1. This isacivil action
brought
pursuant
tothe Oil PollutionAct(OPA),
33 U.S.C.2701,
et fordamages
forinjury
to, destructionof,
lossof,
orloss ofuseof,
certain naturalresources, and thecostsofassessment
thereof,
against
KochPipeline Company,
L.P.,
in connection with the October18, 1998,
release of 963 barrels of crude oil from Defendant's former crude oilreceiving
station(Facility)
in KarnesCounty,
Texas(Incident).
II. JURISDICTION AND VENUE
2. This Court has
jurisdiction
overthesubject
matterand theparties
hereto,
pursuant
toOPA Section
1017(b),
33 U.S.C.2717(b);
and 28 U.S.C. 1331 and 1345.3. This Court has
personal jurisdiction
overthe Defendant because theFacility
is located within thejurisdictional
boundaries for the United States District Court for the Western District ofTexas,
asestablishedby Congress
under 28 U.S.C.124(d)(4).
4. Venue isproperin this
District,
pursuant
to Section1017(b)
ofOPA,
33 U.S.C.2717(b),
and 28 U.S.C.1391,
and1395,
because this is thejudicial
district in which the Incident andresulting
naturalresourcedamages

under 28 U.S.C. 516 and 519.6. The United States

tonaturalresourcesand theirsupporting
ecosystems
belonging

Quality (TCEQ),
theTexas Parks and WildlifeDepartment (TPWD),
and the Texas General Land Office(GLO),
stateagencies
thathave beendesignated by
the Governorofecosystems,
within theboundary
of the stateorbelonging
to,managed by,
controlledby,
orappertaining
tosuchstate. 33 U.S.C.2706(b)(3),
and theNCP,

of naturalresources in and around the Defendant's formerFacility,
located in KarnesCounty,

relevant,
Defendant owned andoperated
acrude oilreceiving
station located in KarnesCounty,
Texas.11. Defendant is a
"person"

of OPA Section1001(27),
33 U.S.C.2701(27).
V. STATEMENT OF FACTS RELATING TO NATURAL RESOURCE DAMAGES 12. Defendant
formerly
owned andoperated
a50,
000-barrel tankaspart
ofacrude oilreceiving
station,
locatedapproximately
400 feet from Marcelinas Creek in KarnesCounty,
Texas. Marcelinas Creek isaperennial
stream, which flows into the San AntonioRiver,
which in turnfeedsinto theGuadalupe
River,
amajor
water sourcefor the San AntonioBay Estuary,
and the Gulf of Mexicobeyond.
13. OnOctober
18, 1998,
963 barrels of crude oildischarged
from theFacility,
about 783 of whichescaped
theFacility's
containmentsystem
and entered Marcelinas Creek wherefloodwaters carried the crude oil several miles downstream toacollection
point just
below the creek's intersection withCounty
Road 237. Thefloodwaterstransported
the oilbeyond
the banks of thecreek,
coating vegetation
and theriparian
areadownstream with oilasthe watersreceded.14. This unauthorized
discharge
of oil resulted inaninjury
orharmto "naturalresources"throughout
theareaof thespill,
within themeaning
of OPA Section1001(20),
33 U.S.C.2701(20),
including
resourcesunder thetrusteeships
of theDOI,
TCEQ,
TPWD and GLO. Thedischarge
has resultedinharm to,injury
to,destructionof,
lossof,
orloss ofuseof,
naturalresources
including,
butnotlimitedto, surfacewater,migratory
birdspecies,
freshwater wetlandhabitat,
riparian vegetation, multiple
treespecies, understory,
coastal and nativegrasses, and the banks of the creek in thevicinity
of the Incident.VI. STATUTORY BACKGROUND
15. OPASection
1002(a),
33 U.S.C.2702(a), provides
that "eachresponsible
party
fora
facility
from which oil isdischarged...
intooruponthenavigable
waters... is liableforthe
damages... specified
in subsection(b)
that result from such incident."16. PursuanttoOPASection
1001(32),
33 U.S.C.2701(32), "responsible party"

any personowning

17. OPA Section1001(14),
33 U.S.C.2701(14),
defines"incident" as"any
occurrenceinvolving
one ormore... facilities...resulting
in thedischarge...

is definedas"any
emission(other
than naturalseepage),
intentionalorunintentional,
andincludes,
but isnotlimited to,
spilling, leaking, pumping, pouring, emptying,
ordumping."
19. OPA Section
1001(23),
33 U.S.C.2701(23),
defines "oil"as "oil ofanykindorinany
form,
including,
butnotlimitedtopetroleum,
fueloil,
sludge,
oilrefuse,
and oil mixed withwastesother than
dredged spoil...
20. OPA Section
1001(21),
33 U.S.C.2701(21),
defines"navigable
waters"as "the21. OPA Section

as"any
structure, group ofstructures,equipment,
ordevice... used forone ormore of thefollowing

are recoverableby

"land, fish, wildlife, biota, air,

water,drinking

held intrustby, appertaining

24. Thecrude oil
storage
tankreferredtoinParagraph
12above,
is a"facility"
within themeaning
of OPA Section1001(9),
33 U.S.C.2701(9),
because itwas and is used for"producing, storing, handling, transferring, processing
ortransporting
oil."25. Atall times
relevant,
Defendantwasthe "owner andoperator"
of theFacility,
within themeaning
of OPA Section1001(26),
33 U.S.C.2701(26).
26. "Oil" within the
meaning
ofOPA Section1001(23),
33 U.S.C.2701(23),
wasdischarged
from theFacility
onOctober18,
1998.27. The
discharge
of "oil" from theFacility
resulted inadischarge
into oruponMarcelinas Creek and/or its
adjoining
shorelines. Marcelinas Creek isanavigable
waterwithinthe
meaning
ofSection 1002 ofOPA,
33 U.S.C. 2702.29. Asa
"responsible
party,
Defendantisstrictly
liabletothe UnitedStates,
andtothe State ofTexas,
"fordamages
forinjury
to, destructionof,
lossof,
orloss ofuseof,
naturalresources,
including
the reasonablecosts ofassessing
thedamage, resulting

30. "Naturalresources, as defined in OPA Section
1001(20),

held intrustby
federal and statetrustees,have beeninjured, destroyed,
orlostas aresult of theIncident,
withinthemeaning
of 33 U.S.C.2702(b)(2).
Thenaturalresourcesand/orservicesimpacted
because of the Incidentinclude,
butare notlimited to,the MarcelinasCreekwatercolumn,
creeksediments,
and benthicorganisms living
insediments,
riparian
habitat,
improved
andunimproved
pasture,
and terrestrial biota in and around Marcelinas Creek.VIII. CLAIM FOR RELIEF
