MOTORCYCLE SECTION

8.10. Vehicle security requirements

The vehicle security requirements in respect of motor vehicles, light delivery vehicles and motorcycles are set out in your schedule. Please refer to this schedule for full details. However, the following conditions must be complied with at all times:

a) proof that the required and approved tracking device or system or any other form of vehicle security has been installed must be provided to us in writing at the inception of the policy or section, or as otherwise agreed in writing. If this requirement is not complied with you will have no cover for theft and hijacking;

b) it is your responsibility to ensure that the service agreement with any such vehicle tracking company is maintained at all times and that in the event for any reason you: i) cancel your service agreement;

ii) fail to pay any subscription due under that agreement;

iii) fail to ensure that the vehicle is linked up to the tracking service and that the vehicle tracking unit is operational and armed at all times we will not cover your for loss or damage arising out of theft and hijacking;

c) unless you have notified us in writing of any modification or alteration to your motor vehicle or motorcycle, or any other material fact affecting the risk and we accept such modification, alteration or fact, all cover under this section shall cease.

We or our authorised representatives are permitted to obtain any information from your security or monitoring services company provided that such company is a Regent approved security, tracking or monitoring service.

9. YOU ARE NOT COVERED FOR:

The following are Specific Exceptions that apply to the whole motor and motorcycle

sections:

We will not pay for loss, damage, death, injury or liability that is caused by or results

from or relates to any of the following:

a) wear and tear, depreciation, rust, mechanical, electrical or electronic breakdowns, failure or breakages;

b) damage to tyres caused by braking, punctures, cuts and burst;

c) damage to the suspension or springs due to uneven roads or surfaces;

d) where the vehicle is being used for racing, rallies, hiring, carrying explosives, driving instruction for reward, or if the vehicle is in the custody of the motor trade unless for the purpose of its overhaul, upkeep or repair, or if the vehicle is designed to carry more than 10 persons including the driver;

e) theft of, or loss or damage to vehicle accessories unless you can prove that you owned or bought them and the accessories were noted in the schedule and included in the sum insured;

f) any claim or expenses for towing, recovery or storage of your vehicle unless such arrangements were made through the Regent Care Line 0800 00 48 48 prior to the

vehicle being towed or uplifted;

g) where the insured vehicle is not or has not been insured according to the stipulated Risk Category;

h) where the driver does not have a current, valid and unendorsed driver’s licence (as

defined by South African Law);

i) if the driver of the vehicle is under the influence of alcohol or drugs or the alcohol content of the driver’s blood exceeds the legal limit;

j) where the vehicle is not in a roadworthy condition, in terms of the Road Traffic Act, or was being used for purposes that are against the law;

k) death or injury to any person getting on, driving in or getting off a towed vehicle, caravan or trailer;

l) any claim that falls within the scope of any compulsory motor vehicle act currently in force;

m) where your vehicle has been stolen by another party under false pretence;

n) where loss, damage or injury has been deliberately caused by yourself or any member of your household or family, or anybody who acts on your behalf;

o) if your premium has been discounted due to a no claim bonus, you are not entitled to payment for any loss or damage until you have produced written proof in the form of a document signed by your previous insurer certifying as correct the facts upon which the no claims bonus discount was granted to you;

p) theft or hijacking where the vehicle has not been fitted with the security requirements appropriate to the value and type of the vehicle and proof of which has been received by us before the event giving rise to a claim;

q) theft of car radio, sound equipment or car telephones, unless you have paid a premium for the optional extension. The optional extension must be shown on your schedule in order to be valid;

s) legal confiscation of the vehicle by authorities or officials; t) vehicles not legally registered in the RSA.

10. CLAIMS

On the happening of any insured event that may give rise to a claim under this policy:

a) you must immediately notify us of such event and forward a completed claim form to us. Written notification of a claim must be received by us within 30 days of the date of loss;

b) you must report the loss to the police within 48 hours and advise us of the case reference number;

c) you must take all reasonable steps to reduce the extent of loss or damage;

d) you must immediately send us any communications which you receive in relation to an insured event which may give rise to a claim. We will not be obliged to enter an appearance to defend the impending legal action if we do not receive the documentation required;

e) you must obtain our consent before proceeding with repairs (other than for replacement or repair of vehicle glass);

f) you must give us any assistance we require and supply all information and documentation we may reasonably require within 30 days of such a request, during the process of a claim and thereafter if necessary;

g) you must make your vehicle available for inspection by us;

h) in the case of loss by theft, burglary or vandalism advise the Police immediately; i) you must not, without our written consent, incur any expense or negotiate, pay, settle,

admit, reject or make any agreement in relation to any claim;

j) we will be entitled at our expense and in your name to take any proceedings necessary to obtain relief from any other party and to take over and conduct the defence and settlement of any claim. You must provide all reasonable assistance and co-operation; k) if we pay the retail value or the agreed value of your vehicle then cover ceases and no

premium is refundable;

l) you must assist us in identifying the vehicle in the case of a recovery following theft or hijack. We will reimburse you for any reasonable costs incurred subject to a maximum of R 2 500;

m) if repairs have not started within 60 days after authorisation by us due to your actions, all benefits in respect of such claim will be forfeited.
