SECTION 6 – MOTOR AND MOTORCYCLE MOTOR SECTION

3. YOU MAY ALSO CHOOSE TO BE COVERED FOR:

You will only be covered for the optional extensions if selected and it is shown in your schedule:

3.1. Vehicle accessories

Any vehicle accessories, which are not standard factory-fitted attachments, will only be covered if noted separately in your schedule, included in the sum insured and premium has been charged. You must provide satisfactory proof to us that such accessories were fitted to the vehicle before the loss.

3.2. Deposit cover

Where we regard your vehicle as uneconomical to repair and write your vehicle off, or if your vehicle is stolen or hijacked and not recovered, we will pay you a benefit of 10% of the sum insured but not exceeding R50 000, towards the deposit for the purchase of a replacement vehicle provided that:

a) this section is in force covering the vehicle at the time of the loss;

b) the benefit will only become payable to you once the underlying claim has been settled by us.

3.3. Car Hire (loss or damage)

a) We will pay the actual car hire charges including the cost of delivery for the delivery of a vehicle (not exceeding 1600cc engine capacity) on an unlimited distance basis but excluding the cost of fuel and lubricants:

i) if your vehicle cannot be driven following loss or damage caused by an insured event;

ii) while your vehicle remains unrecovered following theft.

b) The period of hire must commence not later than 30 days from the day on which: i) your vehicle was handed to the motor trade for repair; or

ii) the theft of your vehicle is reported to us. c) The period of hire must terminate:

i) the day you regain possession of your vehicle;

ii) the day we discharge our liability for the total loss of your vehicle; or iii) after a maximum period of 30 days whichever occurs first.

d) This optional extension is subject to the proviso that the order for the hire of a vehicle must be placed through and authorised by us and you accept any terms and conditions imposed on you by the car hire company.

3.4. Credit shortfall

a) If any vehicle which is comprehensively insured under this section is: i) stolen or hijacked (and not physically returned to us); or

ii) damaged and the assessed cost of repairs exceeds 70% of the reasonable retail value.

We will pay to the registered finance company that financed the purchase of the vehicle any difference between the reasonable retail value and the settlement balance outstanding under a valid credit agreement subject to the total payment not exceeding the limit of indemnity shown in the schedule less the excess.

b) THE SETTLEMENT BALANCE OUTSTANDING means the payment due at any

specified date that would settle the actual debt owing to the finance company but excluding:

i) payment and interest in arrears; ii) any additional finance charges; iii) early settlement penalties;

iv) any other amounts refundable to you;

v) any legal costs owing to the finance company by you. c) Cover under this extension is subject to:

i) liability having been admitted for loss or damage in terms of Own Damage Section – Insured Events;

ii) you providing us within 30 days of the loss or damage a copy of the credit agreement and a statement of your account reflecting the settlement balance outstanding as at the date of loss or damage.

4. YOU ARE ALSO COVERED FOR:

4.1. Liability Section – Insured Events

4.1.1. We will pay for all sums for which you may be legally liable as a result of an accident involving the vehicle, in respect of:

a) death or bodily injury to other persons; b) damage to property.

4.1.2. You are also covered while driving a vehicle which does not belong to you or a member of your household provided that:

a) this vehicle is not purchased, leased or hired by you under a credit or similar agreement; b) it is not covered by any other insurance policy;

c) damage to this vehicle is excluded.

4.1.3. We will also cover any person using your vehicle with your permission provided that such person:

a) is not covered by any other policy;

b) is subject to the terms of the policy as far as they would apply to you; c) has not been refused any motor vehicle insurance.

4.1.4. We will also cover your legal liability for the death or bodily injury of a third party or loss or damage to third party property, caused by a vehicle, trailer or caravan towed by your vehicle, but excluding:

a) damage to the vehicle, trailer or caravan being towed;

b) death or injury to any person in or on a towed vehicle, caravan or trailer;

4.1.5. The maximum limits of our liability in respect of 4.1.1. to 4.1.4. above are:

a) R1 000 000 for fire and explosion for 1 event or series of events arising from 1 incident; b) passenger liability R1 000 000;

c) any other 1 insured event R3 000 000.

4.2. What we will not pay for under liability to third parties:

a) death or bodily injury to any person travelling on or mounting onto or dismounting from the vehicle whether they are fare paying passenger or not;

b) death or bodily injury to any member of your household;

c) death or bodily injury to an employee of yours or your family who is killed or injured in the course of such employment;

d) damage to any property belonging to or held in trust by or in the custody or control of you or your family;

e) liability which is covered by any compulsory motor vehicle legislation.

5. CLAIM-FREE GROUP (NO CLAIM REBATE)

If you have not made any claims under your policy during a period of insurance as set out below and immediately before the renewal or anniversary date, the renewal premium will based on the applicable claim-free group discount as indicated below:

If any claims are made in terms of this section during a period where a claim-free group applies the claim-free group will reduce by 2 in respect of each claim made. Where no claims have been made the claim-free group will increase by 1 for each subsequent renewal up to a maximum of 5.
