REGENT DOMESTIC INSURANCE COVER

POLICY TERMS AND CONDITIONS

INTRODUCTION

This policy is the agreement for personal lines insurance between the Regent Insurance Company Limited (we or us or our) and the Insured (you or your) named in the schedule which forms part of this policy, on the basis that your proposal and declaration whether written or verbal, also forms part of this policy.

We agree to provide insurance in terms of your policy during any period of insurance for which a premium has been paid.

CONSENT TO DISCLOSURE OF INFORMATION

The sharing of claims and underwriting information (including credit information) by Insurers is essential to enable us to underwrite policies, assess risks fairly and reduce the incidence of fraudulent claims. In the public interest and with a view to limiting premiums, you consent to any insurance or claims information being disclosed to us, any other insurance company or its agent by you or any person representing you.

The South African Insurance Association (SAIA) has created a shared database for storing insurance information of policyholders. We all store your information in the shared database to verify any underwriting information against legally recognised sources or databases.

Fighting insurance fraud will benefit you, because fraud affects the short-term insurance industry. It affects the evaluation and determination of risks by insurers, and it affects you directly as it leads to higher premiums.

1. Your right to privacy

Your right to privacy is a fundamental element that must be taken into consideration however it is restricted to the certain limits. These limits include cases where the parties have a legal interest in that information. In terms of South African law, we may disclose and/or receive information if we intend using it to prevent fraud and to underwrite risks fairly.

2. Your authorisation to us

a) You acknowledge that the sharing of information for under writing and claims purposes is in the public interest, as it will enable insurers to underwrite policies and assess risks fairly and to reduce the incidence of fraudulent claims. This will contribute to keeping premiums as low as possible.

b) On your behalf and on behalf of any person who you represent, you waive your rights to privacy of any underwriting and claims information for any insurance policy or claim made by you or on your behalf.

(4)

c) You consent to such information being stored in the shared database and used as set out above.

d) You consent to such information being given to any insurer or its agent.

e) You consent to any underwriting information being verified against and shared with legally recognised sources or data bases.

1. YOUR RESPONSIBILITIES

The following are general conditions and rules which apply to all sections of your policy and you must comply with them so that you can be sure that you will be covered: 1.1. Misrepresentation, misdescription and non-disclosure (the information you give must

be complete and truthful)

If you give us false information or wrong descriptions or if you fail to inform us of any relevant information, the result will be that the particular section or the entire policy, as the case may be, will become voidable i.e. you may lose your cover under that particular section or even the entire policy.

1.2. Jurisdiction

This policy is subject to the exclusive jurisdiction of the courts of the Republic of South Africa (RSA).

1.3. Prevention of loss

You must take all reasonable steps necessary to prevent or reduce loss, damage, injury or liability.

1.4. Change of material facts

You must tell us in writing if any of the policy details or declarations are wrong or if any of these details, declarations or material facts have changed, as this may influence our continued acceptance of the policy, risk or claim. This also applies to the proof of any no claim bonus. A material fact is one which could influence us in deciding whether or not to insure you (such as convictions), and if so, on what terms and conditions and for what premium. If you are not sure whether something is a material fact you should disclose it. This may include giving us information that we have not asked for directly.

If you do not disclose all the material facts your insurance may be invalid and we may refuse to pay any claims you make.

Your duty to disclose material facts is an on-going one. You must continue to keep us informed of any changes in material facts during the course of being insured with us.

1.5. Cancellation

You can cancel your policy at any time by notifying us. If we wish to cancel your policy, we will give you 30 days notice in writing. If you pay your premium annually, you will be allowed a pro-rata refund of the premium less any claim amounts paid or outstanding. If your policy is paid monthly, you will not be allowed a refund of any premium.

1.8. Renewal of annual policies

We do not automatically renew an annual policy and it is your responsibility to make sure that your policy has been renewed with us. If you have a mortgage or a finance agreement which has been paid up, you must ensure that your policy has been renewed.

1.9. Full value

You must ensure that the property covered under Sections 1 – Houseowners, Section 2 – Householders and Section 3 – All Risks is insured for its full current replacement value.
