent or non-consent given to any person by the Minister;or

(b) any other matter pertaining to such consent or non- consent.

purported to be certified by the Minister, is, without proof of theofficeorsignatureofthe Minister, receivablein evidenceas primafacie proof of the factsstated therein for all purposes in

anyaction,proceedingor prosecution.

8.

The

Lieutenant

Governor

in Council

may make

regu- lations,

(a) governingapplications for consent to engage orper- form anyactreferred toinsection2 or3;

(b) providingfortheexpirationand renewalof consents;

(c) prescribing information thatmust becontained inan application orform and requiring any such informa- tion tobeverifiedbyaffidavit;

(d) prescribing the terms and conditions

upon

which a consent of the Minister

may

be granted under this Act;

(e) exempting any person or class of persons from any requirementofthis Actor theregulations;

(f) prescribingforms andprovidingfor their use.

9. This Act

comes

into force

on

a day to be

named

by proclamation ofthe LieutenantGovernor.

10.

The

short title of this Act is the Degree Granting Act, 1983.
